Night to Unite
Fourteen neighborhoods across Mendota Heights went out and re-
connected with neighbors on Tuesday evening, the national "Night to
Unite" (some communities participate in "National Night Out). MHPD
and MHFD personnel split up into teams to make sure each party
was visited by public safety. Health East ambulances and Represen-
tative Rick Hansen also made the rounds on a beautiful August eve-
ning.
The concept behind the Night to Unite is that our neighborhoods are
safer and stronger when citizens get to know each other better. The
Night to Unite is also a wonderful opportunity for public safety staff to
build relationships within the community. Thank you to everyone
who participated.
FSupreme Court Ruling on Variances
R The Minnesota Supreme Court issued a ruling in June 2010 in the case of Krummen-
acher v. City of Minnetonka that significantly shifts 20+ years of judicial interpretation
of the standards for reviewing requests for variances. The court rejected the stan-
dards previously articulated by the courts and instead declared that variances should
only be used as a "very limited tool for avoidance of constitutional infirmity in extraor-
dinary cases." In other words variances can only be granted if a city finds that with -
Dout the variance a property has no reasonable use, i.e. if you have a residential lot
and without a variance no home could be built on the lot. This case almost com-
pletely limits the ability of the Planning Commission and City Council to recommend
or approve variance applications in the future. City staff has received clear direction
from the council to share this court ruling with people potentially applying for a vari-

During the city council meeting on Tuesday John Mazzitello made a presentation to the
council thanking them for the support offered to him and his family during his deploy-
ment to Afghanistan. John presented the city council with a flag that was flown on a
combat mission over Afghanistan on February 28, 2010. John also presented each of
the council members with a 455th Civil Engineering Squadron coin. Mayor Huber
gladly accepted the flag on behalf of the city and thanked John and his family for their
service and sacrifice over the past eight months. Thank you John for your service and
welcome home! The flag and certificate are on display in the case in the lobby at City
Hall.

Next Tuesday is Primary Election Day in Minnesota. Voters in Mendota Heights will have the op-
tion of voting in one of three parties (Democratic, Republican or Independence) and all voters will
get to vote for the non-partisan First Judicial District judge contest. If you have questions on poll-
ing places or registering to vote please contact Nancy Bauer at city hall. Remember to vote on
Tuesday.
Roundabout
The roundabout located at Mendota Heights Road and Visitation Drive is scheduled to open on
Thursday, August 12, 2010. Thank you to all the residents for your patience during the construc-
tion phase of this project. City staff will be looking at other traffic issues in the area now that this
project is complete.

Sergeant Garlock responded to a local establishment on report of a
possible slumper in the parking lot. The vehicle reportedly hadn't

The comments between the two had escalated, ending in a fist fight. Both parties were
charged with DOC; one became belligerent about it, believing he was the victim and the
other calmy accepted his citation and left.
Fireworks Display Sunday 0317 hours
Officers were requested to check out a neighborhood hosting some fabulous fireworks;
around the same time, WSPPD officers were called near the same area for shots fired.
Hmmm....On the way, Officer Shepard was treated to, yes, a fabulous fireworks display -
however, fireworks are not so lovely at 3:30 am. The homeowner advised officers that the
neighbors were all "cool" with the fireworks; officers advised him that when they are called for
"shots fired," obviously not everyone is "cool." The homeowner was cited for Possession of
Illegal Fireworks and MH Noice Ordinance violation.
Domestic Assault/Damage to Property Monday 1545 hours
Officers were requested at a residence on report of a domestic situation; the suspect had
feld the scene. The suspect of this residence, known to officers, was quickly located shortly
after leaving the scene. His mother, the reporting party, informed officers that her son was
once again out of control. The day before, she reported he broke his hand after, in a fit of
rage, he punched a wall while at a gas station. He had an appt with the doctor the next
morning, and when she went to wake up her 18 YOA son, he was irritable/angry about being
awakened, about being asked to wear a shirt, and about who would drive to the appointment.
He felt he should drive, with a broken hand, because she drove too slow and as he became
more enraged, he proceeded to break the handle from the door, hurting his mother in the
process. He took the keys from her and left as she fled to a neighbor's. The son was taken
to DC Jail and given a citation for 5th Degree Domestic Assault and the mother was advised
given a Crime Victim's card.
Medical Wednesday 1310 hours
Officers received a report of an injured bicyclist — he was found near a bike trail with several
abrasions, and some possible memory loss. He was transported to the hospital and his bike
was held at MHPD for safekeeping. He reclaimed his bike the next day and reported he was
fine.
DOC/Underage Consumption Thursday 0215 hours
While ensuring safety at a local bar at closing time, Officers watched two intoxicated persons
leave the bar, barely able to stand. The two approached Officers VonFeldt and Shepard and
advised them it was illegal to park in the parking lot and they should leave. The two persons
were advised they should find a safe ride home and they agreed that was a great idea.
However, three different cabs pulled into the lot, and three cabs were informed no ride was
required. After the third car left, the male party approached Officer Shepard's car and tried
to get in, "because cops gave rides home to their other friends before." The female party
was asked if she had her cell phone — she stated she did — and she agreed to call a friend.
She proceeded to "pretend" she had a phone and "pretend" called her friends (you know,
using that phone on your hand between your thumb and pinkie finger) for a ride and then
used the outdoor facilities/a.k.a. some trees. The female was then found to be under 21 and
had reportedly "snuck into" the bar with her brother, the male party. Detox was notified and
reservations were made, but then the mother was ultimately contacted and she arrived to
take custody of both intoxicated kids, who when PBT'd, were both over .24. The female party
was given a citation for urinating in public and both were released to a very upset mother.

