2006-06-16 Friday NewsPATRICK HOLLISTER IS LEAVING After ten years here at Mendota Heights, Patrick Hollister is leaving to be the Chisago County Planner. Pat and I were "reminiscing" a little today about how much things have changed since he arrived. When he came Chuck Mertensotto was Mayor and Jill Smith and Christine Koch were on the City Council. Larry Shaughnessy was Treasurer and "Shirl" was the Accountant. Shawn Sanders and Marc Mogan were in the Engineering Department, Kim Blaeser was the Senior Secretary, Diane Ward was the Engineering Secretary and Chris Esser was the Parks and Recreation Programmer. Dennis Delmont was the Police Chief. The SOS Gas Station was still in operation across from City Hall. Tom Thumb was still going strong, Town Center wasn't even a dream and George's Golf Tee was still in operation. We are all going to miss Pat here at the City but we are all much richer for having him here for the past ten years. Please join us next Friday at noon if you can, to help us say Goodbye, Good Luck and to wish him well at Chisago County. The audit is now completed. Kristen and I were debriefed by Auditors Tom Hodnefield and Esther Schultz on Tuesday of this week. The auditors were very happy with the financial state of Mendota Heights so it was a good meeting. The audit now needs to be delivered to the State Auditor before the end of June. They are planning on attending the second City Council meeting in August to review the audit with the City Council. Issaae # 10-19 6/16/2006 The Alcohol Compliance Checks 05-25-06 Evening hours Sgt John Larrive and Officer Steve Meyer conducted alcohol compliance Me -1 checks at the licensed establishments in the Mendota Heights, Mendota and ::. Heig ` Lilydale.. Five of the establishments sold alcohol to the underage buyer. In Police one of the failing establishments the employee had to override the automatic check done by the cash register that showed the buyer driver's license to Department belong to an under age person. The employees were cited on scene. The City Councils will be asked to levy a civil penalty against the licensee. DUl / Obstructing Legal Process 05-25-06 2158 hours As Officer Steve Meyer was exiting the MHPD parking lot he observed a car Sixpport traveling S/B on Lexington Avenue at a very high rate of speed, he clocked the Staff car at 70 mph in a 40 mph zone. The car did not stop for the squad with Cath Ransom Y emergency lights and siren activated. The car pulled into a driveway and the Kim Henning driver attempted to go into the house_ When he was told to stop the driver Christina sioss replied "F- - - You, I am on my property.." At th at point he was placed 'under arrest and the fight was on. The man made it into his house and his dad P®lice Officers stepped in. A short time later Sergeant John Larrive arrived and assisted in J h'fi making the arrest. The suspect was read the MH Implied Consent and agreed Brian Convery to a breath test. The man had wild mood swings from extremely cooperative Bobby. Lambert to out of control.. He provided a breath test that revealed a BAC of .20. He Irric Petersen was transported the DC jail. 'Poddi Bosse' DUI Littering 05-26-06 2246 hours Officer Brian Convery stopped the car in front of him for throwing a cigarette fanner Spicer out the window. When asked if she knew why she was being stopped the Chad Mils®n driver gave a blank stare. It was immediately obvious that the driver was J eff �7�nPeldt under the influence of alcohol.. The driver failed all of the SFST's and was Jenny Fordhamplaced under arrest. When asked for her insurance card she advised Officer Steven IVLeye Convery that she did not have any insurance. The driver agreed to provide a Denise Urmann breath test which showed a BAC of .19 deficient sample. She was transported to the Dakota County jail. Investigations Residential Burglary 05-27-06 2316 hours 1 I. z' Reyes Officer Denise Urmann responded to burglary call. upon arrival the house Scott Patrick was thoroughly checked and no suspects were located. In speaking with the homeowner it was learned that money was missing. During this time her son arrived home and was extremely upset_ He relayed that he had shown the cash to friends a week earlier. Photos were taken of the break in. No prints Sergeants ., were pulled as the primary suspects had a legal reason to have prints in the Dona Anderson home. Referred to investigations for follow-up. Neil Garlock Underage Consumption 05-28-06 2328 hours John Larrive Officer Jeff VonFeldt received a loud party call and upon arriving had people running everywhere.. With the assistance of Officer Steve Meyer they Chief gathered up as many of the suspects as they could. Once they determined Mike who lived at the home the parents were awakened and brought