CALL TO ORDER Mayor Levine called the meeting to order at 6:00 p.m. Councilors Lorberbaum, Paper, and Miller, were also present. Councilor Mazzitello was absent. PLEDGE OF ALLEGIANCE Council, the audience, and staff recited the Pledge of Allegiance. AGENDA ADOPTION Mayor Levine presented the agenda for adoption. Ayes: 4 Nays: 0 PULLED CONSENT AGENDA ITEMS G) RESOLUTION 2023-07 FORMALLY ACCEPTING A GIFT FOR A PARK BENCH DONATION Councilor Lorberbaum referenced the $2,000 donation that will be used for the donation of two park benches. She asked the cost that the City would incur for the benches as well, as it mentions that the City will pay the remainder of the cost. Parks and Public Works Director Ryan Ruzek noted that the cost would depend upon the location where the benches are installed. He stated that historically the cost is $1,500 to $2,000 per bench, therefore the cost for the City could be $1,000 to $2,000. He confirmed that there are funds available for this use. Councilor Miller moved to approve RESOLUTION NO. 2023-07 FORMALLY ACCEPTING A GIFT FOR A PARK BENCH DONATION. Councilor Lorberbaum seconded the motion. Ayes: 4 Nays: 0 H) APPROVAL OF REVISIONS TO THE CITY'S PICNIC SHELTER RENTAL POLICY Councilor Lorberbaum referenced language in the policy which states permits will be issued three times during the year and would like to see that language clarified. Parks and Recreation Manager Meredith Lawrence stated that staff would be open to revisions but stated that there is additional language stating that after that time permits will be accepted based on a first come, first serve basis. She explained that the City does permit on the three seasons. She stated that the Park Commission did review the policy and has recommended the language as proposed. Councilor Lorberbaum suggested using the language "three time periods". Councilor Lorberbaum moved to approve AMENDMENT TO THE REVISIONS TO THE CITY'S PICNIC SHELTER RENTAL POLICY AS SUGGESTED BY COUNCILOR LORBERBAUM. Councilor Miller seconded the motion. PRESENTATIONS/RECOGNITIONS A) FIRE CAPTAIN OATH OF OFFICE AND BADGE PINNING Fire Chief Dave Dreelan explained that the Council was asked to conduct a ceremonial swearing in of Captain Hayley Heidelberg, the newest Fire Captain in the Mendota Heights Fire Department. Mayor Levine conducted the ceremonial swearing in of Fire Captain Hayley Heidelberg. She also expressed thanks to all members of the department that serve the community. PUBLIC HEARING A) RESOLUTION 2023-08 ORDERING VICTORIA CURVE STREET IMPROVEMENTS Public Works Director Ryan Ruzek explained that the Council was being asked to preside over a public hearing for the Victoria Curve Street Improvement project. He noted that an incorrect date was provided in the public notice and therefore the Council will still be asked to preside over a public hearing tonight and then continue the item. Larry Poppler, TKDA, stated that the Council approved the feasibility report in December and provided an overview the project details. He noted that a neighborhood meeting was held the previous week which had good participation. He provided an overview of the public input received. He also provided details on the estimated project cost, proposed assessment, and other forms of funding. He reviewed the proposed project schedule. Councilor Lorberbaum asked if the public would be noticed again for the February 7 date. Public Works Director Ryan Ruzek replied that notices and ads have already been submitted. Councilor Paper asked how this project compares to other projects in terms of the amount the City will be paying. Public Works Director Ryan Ruzek replied that the assessments are paying a lower portion of the project cost because of the limited number of parcels to assess. He noted that assessment will cover at least 20 percent of the project cost. He noted that a large amount of MSA funding would be used for the project. Mayor Levine referenced the proposed assessment rate and asked how that compares with previous assessments. Public Works Director Ryan Ruzek commented that this proposed assessment is a bit higher than typical. He stated that they did estimate conservatively and based on bids could be lowered. Councilor Lorberbaum moved to open the public hearing. Councilor Miller seconded the motion. Ayes: 4 Nays: 0 Greg Bolin, 1215 Victoria Curve, referenced an exhibit from the TKDA report included in the December Council packet which provided cross sections of Victoria Curve, with and without parking. He stated that it is his understanding that the section without parking would be in front of residences between Hunter and Glenhill. Mayor Levine confirmed that to be true. Mr. Bolin referenced the watermain replacement, which may impact trees. He provided a photograph of the mature pine trees that he would like to ensure are preserved if possible and asked the position of the City. Vinh Truong, 1217 Victoria Curve, asked if anyone has taken the time to observe the number of pedestrians walking down Victoria Curve. He commented that during the summer there are three or four people at most and therefore was unsure that would justify the need for a trail. He stated that he supports the road project but not the trail. Larry Alexander, 1203 Victoria Curve, stated that he is concerned with potential impacts to mature trees near the perceived property line as he has mature apple trees in that area. He stated that it was his understanding that there was supposed to be a give back of the land that is proposed to be used. He asked for details on the 40 feet that he believed would be given back to the property owners. He asked if there would be ideas on berming or other screening between the private properties and proposed trail. Lynn Burow, 1219 Victoria Curve, asked if the trail is necessary as it would lead to nowhere and there is not much pedestrian activity on Victoria Curve. She believed that would be unwarranted. She stated that she has concern with traffic on 62 and conflicts with pedestrians in that location. She stated that perhaps a guardrail would be more appropriate in that location than a walking path. She reiterated that a walkway is unnecessary. City Attorney Elliot Knetsch noted that this public hearing will be kept open and continued at the next meeting in February. Public Works Director Ryan Ruzek provided details on the existing pedestrian