Councilmember Duggan moved to approve Resolution 2013 -20 and the contract to provide service to ISD 197; "SCHOOL RESOURCE OFFICER CONTRACT FOR SERVICE" with the changes outlined. Councilmember Norton seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) PULLED CONSENT AGENDA ITEM L) APPROVAL OF INVASIVE PLANT REMOVAL CONTRACT IN VALLEY PARK Councilmember Duggan asked for clarification that this removal service would be available to other areas of the community that have invasive plants besides just Valley Park. Assistant City Engineer Ryan Ruzek replied that in 2002 the City hired a consultant to complete a resources management plan for the City. Staff hopes to one day have a five year plan for removal of invasive plants, the same as they do for streets, trails, and sewer maintenance. Acting Mayor Petschel commented that some buckthorn removal has been done around Copperfield Pond. Assistant City Engineer Ruzek answered that there have been some volunteers who have requested permission to remove buckthorn, which was granted. Councilmember Duggan moved to authorize the City Administrator to issue a 'not -to- exceed' purchase order in the amount of $10,000.00 to Great River Greening to begin immediately on invasive plant removals and control. Councilmember Norton seconded the motion. March 19, 2013 Mendota Heights City Council Page 2 pg 4 Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) PRESENTATION A) NORTH URBAN REGIONAL TRAIL (NURT) GREENWAYS STUDY Mr. Chris Hartzell, Dakota County's project manager for the North Urban Regional Trail (NURT), gave an overview of the NURT alignment study, the alignment alternatives under consideration, reviewed trail alignment options one and two which are located within the City of Mendota Heights, and provided an opportunity for the Council to provide input. He explained that the NURT is on the north end of the county; connects four schools in five communities, including South St. Paul, West St. Paul, Sunfish Lake, Mendota Heights, and Lilydale; and connects seven community parks. Since the creation of the NURT, Dakota County created the Greenway Collaborative Vision with the goals of that vision being to create trails that would be away from the streets 80% of the time, provide a ten -foot wide trail, have an aesthetic or natural design signature, grade separated tunnels at arterial roads, and controlled intersections at collector roads. When and where the trail meets regional trail standards, Dakota County would take over the maintenance. The overall deadline for the project in order to capitalize on the federal funding would be to deliver the project by March 2014. The alignment study is focused around the Dodge Nature Center. They have expressed concerns regarding where the construction of this trail is located. The Dakota County Board asked that all of the possible regional alignments to get from Trunk Highway 110 to Marthaler Park be evaluated. In addition to the north/south alignment option that was in the 2008 transportation enhancement grant, the team compared the benefits and impacts of each of the alignments, solicited input, and recommended a preferred alignment for the Dakota County Board's consideration. The team came up with five potential feasible alternative alignments, which included three north/south alignment options. Options one and two are located in Mendota Heights. Mr. Hartzell noted that if Option 5 was chosen it would not meet the intent of the transportation enhancement grant and it would not meet the timing of when this project would need to be delivered. This would most likely result in the loss of federal funding for the trail. Mr. Hartzell then reviewed the different pedestrian crossing treatment options including signage and striping, crosswalk markings, bump -outs, advance warning flashing systems, and tunnels. The County is evaluating the trail by looking at whether it is economically viable, timing, compatibility of whether this works within the Dodge Nature Center and Sibley High School properties, wetland impacts, tree impacts, and technical feasibility. They will select an alignment by April 16th, with construction scheduled for late spring 2014 through 2015. Councilmembers asked questions regarding a chart matrix that was included in the agenda packet, the location of the right -of -way at Sibley High School, which option is the best scenic route, what the options would be if the Dodge Nature Center were to be intractable, the location of the trail in relation to the Garlough Environmental Magnet School, how the existing City trails would fit into the different March 19, 2013 Mendota Heights City Council Page 3 pg 5 options, not allowing dogs in the nature center, maintenance of the trail, tracking usage of the trails in the future, and any oppositions to the greenway project. PUBLIC COMMENTS There were no public comments UNFINISHED AND NEW BUSINESS A) CONTRACT WITH INVER WOOD GOLF COURSE FOR MAINTENANCE OF THE MENDOTA HEIGHTS PAR 3 Assistant to the City Administrator Jake Sedlacek explained that at the close of the 2012 golf season, staff began looking at maintenance options for the Mendota Heights Par 3. Staff spoke with a number of local golf courses, including Inver Wood Golf Course, and they are proposing to conduct all maintenance of the Par 3, including all materials except fuel. The proposed cost is in line with the City's 2013 budget for the Mendota Heights Par 3. The city of Inver Grove Heights sees this as a natural progression of their business and feels they have the knowledge and resources to complete this work. From the City's standpoint, they are proposing a turnkey operation