out to assist. Aschenbrener The parents of the two juveniles were called to came and pick them up. The adults (over 18 YOA) were cited and released to the homeowner. All of the Issue # 10-19 6/16/2006 underage persons were cited in all summons were issued DUp 05-29-o6 1529 hours (yes 3:30 p.m.) Sergeant Donn Anderson and Officer Bobby Lambert responded to an underground parking garage on crashed car with a man sleeping (passed out) inside. The Mercedes convertible had sustained heavy front end damage and the air bags had deployed. The man had some minor but visible injuries. He refused medical treatment. He failed all SFST's and was placed under arrest, At MHPD he was read the MN Implied Consent and after consulting with an attorney agreed to provide a breath test. The reported BAC was ..19_ After being read Miranda the man stated he just went down to put the top up and the car lurched forward striking the wall, When Officer Lambert asked why he wore the seat belt to put the top up he received no answer. Suspect was cited and released to a sober party.. Medical o6-02-06 0925 hours Officer Brian Convery responded to a 911 call of man headed to the high bridge to jump off and commit suicide. The caller reported that she had just hung up with her boyfriend who was at work and has a history of erratic behavior. Officer Convery located the man and after a lengthy conversation convinced him he should see a doctor. Healtheast transported him to Regions for evaluation Datan 06-03-06 0030 hours Officers Steve Meyer and Tanner Spicer received a call of a man in dark colored clothing jumping in front of cars attempting to wave them down on Dodd Road near Wentworth., Officer Meyer located an intoxicated young man walking down the middle of the road. During this time a call came in from a local resident who was awakened by the backdoor of their home slamming shut. In looking out they saw a man in dark colored clothing walk away from the house. A show up line up was completed and the suspect was the same young man. The homeowner could not find anything that was damaged or missing. The suspect blew a .258 on the PBT He was release to Ramsey County Detox. Theft 0641-06 1611 hours nrininnfiv rpnorted on May 24and Officer Jen Fordha-M received information on. thefts- that. 'AlAere ....... -- --I- began follow up investigation. In locating the suspects she contacted parents and then conducted Miranda interviews which cleared multiple thefts from the locker room. A cell phone was recovered. Both suspects were issued court dates. Burglary 06-0606 1806 houm Victim reported to Officer Denise Urmann that sometime between 1130 and 1530 hours someone entered her unlocked house and took a laptop off the kitchen table. The victim had no idea who may have entered the residence. Complainant was not able to provide model or serial numbers for the missing computer- Forwarded for further investigation., CT!m5na1 Dsmelge to PrapaIrlq? 06-007-06 011 houlm 911 caller reported a man bleeding profusely in the Moose Country parking lot. Officer Chad Willson arrived to find a group of people in front, c(rthe ,&idashop anqd` man sitting in the center of the group. The man was bleeding from his hands and feet. He was extrerneiy intoxicated (.215 ®BT) and denied any knowledge of smashing the Bridal shop windows. He had no idea how he was injured. A short time later the person who called 911 came toward and reported seeing the injured person smashing their head against the window and then seeing him walking around bleeding. Suspect was released to the ambulance and will be charged according to the amount of damage he did. Domestic Assault 06-11-06 0117 hours Officers Willson, Meyer and Urmann responded to a physical domestic in progress call.. Upon arrival they could see and hear the fight still going on inside the residence. From the front door the Officers could see a knot on the female's head and blood coming from her ear. When the Officers knocked the parties immediately made their way to the door. They were separated and interviewed. Each told very different stories. The injuries to both were photographed. The injuries received by the female were consistent with her story of being punched and choked. The husband was arrested and brought to the Dakota County jail. Disorderly Conduct 06-12-06 1268hDuFs Officer Brian Convery responded to the Holiday Station where an employee had asked a man to leave for harassing customers for money.. The man refused to leave until the police were called. When Officers Convery and Petersen attempted to talk with the man he clenched up, made fists and refused to speak. He was identified by the IBIS two finger ID system.. He was cited and transported to Bloomington. He was upset because he felt he should be able to ask