trail that dead ends at Hunter. He noted that the section of Victoria Curve from Hunter to the highway is wide with shoulders and therefore staff considered reviewing the width of the roadway with a shared use trail. He stated that the location of the back edge of the trail would match the existing curb line and therefore there would not be additional impacts into resident yards. He stated that this trail segment would fill the gap where people are currently walking on the roadway. He did not anticipate that this trail would become a regional attraction. He stated that Saint Paul Water has identified a needed watermain replacement, which may impact vegetation. He stated that trenchless technology is proposed, with excavations on each end. He noted that each home would then need to be connected to the new water line. He stated that he does not have enough information to know if the trees mentioned would be impacted. Councilor Miller noted that this would be done through boring and therefore a trench is not going to be dug the entire section of road. Public Works Director Ryan Ruzek confirmed that but noted that the water service for the mentioned home is near the pine trees. He stated that they will use trench boxes in attempt to minimize impacts to the extent possible. He referenced the property with the apple trees that was also mentioned and identified the right-of-way as it exists. He stated that if the residents desired, they could request vacation of the right-of-way, but easement would still be necessary for the utilities that exist. Councilor Miller asked the depth of the watermain line. Public Works Director Ryan Ruzek replied that depth is eight feet. He clarified where the on -street parking would be available as proposed. Mayor Levine noted that if the road width is shrunk, that would eliminate the on -street parking ability. Public Works Director Ryan Ruzek replied that in order to use MSA funds, the City needs to meet the MSA requirements for design. He stated that they would not be able to rebuild the road as it exists today, and if that were done, both sides would need to be signed as no parking. He stated that if the trail were not constructed, they could shift the alignment of the road to provide parking on one side without impacting residential properties. He again noted that the City would not proactively vacate right-of-way as there are utilities in that area. He stated that the residents could petition for such action, but easement would still be needed for those utilities. He noted that because they do not anticipate this trail to be a regional draw, they would not pursue a berm or additional screening along the trail. He noted that the mature existing vegetation would act as a screen for those properties. Mayor Levine noted that the public hearing will be continued at the February 7, 2023 Council meeting. NEW AND UNFINISHED BUSINESS A) RESOLUTION 2023-01 ESTABLISHING CITY DEPOSITORIES OF FUNDS Councilor Lorberbaum recused herself. City Administrator Cheryl Jacobson explained that the Council was being asked to adopt the resolution approving the 2023 City depositories. Councilor Paper moved to approve RESOLUTION NO. 2023-01 ESTABLISHING 2023 CITY DEPOSITORIES OF FUNDS. Councilor Miller seconded the motion. Ayes: 3 Nays: 0 Councilor Lorberbaum rejoined the Council. B) RESOLUTION 2023-06 APPOINTING CITY ADVISORY COMMISSION MEMBERS City Administrator Cheryl Jacobson provided a brief background on this item. The Council appoints members to the advisory commissions including the Planning Commission, Parks and Recreation Commission, Airport Relations Commission, and the Natural Resources Commission. Councilor Lorberbaum asked when the appointments would take effect. City Administrator Cheryl Jacobson replied that would depend upon when the seat opened. She stated that because there were two midterm vacancies for the Planning Commission, the candidates could begin immediately whereas the Airport Relations Commission candidate would begin in February. Councilor Miller moved to adopt RESOLUTION NO. 2023-06 APPOINTING CITY ADVISORY COMMISSION MEMBERS. Councilor Lorberbaum seconded the motion. Further discussion: Mayor Levine thanked the community noting that there were 16 incredible applicants. She continued to be impressed by the number of talented residents that apply to volunteer in these positions. She recognized that several members were being reappointed and thanked those individuals for their continued service. Ayes: 4 Nays: 0 COMMUNITY ANNOUNCEMENTS City Administrator Cheryl Jacobson announced upcoming events and activities. COUNCIL COMMENTS Councilor Miller commended public works for continuing to put their best foot forward with snow removal. He also expressed thanks to residents that have been clearing snow around hydrants noting the time saving measure that provides in an emergency situation. Councilor Lorberbaum stated that she was unable to attend the Coffee with the Council event due to potential exposure to COVID and thanked Mayor Levine and Councilor Mazzitello for attending. She stated that she will attend an upcoming session of the event. She recognized and acknowledged the legacy of Dr. Martin Luther King Jr. She congratulated the newly appointed commission members and thanked all that applied. She encouraged those not appointed to reapply in the future. She also thanked the retired commission members as well as those continuing to serve. She stated that the Council meeting time will be changed beginning in February, with work sessions beginning at 5 p.m. and regular meetings beginning at 7 p.m. Councilor Paper congratulated the new Fire Captain and thanked the outgoing members of the different commissions. Mayor Levine congratulated the new Fire Captain. She reminded residents of the tri-district community education catalog which was recently mailed and noted that it provides great opportunities for residents. Levine Mayor ATTEST: Christine Lusian City Clerk 5b CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA DRAFT Minutes of the City Council Work Session Tuesday, January 17, 2023 CALL TO ORDER Mayor Levine called the work session to order at 4:30 pm. Councilmembers Lorberbaum and Paper were present. Staff in attendance included City Administrator Cheryl Jacobson, Public Works Director Ryan Ruzek, Assistant City Administrator Kelly Torkelson, Parks and