Mazzitello, PE, PMP Public Works Director /City Engineer SUBJECT: Rogers Lake Water Quality Report — Saint Thomas Academy BACKGROUND Since the fall of 2001, students from Saint Thomas Academy have been studying the water quality of Rogers Lake in Mendota Heights. After analyzing their laboratory tests, the students form the Environmental Sciences class present their findings to the Mendota Heights City Council. The tests from the fall of 2012 have been analyzed and the students are ready to present their results. The attached information has been provided by Saint Thomas Academy, and will be the basis of their presentation this evening. The attached graphs were prepared by City staff based on the Saint Thomas Academy data in order to show trends in the different analyzed categories. Rogers Lake is maintaining its overall water quality level as compared to the 2011 test results. Total Phosphorous and Total Suspended Solids levels continue to be at, but not over, their regulatory thresholds, with all other measured categories within compliance standards. BUDGET IMPACT None RECOMMENDATION Staff recommends Council receive the water quality report for Rogers Lake from the Saint Thomas Academy students. pg 3 2012 -2013 Chemical Assessment of Rogers Lake Performed by Saint Thomas Academy A. P. Environmental Science Program Thank you for allowing us the time to share our findings withgthe Mendota Heights City Council. Forty students participated in the program this year and all were required to prepare a formal group presentation for the City Council. The winning group will present on Tuesday, March 5. This is a genuine learning opportunity for all forty students, especially the winning group. This document is intended to review the chemical water quality monitoring program used by the A.P. Environmental Science students at Saint Thomas Academy for the Mayor, Council Members, and Staff. The actual data, analysis of the data, areas in need of improvement, and possible solutions will be further discussed at the council meeting. Please direct any questions to Mr. Tony Kinzley, A.P. Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. CALL TO ORDER Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present: Councilmembers Povolny, Petschel, and Norton. Councilmember Duggan was absent. PLEDGE OF ALLEGIANCE Council, the audience, and staff recited the Pledge of Allegiance. AGENDA ADOPTION Mayor Krebsbach presented the agenda for adoption. Councilmember Petschel moved adoption of the agenda. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) PRESENTATIONS A) RECOGNITION OF FUTURE CITIES COMPETITION PARTICIPANTS, FRIENDLY HILLS MIDDLE SCHOOL City Engineer John Mazzitello explained the Future Cities Competition is primarily sponsored by the American Society of Civil Engineers and is for sixth through eighth grade students. City Engineer Mazzitello worked with Friendly Hills Middle School Teacher Mr. Doug Petty and his students on developing teams for entrance into the competition. The students were tasked with creating a futuristic city that deals with the issues that normal municipalities deal with. This year's issue was stormwater runoff. City Engineer Mazzitello introduced Mr. Doug Petty, the faculty lead for the competition, who introduced the teams and gave a little bit of information about the projects they created. Mr. Petty's class had three teams which were entered into the statewide competition. Of the forty-four teams entered in the competition, all three Friendly Hills Middle School teams finished in the top ten. The Council was pictured with each team and their plaques commemorating their achievement. February 19, 2013 Mendota Heights City Council Page 1 pg 16 B) SAL MONDELLI, PRESIDENT AND CEO, 360 COMMUNITIES Mr. Sal Mondelli stated that 360 Communities used to be known as Community Action Council, which was started over forty years ago in the faith community. The organization helps to support people who have hit a rough patch and help them to become self - sufficient. They do this in three ways: • Emergency services through resource centers and food shelves • Violence prevention, safe houses, advocacy actions, working with police to help them identify the warning signs • School Success Program — working with at -risk teenage mothers. Councilmembers asked questions about how the organization works with the schools and how 360 Communities is funded (53% of budget comes from federal, state, and local grants; 7% from United Way; and the remaining 40% comes from contributions from corporations, individuals, Rotary clubs, churches, etc.). CONSENT CALENDAR Mayor Krebsbach presented the consent calendar and explained the procedure for discussion and approval. Ayes: 4 Nays: 0 Absent: 1 (Duggan) PULLED CONSENT AGENDA ITEM K) APPROVAL OF AIRPORT RELATIONS COMMISSION 2013 WORK PLAN Mayor Krebsbach noted that this was a very well done work plan. Councilmember Petschel agreed that the work plan is very well done and is totally on point. The Commission has already had the legislators in to meet with them and has been very