and the City would not need to be supervising the staff. The contract would be for one year and the city will consider its options at the end of this golf season. Acting Mayor Petschel asked for confirmation that the agreement with Inver Wood includes a monthly report that the City of Mendota Heights would receive in terms of their operations and costs for that month. Sedlacek replied that they would provide a monthly report and a monthly invoice, but it would not be a detailed accounting. The report would include operation activities, what work has been completed, and what they see as upcoming maintenance needs. Sedlacek explained that this is a `not to exceed' contract, but that repairs to any city -owned equipment or the irrigation system over $500 would need City approval. Councilmember Norton asked if there had been any other written bids from local golf courses received. Assistant to the City Administrator Sedlacek replied that conversations took place with Mendakota Country Club and Somerset Country Club, but Inver Wood was the only one interested in submitting a bid. Councilmember Povolny feels this is a good agreement and would not cost the City any additional funds. Acting Mayor Petschel commented that the supervisory staff from Inver Wood Golf Course has a tremendous amount of technical expertise in terms of turf maintenance, fertilizers, running irrigation systems, and this would be a benefit to the City. March 19, 2013 Mendota Heights City Council Page 4 pg 6 Councilmember Duggan asked if it was known what the impact would be on the current maintenance contract. Assistant City Administrator Sedlacek replied that this would replace that contract. Councilmember Duggan also asked if there is a proposal to consider a three -year contract. Sedlacek replied that at this point, both parties are more comfortable with the one -year contract to enable each to evaluate as the season goes on. Councilmember Duggan asked if the contract is with the City of Inver Grove Heights or with Inver Wood Golf Course. City Administrator Justin Miller replied that the agreement is actually with the City of Inver Grove Heights. It would be an agreement between cities, much like is done for other services. Councilmember Duggan moved to authorize staff to enter into a maintenance contract for the Par 3 Golf Course with the city of Inver Grove Heights — Inver Wood Golf Course. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) B) RESOLUTION 2013 -21 APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BID, HUNTER/ORCHARD NEIGHBORHOOD STREET IMPROVEMENTS City Engineer John Mazzitello explained that staff has been working on the 2013 street reconstruction project as identified in the five -year street improvement plan. The project would reconstruct Hunter Lane, Orchard Place, and the rural section of Culligan Lane. It would also rehabilitate the urban sections of Culligan Lane, Glenhill Road, Orchard Circle, and Veronica Lane. The project also includes rehabilitating the Veronica Lane sanitary sewer lift station. In October 2012, City Council ordered preparation of plans and specifications for this project with a series of parameters. The proposed resolution would approve the final design plans and authorize advertisement for bids, with a bid opening tentatively scheduled for 10:00 a.m. Wednesday, May 1, 2013. Councilmember Duggan complimented the engineering staff as this has been a very difficult project. Mr. John Dougherty, 1933 Hunter Lane, asked what the plan is for the drainage pipes located on his property and would anything be done to grade the existing areas on his property. Assistant City Engineer Ryan Ruzek replied that it is proposed that the pipes be removed and everything would be graded out. Councilmember Duggan moved to adopting Resolution 2013 -21 APPROVING FINAL PLANS AND SPECIFICATIONS, AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE HUNTER AND ORCHARD NEIGHBORHOOD IMPROVEMENTS (PROJECT #200902). Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) March 19, 2013 Mendota Heights City Council Page 5 pg 7 C) CITY ATTORNEY RFP REVIEW COMMITTEE When the Request for Proposals (RFP) for City Attorney was approved in February 2013, it was suggested that two city councilmembers be named to the review committee. The deadline for submittals is Thursday, March 21, and the review committee would need to meet and make final recommendations by the end of March 2013, with interviews to be scheduled during the week of April 8, 2013. Staff has requested that the Councilmembers nominate and choose two participants. Acting Mayor Petschel nominated Councilmember Norton to the committee because of his legal background. She also removed her name from the nominations. Councilmember Duggan, although he would like to be part of the committee, expressed concerns about his ability to attend the meetings because of his schedule. Acting Mayor Petschel moved to proceed with the Committee Review Approach and nominated Councilmember Norton and Mayor Krebsbach to the City Attorney RFP Review Committee. Councilmember Duggan seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) COUNCIL COMMENTS Councilmember Duggan complimented City Engineer John Mazzitello for completing work towards his Master's Degree in Business Administration with straight A's. He also shared a photograph taken by local photographer Bernie Friel that has appeared in the Audubon Society's Magazine for January/February 2013. Councilmember Duggan also congratulated staff on their choice of a new Parks and Recreation Coordinator. He also commented on the dangerous ice at the corner of Dodd Road and Highway 110. City Engineer