Recreation Manager Meredith Lawrence, and City Clerk Christine Lusian. ROGERS LAKE SKATEPARK RENOVATION Park and Recreation Manager Meredith Lawrence reviewed the City Council's direction from the 2023 budget meetings to replace the existing skate park at Roger's Lake with a modular park and concrete base within the budget of $300,000. Lawrence gave the City Council a project update that included work with the City's skate park design and engineering consultants in addition to working with the City's Skate Park subcommittee. Lawrence explained that the city's design consultant took the feedback received from the subcommittee and designed a proposed modular feature skate park with a concrete pad within the budget provided. The renderings were then shared with the subcommittee for initial input on the design. The subcommittee asked staff to pursue a full concrete park instead of the proposed modular park. Lawrence stated that staff asked the city's design consultant to provide a rendering of a full concrete park within the budget of $300,000. Given the existing parameters, a full -concrete park would be approximately a third of the size of the existing skate park and half the size of a new modular feature skate park. Lawrence noted that with a full concrete skate park a 2023 build would not be feasible, so the project construction would need to be pushed to a future year. Staff asked the Council for direction on next steps. The City Council shared concerns regarding the new skate park being considerably smaller than the existing park, as well as a lack of features compared to what residents were used to if a full concrete park was pursued. Councilor Paper noted that the skate park in Mendota Heights is meant to be for residents to learn how to skate and is not intended to be a regional draw. He noted that there is not a lot of parking at this site and if the skate park becomes the preferred location of skaters throughout the metro area, there will be an issue with capacity. He felt a modular park would meet the priorities of the park and would benefit the residents of Mendota Heights, which is the top priority. Mayor Levine commented that the Council heard from residents in 2020 that the existing modular feature skate park was unique and was loved by the community. She stated she would like to see staff move forward with a modular skate park on a concrete pad, based on the $300,000 budget and would like to see the new park built in 2023. Councilor Paper noted the one change he would like to see would be the inclusion of the skatelite surface in comparison to the steel surface. He noted that this would have a better feel for skaters, would provide a noise dampening mechanism, and would provide the same surface that is currently at the park. Staff noted that the modular skatelite surface would need more maintenance than the steel surface and overall, a modular park would need more maintenance overtime than a concrete park. In addition, the skatelite surface would cost more than the steel surface. The City Council was comfortable with this. Staff noted that a maintenance plan would be included in the final proposal to the City Council. The City Council advised staff to proceed with a concrete base and modular features and asked staff to engage the community via a survey based on this direction. IVY FALLS EAST STREET REHABILITATION Public Works Director Ryan Ruzek updated Council on the project close out and contract status. The project was not completed on time and the city incurred additional costs as a result. Options to move forward include absorbing the additional costs, negotiating the additional costs with the contractor, and mediation. The Mayor and City Council requested the cost of mediation. HIRING REFERRAL PROGRAM Assistant City Administrator Kelly Torkelson explained the proposed hiring referral program that would incentivize existing staff to help the city recruit qualified candidates for open positions. The Mayor and Councilors Lorberbaum and Paper expressed support for the proposal and suggested looking at different incentive amounts dependent upon the position being recruited. Staff were directed to proceed with a hiring referral program. CONFLICT OF INTEREST AND ANTI -NEPOTISM POLICY Mayor Levine asked to discuss family and relatives of city council members serving on city advisory commissions. She noted that community members have expressed concern to her on the matter. Councilor Lorberbaum would like to move forward without a policy and handle each situation individually when it arises. Levine recommends that commissions be filled by community members who are not already first order relatives of the council. Call to Order Chair Norling called the meeting to order at 6:00pm. The following commissioners were present: Gina Norling, William Dunn, David Sloan, Arvind Sharma, and Jim Neuharth. Absent (excused): Kevin Byrnes and Jeff Hamiel. The following guests were present: Rose Agnew, Scott Norling, Michelle Ross, of the Metropolitan Airports Commission (MAC) and Dana Nelson (MAC). Staff present: City Administrator Cheryl Jacobson and Office Support Assistant Sheila Robertson. 2. Approval of Agenda Motion by Neuharth/Second by Dunn to approve the agenda. Motion passed 5-0. 3. Approval of Minutes a. Approve of Minutes of the September 21, 2022 Regular Meeting Motion by Dunn/Second by Sloan to approve the minutes. Motion passed 4-0. Commissioner Sharma abstained. 