proactive. Councilmember Petschel explained that the Airport Relations Commission (ARC) has identified that their biggest challenge is going to be to watch how area navigation develops, and what kind of metrics and measurements they will use to indicate what, if any, effect it has on the City of Mendota Heights. She assured residents that the ARC has a proactive plan going forward and they are watching every operation at the end of the runway. Mayor Krebsbach stated that hard copies of the approved work plan will be made available to the public at city hall and it will also be added to the city's website. Councilmember Norton moved to adopt the Airport Relations Commission 2013 Work Plan. Councilmember Petschel seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) PUBLIC COMMENTS There were no public comments. UNFINISHED AND NEW BUSINESS A) CITY ATTORNEY REQUEST FOR PROPOSALS City Administrator Justin Miller explained the draft request for proposal (RFP) for city attorney services. The RFP calls for a deadline of March 21, 2013 for proposals to be returned to the City and for a new city attorney to be in place by June 1, 2013. City Administrator Miller anticipates between seven and ten proposals to be returned. He noted that it would not be necessary for the Council to interview every firm that submits a proposal. Staff requested Council approve the RFP and then provide staff with guidelines on how to proceed with evaluating the proposals. Councilmember Norton suggested a committee to review the RFP's and choose which ones to continue on to the interview process. February 19, 2013 Mendota Heights City Council Page 3 pg 18 Councilmember Petschel moved to accept the "Request for Proposals for City Legal Services" as presented. A sub - committee of two Councilmembers and city staff will evaluate the proposals and bring three to five firms forward to the full Council for interviews. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) COUNCIL COMMENTS Councilmember Petschel commented that she noticed that St. Paul Water has been in the City over the last few weeks and asked City Engineer John Mazzitello if he could explain what the project is they are working on. Mazzitello replied that there was another water main break in the Friendly Hills Subdivision. St. Paul Water has repaired the pipe and they will come back as weather permits to repair the street. Councilmember Povolny reminded residents to be aware of where their snow shovel is and that their snow blowers are full of gas so they are prepared for the bad weather that has been forecasted. The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, February 26, 2013, in the Council Chambers at City Hall, 1101 Victoria Curve at 7:00 P.M. The following Commissioners were present: Chair Litton Field, Jr.; Commissioners Doug Hennes, Robin Hennessy, Mary Magnuson, Michael Noonan, Howard Roston, and Ansis Viksnins. Those absent: None. Those present were Assistant to the City Administrator Jake Sedlacek, Public Works Director /City Engineer John Mazzitello, and NAC Planner Stephen Grittman. Introduce New Commissioner: Robin Hennessy Chair Field introduced Ms. Robin Hennessy as the newest member of the Planning Commission. Commissioner Hennessy gave a brief background and why she was interested in being a part of the Planning Commission. The other commissioners also gave a brief description of themselves for the benefit of Commissioner Hennessy. Election of Chair and Vice Chair Commissioner Magnuson nominated Litton Field as Chair of the 2013 Planning Commission, seconded by Commissioner Noonan. The nomination was accepted by Commissioner Field. There being no other nominations, the vote was called. AYES: 7 NAYS: 0 Commissioner Roston nominated Mary Magnuson as Vice -Chair of the 2013 Planning Commission, seconded by Commissioner Viksnins. Commissioner Magnuson expressed her appreciation but respectfully declined and nominated Doug Hennes as Vice -Chair of the 2013 Planning Commission, seconded by Commissioner Noonan. Planning Commission Minutes February 26, 2013 AYES: 7 NAYS: 0 Old Business: pg 20 PLANNING CASE #2012 -34 Vince Nonnemacher Conditional Use Permit for an accessory structure to keep pigeons at 1815 Valley Curve Road Assistant to the City Administrator Jake Sedlacek explained that the City Council did discuss the potential code amendment for allowing pigeons in Mendota Heights. The Council voted not to change the code to allow pigeons. The original application was for a conditional use permit for an accessory structure to house pigeons. Given the Council's feedback staff recommended denial of that request as was originally outlined in Mr. Grittman's memo to the Planning Commission dated December 26, 2012. COMMMISSIONER ROSTON MOVED, SECONDED BY COMMISSIONER VIKSNINS, TO DENY THE CONDITIONAL USE PERMIT. Chair Field noted for the record that the applicant was not in attendance. He then asked if the record shows that the public hearing on this application had been closed or was it still open. Assistant Administrator Sedlacek replied that there would be no harm