John Mazzitello replied that this corner has historically had drainage problems. It is believed that currently there is an ice dam inside the culvert. MnDOT will address this issue when the intersection is reconfigured this summer. Councilmember Povolny congratulated St. Thomas on their State High School Hockey Championship. He also congratulated his neighbor who is the Assistant Coach of the Edina Hockey Team. Councilmember Povolny wished his son a happy 16th birthday and hopes he does well on his driver's test. Councilmember Norton stated he had an excellent meeting with Dakota County Commissioner Egan and looks forward to working with him. March 19, 2013 Mendota Heights City Council Page 6 pg 8 Acting Mayor Petschel shared that last week radio station 107.1 FM was at the Olive Grove Olive Oil Store in the Village and thinks it is great that news of the store and The Village is getting out. She and Mayor Krebsbach were at the University of St. Thomas and Calvin boy's basketball playoff game, which St. Thomas won 63 to 62. The crucial three point score was made by a former Henry Sibley student. Acting Mayor Petschel also reminded residents of the Mendota Heights Moms Club blood drive taking place on March 23. City Administrator Justin Miller reminded residents that the summer program registrations for rec programs have opened up. Also, he and Assistant to the City Administrator Jake Sedlacek attended a meeting of the Dakota County CDA and the city was officially awarded a planning grant for the Fischerville site. Councilmember Duggan suggested that the City and staff think about the greenhouse property as it is up for sale. Acting Mayor Petschel suggested it be added as a topic of discussion at the May workshop meeting. ADJOURN Councilmember Duggan moved to adjourn. Councilmember Norton seconded the motion. The March meeting of the Mendota Heights Parks and Recreation Commission was held on Tuesday, March 12, 2013 at Mendota Heights City Hall, 1101 Victoria Curve. Chair Levine called to order the parks and recreation commission meeting at 6:30 p.m. The following commissioners were present: Chair Stephanie Levine, Commissioners Mary McGrory- Ussett, Ira Kipp, Joel Paper, Pat Hinderscheid and Michael Toth. Excused absent: Commissioner David Miller. Staff present: Recreation Program Coordinator Sloan Wallgren, Public Works Director John Mazzitello and Assistant to the City Administrator Jake Sedlacek. Approval of Minutes of February 12, 2013 Commissioner McGrory - Ussett made a motion to approve minutes of the February 12, 2013 meeting; commissioner Hinderscheid seconded the motion. Ayes 6: Nays 0 Introduction of Sloan Wallgren Mr. Wallgren introduced himself as the city's new recreation program coordinator, having started on Monday, March 4, 2013. Mr. Wallgren has experience in both recreation programming and golf course management. Commissioner Hinderscheid commented that he participated in interviews, was impressed with both finalists, and was very pleased that Mr. Wallgren has joined the city. North Urban Regional Trail Plan Mr. Mazzitello introduced Chris Hartzell from Dakota County who has been providing updates to the public on the process to define routes for the North Urban Regional Trail. Mr. Hartzell provided a presentation on the North Urban Regional Trail, defining five options for trail alignments in the area of Marie Avenue and Delaware Avenue. The county intends to create a Greenway, where trails are located in natural environments rather than along roads. Mr. Hartzell stated that Dakota County would maintain the regional trail and answered a number of questions from the commission. Commission comments on the North Urban Regional Trail alternatives included the following: • The county is encouraged to work with School District 197 early in the process. • One commissioner felt that Option 3, taking the trail through Dodge Nature Center property was the best route. pg 10 • One commissioner felt that the nature center property needs to be undisturbed as habitat for a number of animals. • One commissioner felt that Option 1, placing the trail on the western side of Henry Sibley High School property was the best option. Mr. Hartzell thanked the commission for their time and input, and mentioned that a third open house on the topic will be held on Wednesday, March 27, 2013 at West St. Paul City Hall. Recreation Programming and Facilities Update Mr. Sedlacek reviewed the agenda materials, recognizing Mr. Wallgren for getting our Recreation Flyer distributed to more local schools than it has in the past. Mr. Sedlacek also invited commissioners to attend the Junior Golf League registration on Monday, March 18 from 5:00 -7:00 p.m. at City Hall. The commission had questions about the upcoming community conversation on aging — Mr. Sedlacek reported that the event was led by DARTS, and should result in a work plan for the community to plan for the growing number of families dealing with aging issues. The Mendota Heights Parks celebration will be June 1, 2013: Mr. Wallgren reported that the event will feature activities for all ages, including a new attraction - an obstacle course and display by the Army National Guard. Mr. Sedlacek reported that no maintenance requests for parks had been received since the past meeting. Mendakota Park Playground Update Mr. Sedlacek recapped discussion from May 2012, when a presentation was made to the commission on an update to the play equipment at Mendakota Park. The commission recommended that $70,000 be included in the 2013 budget to refurbish the playground. Mr. Sedlacek asked the commission to revisit the issue before issuing a request