4. Public Comments Scott Norling, Mendota Heights resident, asked the MAC representatives present if it was possible to add the Eagan/Mendota Heights Corridor as an overlay on the MAC maps. Unfinished and New Business MAC MSP Airport Updates— Michele Ross, Community Relations Manager Michele Ross, who had spent three years as the Assistant Manager and was newly promoted to Manager, shared MAC's information on the following items: Operational and turbo prop trends, complaint data from Mendota Heights households, average passengers per flight data, Minneapolis/St. Paul (MSP) runway use, Bemidji Aviation departures over Mendota Heights, and COULT departures. i. Turbo Prop Operations Ms. Ross noted that the MSP operations have been steady over the past decade, and they're starting to see an increase since the recent dip from the 2020 pandemic data. She also discussed the runway usage, noting that Mendota Heights arrivals at 30R have increased 11% this past year, and departures at 12L have decreased 17% this past year. FAA Implementation of Eagan Request Ms. Ross noted that the MAC spent 400 hours moving needles and analyzing results, while needing to wait until January, 2022 to implement the request; post -pandemic. She noted the initial departure fix will be called COULT. Mendota Heights household complaints were down during the study period. The commission noted they'd like to see the complaint data points on a quarterly basis. iii. Noise Oversight Committee (NOC) Workplan Ms. Ross shared the NOC's 2023 workplan, noting there will be runway construction in 2023 and 2024. Commissioner Neuharth asked if there would be communication and notification of the closures. Ms. Ross noted there will be emails, news releases, etc. published. b. 2023 Meeting Dates The Airport Relations Commission is scheduled to meet the third Wednesday of odd number months. Following this schedule, the 2023 meeting dates would be as follows: January 18, March 15, May 17, July 19, September 20, and November 15. c. Chair Norling added an item to discuss the commission's 2023 workplan and strategic goals planning. Commissioners Sloan and Dunn suggested waiting until January, after the City Council has more direction. d. Chair Norling added an item to discuss the homeowner's pamphlet previously produced by the commission. She wants to ensure that future homeowners are advised of the information, and asked what the best way to distribute it is. City Administrator Jacobson noted that the Community Development Director has access to the document and can distribute it in the planning phases of some city projects. She also mentioned that a "realtor day" could be a possible way to distribute the information but was uncertain whether or not the St. Paul Area Association of Realtors hosts those any longer. 6. Acknowledge Receipt of Reports and Correspondence a. Review of Airport Operational Statistics (link: https://www.macenvironment.org/reports/) i. Complaint Information City Administrator Jacobson noted that complaint information is compiled by city staff and has not been assigned to a commissioner. She added that when a new member is appointed assignments should be reconsidered. ii. Runway Use Information Commissioner Neuharth noted some potential errors on the 12L and 12 R total operations charts. Commissioner Neuharth agreed to take over the commission duties related to runway use information and data. iii. Turboprop Information Commissioner Neuharth stated he'll work with Michele Ross (MAC) and Bemidji Aviation regarding turbo prop information. iv. Noise Monitor Information Commissioner Dunn noted there will was no significant change over the last six months. b. News Articles City Administrator Jacobson will send out to the commission. Chair Norling will take over the commission duties related to News Articles. 7. Hearings A) PLANNING CASE 2022-22 DROP SHOT LLC/LAMAR LLC, 1415 MENDOTA HEIGHTS ROAD — CONDITIONAL USE PERMIT Community Development Director Tim Benetti explained that the applicant is seeking a conditional use permit (CUP) to place a new indoor athletic club facility inside a vacant space within an existing multi -tenant building, located at 1415 Mendota Heights Road. The proposed name of the facility is Twin City Racquet & Squash Club. The property is generally located at the northwest corner of Mendota Heights Road and Pilot Knob Road and is situated in the I -Industrial district. City Code Section 12-IG-2 allows certain defined "commercial recreation" uses by means of a conditional use permit in the Industrial district. Hearing notices were published and mailed to all properties within 350-ft. of the site; no comments or objections to this request were received. Community Development Director Tim Benetti provided a planning staff report and a presentation on this planning item to the Commission (which is available for viewing through the City's website). Staff recommended approval of this application based on the findings and with conditions. Commissioner Johnson asked if the indoor rule would have to do with the fact that this would be located in an industrial area. Community Development Director Tim Benetti replied that is a requirement by Code, to contain all elements inside the building. Chair Field opened the public hearing. Jeff Mulligan, representing the applicant, stated that he is present to answer any questions. Commissioner Lorberbaum asked for details on potential signage. Mr. Mulligan replied that he is unsure. He stated that they would want something identifying the business. He believed that signage on the building would be appropriate. He confirmed that they would meet City Code. Commissioner Lorberbaum noted the 24-hour facility and asked if staff would be onsite at all times in case someone is injured. Mr. Mulligan replied that they would not have staff 24 hours per day. He stated that there would be staff during the typical hours, but the other hours would be accessible through the key system. Jeff Nath, 1911 Knob Road, stated that his concern is the number of people that will be pulled into an industrial area on the outside of town. He had a concern with lighting as it could attract unsavory characters. He noted that perhaps there is a blue box to alert police if needed, similar to a college campus. Public Presentation B) MISSISSIPPI RIVER CORRIDOR CRITICAL AREA ORDINANCE OVERVIEW AND PRESENTATION Dan Petrik, Lake and River Shoreland Program Manager with MN Department of Natural Resources, reviewed the purpose of the MRCCA which was established in 1976 and regulates 32 communities along the river corridor. He explained the purpose and intent of both the MRCCA Ordinance and Plan and how the two work together. He identified the different primary conservation areas noting that the bluff impact zone and vegetation are the two most impactful in Mendota Heights. He provided more details on bluff and bluff impact zone, vegetative areas, and public corridor views identifying where they exist within the community. He reviewed the different MRCCA districts noting that the district determines the allowed height and setbacks. He noted that one of the most common requests the Commission may review would be variances and explained how those should be considered against the MRCCA standards and regulations and the criteria that should be