in making the motion again to close the public hearing. Commissioner Roston tabled his motion to deny. Chair Field asked if there were any comments from the public on Planning Case #2012 -34. The commission discussed the concept of an interim use permit which was a part of the code amendment considered by city council. Staff advised that it could be addressed separately from the current motion. There being no more discussion regarding the motion on the floor, Chair Field called for the vote. AYES: 7 NAYS: 0 Chair Field noted that this motion for denial would be heard by the City Council on March 5, 2013 at 7:00 p.m. COMMISSIONER ROSTON MOVED, SECONDED BY COMMISSIONER MAGNUSON THAT THE PLANNING COMMISSION REQUESTS THAT THE CITY COUNCIL CONSIDER A CODE AMENDMENT CREATING AN INTERIM USE PERMIT. There being no further discussion, Chair Field called for the vote. AYES: 7 NAYS: 0 Hearings: PLANNING CASE #2013 -01 Yorn Yan Code amendment to allow adult day care in the industrial zone as a conditional use, and a conditional use permit for the same at 1385 Mendota Heights Road Planner Grittman explained that this request is in two parts: 1. Proposed amendment to the zoning ordinance that would establish adult day care as a conditional use permit in the industrial district 2. Request for a conditional use permit under that proposed amendment The applicants, the United Cambodian Association of Minnesota(UCA), are seeking this particular amendment and conditional use permit for the property located at 1385 Mendota Heights Road. That property is zoned and guided for industrial uses and is currently occupied by an industrial and office building. This property is located at the corner of Mendota Heights Road and Pilot Knob and the applicant would be tenants in a portion of that building. Staff is proposing an amendment based on the application request and identified a series of conditions that they would propose be part of that amendment. If the commission and the council Planning Commission Minutes February 26, 2013 pg 22 adopt the amendment, the applicants are also seeking a conditional use permit under these regulations. Staff recommended approval of both the amendment and the conditional use permit under the code as presented. The commission expressed concern that the amendment specifically allows adult daycare and not daycare for children. The applicant, Yorn Yan, UCA explained that the organization was established 1992 to serve Cambodians, but also serves Chinese, Korean, and other refugee people. the building would be used for office as well as adult daycare service. Most clients would utilize group transportation. Most of their clients are 65 years and older with impairments. However, they have some that are 50 years old who qualify for adult daycare services. They are looking to move into this new facility as their current location has become too small. Commissioner Roston asked if an age limitation of 18 years and older would be a problem. Mr. Yan replied that most of the people they serve is 50 years and older. Commissioner Noonan asked where the residents reside that would use this facility. Mr. Yan answered that Dakota County has the second largest Cambodian population in Minnesota, behind Hennepin County. Moving to Mendota Heights would give them the best location to serve both counties. Chair Field asked if there was anyone who wished to testify on the proposed amendments or the conditional use permit. COMMISSIONER VIKSNINS MOVED, SECONDED BY COMMISSIONER NOONAN TO CLOSE THE PUBLIC HEARING. AYES: 7 NAYS: 0 Assistant to the City Administrator Sedlacek, in response to the concerns raised about the ages of 18 and older, suggested that item F in the proposed amendment be changed to read "The daycare facility is properly licensed by the State of Minnesota under applicable statutory requirements for clients ages 18 and over." COMMISSIONER VIKSNINS MOVED, SECONDED BY COMMISSIONER MAGNUSON TO APPROVE THE ZONING ORDINANCE AMENDMENT BASED ON THE FOLLOWING FINDINGS OF FACT, SUBJECT TO THE ADDITIONAL LANGUAGE. 1. ADULT DAYCARE IS PRIMARILY AN INDOOR USE THAT RAISES NO COMPATIBILITY ISSUES WITH OFFICE /INDUSTRIAL USES. 2. The department responded to 15 calls for the month. The majority of calls were classified as false alarms or as good intent calls. Of the 15 calls, five were commercial alarms, three were residential calls, two of the calls were for mutual aid, two were for gas leaks, one was an EMS call, and one call was an accident with injuries. The department responded to one structure fire. Captain four responded directly from his home and was able to control a grease fire with a portable extinguisher before it caused significant damage. Monthly Department Training The monthly department training was on fire alarms and suppression systems. Retired firefighter Roy Kingsley who is the Fire Marshal for Apply Valley brought in a training program that he has developed. The program educates the firefighters on how to deal with some of the problems we face in the field with fire alarms and suppression systems. Monthly Squad