Held Tuesday, April 21, 2015
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. Also present were Councilmembers Duggan,
Povolny, Petschel, and Norton.

Council, the audience, and staff recited the Pledge of Allegiance.

Mayor Krebsbach presented the agenda for adoption. Councilmember Povolny moved adoption of the

D) AUTHORIZE PURCHASE ORDER FOR INVASIVE SPECIES CONTROL — VALLEY PARK
Councilmember Duggan asked if there was a rotation basis in relation to invasive plant species in the
different areas and how that would be determined Public Works Director John Mazzitello replied that
staff did speak with Mr. Wiley Buck of Great River Greening and they do a rotation basis; it is a plan
that they have had in place for some time and it addresses different invasive species each year.
Councilmember Duggan moved to authorize a purchase order for invasive species control in Valley
Park.
Councilmember Povolny seconded the motion.

E) APPROVAL OF 2015 WORKERS COMPENSATION INSURANCE RENEWAL
Councilmember Povolny stated that taxpayers should be aware that there have been a few workers
compensation issues but that this is something that cannot always be controlled. This is something that
is costing more money due to an increase in premiums.
Finance Director Kristen Schabacker confirmed that the City did see a 36.4% increase in the premium.
This is based on the claims that have occurred in the past year. The premium is not something that can
be controlled easily.
Councilmember Duggan noted that his concern was that a base premium increase of $36,000 was being
approved and he wanted it brought to the public's attention.
Councilmember Petschel stated that she would like to discuss having the workers compensation
insurance carrier do an assessment and make loss control recommendations. She suggested this be added
to the May City Council Workshop agenda.
Finance Director Schabacker stated that loss control assessments are done by the League of Minnesota
Cities. Councilmember Petschel reiterated her desire to have this topic added to the May workshop
agenda. Mayor Krebsbach directed Administrator McNeill to add this to the May workshop agenda.
Councilmember Duggan moved to approve the 2015 Workers Compensation Insurance Renewal.

F) PERSONNEL ACTION ITEMS
Councilmember Duggan noted his gratitude to Brian Convery and shared a list of his accomplishments
during his tenure with the Police Department.
Assistant to the City Administrator Tamara Schutta explained that Sergeant Convery was injured while
on duty. He is no longer able to perform the essential functions of his position. His last day of
employment with the City will be April 30, 2015.
Ms. Schutta explained where the city is at in the process for hiring police officers. Staff recommended
the appointment of Stephen Hilyar to police officer.
Ms. Schutta also recommended the appointment of Ryan Crouley to Maintenance I position for the
Public Works department. A conditional job offer has been made contingent upon the results of a
background check. Staff recommended his appointment.
Councilmember Duggan moved to accept the Personnel Action Items Report.

PRESENTATIONS
A) REPORT FROM MHPOBA ON OFFICER PATRICK FUNDRAISER
Police Officer Mike Shepard provided an update on the fundraiser held last week to fund the Patrick
family and the Mendota Heights Police Officers' travel to Washington DC to attend the Police Week,
which will include the honoring of slain Police Officer Scott Patrick. The fundraiser brought in over
$47,000.
The MHPOBA [Mendota Heights Police Officers Benevolent Association] is an incorporated non-profit
organization, registered with the Minnesota Secretary of State as an approved 501(c)(3) charity.
Councilmember Duggan asked that the officer's travel to Washington DC be reviewed to determine if
this is paid or unpaid leave from work. He would be supportive of paid leave as they are doing
something as a service to the City.
Mayor Krebsbach directed staff to send a memo to the Council providing clarification on this situation
and also to provide a list of the officers that are part of the non-profit association and what
responsibilities the City has to this non-profit organization.

B) DISCUSSION ON BROADBAND INITIATIVE
City Administrator Mark McNeill stated that one of the things that Dakota County, Dakota County
CDA, and cities of Dakota County have been working on the installation of a high-speed institutional
and commercial internet connection. This is a large undertaking and the CDA has offered to take the
lead. Ms. Lisa Alfson of the CDA was unable to attend this meeting. Mr. Craig Ebeling was present to
provide an update to the Council.
Mr. Ebeling shared a presentation providing background on this initiative, the results of the investigation
thus far, and future efforts and plans. The group hired a consultant to assist with the investigation, of
which the County offered to pay one-third of the fees, the CDA to pay for one-third, and the cities in
Dakota County were requested to share the payment of the last one-third — prorated on population.
After the presentation, Councilmembers asked questions regarding opportunities for funding through
governmental agencies, franchise fees, what kind of costs would the City be looking at going forward,
and other technological options available.
Council directed staff to work with the participants of this initiative to provide a summary report at the
May workshop meeting and to schedule a separate workshop meeting to focus on this topic.
Councilmember Duggan moved to approve payment for the Design Nine Group initial study in the
amount of $1,182.63, to request staff provide an update to the Council at the May workshop, and to
discuss this further at a future workshop meeting.