considered. He reviewed the vegetation removal that is allowed without a permit as well as that which would require a permit. He explained the difference between that selective vegetation removal and intensive vegetation removal. He reviewed the performance standards for a vegetation removal permit and provided details on the vegetation restoration that would be required. He also provided details on land alteration within the MRCCA and the related requirements. He provided information on permit administration and resources available online. Commissioner Corbett asked if removal of one tree to improve the view of the property owner would be allowed without a permit. Mr. Petrik replied that as long as a whole swath of trees is not removed, it would be allowed. He stated that perhaps that should be done in consultation with neighbors as neighbors appreciate trees as well. Commissioner Lorberbaum commented that she has been walking neighborhoods and listening to concerns of residents. She asked if a community would need to follow the ordinance or issue variances. Mr. Petrik replied that is technically true most of the time but noted that a planned unit development would be a tool a community could use to provide variances and flexibility. Commissioner Katz commented that the community has a lot of natural springs that run along the bluff which could be impacted by development and asked how that would be regulated. Mr. Petrik replied that there is some standard speak to hydrological systems in terms of land alteration that was not included in his presentation. He noted that the City Engineer would need to review the plans to determine the stability of the soil. Commissioner Katz asked if the location of the springs is tracked. Mr. Petrik replied that the DNR does not map that information, but a local community could choose to do so. Commissioner Petschel asked if there has been case law on the delineation between selective and intensive vegetation removal. Mr. Petrik noted that language is fairly new and there has not yet been case law on that topic. He explained the difference between the selective and intensive vegetation removal. Commissioner Johnson stated that the City has underground springs classified as a primary conservation area and asked if Mr. Petrik would find that appropriate. Community Development Director Tim Benetti confirmed that language was added in response to a potential development that encountered that scenario. Mr. Petrik agreed that was a good addition for this landscape. Commissioner Johnson asked if there is a way to map the underground springs. Commissioner Katz commented that property owners were asked by the DNR to provide information on springs on their property at one time but was unsure where that process led. He stated that the information is available on the Minnesota spring inventory. Chair Field noted that unfortunately that suffers from being voluntary in submission, therefore information has only been provided by those that voluntarily contributed their data. He thanked Mr. Petrik for the presentation. New/Unfinished Business Community Development Director Tim Benetti referenced a previously requested update from Commissioner Lorberbaum and noted that staff did go out to further evaluate the property and noted that there was not a lot of cutting. He noted that the tree removal was a result of cutting dead trees. He noted that staff identified a number of additional trees that should be removed because they were dead, dying, or invasive. He stated that staff also identified the areas that should be restored. He also provided an update on the progress of that site, noting that it will remain under the three-year maintenance period and the property owner has continued to be very cooperative. He also asked that the Commission begin to use the Mendota Heights issued emails for Commission business. He noted that the workshop for this week has been canceled. He stated that staff has not yet received any applications and therefore if there is not business to hold a regular meeting, the Commission may hold a workshop instead. Chair Field stated that if there is not a planning case, perhaps a workshop be held the week earlier to avoid the holiday. BACKGROUND As part of the City Council's priority to Enhance City Governance and Services with a focused strategy to Enhance Connections and Community Partners, Businesses and Residents, the Council has supported city sponsored fireworks on Independence Day (July 4). Northern Lighter Pyrotechnics, Inc. has been the city's partner along with Mendakota Country Club, in this annual event. NLP is available again this year to produce the display and Mendakota Country Club is willing to be the host launch site. An agreement between the city, NLP, and Mendakota Country Club is needed. An agreement was drafted by the city attorney in 2022 between the city and NLP and between the city and Mendakota Country Club for accessing their property as the launch site. Staff will update these agreements to be used in 2023. BUDGET IMPACT The FY2023 budget includes $15,000 for this year's fireworks display. With the city's budget, NLP has said they can produce the same show length as last year, 18-22 minutes with the same shell count and a large finale. Staff contacted four additional pyrotechnic companies to seek quotes for the 2023 fireworks display. Unfortunately, the four companies did not have July 4 as an available date in order to provide staff with a proposal. RECOMMENDATION Staff recommends approving the budget expenditure for the City's Fourth of July fireworks display with Northern Lighter Pyrotechnics in the amount of $15,000. Additionally, staff recommends providing authorization to, once finalized, execute the necessary agreements between NLP and Mendakota Country Club for carryout of the event. The CDA administers the Housing Rehabilitation Loan Program, which provides loans of up to $35,000 to eligible low/moderate income homeowners in Mendota Heights. Loans are commonly used for roof repair/replacement, furnace replacement, electrical and plumbing repairs, and insulation. The city has used previous CDBG funds for this program purpose and has funded one or two loans a year. The city submitted its application for CBBG funding by the January 20 deadline, a resolution is needed to complete the request. BACKGROUND Dakota County receives