Training The monthly squad training focused on ice rescue. The training was conducted on Rogers Lake. The training department cut a hole in the ice with a chain saw so the department members could focus on the tactical response to emergencies in the water. Members practiced techniques used to remove a conscious and an uncurious victim who have fallen through the ice. The 2013 Fire Department Instructors Conference is being held April 23 -26, 2013 in Indianapolis, Indiana. I have attended in the past as have other officers and found it to be a very worthwhile event. This training is considered one of the premier opportunities in the fire service for instructors. There are many important sessions at this conference. Two officers would like to attend this conference. BUDGET IMPACT There is $3,500.00 in the fire department budget for this conference attendance. The cost of the conference registration is $530.00 per person to attend. There would also be costs for travel, hotel (estimated to be $2,058.80), and meals. The planning commission tabled discussion on the application for conditional use permit until hearing the outcome of city council discussion of the code amendment. The code amendment to allow pigeons was discussed by city council on February 5, 2013, and was not passed. At their regular meeting February 26, 2013, the planning commission passed a motion recommending denial of the request for a conditional use permit. Mr. Nonnemacher plans on raising the racing homing pigeons as a hobby upon retirement, and would like to construct a 200 square foot pigeon loft in the rear yard of his property to house the pigeons. The Zoning Ordinance allows the keeping of common domestic household pets (including horses) in the R -1 District for noncommercial purposes, provided that any accessory building used to house such animals is located not less than one hundred feet (100') from the nearest residence. As a threshold question, whether homing pigeons are included within the definition of a domestic household pet is at issue. The City does not directly define pigeons as a domestic animal, but rather includes the term "birds" within its definition. Further, pigeons are not included in the City's definition of "food animal" (a definition of "farm animal" is not currently provided). While pigeons are birds, within the potential realm of the ordinance definition, they are kept pg 32 outdoors in a separate building rather than within the household, and are routinely free to leave the premises of the owner. The City may decide that a more detailed categorization of pigeons is necessary within City Code, in which case an amendment to Ordinance would be necessary. An ordinance amendment could do one of two things: 1) specifically include pigeons within the definition of a domestic animal, or 2) create language to specifically allow the raising of pigeons as an accessory or conditional use within the R -1 District. For the purpose of this report and subsequent discussion, planning staff will consider the existing definition of "domestic household pet" as comprehensive enough to include homing pigeons as a domestic "bird," so that the raising of pigeons would be considered an allowed accessory use within the R -1 District. If the Planning Commission and /or City Council determine otherwise, the application should be tabled or denied until an amendment is processed which would include an allowance for the raising and keeping of pigeons. The subject property is both a corner and a through lot. The zoning ordinance requires that all accessory buildings greater than one hundred forty four (144) square feet receive a conditional use permit. As indicated, the applicant would like to build a 200 square foot pigeon loft. Analysis: Conditional Use Permit. In considering an application for a conditional use permit the council will consider the effect of the proposed use upon the health, safety, and welfare of occupants or surrounding lands, existing and anticipated traffic conditions including parking facilities on adjacent streets, and the effect of the proposed use on the comprehensive plan. Specifically, the ordinance sets up the following requirements for consideration of Conditional Use Permits: Conditional Use Permit Standards. According to Section 12-1L-6, in considering an application for a conditional use permit, the Planning Commission and City Council shall consider the following factors: • Effect of the proposed use upon the health, safety, and welfare of occupants, surrounding lands, or community; Staff Comment: The proposed accessory structure is to be used for housing racing homing pigeons. As noted above, this use may be seen as not allowed under the current ordinance language. Some communities have had issues with homing pigeons, with respect to roosting on neighboring buildings, soiling house and garden improvements in neighboring areas, and similar concerns. The applicant should identify how they will address these types of concerns as they may relate to the proposed use of the building. 