NEW AND UNFINISHED BUSINESS
A) RESOLUTION 2015-29 APPROVE PLANS, ADVERTISEMENT FOR BIDS
FOR VICTORIA ROAD SOUTH RECONSTRUCTION
Public Works Director John Mazzitello explained that Resolution 2015-29 would authorize staff to
advertise for bids for construction of the second phase of the Victoria Road South reconstruction. The
first phase was constructed in 2014 from Highway 13 to Marie Avenue. This project would reconstruct
Victoria Road South, south of Marie Avenue terminating at Lexington Avenue. The reconstruction
project would completely rebuild the road, install curb, gutter, and storm sewer.
Also included with this bid package is an alternate bid that would be separate from the reconstruction
project. The alternate bid would be for reconstructing the upper City Hall parking lot. Staff has found
that tying other projects in with street projects that are in close proximity enables a better economy on
the project.
If approved, the bid opening would be scheduled for May 14, 2015 and a bid award would come to
Council at the May 19, 2015 meeting. Construction would begin in June 2015, after school ends.
Construction would be complete in the fall of 2015, before school begins. The assessment hearing

would be held in October 2015. Final wear course of bituminous pavement would be placed in the fall
of 2015.
The cost estimate for Victoria Road is $1.67M and the cost estimate for the parking lot project is
approximately $165,000.
Mayor Krebsbach noted that the Council has had extensive workshop meetings on this street
reconstruction project.
In response to a question raised by the Council, Mr. Mazzitello explained that the feasibility report
completed for the Victoria Road project did not include the City Hall parking lot reconstruction and the
costs of that project were not included in the City's portion of the bonds issued for the project. He met
with Finance Director Schabacker and determined that there are sufficient funds between the City Hall
fund balance, facility reserve, and a source or utility to cover the cost of the project. He also noted that
the City is under no obligation to complete the parking lot project if prices are not favorable.
Councilmembers asked questions regarding the available funds to pay for other City Hall projects.
Councilmember Norton moved to adopt RESOLUTION 2015-29 APPROVING FINAL PLANS AND
SPECIFICATIONS, AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE VICTORIA
ROAD SOUTH RECONSTRUCTION PROJECT (PROJECT #201308a).

COMMUNITY ANNOUNCEMENTS
Assistant to the City Administrator Tamara Schutta made the following announcements:
• The April edition of the Heights Highlights newsletter is out.
• Clean -Up Day will be held at Mendakota Park on Saturday, May 2 from 8:00 a.m. to 12:00 p.m.
Document shredding will also be completed at this site for the residents.
• June 5 and 6 is the Parks Celebration. June 6 is the 5K Run/Walk.
• The City is accepting applications for the 10th annual Citizens Academy.
• The City received the $10,000 redevelopment grant from the Dakota County CDA for creating a
redevelopment plan for the industrial district.
COUNCIL COMMENTS
Councilmember Duggan requested from staff updated information on the possible dog park location. He
also noted the number of thefts of items left inside unlocked vehicles and reminded everyone to lock
their cars, even when they are parked in their own driveways. He also asked, in light of the newly
adopted food truck ordinance, if ice cream trucks would be allowed?

Councilmember Petschel noted that the Justice Department was leaning towards not approving the
merger between Comcast and Time Warner. She also stated that she has received multiple positive
comments from residents on the Heights Highlights article on sump pumps.
Mayor Krebsbach thanked staff for the Heights Highlights, the broadband presentation, and receipt of
the redevelopment grant.

34 Planner Nolan Wall explained that the applicant was seeking a variance from the rear yard setback
35 standard to construct an approximately 216 square foot addition to the existing dwelling at 873
36 Highway 110. The subject parcel is 0.43 acres and even though it has a Highway 110 address it is
37 a corner lot fronting Carmel Lane, and Crown Pointe Drive to the west. The property is zoned
38 R-1 Single Family Residential and guided as low density residential in the Comprehensive Plan.

40 Planner Wall shared an image of the proposed site plan as provided by the applicant. The proposed
41 addition would connect the detached garage to the dwelling to add mudroom and bedroom/office
42 spaces. The north side of the existing structure encroaches into the required rear yard setback;
43 therefore a variance is required.

