BACKGROUND The River to River Greenway travels 7.7 miles from the Lilydale trailhead of the Big Rivers Regional Trail to Kaposia Landing in the communities of Mendota Heights, West St. Paul and South St. Paul. The greenway links: •Valley Park •Village at Mendota Heights •Henry Sibley High School •Dodge Nature Center •Garlough Park and Elementary School •Marthaler Park •West St. Paul City Hall •Robert Street commercial corridor •Wentworth Library •West St. Paul YMCA •Thompson Oaks Golf Course •Thompson County Park •Kaposia Park The greenway area contains a rich history with stories of key historical figures, movement corridors, and open space preservation areas. Dakota County developed a Master Plan for this Greenway in 2015 which was supported by the Mendota Heights City Council under resolution 2015-39. Elements of the proposed plan include an underpass of Dodd Road north of Highway 62 and realigned trail segments north of Marie Avenue. The realigned trail sections would have impacts to some vegetation in the park but would also provide an opportunity to have looped trails and provide better access in the park. REQUESTED ACTION The Council is asked to interact with Dakota County staff on the proposed plan and provide direction to the County on developing final construction plans. Once Dakota County has direction on how to proceed with the Greenway improvements, the plan will be presented to the Parks and Natural Resources Commissions for comments and recommendations. Method •On 10/25/2022, Dakota County Staff determined that a full inventory of higher value trees north of Marie Ave where the proposed construction footprint would necessitate tree removal. •This tree survey did not account for ‘lower value’ trees such as boxelder, ash, cottonwood or aspen/poplar, given that these trees are typically the first to grow back quickly in a site. •Natural Resource Management Plans suggest that some areas occupied by ‘lower value’ trees could be converted to and maintained as native prairie vegetation, and other areas could be replanted and converted to higher value oak forests, woodlands or savannas. Findings •Within the pine plantation north of Marie Ave, a total of 41 white pine trees would be proposed for removal. •The pine trees within the construction boundary were found to be an average 12” in diameter, with two trees greater than 20” in diameter, and most (80%) below 15”. •An alternative alignment to the east of the plantation that would straighten the existing trail by the tennis court would impact bur oak (4), pin oak (2), black cherry (2), and white pine (2). •Additional impacts to the north included American elm (11), Northern pin oak (4) and Basswood (2) trees. Some of these impacts can be reduced with narrower construction footprints. Natural Resource Recommendations •The trail alignment north of the tunnel that would travel through the pine plantation would be the least impactful to higher-value ecological communities. •The eastern alternative alignment that would straighten the trail near the tennis courts would have a larger impact on higher value communities and would be at odds with Mendota Heights’ Natural Resource Management Plan. •Regardless of whether the trail will be built through the pine plantation, it is recommended that some thinning of the pine plantation could occur. Many of the subcanopy trees are being shaded out and dying and the size distribution is skewed towards smaller diameter trees, indicating competition. The County’s River to River Greenway NRMP recommended removal of ~1/3 of the pines to allow for more diverse trees and shrubs to grow in the subcanopy. A future projected forest canopy of mixed oak and pine forest would be more resilient and support more biodiversity in future climate scenarios, compared to doing nothing. BACKGROUND The Minnesota Department of Transportation (MnDOT) acquired land from properties for the construction of the Mendota Interchange, Highway 55, and Lemay Lake Road. MnDOT released a parcel and portions of right-of-way to the city in 2010 and 2013. Some of this released land was held by the Perron Family originally. The original homeowner, John Perron and family members Steve Perron (son) and Spencer Perron (grandson) have inquired with the city about purchasing the original land parcel back into the family to construct a single family home and return the property to the city tax rolls. The lots in question were originally Lot 8 & Lot 9, Block 5 of the Furlong Addition. Staff reached out to MnDOT and Dakota County. Dakota County was able to change the ownership of this parcel to Mendota Heights from MnDOT and combine the two lots into one parcel based on the Quit Claim Deed issued to the city. MnDOT did not provide much information: It looks like there is nothing in the deed, and also this deed is stamped “excess acquisition” at the top. If we bought this as excess, we could not sell it back to the original owners, supporting the position that no such right of first refusal probably ever existed. That said, if they’re claiming they have a right of first refusal, they will need to produce some evidence of that as our records do not support their claim. We conveyed the property to the road authority for road purposes, the most correct thing to do would be to quit the title, but I’m sure many road authorities just vacate the road and sell it. That’s at their and the future property owners risk. I don’t think there would be a well-founded challenge from anyone challenging the conversion from road to other use, but I guess the risk always exists that someone will come up with a novel argument. 5bCity Council Work Session | Tuesday, December 20, 2022 | Page 15 of 24 The parcel now appears to be one lot of record totaling 20,965 square feet. City Council directed staff to engage the neighbors before considering if the city would entertain an offer on this parcel. Letters were sent to all properties in the Furlong Addition plat as well as all properties within 350 feet of the parcel. Two responses were received from this engagement and are included in the packet. REQUESTED ACTION The Council is asked if there is interest in selling city owned land for development of a single-family residential home. The city is under no obligation to sell the land, vacate the right-of-way, or to proceed with any action. If the city chooses to sell the land, they are also under no obligation to sell to the Perron family and could sell the property on the open market. Next steps? I want to share a concern about the construction of a home on that spot. I worry that removing that greenspace will significantly increase the road noise coming from Highway 55. Between the low flying aircraft and the multiple highways immediately north of Lemay Lake Road there is a lot of environmental noise and I would hate for that to increase in the neighborhood. Thank you for sending the informational letter regarding the Perron family parcel of land. We were in Egypt on vacation and did not receive the letter until late last week. Photo attached. :) Upon review, we have a some questions: 1. Will the house and/or construction plans be shared? House plans are generally not part of a public record unless the home requires variances, etc. The lot is rather large so I would not think they need a variance for anything. You may be able to stop in and see the plans but they would not be posted or mailed out. 2. Will the vegetation along LeMay Lake Road, adjacent to the parcel of land be maintained? Undetermined. I am not aware of a house being designed on the site but assume some vegetation will need to be removed. There is a large open area currently so I would not expect the lot to be clear cut. 3. Does the parcel already have a water main hook-up? No, sewer and water connection would need to be made into the public utilities under Lakeview Ave. 4. Do the Perron's plan to live in the home? I believe so. The grandson and the son of the original owner both attended a Council workshop. I assume the grandson would be building a home here. 5. Will this new housing project be circulated to the ARC for review? I believe the city code address building requirements for homes within the airport noise overlay district. I am not aware of plans being routed to ARC for review. BACKGROUND Regular city council meetings are held on the first and third Tuesday of the month and begin at 6:00 pm, unless posted otherwise. City council work sessions are held prior to the regular city council meeting on the third Tuesday of the month and typically begin at 4:00 pm. From time to time, depending on the work schedules of city council members, the city council is asked to consider changing the start time of meetings. Councilmember-elect Lorberbaum has asked the council to consider changing the regular meeting start time to 7:00 pm and work session meeting starting time to 5:00 pm or later, depending on agenda length. BUDGET IMPACT N/A ACTION RECOMMENDED/REQUESTED The council should discuss and provide direction on meeting start times.
