Held Tuesday, May 5, 2015
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. Other Councilmembers present included
Duggan, Povolny, Petschel, and Norton.

Council, the audience, and staff recited the Pledge of Allegiance.

Mayor Krebsbach presented the agenda for adoption. Councilmember Povolny moved adoption of the

D) APPROVAL OF PERSONNEL ACTION REPORT
Councilmember Duggan noted that the Police Department has had a few challenges as they have lost an
officer through a sad event, several through retirements, and one a for medical reason. The department
has been working very hard over the last several months to get it back to where it should be. This is the
fourth officer that has recently been hired. He is very pleased to see Phil McCarthy come on board.
Officer McCarthy will be introduced to the City Council on June 2, 2015.
Councilmember Duggan moved to approve the Personnel Action Report.

G) APPROVAL OF CLAIMS LIST
Councilmember Petschel wanted to make the residents aware that the City has made our first half
payment to the City of West St. Paul for the improvements to the ice arena. She asked City
Administrator Mark McNeill to provide an update in terms of where the City of West St. Paul is on the
improvements.
City Administrator McNeill replied that the improvements have been delayed for a short time due to the
ground being frozen deeper than anticipated; however, they still anticipate being able to get the arena
operating on time.
Councilmember Petschel moved to approve the Claims List.

A) SWEARING IN CEREMONY OF POLICE OFFICER STEVE HILYAR
Chief of Police Michael Aschenbrener introduced Police Officer Steve Hilyar and provided highlights of
his background and experience. Police Officer Steve Hilyar read the Police Officer Code of Ethics and
was sworn in by Mayor Krebsbach.

Since the year 2000, the City of Mendota Heights has recognized Officers, Reserves and Citizens for
going above and beyond to make Mendota Heights a better place to live. The following is the list of

NEW AND UNFINISHED BUSINESS
A) RESOLUTION 2015-30 VARIANCE AT 873 HIGHWAY 110, PLANNING CASE 2015-09
Planner Nolan Wall explained that the applicant was seeking a variance from the rear yard setback
standard to construct an approximately 216 square foot addition to the existing dwelling at 873 Highway
110. The subject parcel is 0.43 acres and even though it has a Highway 110 address, it is actually a
corner lot that fronts Carmen Lane to the south and Crown Point Drive to the west. The parcel is zoned
R-1 single-family residential and guided as low density residential on the Comprehensive Plan.
The proposed addition would connect the detached garage and dwelling to add a mudroom and
bedroom/office space. The north side of the existing structure encroaches into the rear yard setback area;
therefore, a variance is required. Planner Wall explained the rear yard setback requirements and shared

that the proposed addition would be constructed flush with the existing dwelling's north wall and would
not encroach further into the rear yard setback area. The proposed addition would be finished with
stucco and painted to match the existing structures. The addition meets the R-1 districts building height
and other setback requirements.
Staff recommended approval of this variance request.
Councilmember Duggan questioned the necessity of condition #2. Planner Wall stated this is standard
language.
Council member Petschel acknowledged the quality of the plans.
Councilmember Duggan moved to adopt RESOLUTION 2015-30 APPROVING VARIANCE AT 873
HIGHWAY 110 based on the Findings of Fact and Conditions as outlined in the resolution.

COMMUNITY ANNOUNCEMENTS
City Administrator Mark McNeill made the following announcements:
• Clean-up Day was held on May 2. There were over 20 volunteers who assisted. It was a
successful Clean-up Day in terms of the amount collected: nine tons of paper shredded, 362
vehicles came through, $3,600 collected to off -set the fees.
• Development Open House for Lemay Lake Shores will be held in the City Council Chambers
from 6:00 pm to 7:30 pm on Wednesday, May 20, 2015.
• Park Celebration / 5K Run is June 5 - 6. Music at Market Square Park at 6:00 pm Friday, 5K run
at 9:00 am Saturday, Parks Celebration at Mendakota Park 11:00 am -2:00 pm Saturday.
• Sign up for the Citizens Police Academy held on Thursday evenings from September 17 through
November 19, 2015.
COUNCIL COMMENTS
Councilmember Norton commented that it is nice to see everyone out enjoying the trails and the parks
now that the weather is very nice.
Councilmember Petschel reiterated how proud she is of the Police and Fire departments. She also
requested that Public Works Director John Mazzitello explain why residents in her area received a
phone call from Excel Energy.
Public Works Director Mazzitello replied that Excel Energy is going through several neighborhoods in
Mendota Heights checking for conflicts between their utility conduits and sanitary sewer service laterals
that come from homes to the main in the street. They are doing this work by inspecting from the main.

If a conflict is identified, they will contact the property owner and arrange a time to initiate a repair.
Most of the properties they have looked at throughout Mendota Heights have no conflict.
Councilmember Petschel also shared the sad news of the passing of Sister Marie Terez from the Convent
of the Visitation.
Councilmember Povolny noted how much he enjoyed working with others on Clean Up Day.
Councilmember Duggan tried his hat at horseshoes in West St. Paul. They are looking for additional
players on Tuesdays at 9:30 am and 12 noon.
He also noted that St. Peter's Church is 75 years old [old St. Peters] and 10 years old [new St. Peters]. A
celebration will be held on July 12, 2015.
St. Thomas Academy has two nationally recognized teachers this year, Caroline Little for French and
Mark Westlake for Science.
Councilmember Duggan asked staff to find out how many group homes should be allowed in a
community. Mayor Krebsbach recommended that this may be an item to add to an upcoming workshop
agenda, along with `legislative' agenda items. City Attorney Tom Lehmann replied that group homes are
heavily regulated by the State and have a lot of exceptions to zoning codes. It is a topic that has been
discussed by a lot of communities but it is something that staff could look at.
Mayor Krebsbach also noted the passing of Sister Marie Terez. She also recognized the strength in the
City with the Police, Fire, and EMS. She also joined in recognizing all city staff.