45 Planner Wall then shared the City's rear yard setback requirements, the location of the current
46 structure, and the location of the proposed addition. The proposed addition would be constructed
47 flush with the existing dwelling and would not encroach further into the rear yard setback.

50 and meets the R-1 district's building height and other setback requirements.

95 Proposed amendments to the Wireless Antennas, Towers, and Accessory Structures section of the
96 City Code

98 Planner Nolan Wall explained that the City of Mendota Heights was considering amendments to
99 Title 12, Chapter 1, Article D, Section 14 of the City Code concerning Wireless Antennas, Towers,
100 and Accessory Structures, which currently require Conditional Use Permit approval. Since 2013
101 the City has process five Conditional Use Permit applications for minor improvements to existing
102 wireless antenna facilities. The projects typically included equipment change -outs, antenna
103 replacements, and interior modifications to existing accessory structures. In all cases those
104 improvements did not increase the height of the wireless antenna structure itself or expand the
105 footprint of those existing accessory structures.

107 Similar to other application processes, these conditional use permits do require a public hearing
108 and take a significant amount of staff time to process. In addition, staff has heard from applicants
109 that the five-week minimum approval process can be burdensome. Based on feedback from the
110 Commission and from City Council, staff proposed amendments that would allow certain projects
111 to be approved administratively.

113 Planner Wall shared Draft Ordinance 476, which adds a new section to the City Code to address
114 this issue and proposes a few conditions, which would allow for administrative approval. He
115 explained that the amendment would not change what an applicant would have to submit; it's just
116 changing how the City would review and approve such applications.

176 • The City received a redevelopment planning grant from the Dakota County CDA in the
177 amount of $10,000; the City will be matching an additional $10,000 from city funds to do
178 a redevelopment plan for the entire industrial district. Staff is currently working with

180 months. This process will include the Planning Commission as well.

SUBJECT: Receipt of a Tree Donation
BACKGROUND
The city auditor has advised that Minnesota State Statute 465.03 "Gifts to municipalities"
requires all donations be acknowledged by resolution. This memo meets Minnesota State
Statutory requirements.
The city recently received a donation from the Thursday Club, a group of area residents that
meets at Mendakota Country Club every Thursday, to plant a tree at Mendakota Park. Members
of the Thursday Club will be able to see their donated tree along Mendakota Drive as they enter
and exit the Country Club.
BUDGET IMPACT
Not applicable
RECOMMENDATION
Staff recommends the City Council pass the attached resolution accepting the donation of a tree
for planting in Mendakota Park. If Council desires to implement the recommendation, pass a
motion adopting Resolution 2015-31, a "RESOLUTION FORMALLY ACKNOWLEDGING
THE RECEIPT OF DONATION FOR TREE PLANTING AT MENDAKOTA PARK."

RESOLUTION FORMALLY ACKNOWLEDGING THE RECEIPT OF
DONATION FOR TREE PLANTING
WHEREAS, the City of Mendota Heights desires to follow Minnesota Statute
465.03 "Gifts to municipalities"; and
WHEREAS, the Minnesota State Statute requires a resolution to accept gifts to
municipalities; and
WHEREAS, the City has previously acknowledged gifts with a resolution; and
WHEREAS, the City Council of the City of Mendota Heights have duly
considered this matter and wish to acknowledge the civic mindedness of citizens and
officially recognize their donations.
NOW THEREFORE BE IT HEREBY RESOLVED that the City Council of
the City of Mendota Heights is accepting donation from the Thursday Club to plant a tree
at Mendakota Park.
Adopted by the City Council of the City of Mendota Heights this 5th day of May, 2015.