2 pg 33 • Existing and anticipated traffic conditions including parking facilities on adjacent streets; Staff Comment: The accessory structure shall not influence traffic conditions or parking facilities on adjacent streets. • Effect of the proposed use on the comprehensive plan; Staff Comment: The Comprehensive Plan has designated this parcel as Low Density Residential. A detached accessory structure for storage is a compatible use with this designation. • It must be determined that the proposed use will not seriously depreciate the surrounding property value; Staff Comment: The proposed building will be 8 feet wide by 25 feet in length, with an overall height of approximately 10 feet, constructed on a concrete slab. The building will be covered in "drivit" sheathing and asphalt shingles, designed to be compatible with the principal building. The proposed building location would be 30 feet from the east property line, one of the parcel's frontages on Hilltop Road. The building is proposed to be 18 feet from the south property line, an adjoining single family parcel. Both the applicant's house and the neighboring house to the south have setbacks from Hilltop Road of 45 feet or more. As such, the proposed location of the structure would extend at least 15 feet closer to the street than either principal residence. If the structure is to be approved, it should be no closer to the street than the homes on either of these parcels. • Proposed use is in harmony with the general purpose and intent of this chapter. Staff Comment: The proposed structure meets all other Ordinance requirements, including setback requirements pg 34 Action Requested: Following a public hearing, the Planning Commission may make one of the following recommendations on the proposed Conditional Use Permit: (1) Recommendation of approval for the Conditional Use Permit for an accessory building of 200 square feet, more than the permitted 144 square feet allowed by the zoning ordinance. This recommendation should be accompanied by findings for approval as attached to this report, and the following conditions: a. The proposed building is relocated to be no closer to the street than either of the adjoining principal houses, including the applicant's house at 1815 Valley Curve, or the property to the south at 828 Hilltop Road. b. The structure is maintained and not permitted to deteriorate in any way. c. The structure is not permitted to maintain odors or discoloration that is visible from adjoining property or from the public street. d. Landscaping is added to the south side of the building to enhance the screening of the building from the adjoin parcel. (2) Recommendation of denial for the Conditional Use Permit, based on findings for denial attached to this report. (3) Tabling of the Conditional Use Permit, pending further consideration of the proposed use of the building (keeping and raising of racing homing pigeons), contingent on the applicant's agreement to extend the timeline for consideration of the CUP. Staff Recommendation: Planning staff does not recommend the CUP. The use of the building appears to raise issues of compatibility in a single family residential neighborhood. Staff would recommend that if the keeping of racing pigeons is to be considered acceptable, a set of standards should be prepared as a part of the zoning ordinance in order to minimize potential problems with the use. If the Planning Commission believes that the use is acceptable, staff would recommend that the conditions listed above are included in any approval to give the City the ability to manage concerns over compatibility, maintenance, and operation. The Overlook Road Neighborhood Rehabilitation was also identified as a 2013 street rehabilitation project in the 2012 -2016 SIP. The proposed improvements for these two neighborhoods are similar in nature and staff believes that combining the two neighborhoods into one project would reduce staff time and would produce lower unit prices during construction due to the project size. The combined project will be called the Crown Point & Overlook Neighborhood Rehabilitation. Council ordered the Crown Point & Overlook Neighborhood Rehabilitation improvements at their September 18, 2012 meeting, and directed staff to prepare plans and specifications for this street rehabilitation project. This project includes rehabilitating Crown Circle, Crown Court, Crown Point Drive, Lilac Road between Marie Avenue and Douglas Road, Overlook Lane, Overlook Road, Summit Lane between Marie Avenue and Overlook Road, the Marie Park parking lot, and rehabilitating the Lexington Avenue trail between Highway 110 and Douglas Road. The proposed project also includes street preventative maintenance including crack sealing and seal coating on Highway 110 Frontage Road /Carmen Lane, Bachelor Avenue, Trail Road, Sutton Lane, Stanwich Lane, Lansford Lane, Round Hill Road, Hidden Creek Trail, Nature Way, Evergreen Knoll, Gryc Court, Pamela Lane, Deer Trail Point, Deer Trail Court, Wachtler Avenue south of Wentworth Avenue, and Mayfield Heights Road. Proposed improvements to the trail on the