Minutes of the Council Workshop
Held Tuesday, May 12, 2015
Mayor Krebsbach called the meeting to order at 1:10 p.m. Also present were Councilmembers Duggan,
Norton, Povolny, and Petschel. Staff in attendance included City Administrator Mark McNeill, Assistant to
the City Administrator Tammy Schutta, Public Works Director John Mazzitello, Finance Director Kristen
Schabacker, Planner Nolan Wall, Police Chief Mike Aschenbrener, Recreation Program Coordinator Sloan
Wallgren, and City Clerk Lorri Smith.
1. PUBLIC WORKS
a. Discussion of Water Contract
Public Works Director John Mazzitello and General Manager Steve Schneider, St. Paul Water, reviewed
the draft agreement to convey the water facilities to St. Paul Water. The current water services agreement
is set to expire in November 2015. They reviewed with the Council the proposed agreement which would
have no end date. The city could, at any time, claim the system back.
The agreement would offer the residents of Mendota Heights a lower rate on their water consumption. The
Council discussed the units paid by residents now and what that would be after a transfer. The Council
questioned what the value of the 20% surcharge over the life of the contract would be. The Council asked
staff to estimate the revenue that would be needed to operate if the system is transferred.
The Council asked to review the old and new contracts together to determine the differences. This item
will be brought back to an upcoming workshop meeting.
b. Sump Pump update
Mazzitello updated the Council on the steps being taken to make residents aware of the proper sump pump
discharge. An article was put in the April Heights Highlights, a flyer is being developed to hand out to
residents, and the Building Official is speaking with home owners he has contact with who need to correct
their sump pump discharge system. Social media and an article in the South West Review are also being
considered. The information campaign will continue through 2015. An inspection program potentially
could be implemented in 2016.
c. Discussion of Warrior Drive and Mendota Road Reconstruct
The Council discussed amending the CIP by moving the Mendota Road construction from 2017 to 2016, in
order to complete the project at the same time as the Warrior Drive project is completed. Mendota Heights
Road would then be moved from 2016 to 2017. The Council was agreeable.
d. Trash Hauler Zones
A majority of the Council members spoke against moving this item forward. The Council was in
consensus to place an article in the Heights Highlights encouraging neighborhoods to join together to

organize their trash collection on the same day to alleviate the issues of the noise of multiple trucks,
unattractive trash cans set out throughout the week, and safety for the children.
2. PARKS
a. Dog Park Discussion
Recreation Coordinator Sloan Wallgren reviewed three potential sites for a dog park. Pilot Knob South, a
3.5 acre site, was favored as a temporary site. Staff was directed to get the City Attorney's opinion as to
whether a temporary dog park use can be designated at this site without changing the underlying zoning.
Staff will also review the source of funding for these improvements and notify the adjacent homeowners of
this proposed use.
3. DEVELOPMENT ISSUES
a. Discussion of Sale of Village City -Owned Lots
Planner Nolan Wall reviewed the site plan for The Village area. The Council discussed possible
development opportunities for the three city owned properties. The Council discussed ways to seek out
interested parties for development of these city -owned parcels. They discussed residential development or
development of a restaurant on the two larger parcels.
The Council directed staff to begin the process of marketing the properties by sending a letter of interest to
targeted developers, providing them with guidelines for development. The Council also discussed meeting
with restauranteurs who live in Mendota Heights to hear their thoughts on development of the site.
b. Infill Residential Development
Planner Nolan Wall presented the Council with a draft ordinance establishing regulations for `teardowns' in
order to protect the character of the neighborhoods. Planner Wall discussed options for the code
amendments. Limiting the height of the structure was discussed.
The Council directed staff to bring this draft ordinance to the City Council, omitting Sections 4 and 5
which discuss limiting the structure height.
c. Rental Licensing
Planner Wall discussed with the Council an amendment to the City Code concerning rental housing. The
current code language limits rental licensing to the RI residential zoning districts. The proposed code
amendment would expand the licensing to all residential zoning districts in the city. This would apply to all
single-family detached and attached dwellings.
The Council directed staff to bring the proposed ordinance forward to the Council.
4. MISCELLANEOUS ISSUES
a. Emergency Action Plan
Chief Aschenbrener reviewed with the Council corrective actions that could be made to make the City Hall
building more secure. Staff was directed to prioritize the list and present it at the budget workshop. Staff
was also directed to schedule security training for Council and staff.
b. Workers Comp Information

Finance Director Kristen Schabacker reviewed with the Council what the rates for Workers Compensation
insurance are based on. She also noted that claims are considered for the last three years. She reviewed the
experience modification for the past year and the estimate for next year.
The Council requested that the costs be projected out for the next three years for the budget workshop.
c. Discussion of 2016 Budget Parameters
The Council discussed the parameters for the 2016 budget. Staff will bring back suggestions at the June
workshop.
d. Set June Workshop Date
The next workshop meeting was scheduled for Tuesday, June 23, 2015, starting at 1:00 p.m.
The workshop adjourned at 4:55 p.m.