for proposals on the project. A replacement structure could run in the range of $140,000 - $160,000. The commission supported refurbishing the playground, hoping that the project may be completed this spring. Commissioner Hinderscheid made a motion directing staff to develop a request for proposals to refurbish the playground at Mendakota Park. Commissioner Paper seconded the motion. Ayes 6: Nays 0 Commission Comments The commission welcomed Mr. Wallgren to the commission, and wished him well in the new position. Commissioner Paper recognized Terry Blum and all of the ice rink staff for a great season. pg 11 The commission expressed their appreciation for the public works staff for their efficient work to clear roads and trails following snowfalls. The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, March 13, 2013 at 7:00 p.m. at 1101 Victoria Curve, Mendota Heights, MN. The following commissioners were present: David Sloan, Kevin Byrnes, Jim Neuharth, Sally Lorberbaum, and William Dunn Absent: Gina Norling and Paul Portz (both excused) Also present: City Administrator Justin Miller Approval of Minutes Lorberbaum made a motion, seconded by Dunn, to approve the February 13th minutes as submitted - all voted in favor. Sunfish Lake Representative Vacancy Chair Sloan reminded the commission that Gretchen Keenan, the former Sunfish Lake at -large representative to the NOC, had submitted her resignation. The commission discussed how to involve the new Sunfish Lake representative and agreed to wait a few months and discuss it at a future ARC meeting. Review of 2012 Actual Noise Contour Report Miller presented key findings of the MAC's "2012 Actual Noise Contour Analysis" and pointed out areas of interest to Mendota Heights. Of note was that the contours continue to shrink as operations remain lower than the 2007 forecast and planes are quieter in general. Also of note is that residential areas along Lemay Lake Road were once in the 60 DNL but now show readings lower than 60. No action was required. Acknowledge Receipt of Various Reports /Correspondence The monthly reports for January 2013 were acknowledged and commissioners updated their respective areas of focus. Neuharth discussed the Six Sigma literature he presented at the last meeting and made several suggestions about how the commission should react when certain measurements reach outside the upper control limits. Miller and Neuharth agreed to meet before the next meeting to discuss how to improve the charts presented to the commission. The commission also discussed inviting a speaker to our next meeting. Miller indicated he would review the list of speakers that was generated by the commission and discuss with Chair Sloan who to invite to the April meeting. Adiourn Dunn made a motion, seconded by Lorberbaum, that the meeting be adjourned. All voted in favor. Meeting adjourned at 8:00 pm. CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA pg 13 5d. Traffic Safety Committee Meeting March 19, 2013 — 5:30 P.M. 1. Follow -Up on Past Discussion Items A. Request to change Yield Sign to a 4 -Way Stop Sign at the — Requested by Ms. Melissa Brown of 1640 James Road via e -mail through City web page. The TSC recommended installing a second yield sign on the southeast corner of Douglas Road and James Road to provide adequate advance warning of the intersection. Update: Due to fall storm cleanup activity, this has not taken place yet. Public Works will install the second Yield Sign in the spring. B. Pedestiran Crosswalk on Lexington at Victoria - Requested by Ms. Sally Lorberbaum of 890 Douglas Road via e -mail. The TSC recommended requesting Dakota County install a crosswalk at the intersection. Dakota County stated that the crossing was too long to warrant a traditional crosswalk, but recommended a median be installed with a crosswalk. The median would eliminate the left turn lane form southbound Lexington to eastbound Victoria, but would provide a safe haven for crossing pedestrians. TSC recommended the median with a crosswalk installed on either side. City Council passed a motion to formally request Dakota County include this project in their plans as soon as possible. Update: Dakota County has programmed the project into their 2013 Capital Improvement Plan and the median /crosswalk should be installed this year. C. No Parking on north side of Pueblo Lane adjacent to Friendly Hills Park — Requested by the Mendota Heights Police Department. The TSC recommended analyzing the parking situation along Pueblo Lane, and sending a letter to potentially affected property owners. Update: A letter was sent to property owners along Pueblo Lane requesting they provide their thoughts and opinions to staff by April 5th, 2013. If not objected to by the residents, an ordinance would be brought to City Council at a future date to codify the no parking area. D. Installation of a traffic signal at Dodd Road and Wagon Wheel Trail — Requested by Heidi McEllistrem of 1025 William Court via e -mail. The TSC recommended no action on this issue. City Council directed staff to contact MnDOT to ask the question about installing a signal at Dodd Road and Wagon Wheel /Decorah. Update: Staff asked MnDOT about a signal. They stated a signal was not warranted. pg 14 2. New Discussion Items A. Request for traffic control at Karl Hohenstein Place and Main Street (The Village) — Requested by Ms. Naiomi Lifejoy of 702 Linden Street Traffic southbound on Karl Hohenstein cannot see traffic eastbound on Main Street due to the building corner. Resident' concern is: "I find it worrisome that there is no STOP sign at the intersection by the crosswalk. I have seen cars drive straight through there and on to the shops without looking to the right for any oncoming traffic. It is a blind corner where the clothing store is, and you cannot see cars approaching from the right until they are right there." Recommendation: The TSC recommends that a stop sign be installed on the southbound lane of Karl Hohenstein with a cautionary white background sign that says, "Cross Traffic Does Not Stop." The cautionary sign does not require a Council action, but the Stop sign would need to be codified. If Council would like to implement the TSC recommendation, staff will bring forward an Ordinance at a future date to codify the Stop sign as described. 