Item 1: Authorize Appointment of Police Officer
Staff continues with the recruitment process to fill Police Officer vacancies. We currently have
two positions to fill. November 2014, we posted a position announcement for a lateral, seeking
candidates with two plus years of experience. The position was advertised with a starting salary
range of $4,978 - $5,383 per month. We are happy to report that we have completed a thorough
background investigation on Police Officer Candidate Philip McCarty. Mr. McCarty has also
completed his psychological evaluation and physical examination.
It is our pleasure to recommend the appointment of Philip McCarty as a Police Officer for the
City of Mendota Heights. Mr. McCarty has over 2 1/2 years of experience in the field of Law
Enforcement. He currently serves as a Police Officer for City of Lakefield, Minnesota. He also
serves as a part time Deputy for Jackson County Sheriff's Department. Mr. McCarty earned an
Associates' degree in law enforcement from MN West Community College. Throughout the
interview process, Mr. McCarty demonstrated a high level of energy and enthusiasm. Mr.
McCarty will be a great addition to the Mendota Heights Police Department.
City staff recommends that city council approve the appointment of Philip McCarty as a Police
Officer effective June 1, 2015. Starting salary will be $4,978 per month. This is step two of the
2014-2015 Law Enforcement Labor Services, Inc. Labor Agreement.
Mr. Philip McCarty will be formally introduced to the city council at the June 2, 2015 meeting.
Item 2: 2015 Engineer Intern
At a recent meeting, City Council gave approval for staff to begin the hiring and recruitment
process for an Engineer Intern. The Engineering Department will experience a busy spring and
summer with design and construction projects including South Victoria Road Reconstruction,
Sanitary Sewer Cleaning, Televising and Lining Project, GIS updates, sign inventory, CAMP
monitoring on Lemay Lake, E Coli monitoring in Interstate Valley and Asset Management
inventory and program implementation. In addition to these projects, the department will be
contracting for street striping and seal coating, resolving drainage issues, updating record
drawings and preparing feasibility reports for potential 2016 projects.

The primary objective of this position is to assist the Engineering Division of the Public Works
Department with construction staking, construction observation, records management,
geographical information (GIS) data and base mapping, engineering, project development,
planning, public requests and other Division functions as assigned. Staff interviewed Nick
Tomlyanovich for the Engineer Intern position. Mr. Tomlyanovich is a student at University of
Minnesota Duluth pursuing his Bachelor of Science degree in Civil Engineering. Mr.
Tomlyanovich will be able to start on a full-time basis June 1 and work through August.
City staff recommends that city council approve the hiring of Nick Tomlyanovich as Engineering
Intern pending a background check, at the authorized wage of $12.00 per hour.
Item 3: 2015 Police Intern
This summer, Cale Schliesman will be completing an unpaid internship with the Mendota
Heights Police Department. Mr. Schliesman is a student at Winona State University pursuing his
Bachelor degree in Criminal Justice. Part of his requirement for graduation includes a 400+ hour
internship with a law enforcement agency. Mr. Schliesman will be assigned to complete several
projects for MHPD along with experiencing the day-to-day activities of a Police Officer this
summer.
City staff recommends that city council approve the unpaid internship for Cale Schliesman,
beginning May 11, 2015.
Item 4: 2015 Public Works Summer Seasonal Hires
At a recent meeting, City Council gave approval for staff to begin the hiring and recruitment
process for the Public Works Department. Employees from the 2014 season have re-applied for
their positions. Applicants were offered their position contingent upon a successful completion
of a criminal background check and council approval. Staff is recommending the following
individuals for employment for the spring/summer 2015 season:

BACKGROUND
The engineering department would like to purchase a new pickup truck to replace a 1999 pickup.
The 1999 Ford F150 pick-up has exceeded its life and is requiring increasing maintenance and
repairs as it continues to get older. Although being purchased by the Engineering Department,
the vehicle would be available to all City Staff if not in use.
BUDGET IMPACT
In the 2015 Engineering Budget, there is $30,000.00 capital improvement budgeted to purchase a
new truck, bed cover and light package. Staff has received three quotes for a new 2015 F150
super cab pickup truck. One quote was off the state contract at Midway Ford in the amount of
$30,054.00, a second quote from Apple Ford was $27,441.88. The final quote was from Inver
Grove Ford in the amount of $27,400.00. Both quotes do not include applicable tax and license
fees. The prices do include the trade in value for the old truck. This leaves approximately
$2,600 for the purchase of a bed cover and light package at a later date.
RECOMMENDATION
Staff recommends that the City Council authorize a purchase order to be made to Inver Grove
Ford for $27,400.00 plus tax and license fees.
If the City Council concurs with the recommendation, they should pass a motion authorizing
staff to execute a purchase order for the purchase of a new 2015 F150 super cab pickup truck in
the amount of $27,400.00 plus tax and license fees. This action requires a simple majority vote.