PARKS AND RECREATION MEETING
April 14, 2015
The April meeting of the Mendota Heights Parks and Recreation Commission was held on
Tuesday, April 14, 2015 at Mendota Heights City Hall, 1101 Victoria Curve.
Chair Hinderscheid called to order the parks and recreation commission meeting at 6:30 p.m.
The following commissioners were present: Chair Hinderscheid, Commissioners: Ira Kip,
David Miller, Stephanie Levine, Michael Toth, and Joel Paper and Student Representatives
Joe Quehl and Rachel Farber. Absent: Commissioner Evans. Staff present: Recreation
Programmer Sloan Wallgren.

Archery Range
Mr. Wallgren explained that the commission had talked about the possibilities of adding an
archery range in the city. The commission invited residents to the meeting to hear their
thoughts and ideas about the topic. Mr. Wallgren explained that he received about 2 dozen
emails from residents there were very supportive of the idea. Several residents were in
attendance to show their support of the possibilities of an archery range in the city.
Mr. Wallgren stated that the Minnesota DNR would announce their available grant money in
the next few weeks and that staff would apply for funds if the commission thought it was a
good idea.
COMMISSIONER LEVINE MADE A MOTION FOR STAFF TO APPLY FOR GRANT
MONEY WITH THE MINNESOTA DNR, AND OVER THE SUMMER STAFF AND THE
COMMISSION COULD WORK ON FINDING A SITE AND DESIGNING THE RANGE.

Recycling in the Parks
Mr. Wallgren updated the commission that the city has received 12 new recycling barrels from
Dakota County. The barrels have been placed at parks throughout the city. Staff will continue
to monitor areas that need more recycling for future planning

50+ Programming Meeting
Mr. Wallgren informed the commission that staff from the city, school district and county
worked together to conduct a meeting for adults 50+ to generate ideas for future programming
About 20 residents attended the meeting on March 31, 2015 at Mendota Elementary. Some
ideas that were generated were that residents want to see some day trips offered, other would
like to start a walking club, and other were very interested in playing pickleball. Staff will
work with the school district and county to see if we can offer some programs beginning in the
fall.
Marie Park Hockey Rink
The commission discussed the idea of using the new paved hockey rink at Marie Park to offer
pickleball and a full court basketball area. There is room inside the rink to stripe four
pickleball courts and a basketball court. The cost to stripe the courts will be about $2,000.

Canoe Rack
The commission discussed the possibilities of adding a canoe rack at Rogers Lake Park. Staff
said that a canoe rack could be built by city staff for a few hundred dollars. Neighboring cities
rent out their canoe rack for $50-$200 per canoe for the season. The commission agreed that
$50 would be a decent amount to charge for a yearly canoe rack rental.

Commission Comments
Commissioner Kipp announced that the Rogers Lake Homeowners Association will be doing a
clean-up at Rogers Lake on May 2nd
Commissioner Levine asked residents to report any issues in the parks to city hall as soon as
possible.
Commissioner Paper thanked thank everyone for attending the meeting and sharing their thoughts.
Commissioner Toth encouraged people to clean up after themselves at the parks.
Commissioner Miller was happy to see things moving forward.
Chair Hinderscheid thanked the residents in attendance and encouraged people to sign up for the
Friday News.

Update
The golf course was very active and busy during the month of April. The course continues to see
new customers that are out to play Footgolf. The course launched a new Groupon Deal on
May 1St featuring rounds of Footgolf at discounted prices. During the first week the course sold
over 250 deals, which generated $2,500 for the course and brought many non -golfers to the Par 3.
Registration for Junior Golf Camps and Junior Golf Leagues continues to be strong. We currently
have roughly 200 youth register for our programs. This year we are also offering a new program
for youth ages 4-6 on Friday nights and Saturday mornings, there are 45 youth registered for these
two programs. New this year, each participant in one of our youth programs will receive a Mendota
Heights Par 3 tee shirt, which will help with advertising and promoting the course.
Maintenance Update
The golf course made it through the winter in great condition. We did have an issue with moles
digging holes out on the course, but we now have that issue under control. The new Toro Sandpro
that we purchased last year is working great and is keeping our bunkers in good shape.
Staff will continue to work on the garden area in front of the clubhouse to keep it looking beautiful.
The fence around the back patio has been stained, and we are planning on staining the maintenance
building very soon. Staff is in the process of getting a company to do some concrete work around
the clubhouse to help clean it up.
Budget
Total sales for the month of April were $14,363 and total expenses were $9,828. Total sales for
the year through April are $26,526 and expenses are $26,141 resulting in a net profit of $385 year
to date.