3. Review of Speed Cart Data a. The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, August 28, 2012, in the Council Chambers at City Hall, 1101 Victoria Curve at 7:00 P.M. The following Commissioners were present: Commissioners Noonan, Hennes, and Hennessey. Those absent: Chair Field, Commissioners Roston, Magnuson, and Viksnins. Those present were Assistant to the City Administrator Jake Sedlacek, Public Works Director /City Engineer John Mazzitello, and NAC Planner Bob Kermis. There not being a quorum attending the meeting, the Commissioners were informed that they could hold the public hearings, gather input, ask clarifying questions on cases, but would be unable to take any actions on any items. Approval of February 26, 2013 Minutes Held over to the next Planning Commission meeting Hearings PLANNING CASE #2013 -02 Jane McKoskey Lot Split at 668 — 1st Avenue Mr. Bob Kermis, Senior Planner explained that the applicant is proposing to split a property at 668 — 1st Avenue into two individual parcels. The property is currently occupied on the east side by a single family and a detached accessory structure. This property is zoned R1 — Single Family Residential. Within the R1 districts, minimum lot width of one hundred feet is required and a minimum area of fifteen thousand square feet is required. At the time of the original staff report it was believed that there was an inability of the lots to meet the minimum area and width requirements. It was noted that the submitted survey differs from the actual plat drawing. The submitted survey is actually inaccurate in that twenty additional feet of area actually is provided per the plat. Therefore, the concern over the area requirement is a non - issue. The other item of note is that the survey identifies an alley to be vacated. That alley actually was formally vacated several years but was simply never finalized. Staff recommended approval of this application subject to the following conditions: 1. The word "proposed" be removed from the shaded area relating to the vacated alley Planning Commission Minutes March 26, 2013 pg 16 2. The applicant includes five -foot drainage and utility easements along interior lot lines. Mr. Richard Burrows was on behalf of the application. Commissioner Hennes asked if there was a timing issue on getting this application approved. Mr. Burrows replied that the family would like to move forward with their father's estate. Commissioner Noonan supported approval of the application, should City Council be inclined to deal with it without the recommendation of the Planning Commission. Commissioner Hennessey and Hennes echoed that sentiment. Should Council decide to move forward with this application, they would consider it at their April 2, 2013 Council Meeting. PLANNING CASE #2013 -03 Brian Smith Zoning Amendment to allow beekeeping Mr. Bob Kermis, Senior Planner explained that the Somerset Country Club is requesting an amendment to the R1 — Single Family Residential Zoning District which would allow the keeping of bees as an accessory use. Currently, the ordinance prohibits food animals, which include animals typically raised for the purposes of food production. Currently that does include bees. Thus the keeping of bees is not currently allowed in the zoning district. Mr. Kermis noted that there has been a movement related to the keeping of bees in residential area over the past few years. Many cities have considered this issue; some who have approved the keeping of bees identify it as a local food source, a means of pollinating area plants, and have found that the impacts really are not all that significant upon neighboring uses. In those cities, it is common to regulate the number and size of the hives to minimize the neighborhood concerns. Most area cities have chosen not to allow the keeping of bees within residential zoning districts. The primary concerns are about bee stings, etc. The City of Minneapolis has a zoning process that allows the keeping of bees if neighboring properties find the activity to be acceptable. That process is not available in most cities, including Mendota Heights. Occasionally cities have addressed this issue by allowing this activity only on larger rural type lots. In this particular case, that would seem to be appropriate if the city is inclined to allow this activity. The applicant has suggested that the amendment limit the bees to a maximum of ten hives on properties of fifty acres or more. Staff feels that the imposition of the conditions proposed in the amendment would minimize any observable impacts on the neighboring parcels. Staff would support the amendment. The planning commission had a number of questions on the nature of bees, and the difference between domestic and feral bees. Planning Commission Minutes March 26, 2013 pg 17 Mr. Alan Spalding, 45 Windy Hill, Sunfish Lake, MN is a member of Somerset Golf Course and a beekeeper. Spoke in favor of the code amendment, answering several questions