an annual allocation of CDBG funds, which is a federal program administered by the Department of Housing and Urban Development (HUD). The program is designed to assist local governments with various community development projects and programs that primarily aid low- and moderate -income residents. Per HUD rules, the CDBG allocation is based on three factors: a community's population, people in poverty, and overcrowded housing units. Each city receives a percentage of the annual Dakota County CDBG allocation based on these factors. Because these factors change over time, the allocation to each city will change over time. BUDGET IMPACT None. The allocated CDBG funds and loans provided through the Housing Rehabilitation Loan Program are administered by the Dakota County CDA. Due to contractor delays which exceeded the specified construction schedule, TKDA is requesting additional compensation. DISCUSSION The original assumptions for the construction inspection on the Ivy Falls East project was 16 weeks with an October 2021 completion. The work on the project extended into the summer of 2022 requiring additional inspection services. The extended work also required additional material testing from Braun Intertec (sub -consultant) for quality assurance. BUDGETIMPACT Funding for the change orders is not expected to have a major impact to the overall project costs and is within the estimated indirect costs. TKDA is requesting an additional $25,000 for completion of this project. The original contract with TKDA totaled $130,000. The construction contract on the project totaled $1,560,477.72. The fire provided an extra challenge in that there was a significant amount of gasoline that was leaking from the vehicle and was continuing to burn. Medical/Extrication: 6 Six calls in the month of December were medical in nature. Hazardous Situations: 3 December had two carbon monoxide incidents (with carbon monoxide found to be present) and one call was for power lines that were down. Service Call: 3 Three fire calls to the fire department were coded as service calls. These included: A broken water line that was spraying onto a power outlet, a vehicle accident, and a resident needed assistance with a smoke detector. False Alarms/System Malfunctions: 2 There were two false fire alarms in December. One was due to a malfunction (broken sprinkler head) and the other was an unintentional activation of an alarm. Good Intent: 3 The department responded to a CO alarm call where the homeowner could not get the detector to stop chirping. It was later discovered that new detectors had been installed and the old one (which was chirping) was in the garbage. One call was a smoke scare and the other call was a smell of gas investigation. Dispatched and Cancelled En route: 4 Four calls were paged to the department and then cancelled before firefighters arrived on scene. Mutual/Auto-Aid Other: 1 One auto/mutual aid request was received from South Metro Fire but the call was cancelled before our truck arrived. This Public Hearing is a continuation from the January 17, 2023 meeting. BACKGROUND The preparation of a feasibility report for the Victoria Curve Street Improvements which is required to follow the Minnesota Statutes Chapter 429 process was authorized by the Mendota Heights City Council by adopting Resolution 2022-63 at the City Council meeting held on August 16, 2022. The Statute 429 process is required because the city intends to assess a portion of the project. The feasibility report for the Victoria Curve Street Improvements was accepted by the Mendota Heights City Council and called for a Public Hearing on January 17, 2023 by adopting Resolution 2022-97 at the December 20, 2021, city council meeting. The recommendation of the feasibility report was to proceed with this project. The proposed streets to be rehabilitated are Victoria Curve and Orchard Hill. Based on our observations, as well as our pavement management system, a majority of these streets have deteriorated to the point where it is no longer cost effective to patch the street and rehabilitation is necessary. DISCUSSION The feasibility report indicates the estimated costs for the project, along with preliminary assessment estimates. At the end of the feasibility report, a project financing summary is included to show project cost splits and funding sources to be utilized. The total estimated cost of the project is $2,090,000 including indirect costs. The largest contributor to the increased costs allocated to the city are due to Victoria Curve having minimal assessable properties. Staff held an informational meeting on January 12, 2023. Issues A Neighborhood Informational Meeting was held on January 12, 2023 to provide the property owners an opportunity to discuss the projects in an informal setting prior to the Public Hearing. Staff presented the proposed improvements, project costs, estimated assessments and answered resident's questions. Twelve residents attended the informational meeting representing eight properties. Staff also meet with Beth Jacob separately. Some concerns resolved along vegetation removal along Victoria due to water main replacement, equality of costs for Orchard Hill versus Victoria Curve, a resident near Highway 13 in the city of Mendota was also concerned for vegetation as he has designed a new home on his parcel, various other aspects of the project were also discussed and questions answered. Minutes from the meeting have not been finalized. BUDGETIMPACT Street improvement projects are proposed to be assessed to the benefiting property owners. Pursuant to the City's Street Rehabilitation and Reconstruction Policy, the benefiting properties should be assessed 50% of the street reconstruction and rehabilitation costs. This reduces the assessable front footage or number of units. In these areas, a frontage or unit count was added and assigned to the City to normalize the assessment rates. Residential assessments for the project are calculated to be, $7,609 for the street improvements. Staff is hopeful that competitive bids will be received on the project reducing the assessment to residential properties. Minnesota Statutes Chapter 429 Special Assessment Bond Issue requires that a minimum of 20% of the total bond issue amount be recovered through special assessments. As the project is designed and competitively bid, the calculated