BACKGROUND
Public Works staff provides vital and essential services to the City of Mendota Heights on a daily
basis, often with little or no recognition. Whether it is snow plowing, street repair, sanitary sewer
cleaning, water main and/or fire hydrant maintenance, parks maintenance, City owned landscape
management, Facility repair and maintenance, or inspecting and repairing the inlets and outlets to our
stormwater ponds, Public Works staff does their absolute best to make the City of Mendota Heights
safer, healthier, and a great place to work, live, and play.
Each year the American Public Works Association (APWA) sponsors "National Public Works Week"
to help make and keep communities across the country aware of the important role public works and
infrastructure plays in their everyday life. This public support is critical to the sustained efficient
operation of Public Works facilities and infrastructure assets throughout the City. This year, APWA
has set the week of May 17th through May 23rd as "National Public Works Week." Throughout the
country, cities and counties are recognizing this week in honor of all their public works employees,
and educating their residents and civic organization about the importance of planning, designing,
building, maintaining, managing, and operating municipal infrastructure; the backbone of our
communities and improving the quality of life for everyone.
This year's theme is "Community Begins Here" as recognition that a healthy, well-maintained
infrastructure system is essential to strong and vibrant community. By building and maintaining
lasting infrastructure, and by planning for the efficient allocation of future resources, we are able to
have clean water; safe streets, clean parks, and neighborhoods; efficient traffic; and safe, livable, and
attractive communities. All because of Public Works.
BUDGET IMPACT
There is no budgetary impact to recognizing "National Public Works Week."
RECOMMENDATION
Staff recommends City Council formally recognize "National Public Works Week," by adopting the
attached RESOLUTION 2015-34, "A RESOLUTION RECOGNIZING NATIONAL PUBLIC
WORKS WEEK AS THE WEEK OF MAY 17, 2015 THROUGH MAY 23, 2015." This action
requires a simple majority vote.

WEEK AS THE WEEK OF MAY 17, 2015 THROUGH MAY 23, 2015
WHEREAS, public works services provided in Mendota Heights are an integral part of our
residents' everyday lives; and
WHEREAS, the support of an understanding and informed constituency is vital to the efficient
operation of public works facilities and services such as water service, sanitary sewers, storm sewers,
street maintenance, trails, park maintenance, and snow plowing; and
WHEREAS, the health, safety, comfort, and quality of life of Mendota Heights residents greatly
depends on these facilities and services; and
WHEREAS, the quality and effectiveness of these facilities and services, as well as their
planning, design, construction, and maintenance is critically dependent upon the efforts and skill of
public works officials and staff; and
WHEREAS, the efficiency of the qualified and dedicated personnel who staff the public works
department is materially influenced by the residents' attitude and understanding of the importance of the
work they perform; and
WHEREAS, the 2015 theme of National Public Works Week is, "Community Begins Here,"
signifies the importance of a strong commitment to Public Works in order to develop and maintain a
quality community; and
WHEREAS, it is the desire of the City of Mendota Heights to recognize the superior
performance and dedication of its public works staff and honor the vital service they perform for the City
on a daily basis.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that the week of May 17th through May 23th, 2015 is to be recognized as "National
Public Works Week" in the City of Mendota Heights, Minnesota; and
BE IT FURTHER RESOLVED that residents and civic organizations are called upon to
familiarize themselves with the efforts necessary to provide Mendota Heights with the public works
facilities and services we all enjoy, and to recognize the contributions made by public works staff every

SUBJECT: Resolution of Support for the Robert Street Transitway Alternatives Analysis
BACKGROUND
In 2011, a Joint Powers Agreement (JPA) was completed establishing an inter -agency panel co-
sponsored by the Dakota County Regional Railroad Authority (DCRRA) and the Ramsey County
Regional Railroad Authority (RCRRA) to conduct the Robert Street Transitway Alternatives
Analysis (AA). The JPA established a Steering Committee (SC) and a Technical Advisory
Committee (TAC) that would oversee the project. Mendota Heights was included as a
stakeholder and provided representation to both committees. Mayor Krebsbach and Council
Member Povolny served as primary and alternate for the SC, and Ryan Ruzek and John
Mazzitello served as primary and alternate for the TAC.
Over the past several years different alternatives were proposed, reviewed and analyzed by both
the SC and the TAC. Public and stakeholder meeting were held, and two alternatives presented
themselves as the most viable alternatives for transit service. The SC ultimately recommended
two alternatives for the final report: Bus Rapid Transit (BRT) and streetcars in the Robert Street
Corridor. The SC decided that leaving both alternatives on the table would provide greater
flexibility for future economic development and land use planning in the corridor.
The attached Resolution of support is being requested by Dakota County staff for inclusion in
their presentation to the County Board later this summer.

RECOMMENDATION
Staff recommends the City Council pass the attached resolution of support for the process and
selected alternatives for the Robert Street Transitway Alternatives Analysis. If Council desires to
implement the recommendation, pass a motion adopting Resolution 2015-33, a "RESOLUTION
SUPPORTING THE PROCESS AND CONCLUSIONS FO THE ROBERT STREET
TRANSITWAY ALTENATIVES ANALYSIS." This action requires a simple majority vote.

RESOLUTION SUPPORTING THE PROCESS AND CONCLUSIONS FO THE
ROBERT STREET TRANSITWAY ALTENATIVES ANALYSIS
WHEREAS, the Dakota County Regional Railroad Authority (DCRRA) and the
Ramsey County Regional Railroad Authority (RCRRA) serve as co -project sponsors in
the conduct of the Robert Street Transitway Alternatives Analysis (AA), formalized
through the execution of a joint powers agreement (JPA) in August 2011; and
WHEREAS, in July 2012, the DCRRA and RCRRA commenced an AA
compliant with the Federal Transit Administration's (FTA) New Starts program; and
WHEREAS, the JPA has defined an oversight structure for the AA that
established a Steering Committee and Technical Advisory Committee co-chaired by the
DCRRA and RCRRA and incorporated municipalities and agencies within the study area,
including the city of Mendota Heights, into the evaluation and decision making processes