east side of Lexington Avenue between Highway 110 and Douglas Road include reclamation of the existing trail and placing a 2.5" bituminous wear course over the reclaimed material and installing pedestrian curb ramps. Dakota County has included this project in their Capital Improvement Plan (CIP) to augment project cost. The City is responsible for 45% of the construction cost and design services, and the County will provide 55% of the construction cost and design services. The total estimated cost of the Lexington Avenue trail improvements is $60,000. Preventative Maintenance Proposed improvements for Highway 110 Frontage Road /Carmen Lane will include replacing broken section of bituminous curb, bituminous leveling near Highway 110, crack sealing and seal coating. The proposed project also includes preventative maintenance to Bachelor Avenue, Trail Road, Sutton Lane, Stanwich Lane, Lansford Lane, Round Hill Road, Hidden Creek Trail, Nature Way, Evergreen Knoll, Gryc Court, Pamela Lane, Deer Trail Point, Deer Trail Court, Wachtler Avenue south of Wentworth Avenue, and Mayfield Heights Road, which consists of crack sealing and seal coating. The City of Mendota Heights has a Joint Powers Agreement (JPA) administered by the City of Burnsville, which lasts through December 31, 2013. Although the JPA is written for a number of services, the City of Mendota Heights only utilizes limited services provided by the JPA (Crack Sealing and Seal Coating /Chip Seal). These services are delivered at a comparable or reduced unit cost to bid prices the City could get on their own, and the administrative fees paid are slightly more economical than if the services were administered by in -house staff. Staff proposes having the crack sealing and seal coating completed under the JPA. The total estimated cost of the crack sealing and seal coating is $100,000. Project Schedule pg 53 The Engineering staff has substantially completed the plans and specifications for this project. The next step is to advertise for bids. The Crown Point & Overlook Neighborhood Rehabilitation project is proposed to be financed by special assessments, Dakota County funds (Lexington Avenue trail improvement), and municipal bond sales. RECOMMENDATION Staff recommends that the council approve the final plans and specifications and authorize staff to advertise for bids. Mr. Yan also requested a conditional use permit to locate an adult daycare in the existing building at 1385 Mendota Heights Road. The property is zoned as I — Industrial and used as office. The planning commission heard the request at their regular meeting on Tuesday, February 26, 2013. Planner Grittman reviewed his report, noting that the amendment to allow daycare for adults is anticipated to have minimal impact in commercial /industrial zones. A daycare for children would not be viewed the same way. The planning commission sought to clarify that the amendment would only pertain to adults, and supported additional language to the drafted amendment presented by Mr. Grittman. Occupancy limits were discussed; Mr. Grittman stated that occupancy is a condition of state licensing requirements. The applicant thanked the commission for their consideration, and explained that the organization has outgrown it's current space in Inver Grove Heights. Dakota County has the second highest concentration of Cambodian population in Minnesota, behind Hennepin County. The proposed location provides great access for clients in both counties. Mr. Yan clarified that the overwhelming majority of their clients would be transported to the facility via shuttle vans, limiting traffic impact. There were no comments at the public hearing. BUDGET IMPACT N/A RECOMMENDATION The planning commission recommended approval of the code amendment and the conditional use permit as shown in the attached documents. Each action requires a simple majority vote by the council. If the city council desires to implement the recommendation, pass a motion adopting ORDNANCE 446, AMENDING TITLE 12, CHAPTER 1 OF CITY CODE. They would occupy about 4,000 square feet of a 32,000 square foot building. Office and administrative uses are permitted in the Industrial zoning district, however, the proposed adult day care activity is not currently listed in the district. As such, the applicants are seeking an amendment to the Industrial District uses to add Adult Day Care as a Conditional Use Permit, and then also seeking a CUP for this facility under the proposed revision to the code. Analysis: Zoning Amendment. Daycare, as noted above, is not currently listed as an allowable use in the Industrial District. Daycare is allowed as a permitted use in four of the five Business Districts (B -1A through B -4), with the exception of B -1. Daycare is also allowed in the Residential Districts by Conditional Use Permit. The current listing in pg 72 those districts does not distinguish between Adult or Child daycare, although the residential item uses use term "Private Nursery or Daycare School ". Adult Daycare, as proposed by the applicants in this case, consists of