Mazzitello, PE, PMP, MBA — Public Works Director/City Engineer Nolan Wall, AICP — City Planner SUBJECT: Expedited Building Permit — Glen Toro Road Lots BACKGROUND In 1998, the City of Mendota Heights approved a Planned Unit Development (PUD), Preliminary Plat and Developers Agreement for the Glen Toro Second Addition Development. The development consists of nine lots, five of which have been developed. The developer has sold two of the remaining undeveloped lots and now wishes to obtain Building Permits to construct two new homes on Lot 3, Block 2 and Lot 5, Block 1 of the development. The 1998 approval Resolution and Developers Agreement do not address the incorporation of City Wetlands Permits into the overall approval. The only mention of City Wetlands Permits is in a staff memo for the approval. At that time, it is believed that there were no wetlands identified that impacted either of the two lots in question. In 2006, the City updated the Wetlands Map, and a wetland was identified on Lot 5, Block 1. This newly identified wetland requires City Wetlands Permits for the development of the two lots in question. The Builder for the Lot 3, Block 2 home has submitted for Building Permit. The entire house proposed is located outside the 100 -foot radius regulated area around the wetland, and could proceed without a City wetlands permit; however, the proposed driveway would be constructed within the 100 -foot radius. Mendota Heights City Code Section 12-2-6A states that a wetland permit is required when one of more of the following activities is proposed within 100 feet of a, "wetland or water resource area": 1. The deposit or removal or permitting the deposit or removal of any debris, fill or any other material over one hundred (100) cubic yards. 2. Any excavation over one hundred (100) cubic yards. 3. The digging, dredging, filling, or in any other way altering or removing any material from water bodies, watercourses, wetlands, floodplain, or natural drainage system. 4. The construction, alteration, or removal of any structure. The removal of vegetation. 6. The altering of any embankment or ponding area or the changing of the flow of water or ponding capacity. 7. Permanently storing materials. 8. Disposing of waste materials, including, but not limited to, sewage, garbage, rubbish, and other discarded materials. 9. Installation and maintenance of essential services. Staff has identified that a City Wetlands Permit is needed due to the removal of vegetation (#5) and addition of impervious surface (#6 — changing of the flow of water) within 100 -feet of the wetland area. The City has not yet received a Building Permit application for the house proposed on Lot 5, Block 1. Staff believes this lot can follow the standard procedure for a City Wetlands Permit. BUDGET IMPACT Fees and escrow amounts for these applications would be designated to cover the staff time necessary to process the City Wetlands Permits.