Steering Committee that guided a technical analysis evaluating numerous potential route
alignments and modes; and
WHEREAS, the AA produced a limited number of alternatives for detailed
analysis and consideration by the Steering Committee; and
WHEREAS, The AA incorporated numerous opportunities for public and
stakeholder involvement throughout the course of the study, including open house
meetings, stakeholder presentations, and regular distribution of information on the AA
through email and website communications; and
WHEREAS, the AA evaluation process developed and overseen by the Steering
Committee and Technical Advisory Committee identified two alternatives, Robert Street
Arterial Bus Rapid Transit and Robert Street Streetcar, that can meet the goals
established for the project; and
WHEREAS, the Steering Committee has acted to conclude the AA without
selection of a single alternative to allow for additional local land use planning to better
understand and facilitate the potential economic development benefits of a future transit
project, allow for the formation of regional policy on the development and operation of
streetcar, further consider FTA's requirements for land use planning in cities'
comprehensive planning processes, and further coordinate with the St. Paul on its
streetcar system planning efforts.

NOW, THEREFORE, BE IT RESOLVED, that the City of Mendota Heights
supports the evaluation process conducted by the AA and its conclusions; and
BE IT FURTHER RESOLVED, that the City of Mendota Heights supports the
decision by the Steering Committee to conclude the AA with two alternatives that will be
carried forward for consideration in further study at a later date.

SUBJECT: Accept Bids and Award Contract for 2015 Sanitary Sewer Rehabilitation
Project
BACKGROUND
Four proposals (see attached resolution) were received and opened on Wednesday, May 13, 2015
for the Sanitary Sewer Rehabilitation Project. Insituform Technologies submitted the low bid of
$276,579.30. Their bid was higher than the Engineer's Estimate of $245,460.00. The higher
costs are due to the large diameter pipes for the interceptor line. The city has not lined many
large diameter pipes on past projects resulting in limited data for estimating unit costs for this
project.
Our sanitary sewer system is aging. Many of our pipes are 60 years old and will soon be in need
of repair. Cleaning our sewer system on a regular cycle will help extend the life of the pipes.
Televising of the system will show where immediate repairs are needed. Lining pipes in need of
repair with cured -in -place -pipe will extend the life of our system.
The 2015 Sanitary Sewer Rehabilitation Project consists of lining approximately 4000 feet of
sanitary sewer. The locations were determined from the report provided with the 2009, 2011 &
2013 sanitary sewer cleaning and televising projects. Staff anticipates lining as many sanitary
sewer pipes as possible without exceeding the budgeted amounts with the following priority:
1) Huber Drive from Bent Tree Lane to Cheyenne Lane.
2) Mendota Heights Road from Pilot Knob to Main lift station.
3) Mendota Heights Road from Highway 55 to RJ Ryan site.
4) Rogers Park
The completion date for the project is November 30, 2015. Staff expects that Insituform
Technologies is capable of meeting the completion dates and implementing the project in
accordance with the plans and specifications given.

The project costs will be funded through the Sanitary Sewer Utility Fund and Metropolitan
Council I&I grant. The 2015 city budget includes $172,000.00 for sanitary sewer maintenance
and an approximate carryover from 2014 of $135,000.00. The grant from the Met Council is
$27,500.00. The 2015 budget would then have around $58,000.00 for cleaning and televising.
RECOMMENDATION
Staff recommends that the council accept the bids and award the contract to Insituform
Technologies for their bid in the amount of $276,579.30.
If city council wishes to implement the staff recommendation, pass a motion adopting
RESOLUTION 2015-35 ACCEPTING BIDS AND AWARDING CONTRACT FOR
THE 2015 SANITARY SEWER REHABILITATION (PROJECT #201505). This

BACKGROUND
The City of Mendota Heights currently owns two copiers. Each copier is over six years old and
calls for maintenance are increasing. One copier is located within the Police Department and was
identified in the 2015 CIP to be replaced for $9,000. The other copier is located within the
Administration Department. The City currently pays a quarterly maintenance cost for each
copier. The maintenance and supplies for the MHPD copier is approximately $3,100.00 annually.
Per the City's Purchasing Policy, it's been determined that we can lease a copier through the
State of Minnesota Contract. Some of the benefits of leasing through the State of Minnesota
Contract allows for upgrade/downgrade of equipment without penalty, maintenance is included
in the lease, and hard drive security and cleansing. Leasing a copier also allows for us to keep up
with emerging technology.
The maintenance agreement on this contract includes all service and supplies (except paper and
staples), and a 3 -hour response time for service calls. All black and white copies will be billed at
$25.00 for 2000 images. Anything over 2000 will be billed at $.0065. Color copies will be billed
at $.067 as used. The Police Department's monthly average for color copies is 560. Based on this
average, it is estimated that color copies will cost $37.52 per month. The annual amount for a 5 -
year lease plus maintenance costs of the Ricoh Aficio MP C3003 copier is $2,964.72.
BUDGET IMPACT
The annual amount for a 5 -year lease of the Ricoh Aficio MP C3003 copier is $2,214.48. The
maintenance costs are $25 per month for 2000 black and white copies. Color copies are billed at
$.067 as used. The annual amount for a 5 -year lease plus maintenance costs of the Ricoh Aficio
MP C3003 copier is $2,964.72.
RECOMMENDATION
It is recommended that the City Council authorize the City Administrator to enter into a five year
contract with Metro Sales, Inc. for one Ricoh Aficio MP C3003 copier for the Police
Department.