assessment amount will be updated leading up to the adoption of the assessment roll. The improvements are necessary to allow for safe and reliable street and utility services within the City of Mendota Heights. The project will be competitively bid to allow for a cost effective improvement. The feasibility study has provided an overall analysis of the feasible improvements for consideration within this project area. Therefore, the proposed improvements within the areas outlined in this report are necessary, cost effective, and feasible from an engineering standpoint. RECOMMENDATION Staff recommends that the Council conduct the Public Hearing and order the improvements, authorizing staff to prepare the plans and specifications for the Victoria Curve Street Improvement project. CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2023-08 A RESOLUTION ORDERING OF IMPROVEMENT PROJECT AND PREPARATION OF PLANS AND SPECIFICATIONS FOR THE VICTORIA CURVE STREET IMPROVEMENT PROJECT (PROJECT #202305) WHEREAS, on December 20, 2022, the Mendota Heights City Council authorized the holding of a public hearing (the "Hearing") under Minnesota Statutes, Chapter 429, as amended (the "Act"), to discuss and consider various street rehabilitation projects, storm water infrastructure improvement and replacement, aggregate base, concrete curb and gutter improvements, bituminous surfacing, trail improvements, and appurtenant work (collectively, the "Improvements"), in and along portions of the following streets: Victoria Curve from Lexington Avenue to Trunk Highway 13 and Orchard Hill from Lexington Avenue to the Cul-de-sac (collectively, the "Assessment Area"); and WHEREAS, also on December 20, 2022, the Council received a feasibility report on the Improvements from the Public Works Director (the "Feasibility Report"), which report explored the feasibility and estimated costs to provide the Improvements under the Act; and WHEREAS, the estimated costs of the Improvements, as detailed in the Feasibility Report, is $2,090,000, and will be financed from a combination of available City Utility Funds, Special Assessments, Municipal State Aid, and general obligation improvement bonds; and WHEREAS, the Public Works Director has held neighborhood informational meetings in January, to give each neighborhood in the Assessment Area a summary of the Improvements, and the necessity of such Improvements to the general overall health of the City; and WHEREAS, ten days' mailed notice and two weeks' published notice of the Hearing was given, as required by the Act, and the Hearing was held on the date hereof, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, a reasonable estimate of the total amount to be assessed, and a description of the methodology used to calculate individual assessments for affected parcels within the Assessment Area, has been made available for the Hearing. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Mendota Heights, Minnesota, as follows: The Improvements are necessary, cost-effective and feasible as detailed in the Feasibility Report. Specifically, the Improvements are necessary to update the City's street infrastructure system, as many streets were originally constructed more than 30 years ago, and contain pavement that has been continually patched, overlaid, seal coated, and slurry sealed, but now is in need of rehabilitation. The repair of associated aging storm water infrastructure concurrently with the street reconstruction is additionally recommended for project efficiency. Finally, the Improvements are feasible from an engineering standpoint. 2. The Improvements are hereby ordered. The Council shall let the contract for all or part of the Improvements, as authorized by Section 429.041, Subdivision 1 of the Act, no later than December 31, 2023. 3. The portion of the Improvements related to associated storm water infrastructure are instituted under the Act, and this portion of the Improvements can be more economically completed if consolidated and joined as one project with the Improvements, as allowed pursuant to Minnesota Statutes, Section 435.56, as amended. Therefore, all subsequent proceedings under the Act related to the Improvements shall be conducted in all respects as if the various separate proceedings had originally been instituted as one proceeding. The actions of City staff and consultants to consolidate the storm water infrastructure portion of the Improvements with the remainder of the Improvements are approved and ratified. 4. The Improvements have no relationship to the City's Comprehensive Plan. The Public Works Director shall prepare plans and specifications for the making of such Improvements, which plans and specifications shall be placed on file at the City upon completion. 6. The Council declares its official intent to reimburse itself for all or a portion of the costs of the Improvements from the proceeds of tax-exempt bonds. The City has a reasonable expectation that it will issue one or more series of tax-exempt bonds in the estimated maximum principal amount of $2,090,000 to finance the Improvements, and the City will make reimbursement allocations with respect to such original expenditures for the Improvements from the proceeds of the Bonds. They purchased the adjacent Mears properties a few years ago, with the intention of subdividing the larger land parcel into new single-family parcels. For now, they have decided to delay a major subdivision of the larger land area and propose a minor subdivision/lot line adjustment to obtain the back (southeast) portion of the 4.3 acre parcel so that portion may be combined with their homestead. The Holecs are proposing to subdivide the 4.3 acre parcel by means of a lot line adjustment, to create two parcels: "Parcel A" to consist of 160,567 or 3.69 acres of land; and "Parcel B" to consists of 26,129-sq. f.t, or 0.60 acres of area. At the January 28, 2023 Planning Commission meeting, a planning report was presented, a duly noticed public hearing was held, and public comments and testimony were recorded into the public records. A copy of the 1/28/2023 planning report including the survey of the proposed conditions is attached to this memo. The City received one email inquiry regarding the potential to further subdivide the land and complete a similar process with an adjacent contiguous property. Public testimony provided during the