The Parks Crew is still working on the hockey boards at the hockey rinks.
They repaired the sprinkler heads at the Kensington soccer fields. All
sprinkler heads were marked at Mendakota and Kensington fields and the
fields were aerated. The ball fields at Mendakota Park and soccer fields at
Kensington Park were fertilized.
Rich cleaned the floats at the Veronica lift station. The manhole cover was
changed on Wachtler Avenue. The sanitary sewer lines were cleaned on
Copperfield Drive, Stone Road, Watersedge Terrace, Fieldstone Drive, Pond
View Drive and Grieve Glen Road. Fire hydrants were painted on Highway
13.
The Streets Crew helped the Parks Crew cleaned up trees on the pedway
that runs through Kensington Park. A new street sign was made up for
Lakeview Avenue and LeMay Lake Road that was taken. A sign head was
fixed on South Plaza Drive. Barricades were dropped off for National Night
Out on Wilshire Court, Mears Avenue, Bluebill Drive, Bluff Circle, Downing
Street and London Road. Buckthorn was picked up from Pagel Road. Tim
helped Cliff work on the John Deere backhoe.
Engineering
Visitation Drive/Mendota Heights Roundabout - The contractor stabilized
area soil with sod, seed, and erosion control blanket on Friday (8/6) and
should be placing the final lift of bituminous (asphalt) on Monday (8/9),
striping is scheduled to be completed by Wednesday (8/11), and the
roundabout should be open by August 20th once interim lighting is installed.
Final lighting installation should be complete by Labor Day.
Highway 55/Mendota Heights Road Intersection - The project is out for bid.
Bid opening is scheduled for August 23rd, and the project should begin
construction by September 15th. Residents should be aware of traffic
revisions at this intersection beginning on September 15th. The
project is scheduled for completion by mid-December.
2010 Reconstruction/Rehabilitation Project - The contractor paved the first
lift of pavement on Monday (8/2) and Tuesday (8/3) installed driveways on
Friday (8/6). The contractor will be completing the cul-de-sac at the end of
Spring Street next week and then will moving on to the mill and overlay
portion of the project. Manholes still need to be exposed as well as
boulevard work.
Street Improvement Plan - Staff will be presenting the 2011-2015 Street
Improvement Plan (SIP) to City Council after the 2011 Budget work session
on August 17th. The SIP is a projection of the next 5 years for street
reconstruction, street rehabilitation, and utilization of the City's Municipal
State Aid account. Once comments are received from Council during the
work session, a final version will be brought before Council for public
comment and formal adoption.
Public Works Director/City Engineer Returns - John Mazzitello has returned
from his deployment to Afghanistan with the Minnesota Air National Guard.
He started back with the City on Monday (8/2), and is getting back up to
speed on the status of projects and overall state of the Department. John
would like to thank the City (Council, Staff, and Residents) for making the
transitions both to and from deployment incredibly easy for both him and
his family, and also for all the support provided during his absence.