Personnel Action Items
Item 1. Successful Completion of Probationary Period, Project Engineer Almin Ramic
Effective May 12, 2015, Almin Ramic has successfully completed his probationary period as
Project Engineer. Almin has been a valued member of the engineering department
assisting with project management, storm water design, plan review and interacting with
the public. Almin is a great addition to the city.
City staff recommends that the City Council officially appoint Almin Ramic to the position of
regular, full-time Project Engineer, effective May 12, 2015.

At a recent meeting, City Council gave approval for staff to begin the rehiring and recruitment

WHEREAS, Garold "Jerry" Murphy has provided service to the City of Mendota Heights for nearly
forty-eight years in its Police Department; and
WHEREAS, during that time, Jerry Murphy has given selflessly of his time as a volunteer, as a Police
Reserve, and as a licensed part-time police officer; and
WHEREAS, Jerry Murphy began working when the Mendota Heights Police Department had been
organized for only five years, and has worked for, and with, every MHPD Chief during that time; and
WHEREAS, Jerry Murphy has been integrally involved with countless community events, ranging
from traffic control to Citizens Academy to neighborhood speed checks; and
WHEREAS, Jerry Murphy made himself available twenty four hours a day by always carrying his
police radio with him to allow for quick responses; and
WHEREAS, in 2013 Jerry Murphy received the Presidential Volunteer Service Award in recognition
of contributing what was then in excess of 13,000 hours of volunteer service to the community; and
WHEREAS, Jerry Murphy is fondly known in the MHPD for bringing doughnuts to share every
Thursday since 1980; and
WHEREAS, the City Council, staff, and Mendota Heights community wish to honor and recognize
Jerry Murphy as a consummate volunteer and civic servant for Mendota Heights.

Twin City Beverage, Inc.
BACKGROUND
A public hearing has been scheduled for this evening to receive public comment regarding the issuance
of an off sale intoxicating liquor license. The City has received an application for an Off Sale
Intoxicating Liquor license from Diljit Khoso, owner of Twin City Beverage, Inc. This is a transfer of
the license currently issued to Poopha, Inc., d/b/a Mendota Liquor Barrel, located at 766 Highway 110.
The applicant has submitted a complete license packet and paid the required fees. The Mendota
Heights Police Department has completed a thorough investigation of the applicant and has found no
issues or concerns.
Per City Code, all new liquor license applications shall not be approved before the next regular City
Council meeting following the public hearing. If approved at the next City Council meeting, the license
application would be sent to the State Liquor Control for their approval of the license.
RECOMMENDATION
Staff recommends the City Council hold the public hearing, consider comments from the public, and
close the public hearing. Official action on the license would take place at the next City Council
meeting scheduled for June 2, 2015.

BACKGROUND
Since 2013, the City has processed five CUP applications for minor improvements to existing wireless antenna
facilities. The projects typically included replacement of antennas, change -out of equipment and cables, and
interior modifications to accessory structures. Based on feedback from the Planning Commission and Council,
certain applications for minor equipment improvements to existing wireless antenna facilities could be reviewed
and administratively -approved and still accomplish the intent of the ordinance; while making the approval process
more efficient and equitable.
Attached is DRAFT Ordinance 476 for review and potential action. As proposed, it would only apply to certain
improvements to existing wireless antenna facilities; new towers would require a public conditional use permit
review/approval process.
The Planning Commission conducted a public hearing at the April 28 meeting; there were no public comments.
The Commission recommended several amendments to the DRAFT ordinance for consideration by the City
Council. A condition requiring no increase in structural load to an existing structure was recommended for
elimination. In addition, the Commission recognized the intent of the proposed amendment was to accommodate
certain improvement projects that had minimal visual impacts to be approved administratively. The recommended
language included adding the word "material" to conditions 3-5; for example:
"No material increase in the total number of existing antennae."
After consultation with the City Attorney, it was determined that "material" was undefined and may be too
subjective to interpret equitably. Therefore, staff proposed a revision to condition #4 that would allow for an
increase in height of building -mounted antennae that still comply with the 15 -foot height requirement.
BUDGET IMPACT

RECOMMENDATION
The Planning Commission recommended approval of DRAFT Ordinance 476 with revisions based on their
discussion, as described in Planning Case 2015-11. If the City Council desires to implement the recommendation,
pass a motion adopting ORDINANCE 476 CONCERNING WIRELESS ANTENNAS, TOWERS, AND
ACCESSORY STRUCTURES.
This matter requires a simple majority vote.