about bees. Mr. Spalding noted that the City of Stillwater recently approved a beekeeping ordinance if anyone was interested in looking at a comparable case study. Mr. James Bade, Somerset Golf Course Superintendent noted that the Town and Country Golf Course in St. Paul started this program last year and the University of Minnesota is involved. Somerset is a one hundred forty -nine acre plot and is certified by Audubon International, for golf course management. Ms. Laurie Tostrud, a member of Somerset Golf Course and a resident at 1490 Somerset Court also spoke in support of the amendment. Commissioner Noonan supported the amendment with the proposed conditions. Commissioner Hennessey felt that the positive attributes outweigh any potential negative consequences, as did Commissioner Hennes. As a condition of the approval of that lot line adjustment, the City Council required the owner of 1669 Lilac Lane to "donate an appropriate portion of the front of his lot to the City for street right -of- way." This donation did not take place, and ownership of 1669 Lilac Lane has since changed. In an effort to make good on the original agreement, to clear up title issues on the two properties, and to assist the owners of 1675 Lilac Lane in closing on the sale of their property, the current owner of 1669 Lilac Lane is offering the attached permanent roadway easement as fulfillment of the condition in the City 1997 approval of the lot line adjustment. The attached Certificate of Survey is from Planning Case File 97 -14, the original lot line adjustment case, and shows the lot line adjustment approved by City Council. The easement is necessary to de- conflict the eastern-most property corner and the actual roadway of Lilac Lane. By accepting this easement, Lilac Lane would no longer clip private property. The property is guided for low- density residential and zoned for single family residential. The subject property consists of four lots from the original plat which were combined into one lot. The applicant is seeking to split the property into two equal lots. Bob Kirmis of NAC Planning presented the request to the planning commission at their regular meeting March 26, 2013. Mr. Kirmis noted that during staff work on the application, it was discovered that the alley south of the subject parcel was vacated by the City of Mendota Heights in 1990, but not properly processed. The proposed lot split, including the area of the vacated alley results in two lots which exceed minimum lot standards. The planning commission conducted a public hearing, there were no public comments. The commission did not have a quorum and was unable to officially close the public hearing, or make a formal recommendation on the planning case. Staff has reviewed city code and found that under Title 11, Chapter 2, Section 1F, the city council may act upon a request for subdivision/lot split without a formal recommendation by the planning commission. Feedback from the commissioners in attendance supported the lot split. BUDGET IMPACT N/A RECOMMENDATION City staff recommends closing the public hearing on planning case 2013 -02. The proposed lots will both be approximately 120 feet in width along 1st Avenue, and 125 feet in depth. Analysis: The zoning ordinance requires that single family parcels consist of 15,000 square feet in total area, and no less than 100 feet of width. Based upon the current plat, the proposed subdivision creates two parcels, each with 120 feet in width, and 15,000 square feet of area, meeting the minimum requirements for the district. The existing structures will meet the required setbacks from the new lot line, and appear to meet all other setbacks with the exception of the rear setback from the existing detached pg 33 garage. This building encroaches onto an alley that is identified on the attached survey as "Proposed Vacated Alley ". The alley and encroachment are existing conditions that are not affected by the proposed subdivision, and otherwise would not interfere with the City's ability to consider the subdivision proposal. BACKGROUND A public hearing has been scheduled for this evening to receive public comment regarding the issuance of an intoxicating liquor license. The City has received an application for an On Sale and Sunday Intoxicating Liquor License from Ai Cai Li, owner of Haiku Japanese Bistro Inc. This is a new restaurant locating at 754 Highway 110, in Mendota Plaza. The applicant has submitted a complete license packet and paid the required license and investigation fees. The Mendota Heights Police Department has completed a thorough investigation of the applicant and has found no issues or concerns. The applicant has provided a Certificate of Liquor Liability Insurance and a Liquor Bond. The license application indicates that the restaurant will have a minimum of 1,000 square feet in floor area and seating for a minimum of 50 guests. Although the seating of 50 does not meet our current minimum standards for a Tier Two Liquor License, which is a minimum of 100 guests, city staff is proposing later in this meeting to amend the Code to a minimum of 50 guests. Per City Code, all new liquor license applications shall not be approved before the next regular City Council meeting following the public hearing. If approved at the next regular City Council meeting, the license would be effective May 1, 2013 through June 30, 2013. RECOMMENDATION Staff recommends that the City Council hold the public hearing, consider comments from the public, and close the public hearing. Licensing Period for Malt Liquor - The licensing period for 3.2 percent malt liquor licenses is currently June 1 