Since, noise complaint calls have been on the rise. Noise complaints come in all varieties from, the guy down the street “having a party, has a loud motorcycle, the garbage truck comes at 5:00 a.m., his dog is barking or the neighbor’s pool filter is noisy.” 4-1-4: NUISANCES AFFECTING PEACE AND SAFETY: H. Noises And Vibrations: All unnecessary noises and annoying vibrations. Don’t get ahead of yourself, the Minnesota Pollution Control Agency (MN PCA) has the last word. For a standard noise complaint, the MN PCA follows: 7030.0020: NOISE STANDARDS: Definitions; daytime is between 7:00 a.m. and 10:00 p.m. and night time 10:00 p.m. to 7:00 a.m. The statute clearly spells out how much noise can be made & what the exemptions are. The neighbor’s dog won’t stop barking! Yes, this is illegal. 4-1-4: NUISANCES AFFECTING PEACE AND SAFETY: M. Barking Dogs: No person shall keep or harbor a dog which habitually barks or cries. Any such dog is hereby declared a public nuisance. 5-3-5: NUISANCE CONDITIONS: A. Barking Dogs: No person shall keep or harbor a dog which habitually barks or cries. Any such dog is hereby declared a public nuisance. Most callers wait until they can’t take the barking anymore, and then call 911 (yes that is the best thing to do). We nearly always try to work with the pet owners before issuing citations. In order to issue a citation, the dog must bark for 15 minutes continuously, unprovoked. 4-2-4: COLLECTION AND DISPOSAL REGULATIONS B. Collection Schedules: 1. Weekly Collection: All licensed haulers shall make weekly collection of separated garbage and other refuse and yard waste available to customers. In the case of recyclables, all licensed haulers shall make weekly collection available to custom- ers, unless a hauler is providing a "one sort" service, in which case the hauler may make collection available to customers every other week. (Ord. 389, 1-20-2004) 2. Hours Of Collection: No collections of garbage, other refuse and/or recyclable materials shall be made except between the hours of seven o'clock (7:00) A.M. and six o'clock (6:00) P.M. Monday through Friday. Police Chief, Mike Aschenbrener 2 DAR/NO INS/DRUGS FRI 8/26 0858 HOURS While on routine patrol, Officer Weston Raberge ran a plate and the license status of the registered owner came back as revoked. Raberge initiated a traffic stop and approached the vehicle. An expired proof of insurance was provided. Raberge spotted a glass pipe on the drivers side door handle. A further search of the vehicle was made and additional drug paraphernalia were located. The driver was issued a citation for DAR/ No Ins/Possession of Drug Paraphernalia and the vehicle was towed. TRAFFIC STOP/DRUGS FRI 8/26 1458 HOURS While on routine patrol, Officer Weston Raberge observed two males smoking marijuana outside their vehicle and then sat back in their vehicle. A traffic stop was conducted and the driver and passenger both admitted to smoking marijuana. The vehicle was searched and marijuana was located inside the glove compartment. The passenger admitted that it was his. He was issued a citation for Possession of Marijuana. THEFT OF GAS SAT 8/27 1204 HOURS Sergeant Eric Petersen responded to a local gas station on a gas drive off report. The store employee was able to gather the license plate number and a suspect description. Petersen ran the plate and the vehicle and suspect description were a match. A letter and citation for Theft of Motor Fuel and DAR was issued to the registered to owner. TRAFFIC STOP/DAR/NO INS SAT 8/27 1519 HOURS While on routine patrol, Officer Weston Raberge observed a vehicle with expired registration displayed. A traffic stop was conducted and he made contact with the registered owner. The driver provided a drivers license and expired insurance. Vehicle was towed and he was issued a citation for Uninsured Vehicle and Vehicle Registration Required. THEFT OF GAS SUN 8/28 0729 HOURS Officer Weston Raberge was dispatched to a local gas station on a gas drive off report. The employee was able to gather a vehicle description and the registered owner loved nearby. Raberge responded to the WSP address of the registered owner and found the suspect vehicle parked on the driveway, missing its front license plate, covered in dew and appeared to not have been moved for quite some time. Raberge made contact with the owner inside the home and claims his vehicle should have a front license plate. WSP PD was notified of the incident. Case pending video surveillance. 3 TRAFFIC STOP/DAS/NO INS SUN 8/28 1137 HOURS While on routine patrol, Officer Weston Raberge observed a white van run a red light at an intersection, nearly missing two vehicles. Raberge conducted a traffic stop and made contact with both the driver and the passenger of the vehicle. The driver notified Raberge that his drivers license was suspended and he had no ID on him. The passenger stated the vehicle was his but he did no have any insurance on it. The vehicle was towed, the driver was issued a citation for DAS and the passenger for No Ins. AOA SUN 8/28 1200 HOURS Sergeant Eric Petersen assisted Eagan PD on a shots fired, officer involved shooting. While en route, Petersen heard over dispatch that the suspect was down. Petersen arrived on location and assisting Eagan PD with securing the property. A short time later, Petersen was relieved from the scene. TRAFFIC STOP/DAR/NO INS TUE 8/30 1640 HOURS While on routine patrol, Sergeant Tanner Spicer ran a license query on a vehicle where the registered owner came back as revoked. Spicer conducted a traffic stop and made contact with the driver. Spicer asked the driver if she was aware of her driving status and she said she was aware but needed to get to work. She lied about having insurance and then admitted to not having it. The vehicle was towed and she was issued a citation for DAR and No Ins. ARMED ROBBERY TUE 8/30 2349 HOURS Officer Steve Hilyar and Officer Jennifer Fordham responded to a local gas station on a report of an armed robbery. While en route, officers were notified that the suspect had fled on foot after holding the store employee at knife point. Upon arrival, a witness stated the male left in a silver/gray Mazda sedan. Items taken in the robbery were cash, lottery tickets and cigarettes. A suspect description was given to officers. Case pending. DANCO VIOLATION THUR 9/1 2043 HOURS Officer Phil McCarty along with Officer Jeff VonFeldt were dispatched to a business parking lot on a report of a dispute. Officers arrived on scene to find one adult female and one juvenile female, both sisters. The juvenile female had large amounts of blood on her and would not comply with demands and kept trying to leave the scene. The adult female stated that her sister was a runaway that had been reported to Eagan PD. Prior, the juvenile female had called her ex boyfriend for a ride, who did give her a ride to her sister at the parking lot location. There is an active DANCO that he may not have any contact with her.