AN ORDINANCE AMENDING SECTION 12-1D-14 OF THE CITY CODE OF THE
CITY OF MENDOTA HEIGHTS, MINNESOTA, DAKOTA COUNTY, CONCERNING
WIRELESS ANTENNAS, TOWERS, AND ACCESSORY STRUCTURES
The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Title 12 -1D -14(I) is hereby added as follows:
I. Administrative Procedures And Exemptions: The city administrator may, at his or her discretion, direct
the appropriate staff member to review conditional use permit requests for improvements to existing
wireless antenna facilities. The City may impose such conditions and require such guarantees deemed
reasonable and necessary to protect the public interest and ensure compliance with the standards and
purposes of the City Code. Administrative approval of such requests may be granted when all of the
following conditions exist:
1. Requirements in 12 -1D -14(H) are met and submitted for review.
2. Request seeks to adjust, maintain, repair, or replace existing antennae and accessory structures or
the elements of an antenna array, including remote radio units (RRU), affixed to a tower or
antenna.
3. No increase in the total number of the existing antennae.
4. No increase in the total height of the existing antenna structure. Height of individual building -
mounted antennae may be increased in compliance with 12-1D-14(C)(2)(b).
5. No external modification or expansion of the existing accessory structure.
6. Existing wireless antenna facility, including the wireless antenna structure and accessory
structure, is compliant with all conditions contained in the original conditional use permit.
Section 2.
This Ordinance shall be in effect from and after the date of its passage and publication.
Adopted and ordained into an Ordinance this nineteenth day of May, 2015.

DESCRIPTION OF THE REQUEST
The City is considering amendments to Title 12, Chapter 1, Article D, Section 14 of the City Code
concerning wireless antennas, towers, and accessory structures.
BACKGROUND
According to Title 12-1D-14 of the City Code:
Wireless telecommunication towers, antennas, and accessory structures, including, but not limited to,
cellular, PCS technology, and wireless Internet, are a conditional use in all zones within the city...
Since 2013, the City has processed five CUP applications for minor improvements to existing wireless
antenna facilities. The projects typically included replacement of antennas, change -out of equipment and
cables, and interior modifications to accessory structures. In all cases, the improvements did not increase
the height of the wireless antenna structures or expand the footprint of the accessory structures. From the
ground, the projects were mostly inconspicuous.
Conditional use permits require a public hearing and significant staff -time to process. In addition, the
minimum five-week application approval process can be burdensome to applicants. Based on feedback
from the Planning Commission and Council, certain applications for minor equipment improvements to
existing wireless antenna facilities could be reviewed and administratively -approved and still accomplish
the intent of the ordinance; while making the approval process more efficient and equitable. The Council
has approved similar processes for applicable wetlands and fence permits.
As a result, staff has identified potential code amendments concerning the approval process for discussion
and recommendation by the Planning Commission. The goal is to streamline the process for certain wireless
antenna facility improvement projects.

As contained in DRAFT Ordinance 476, the proposed amendment would be added to the existing Code
section concerning wireless antennas, towers, and accessory structures. As proposed, it would only apply
to certain improvements to existing wireless antenna facilities; new towers would require a public
conditional use permit review/approval process. Once approved by the planning and engineering
departments, the Building Official would review the plans to determine if a building permit is required.
ALTERNATIVES
Following the public hearing and further discussion, the Planning Commission may consider the following
actions:
1. Recommend approval of DRAFT Ordinance 476, as presented or as amended by the Commission.
OR
2. Recommend denial of DRAFT Ordinance 476.
OR
3. Table the request, pending additional information and revisions from staff.
STAFF RECOMMENDATION
Staff recommends the Planning Commission discuss the proposed code amendment (Alternative #1). If
acceptable to the Commission, action can be taken at this month's meeting. Staff would propose to bring
back any substantial revisions for review and further discussion at a future meeting prior to making a
recommendation to the City Council.

SUBJECT: Ordering of Feasibility Report for Mendota Road Neighborhood
Improvements Project (201507)
BACKGROUND
The purpose of this memo is to request the council to order a feasibility report for the proposed
2016 street reconstruction and rehabilitation project (see attached map). Staff identified the
Mendota Road Neighborhood Improvements as a 2016 street reconstruction and rehabilitation
project in the 2013-2017 Street Improvement Plan (SIP).
As identified in the 2013-2017 SIP, the proposed street to be reconstructed is the rural section of
Mendota Road (previously Hwy 110 Frontage Road) from Delaware Avenue to Oak Street in
Mendota Heights. This street has deteriorated to the point where it is no longer cost effective to
patch. Under the circumstances, the questions that need to be resolved are related to the design
details of the street as opposed to whether or not the street should be reconstructed.
The proposed streets to be rehabilitated, as identified in the 2013-2017 SIP, are High Ridge
Circle, Sibley Court, and Warrior Drive. Based on our observations as well as our pavement
management system, these streets have deteriorated to the point where it is no longer cost
effective to patch the street and rehabilitation is necessary. Residents on these streets were not
surveyed although staff has received several telephone inquiries as to when resurfacing will take
place. Staff will send out a survey to the property owners that would be affected by the Mendota
Road Neighborhood Improvement project soliciting their opinions and preferences regarding the
project type, need and schedule.
The streets to be rehabilitated have concrete curb and gutters so a pavement replacement is
proposed. Street rehabilitation typically includes removing and replacing the existing
bituminous surface with a new bituminous surface, curb and gutter repair, and catch basin repair.
Before staff presents the feasibility report to the city council, a neighborhood meeting will be
held to discuss possible design issues for the proposed project.

BUDGET IMPACT
The 2013-2017 SIP estimated the total project costs for the Mendota Road Neighborhood
Improvements to be approximately $1,755,000. The project costs in the SIP are rough estimates
using 2013 dollar amounts which will be refined during the budget, feasibility report and bidding
process. Mendota Road Neighborhood Improvements project is anticipated to be financed by
special assessments, municipal bond sales, municipal state aid funds, and utility funds.
RECOMMENDATION
Staff recommends that council formalize and start the public improvement process by ordering
the preparation of a feasibility report for High Ridge Circle, Sibley Court, Warrior Drive and
Mendota Road from Delaware Avenue to Oak Street in Mendota Heights.
If city council wishes to implement the staff recommendation, pass a motion adopting
RESOLUTION 2015-32 ORDERING PREPARATION OF FEASIBILITY REPORT FOR
THE MENDOTA ROAD NEIGHBORHOOD REHABILITATION (PROJECT #201507).
This action requires a simple majority vote.