through May 31 of each year. The licensing period for all other liquor licenses (Intoxicating and Wine) is July 1 through June 30 of each year. There are currently three licensees that have both an on -sale 3.2 percent malt liquor and a wine license. To allow for the dates of coverage for their liquor liability insurance to be consistent for both licenses, staff is recommending the Council amend the licensing period for 3.2 percent malt liquor licenses to coincide with other liquor licenses. The change would make all liquor licenses effective July 1 through June 30. When the current malt liquor licenses are renewed in May, we will recommend that those licenses be extended through June 30, 2014, if they provide sufficient liquor liability insurance coverage. Minimum Seating for Tier Two Intoxicating Liquor - The City has received an application for an On Sale Intoxicating Liquor License for a new restaurant. The license application qualifies for the Tier Two fee level in that they have a minimum of 1,000 square feet in floor area, but they will only have seating for 50 guests. The City Code states that applicants must have a minimum seating of 100 guests to qualify for a Tier Two intoxicating liquor license. City staff is recommending the City Code be amended from a minimum seating of 100 guests to a minimum seating of 50 guests to qualify for a Tier Two intoxicating liquor license. RECOMMENDATION Staff recommends that the City Council approve Ordinance 447 Amending Title 3 of the City Code to Amend the Licensing Period for 3.2 Percent Malt Liquor Licenses and Amending the Requirements for Obtaining an On -Sale Intoxicating Liquor License Tier Two, and to approve the summary publication of the ordinance. Approval of this ordinance requires a majority vote of the city council. Bob Kirmis of NAC Planning presented the request to the planning commission at their regular meeting March 26, 2013. Alan Spaulding and James Bade spoke for the applicant. Mr. Spaulding clarified: • Somerset is seeking to keep bees to promote pollination of flowers and fruit trees on the property. • Honey Bees are bred for production and temperament and pose little threat to people. • A single hive may hold up to 60,000 bees at it's peak. • Somerset anticipates starting with 2 -4 hives, but has requested up to ten, which is still far less than a commercial operation. • The common Honey Bee may travel up to two miles — a 100' buffer ensures space for the core activity of the hive. o Mr. Spaulding has four hives at his residence which are located 100' from his home; he has found it to be a reasonable distance. • It is much more common to be stung by a wasp or hornet, which are often confused with bees. Mr. Bade clarified: • The Town and Country Golf Course in St. Paul established a beekeeping program in 2012 with assistance from the University of Minnesota. • Somerset is certified by Audubon International for course management practices, beekeeping is consistent with Audubon standards. • The course has experience with feral bee hives and has not had issue with bee stings. The planning commission conducted a public hearing, Laurie Tostrud, from 1490 Somerset Court spoke in support of the code amendment. The commission did not have a quorum, and was unable to officially close the public hearing, or make a formal recommendation on the planning case. Staff has reviewed city code, and found that under Title 12, Chapter 1, Section L, Sub - section 8F.3, the city council may act upon a code amendment without a formal recommendation by the planning commission. Feedback from the commissioners present was in favor of the code amendment. BUDGET IMPACT N/A RECOMMENDATION pg 64 City staff recommends closing the public hearing on planning case 2013 -03. Currently, the ordinance permits the keeping of "Domestic Animals ", defined as "common domestic household pets ". The ordinance further prohibits the keeping of "Food Animals ", which are defined as animals "typically raised for purposes of food production ". Bees would be included in the "Food Animals" class, and not currently allowed in residential areas of the city. Analysis: A movement to permit the keeping of bees in residential areas has been common over the past few years, and many communities have considered the matter. Those favoring bees cite benefits of local food sources, pollination of area plants, and claim few concerns with problems related to beekeeping. Where such ordinances have permitted pg 67 bees, it is common to limit the number and size of hives and colonies to minimize neighborhood concerns. Most suburban communities have chosen not to allow bees in significant quantities, although some have. Concerns most often raised with keeping bees in suburban areas related to the potential concentration of bees in areas where residents may fear allergic reactions to stings. Bee supporters often cite the City of Minneapolis as an urban area in which bees are allowed. In Minneapolis, bees may be allowed under a zoning process in which the neighbors of the applicant must agree to the activity. This is zoning authority that suburban communities such as Mendota Heights do not have. Instead, if it is to be considered, the keeping of bees must be allowed under the same conditions throughout the zoning district in which it is listed. Occasionally, cities have dealt with the issue by allowing bees only on large lots, where extensive setbacks can be maintained. This is one option if the City wishes to consider approval of an amendment for the golf club. It should be noted that the additional land and setbacks do not eliminate the issues raised by bees, but they can mitigate