SUBJECT: Resolution Approving a Variance Request at 873 Highway 110
BACKGROUND
The applicant intends to construct an approximately 216 -square foot addition connecting the existing
dwelling and detached garage to add a mudroom and bedroom/office. The north side of the existing
structures encroach into the required rear yard setback; therefore the proposed addition requires a variance.
The proposed addition would be constructed flush with the existing dwelling's north wall and would not
encroach any further into rear yard setback. As a result, the variance request is for approximately 18 feet
for construction within the existing encroachment area. The proposed addition would be finished with
stucco to match the existing dwelling and meets the R-1 District's building height and other setback
requirements.
The Planning Commission conducted a public hearing at the April 28 meeting; there were no public
comments.
BUDGET IMPACT
N/A
RECOMMENDATION
The Planning Commission recommended approval of the variance request, with conditions, as described in
Planning Case 2015-09. If the City Council desires to implement the recommendation, pass a motion
adopting RESOLUTION 2015-30 APPROVING A VARIANCE AT 873 HIGHWAY 110.
This matter requires a simple majority vote.

RESOLUTION 2015-30
RESOLUTION APPROVING A VARIANCE AT 873 HIGHWAY 110
WHEREAS, Mark Swenson has applied for an approximately eighteen -foot (18) variance
from the rear yard setback standards in order to construct an addition to the existing dwelling at 873
Highway 110 as proposed in Planning Case 2015-09 and described in Exhibit A; and
WHEREAS, the Mendota Heights Planning Commission held a public hearing on this matter
at their regular meeting on April 28, 2015.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the
variance request as proposed in Planning Case 2015-09 is hereby approved with the following findings
of fact:
1. The proposed addition is a reasonable use of the property, meets the purpose and intent of the
City Code, and is consistent with the Comprehensive Plan.
2. The platting of the Crown Point Addition and location of the pre-existing structures on the
subject parcel created a unique circumstance upon the property not created by the applicant.
3. The proposed addition will not extend any further into the rear yard than the existing dwelling
and represents a small increased encroachment while still maintaining a large front yard setback.
4. The proposed addition will not alter the essential character of the neighborhood.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the variance
request as proposed in Planning Case 2015-09 is hereby approved with the following conditions:
1. A building permit be obtained prior to construction of the addition.
2. The applicant shall submit grading plans and a dimensioned site plan with associated
easements, subject to review and approval by the City Engineering Department as part of any
building permit application.

DESCRIPTION OF THE REQUEST
The applicant is seeking a variance from the rear yard setback standards to construct an addition to the
existing dwelling at 873 Highway 110.
BACKGROUND
The subject parcel is 0.43 acres (18,681 square feet) and contains an existing single-family dwelling and
3 -car detached garage. Even though it maintains a Highway 110 address, the parcel is a corner lot fronting
Carmen Lane and Crown Point Drive to the west. The parcel is zoned R-1 One -Family Residential and
guided as LR Low Density Residential. The applicant intends to construct an approximately 216 -square
foot addition connecting the dwelling and garage to add a mudroom and bedroom/office. The north side of
the existing structures encroach into the required rear yard setback; therefore the proposed addition requires
a variance.
ANALYSIS
Comprehensive Plan
The subject parcel is guided LR Low Density Residential in the 2030 Comprehensive Plan. The applicant's
request to construct an addition is consistent with the continued use as a single-family residence.
Rear Yard Setback Variance
The R-1 District's required rear yard setback is 30 feet or 20% of the average lot depth, whichever is greater.
In this case, the required setback is 30 feet. As shown on the Site Plan, as submitted by the applicant, the
existing structures are located approximately 11-14 feet from the rear property boundary line and are
considered legally nonconforming.
As shown on the building plans, the proposed addition would be constructed flush with the existing
dwelling's north wall and would not encroach any further into rear yard setback. As a result, the variance