group social activities for seniors who are otherwise home - bound. The applicants operate small vans or buses and pick up seniors at their homes and bring them to the site for activities, returning them home again by van or small bus. The applicants propose to operate the daycare for three days per week (Tuesday — Thursday), from 9:00 a.m. to 1:00 p.m. Daycare operations are common in commercial and industrial areas in many communities. Although they raise some issues for traffic control and use compatibility that would not be typical to industrial districts, proximity to work environments often results in zoning allowance of daycare uses in those areas. The application in this case anticipates Adult Daycare in the Industrial District by Conditional Use Permit. There are a number of reasons to consider this amendment in steps. These include the following: (1) Adult Daycare is often provided just as the applicants propose — via van or bus delivery at specific times (often peak), rather than individual drivers. This helps to limit traffic conflicts and parking concerns in the industrial area. This contrasts with Child Daycare which is dominated by children who are driven individually to the site, commonly during peak traffic periods. (2) Adult Daycare is almost always dominated by indoor activity, resulting in fewer concerns over land use compatibility due to noise, on -site or adjacent street truck traffic, or other conditions common to industrial areas. This is in contrast to Child Daycare, in which outdoor activity is a condition of most licensing requirements. (3) The Conditional Use Permit requirement permits the City to examine each application to ensure that the particular site in question will have adequate facilities to avoid land use or operational conflicts with the site or neighborhood. This is important to ensure that the long -range land use of the properties in the district are not compromised by non - industrial uses. As such, the proposed amendment would be made to the Industrial District Conditional Uses, Section 12-1G-2, as follows: Adult Daycare, provided that the proposed facility meets the following conditions: A. Clients are brought to the site primarily through the use of group transportation, such as vans or buses. B. A separate exterior entrance is available to the facility for clients and staff. C. If located in a multi- tenant building, the daycare facility is found to be compatible with the other uses that are allowed on the property under the applicable zoning regulations. E. Outdoor activities on or around the property in question, if part of the program, are accessible via adequate pedestrian facilities such as sidewalks or trails. F. The Daycare facility is properly licensed by the State of Minnesota under applicable statutory requirements. Conditional Use Permit. The proposed site, noted, is at 1385 Mendota Heights Road, the northeast corner of Mendota Heights Road and Pilot Knob. The applicants would occupy the northeast corner of the building, where there is a direct exterior entrance to the east -side parking lot, along with other exits to common space in the building. As noted above, clients would be brought to the facility via van or small bus from their homes at about 9:00 a.m. on Tuesday, Wednesday, and Thursday of each week, leaving the site about 1:00 p.m. to return home. They have indicated to staff that they would not likely have outdoor activity. It is noted that a trail exists on the west side of the property along Pilot Knob Road, and Mendota Heights Road has a trail along the south side of the roadway. No on -site sidewalk currently provides access from the applicant's entrance to these trails. The applicants will also utilize the facility for their offices from which they coordinate other social services to members of their client community. The applicants currently hold a license from the State for a different location — their interest in this site would be to move both their daycare and office uses to a single combined location. Action Requested: Following a public hearing, the Planning Commission may consider one of the following Actions: Zoning Ordinance Amendment. (1) Motion to recommend approval of the amendment to the Zoning Ordinance, specifically the 1, Industrial District, to add Adult Daycare by Conditional Use Permit. DISCUSSION: As Council is aware, the department has been following a capital replacement plan for all of our major pieces of equipment. We have been working towards replacing one major piece of equipment every five years. Since we have five major pieces of equipment we would be replacing equipment after it reaches 25 years of age. This is a little longer than is the industry standard of 20 years, however, our experience has been that this is reasonable based on how we specify our equipment and how we use and take care of it. The proposed truck will replace our 1978 1250 gpm engine with Squrt. The existing truck has served us well and was scheduled to be replaced in 2014. As you are aware, the truck suffered a major engine failure last October