RESOLUTION 2015-32
A RESOLUTION ORDERING PREPARATION OF FEASIBILITY REPORT FOR THE
MENDOTA ROAD NEIGHBORHOOD IMPROVEMENTS (PROJECT #201507)
WHEREAS, it is proposed to construct improvements on Mendota Road (previously
Hwy 110 Frontage Road) from Delaware Avenue to Oak Street in Mendota Heights including
the construction of storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing,
and appurtenant work; and
WHEREAS, it is proposed to construct improvements on High Ridge Circle, Sibley
Court, and Warrior Drive including the removing of the existing bituminous surface,
construction of bituminous surfacing, concrete curb and gutter repair and appurtenant work; and
WHEREAS, this project is identified in the City's 2013-2017 Street Improvement Plan;
and
WHEREAS, it is proposed to assess the benefited property for all or a portion of the cost
of the improvements, pursuant to Minnesota Statutes, Chapter 429,
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that
the proposed improvements be referred to the City Engineer for study and that he is instructed to
report to the Council with all convenience and speed advising the Council in a preliminary way
as to whether the proposed improvements are necessary, cost-effective and feasible and as to
whether they should best be made as proposed or in connection with other improvements, and
the estimated costs for the improvements as recommended.
Adopted by the City Council of the City of Mendota Heights this nineteenth day of May, 2015.

SUBJECT: Traffic Safety Committee Report and Recommendations
BACKGROUND
The Traffic Safety Committee (TSC) met on May 5th, 2015 at 5:30pm. In attendance at the
meeting were Public Works Director/City Engineer John Mazzitello, Police Chief Mike
Aschenbrener, Council Member Mike Povolny, and Planning Commission Chair Litton Field Jr.
Fire Chief John Maczko was excused. Also in attendance were residents of the Warrior Drive
neighborhood and Council Member Duggan. The TSC discussed three issues:
REPORT AND RECOMMENDATIONS
1. Request to limit available parking to Warrior Drive Residents at north end of the
west side of the street. Requested by Warrior Drive Resident at the March 19th City
Council Meeting.
Discussion started around why the street was constructed to the size it is and who paid for
the improvements. The requesting resident brought up the circumstances before the trail
was added which allowed him to utilize the east side parking. He spoke in favor of
resident only parking. Discussion then moved to the WSP side of Sibley HS and how
signs handled the problem. Chief Aschenbrener was check with WSPPD for citation
numbers. Another area resident advised that just placing signs would handle problem.
TSC explained that the City cannot place signs that are unenforceable and that sign
inventory for function and applicability is a new State requirement. Discussion continued
around the public's expectation for enforcement. Povolny stated we should run a test
case in front of the west side residents and it was suggested that a three hour limit for
public on -street parking be tried as it is in compliance with the Uniform Sign Code.
More discussion occurred around the construction timing and waiting.
Recommendation: The TSC recommends adopting an Ordinance codifying a 3 -hour
parking limit for the north 600 feet of the west side of Warrior Drive. If Council would
like this recommendation implemented, direct staff to bring forward a Ordinance at a
future Council meeting.
2. Analysis of 3- hour parking limit on the entire east side of Warrior Drive, as well as
the northern portion of the west side. Requested by Mayor.
TSC members expressed concern that issues that have been decided get repeatedly
brought back to TSC after a decision has been made.
Recommendation: TSC unanimously reaffirmed the previous recommendation that the
parking on the east side of Warrior Drive receive no further alteration, and that the City
continues to work with ISD 197 and high school staff on educating students and faculty of
the safety concerns of the neighboring residents. Once the 2016 rehabilitation of Warrior
Drive is complete, parking can be readdressed if necessary, but it is the belief of the TSC
that the rehabilitation project will be able to address the concerns of the neighbors.
3. Design Concepts for Warrior Drive Rehabilitation (2016 project) — Requested by City
Staff
Seven design concepts were discussed. Preliminary design layouts showed that two were
not feasible without adding width to the street (angled parking & separated parking lane).
The five remaining concepts were: rehabilitation as -is (do nothing option), restoration to
original use with parking on both sides of the street (lose/lose option), curb adjustment
option to include bump -outs at trail connections and intersection, 5 -foot median option,
and 7 -foot median option. All but the do-nothing and lose/lose designs incorporated a
variety of traffic calm concepts such as narrowed traffic lanes, median strips, striping and
bump outs. The two median design concepts were well received by both members of the
committee and the public present at the meeting. Discussion extended around the
possibility of making the high school driveway an entrance only (this would be an
ISD197 decision) and using the median with some bollards to increase public safety
access. Timeline for the 2016 project was discussed as well as who would be notified as
a potential stakeholder in the project.
BUDGET IMPACT
New 'no parking" signs for the north 600 feet of the west side of Warrior Drive would be 4200
each. Existing posts would be used for the signs.
RECOMMENDATION
Staff recommends Council receive the TSC report and recommendations.