for money without it offending or causing people to be concerned.. They prepared for the USSSA Baseball Tournament by installing mounds on all four fields at Mendakota Park. Sprinkler heads were repaired and valves replaced at City Hall. Trees were planted at City Hall from the celebration, Gertens and the City. The Street Crew did street patching on Callahan and filled potholes ,,l on Miriam andu Ali c _,�, �pntpq were cleaned, The dead n sign and crime watch sighs were relocated on Brompton Place. Joh Ambrose made repairs to the bent jack stand on the roller trailer. Engineering Attached is a Dakota County 2006 Overlay Construction Update. Wachtler Avenue, Wentworth Avenue and Delaware Avenue are scheduled for overlays the week of June 26tH Construction of the sanitary sewer, storm sewer and watermain is complete at the Summit of Mendota Heights. Curb and gutter installation is scheduled for next week. The streets are scheduled to be paved by July 4th. `i • This letter is being sent because you are a property owner along a County Road scheduled for pavement rehabilitation this summer. What's Being Done? Each year Dakota County rehabilitates approximately 25 miles of pavement. The 2006 overlays include work on: CR 4, CR 8, CSAH 23, CSAH 26, CSAH 28, CSAH 42, CSAH 46, CR 62, and CSAH 63. A map is attached on the backside of this update showing the locations of the paving. This year's contractor, McNamara Contracting, Inc., will be placing new asphalt on the driving lanes; and in most cases, paving the gravel shoulders on your roadway. A small amount of paving on your driveway will occur immediately adjacent to the County Road. The end product will be a better looking, longer lasting, and smoother road. In most cases, pavement rehab is accomplished by overlaying the existing roadway with a new layer of asphalt. In some cases it is necessary to grind away an inch or two of pavement before placing the top layer of asphalt. This process is called a "mill and overlay." Both the overlay and mill and overlay are cost- effective solutions for extending the life of the pavement. N UR Overlays June 14, 2006 When will the Work be Completed on CR 8? Work on CR 8 will begin the week of June 19 from TH 13 in Mendota Heights to Humboldt Avenue in West St. Paul. Aggregate will be added to the shoulders in preparation for paving the roadway and shoulders. After that is complete, aggregate will be placed along the edge of the pavement. This work will take about two weeks to complete. What Should I Expect? The road will remain open to traffic during paving and you will have access to your property throughout construction. While the contractor performs these operations, you may encounter a short delay. The contractor typically paves approximately two miles of roadway per day so the time spent working along your property should be short. For the safety of both the residents and the workers, we ask for your patience. Recycling CSAH 23 A six -mile stretch of CSAH 23 between 330h Street and CSAH 86 in Greenvale Township will be rehabilitated using a process called "Cold In -Place Recycling." In this process, a milling machine removes the existing pavement, crushes and sizes it, adds an adhesive, and then relays the asphalt. Vehicles can drive on the pavement within a few hours. After this process, the contractor will add a two-inch layer of pavement on top of the recycled material. This process is being used because paving over it would not correct the cracking. Hollister, Administrative Assistant SUBJECT: Pre -Application Meeting Synopsis Staff met with nine potential applicants on Monday, June 12, 2006. Steve Grittman, Sue McDermott, and Patrick Hollister were present. Gail Washenberger, 1773 Victoria Road Mr. Grittman and Mr. Hollister met with Gail Washenberger at her house to discuss her landscape screening of her RV. The ordinance requires that RVs be "adequately screened". Planner Grittman had suggested arborvitaes a minimum of four feet tall and spaced three feet on center, extending a minimum of three feet beyond the front and rear of the motor home. Ms. Washenberger has planted the arborvitaes, although some of tli—. are not quite Lour feet tall. Mr. Grittman said that given the rapid growth of these .. plants most of them should be at or near four feet within one growing season. As an interim measure, Ms. Washenberger has placed four -foot high planter boxes in between the arborvitae where they will remain until the trees reach the appropriate heights. Planner Grittman felt that this was an acceptable interim solution. (Councilmember Duggan joined us for this discussion.) Mr. Nelson was recently granted a wetlands pen -nit to landscape his back yard. Mr. Nelson said that although he did not anticipate it in his original Wetlands