and we have been working diligently on specifications for a replacement since. We have been relying on mutual aid for assistance, if needed, to assist us until a bid process could occur. As part of the bidding process we are asking bidders to provide /include the cost of a loaner engine that can be used until the new truck arrives in late 2013 or early 2014. The specifications on the equipment have been developed over the past four months by a Fire Department Truck Committee lead by Assistant Chief Dave Dreelan who was assisted by Captain Scott Goldenstein and Firefighter Jamie Lerbs who lead two sub - committees. The specifications were developed to be as open as possible to allow several manufacturers to bid. The truck is specified as the committee would like the truck equipped but also provides some items to be deducted if needed. While the committee considers these items important it also realizes that there is not an unlimited amount of dollars available. The project will involve taking the 55' Master Stream "SQURT" device off of the existing 1978 chassis, rehabilitating it and installing it on a new chassis that matches our last truck purchase in 2009. After consulting with Councilmembers Povolny and Norton we are also bidding an option that would allow bidders to install a new "55' Squrt" rather than refurbish the existing unit if pg 86 they feel that is the best and most economical approach. The department and council could then decide what is in the best interest of the city. The remaining 1978 chassis and body would become the property of the successful bidder. As Chief I feel very strongly that the new truck and equipment needs to be as compatible as possible with our existing equipment to minimize training and maximize efficiency without sacrificing changes in technology. The truck committee proposal meets that standard with a chassis that is similar to our 2009 engine in layout, use, and size and a "master stream device" (the 55' SQURT) that we have used for 34 years and operates functionally like our 65' TELE- SQURT. The truck is also proposed to carry a minimum 500 gallons of water and like the 2009 fire engine be equipped with a 1500 gpm Waterous pump (made in South Saint Paul) with foam capability, roll -up doors, as opposed to swing -out doors, that are safer, by not hiding a firefighter behind a door, and allowing easier access to equipment, and an equipment body built of stainless steel to provide the longevity we are looking for (the truck we are replacing was also made of stainless steel). While many hours of research and talking with vendors has gone into the specifications, the committee wants to be sure that we obtain the best value for the dollar on equipment that meets the department's needs. To help up meet that goal, we will be scheduling a pre -bid conference whereby any manufacturer who wishes further information, or has concerns about the specifications, may ask for clarification. This should also help maximize the competitive market. The actual specifications are over 100 pages, so they are not included in this report. They are available for review at city hall if desired. FUNDING This truck has been planned for in our equipment replacement schedule with a budget estimate of $550,000. Council will need to decide at time of award how it wishes to fund the purchase of the truck as several options are available including: using debt service to pay Equipment Certificates, the Equipment Reserve Fund, City Reserves or a combination thereof. I will work with City Administrator Miller and Finance Director Schabacker to evaluate options to present options to Council for consideration at time of award. RECOMMENDATION: I recommend that the City Council approve the attached Resolution No. 2013 -17 "Resolution Approving Specifications and Authorizing Advertisement for Bids for a 1500 GPM Engine with 55" SQURT". pg 87 City of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 2013 -17 RESOLUTION APPROVING SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR A 1500 GPM ENGINE WITH 55' SQURT WHEREAS, the City Council has therefore directed the Fire Chief to proceed with the preparation of specifications thereof; and WHEREAS, the Mendota Heights Fire Department Truck Committee and Fire Chief have prepared the specifications for said fire apparatus and has presented such specifications to the City Council for approval. NOW THEREFORE, IT IS HEREBY RESOVLED by the City Council of the City of Mendota Heights, Minnesota, as follows: That the specifications for said improvements by and they are hereby in all respects approved. That the City Clerk with the aid and assistance of the Fire Chief be and is hereby authorized and directed to advertise for bids for said fire apparatus all in accordance with the applicable Minnesota Statues, such bids to be received at City Hall of the City of Mendota Heights by 4:OOpm Thursday, April 4, 2013, at which time they will be publicly opened at City Hall by the City Clerk, tabulated, and will then be considered by the City Council at a regular Council meeting.