public hearing included questions and concerns regarding the potential development and/or subdivision of the larger parcel identified as Parcel A. ANALYSIS Title 11-1-5.0 of the City Code (Subdivision Ordinance) allows lot line adjustments to take place, provided the following standards are met: Lot line adjustment request to divide a lot which is a part of a recorded plat where the division is to permit the adding of a parcel of land to an abutting lot and the newly created property line will not cause the other remaining portion of the lot to be in violation with this title or the zoning ordinance. This request to modify the unified parcel boundary line meets this City Code section, as the resulting parcel is being added to an abutting parcel; and the resulting adjustment does not cause the other remaining lots to be in violation of the zoning ordinance. The Holec's wish to keep the new Parcel B as an untouched and preserved natural extension to their current rear yard area with 8 Beebe Avenue. No new or separate single-family development can occur or would be allowed on this parcel without the required street frontage; and the city has conditioned that this new parcel must be combined with the Holec's main homestead parcel to avoid any creation of a "non- conforming parcel" without any access or frontage on a public roadway system. The resulting Parcel A will have enough frontage to create one or more lots along this Dodd Road (State Hwy. 149) frontage; or to have a new single-family subdivision served by a new public roadway system such as a small cul-de-sac section. However, the Holec's are not proposing any new lots or improvements to the larger Parcel A at this time or under this lot line adjustment application. This lot line adjustment will have minimal or no impact upon the neighboring properties, the residual parcel, and it will not impede the normal use, enjoyment and purpose of the entire Hunter Lane neighborhood. BACKGROUND The subject property is comprised of two separate parcels with the larger parcel being 6.28 acres and the smaller parcel being 0.46 acres. The Owner, Lawrence and Mary Culligan, own both properties that are subject to this Application. The existing smaller 0.46 acre parcel is a developed single-family lot, and the larger parcel is currently vacant. The Owner is proposing to subdivide the large 6.28 acre parcel by means of a lot line adjustment, whereby two parcels would be created: "Parcel A" to consist of approximately 5.8 acres of land; and "Parcel B" to consist of approximately 1.12 acres of land. DESCRIPTION OF THE REQUEST Mr. and Ms. Culligan own both properties that are part of this applicant. They would like to obtain the northern portion of the larger lot to add to their property at 1941 Glenhill Road. The Culligan's are seeking to subdivide the large 6.28 acre parcel by means of a lot line adjustment, whereby two parcels would be created: "Parcel A" to consist of approximately 5.8 acres of land; and "Parcel B" to consist of approximately 1.12 acres of area. The Culligan's intend to keep and adjoin Parcel B to their own 1941 Glenhill Road property, while the resulting Parcel A will remain vacant. ANALYSIS Title 11-1-5.0 of the City Code (Subdivision Ordinance) allows lot line adjustments to take place, provided the following standards are met: Lot line adjustment request to divide a lot which is a part of a recorded plat where the division is to permit the adding of a parcel of land to an abutting lot and the newly created property line will not cause the other remaining portion of the lot to be in violation with this title or the zoning ordinance. This request to modify the unified parcel boundary line meets this City Code section, as the resulting parcel is being added to an abutting parcel; and the resulting adjustment does not cause the other remaining lot to be in violation of the zoning ordinance. The resulting Parcel A will have enough frontage and lot area to be potentially further subdivided in the future, but such request is not a part of the consideration for this application. This lot line adjustment will have minimal or no impact on the neighboring properties, the residual parcel, nor impede the normal use, enjoyment and purpose of the entire Valley View Oak neighborhood. The subject parcels are located within the Mississippi River Corridor Critical Area (MRCCA) and are subject to the standards contained within this section of the City Code. Title 12-3-11.B.2. (Critical Area Subdivision and Land Development Standards) provides an exception to the subdivision and land development standards if it is a minor subdivision that consists of two (2) or fewer lots. Since the proposed minor subdivision and rearrangement and lot line adjustment requires Parcel B to be adjoined to the property at 1941 Glenhill Road there is no net increase in the number of lots. As presented, the proposed minor subdivision is not subject to the design standards established. No new structures or improvements on the lot(s) are proposed as part of this application. A condition is included that states that all future improvements on the lot(s) are subject to individual MRRCA review and all necessary permits must be obtained. ALTERNATIVES 1. Recommend approval of the lot line adjustment, based on the attached findings -of -fact and based on certain conditions; or 2. Recommend denial of the lot line adjustment, based on the revised findings -of -fact that the proposed adjustment is not consistent with the City Code or Comprehensive Plan and may have a negative impact on the surrounding neighborhood and/or properties; or 3. BACKGROUND In 2007, voters approved a referendum authorizing the City to acquire and improve the Mendota Heights Par 3 Golf Course, by issuing $2,790,000 in General Obligation Bonds. The City paid the final bond payment for the Par 3 property on February 1, 2023. At the November, 2022 work session, the City Council requested that staff plan an event at the Mendota Heights Par 3 Community Golf Course to acknowledge the payoff of the Par 3 bonds. BUDGETIMPACT The FY2023 budget did not include funds for the requested event. RECOMMENDATION Staff is seeking direction from the City Council on the scope and budget for the acknowledgement event. ACTION REQUESTED The Council is asked to discuss ideas and budget and provide staff with direction for the proposed event.