Permit application, his contractor now informs him that he needs to import 50 cubic yards of fine dirt in order for his plantings to survive. Staff asked Mr. Nelson to meet with us to determine if this would require an additional Wetlands Permit. Mr. Nelson described his planned activities. Staff reviewed the Wetlands Ordinance and determined that no Wetlands Pen -nit was necessary as long as less than 100 cubic yards of dirt is imported. Staff told Mr. Nelson that he may proceed with importing the dirt. Bob Dahm and Rick Pederson, Burr Oak Landscapes 1875 Hunter Lane Mr. Dahi-n and Mr. Pederson met with Staff on behalf of the homeowner at 1875 Hunter Lane to discuss their plans to add a swimming pool. Staff determined that the property is within the Mississippi River Critical Area Corridor and provided the gentlemen with the appropriate materials for a Critical Area Permit application. This application will be on the June 2006 Planning Commission agenda. Lance E. Lemieux, Southview Senior Living, and Rick Fenske, Weis Builders, Inc. Southeast Corner of Lexington Avenue and Highway 13 Mr. Lemieux and Mr. Fenske met with Staff to discuss the possibility of placing a residential facility for Alzheimer's patients at the southeast comer of Lexington Avenue and Highway 13. The parcel is within the Critical Area and has a limited buildable area due to steep slopes. The gentlemen said that they were aware of these limitations but that they felt that there was adequate room for the facility. The gentlemen showed some pictures of some of their other facilities, which are one-story and residential in appearance. The property is zoned R-1. Staff reviewed the R- I zoning description and determined that this type of use is a Conditional Use in the R- I zone. Staff provided the gentlemen with the appropriate materials for applications for a Conditional Use Permit and a Critical Area Permit. The gentlemen intend to apply in time for the July 2006 Planning Commission meeting. t 0701wi I G"U"11 F"Twil 2031 Victoria Road Mr. Zarich met with Staff to discuss his plans for a pergala in back of the main building at Dakota Communities. Mr. Grittman reviewed the plans and determined that the pergala constitutes a landscape feature and therefore no planning approvals are necessary. Staff referred Mr. Zarich to the Code Enforcement Officer just in case a building permit is necessary. Mike Falk, McDonald Construction Hanson Property, Hwy 13 and Wachtler Mr. Falk met with Staff to discuss the redevelopment potential of the Hanson property at 13 and Wachtler. Upon review of the GIS data for the property Mr. Falk discovered that the property was not as large as he thought and that therefore he was not interested in pursuing redevelopment of the property any further. Mr. Lainana has a two -car attached garage which he would like to expand. Staff reviewed the GIS information for Mr. Lamana's property and determined that he only has a few feet available for expansion toward the side lot line without a variance. Staff also discussed with Mr. Lamana scenarios of expanding toward the front or toward the back, but both presented other challenges. Mr. Lamana said that he would be content to expand the garage a few feet toward the side lot line without the need for a variance. Fred Schumaker, 1400 Clement Mr. Schumaker has both an attached garage and a detached garage. Mr. Schumaker expressed interest in remodeling and expanding his detached garage. Staff told Mr. Schumaker that today's code only allows one garage per single-family dwelling. Staff told Mr. Schumaker that he had three options: (1) He could repair the detached garage without expanding it, (2) he could apply for a Conditional Use Permit to expand the garage and commit to removing the garage door and refrain from keeping cars in the structure, or (3) he could apply for both a Conditional Use Permit and a Variance expand the garage and allow for more than one garage. Staff told Mr. Schumaker that it was quite unlikely that option (3) would be approved. Mr. Schumaker said that he would consider his options and contact Staff again later. Gregory s Suckow, Grubb & Ellis 2401 Pilot o 1 b Road Mr. Suckow met with Staff to discuss a tenant of the building at 2401 Pilot Knob road. The tenant is ICHOR and they make granite countertops. ICHOR is currently storing some material outside in violation of the Zoning Ordinance. The Code Enforcement Officer has notified ICHOR of the violation and has instructed them to cease storing materials outside. Mr. Suckow asked if it would be possible to apply for a Conditional Use Permit for outdoor storage. Planner Grittman reviewed the zoning ordinance and determined that there was no provision for a Conditional Use Permit for outdoor storage in the I zone.