the impacts of those issues to surrounding neighbors. The applicant has suggested an amendment that would limit bees to a maximum of ten hives, and on properties only of 50 acres or more. To accomplish the amendment, two changes would need to be made to the zoning ordinance. The first would be a change to the definition section which currently would prohibit bees as a member of the class of "Food Animals ". The second would be an addition to the Residential zoning districts which adds "Keeping of Bees" as an allowed accessory use, subject to the conditions necessary to mitigate concerns over potential impacts. Such language would be similar to the following: ANIMALS, FOOD: Fish, fowl, cattle, swine, sheep and others typically raised for purposes of food consumption, with the exception of bees where specifically allowed by the zoning districts. As the Commission is aware, the City Council recently denied a proposed amendment that would have created an exception to the animals ordinance for homing pigeons. The issues with that application were somewhat distinct from the keeping of bees, however, pigeons do not fit clearly into any of the ordinance categories of animals, while bees are clearly prohibited under the current language. 2 pg 68 The restriction here to 50 acre parcels should allay concerns over the concentration of bees in too small an area. Obviously, bees are naturally occurring animals and may create a hive in natural conditions without human intervention. This clause should permit the beekeeping process to occur without impacts on neighboring areas. Action Requested: Following a public hearing, the Planning Commission may consider one of the following recommendations: 1. Approval of an amendment to the zoning ordinance adding bees as an allowed accessory use in the residential zoning district or districts, as specific in this report and Planning Commission action, incorporating findings as attached to this report. 2. Denial of an amendment to the zoning ordinance that would add bees as an allowed use in residentially zoned areas, based on findings attached to this report. Staff Recommendation: Planning staff recommends approval of the amendment. While some communities have incorporated the keeping of bees in residential areas, the issue raises a number of issues with the compatibility of this activity with normal residential use of property. However, the limitations of this amendment to 50 acre parcels or greater should have the effect of minimizing any observable impacts to neighboring parcels. Supplementary Materials: 1. Funds remaining after remove of utility lines and poles were to be used for restoration of areas disturbed by utility work, and to focus on troublesome areas in the restoration of vegetation in the site. Actual costs to bury utility lines and remove poles came in less than anticipated, resulting in a grant balance of $25,830 which should be spent before June 30, 2013. Attached you will find a contract proposal from Great River Greening to repair damage from the utility crews, and to conduct a demonstration project which would bring grazing animals to the site. Grazing is a growing trend in open space management, but has not been utilized in a metro -area open space site. Great River Greening has developed a plan, supported by the Dakota County Farmland and Natural Areas Program, which would bring horses to Pilot Knob on a daily basis to graze selected areas of the prairie. Representatives of Great River Greening will be in attendance to discuss the plan in further detail. Staff has discussed the impacts of having grazing on the Pilot Knob site. The primary issue was the presence of farm animals in Mendota Heights. Pilot Knob is guided in our comprehensive plan as Nature Preserve /Open Space and is zoned as residential property. City Code allows for keeping of grazing animals on a non - commercial basis, provided that any new stable or building be 100' or more from any residential lot. The plan proposed by Great River Greening includes temporary fencing, located more than 100' from residential lots on Valencour Circle. Police, Fire and Public Works staff have all been made aware of this plan, with the primary concern of containing the animals. The attached plan requires horse owners to monitor their animals while on site. BUDGET IMPACT The proposed contract for $25,000 is within the existing grant balance; there is no anticipated impact on the 2013 City Budget. RECOMMENDATION Staff recommends accepting the proposed contract. The proposed trail connection would be on the south side of Highway 13. The City has an opportunity to apply for a grant through the Minnesota Department of Natural Resources' (DNR) Local Trail Connections Program. This grant application requires a resolution of support from the City Council. If approved, the attached resolution would be sent to the DNR in support of the City's grant application. The estimated cost of the trail connection project is $117,400. 75% of the construction costs would be covered by the grant with the remaining 25% being provided by the City. Mendota Heights' Municipal State Aid (MSA) account has sufficient funds available to cover the City's portion of the construction costs. BUDGET IMPACT If awarded the grant, the City of Mendota Heights would be responsible to provide 25% matching funds for the project. Cost estimates show this amount to be approximately $29,350 and could be paid out of the City's Municipal State Aid (MSA) funds. If not awarded the grant, and if Council wishes to proceed with the trail connection project, the entire construction cost would be paid out of the City's MSA account.