request is for approximately 18 feet for construction within the existing encroachment area. The proposed
addition would be finished with stucco to match the existing dwelling and meets the R-1 District's building
height and other setback requirements.
When considering a variance for the proposed addition, the City is required to find that:
1. The request is in harmony with the general purposes and intent of the ordinance and comprehensive
plan and the applicant proposes to use the property in a reasonable manner.
The applicant's request to construct an addition to an existing single-family dwelling to add storage and
living space is a reasonable use of the property. Besides extending the existing encroachment into the rear
yard, the proposed addition is otherwise compliant with the Code and consistent with the Comprehensive
Plan.
2. The applicant establishes there are practical difficulties with complying with the ordinance due to
circumstances that are unique to the property which are not created by the applicant or based on
economic considerations.
According to Dakota County property records, the existing dwelling was constructed in 1945. The Crown
Point Addition, which includes the subject parcel, was approved by the City in 1977 and platted in 1978.
As a result, the existing rear yard setback nonconformity was created as the subdivision was platted around
the pre-existing structures on the subject parcel. However, the meeting minutes approving the preliminary
and final plats did not include any discussion of creating such a nonconformity.
Based on the existing conditions, the applicant has established a practical difficulty in constructing the
proposed addition in compliance with the required rear yard setback standards. In addition, the existing
encroachment is a unique circumstance not created by the applicant.
3. The request will not alter the essential character of the locality.
The proposed addition to connect the existing dwelling and detached garage will not increase the existing
encroachment into the required rear yard and will be constructed with the same exterior finish and color.
The subject parcel's structures pre -date the platting of the surrounding subdivision and all of the dwellings
in the neighborhood have attached garages. In addition, the property will still maintain a front yard setback
of nearly 70 feet from Carmen Lane to offset the extended encroachment along the rear property boundary
line.
ALTERNATIVES
Following a public hearing, the Planning Commission may consider the following actions:
1. Recommend approval of the variance request for construction of an addition within the required
rear yard setback area based on the attached findings of fact, with conditions.
OR
2. Recommend denial of the variance request for construction of an addition within the required rear
yard setback area based on the findings of fact that a practical difficulty is not established and
expansion alternatives exist that do not require a rear yard setback variance.
OR
3. Table the request.

STAFF RECOMMENDATION
Staff recommends approval of the variance request for construction of the proposed addition within the
required rear yard setback area based on the attached findings of fact (Alternative #1), with the following
conditions:
1. A building permit be obtained prior to construction of the addition.
2. The applicant shall submit grading plans and a dimensioned site plan with associated easements,
subject to review and approval by the City Engineering Department as part of any building permit
application.
3. Any land disturbance activities must be in compliance with the City's Land Disturbance Guidance
document.

The following Findings of Fact are made in support of the proposed request:
1. The proposed addition is a reasonable use of the property, meets the purpose and intent of the
City Code, and is consistent with the Comprehensive Plan.
2. The platting of the Crown Point Addition and location of the pre-existing structures on the subject
parcel created a unique circumstance upon the property not created by the applicant.
3. The proposed addition will not extend any further into the rear yard than the existing dwelling
and represents a small increased encroachment while still maintaining a large front yard setback.
4. The proposed addition will not alter the essential character of the neighborhood.

Re: Letter of Intent for new home addition
To whm it may concern:
We are intending to build a new addition to our home this upcoming Spring which will connect the
existing home to our attached three car garage. Due to an increase in family size, we are needing more
space and intend to use the new FT2 as a mudroom for entrance to the East side of the home as well as
an additional bedroom / office (separated by a wall) which will open up from the existing kitchen (see
existing construction drawings). We are fully aware that our property does sit a bit too far back on the
lot thus the request for a variance & approval. The new addition will fit directly between the home and
garage and not stretch a single inch further back on the property. We did chat with all neighbors within
the existing 100' range of our lot and all are very excited for the end product (as the new space will
greatly add appeal to our home as well as the neighborhood itself). We also shared the drawings with
Annie Small (our neighbor directly inback / parcel #27-185OO-01-2Q0)and she gave her blessing aswell.

A variance is a request to vary from the City of Mendota Heights zoning standards. Under
Minnesota State Law, variances shall only be permitted when they are in harmony with the
general purposes and intent of the zoning code and when consistent with the comprehensive

requests, has three parts: (1) the proposed use of the property is a reasonable; (2) unique

We are looking at adding a mudroom / home office addition that will connect the existing home to
the detached 3 car garage. After speaking w Nolan Wall, he informed us that the existing home sits
a bit too far back on the property thus encroaches into the setback (30' requirement). The addition
we would like to put on will run parallel w the back of the home and will NOT encroach any further
back (see construction drawings). Our home was built in the 50's and the side entry off the patio is
extremely small thus the need for a mudroom. I also was recently married and needed to vacate my
home office (bedroom 2 of 3) and make into a bedroom. I work primarily from home and the extra
space behind the mudroom will be used as an office / bedroom #4. We will also stucco the exterior
of the additiona to blend it in w the home and hope to also paint the exterior later this year.
2. Please describe the circumstances unique to the property (not created by you).
Our "back yard" is a thin strip of land which does not have the 30' setback. To my knowledge, our
home was the 1st home built in the subdivision well before the setback requirements were put in
place.
3. In your opinion, will the variance, if granted, fit with the character of the
neighborhood?

Why or why not?
Absolutely. The accepted variance will allow us to increase the FT2 of the home to fall in line with
most of the homes in the neighborhood (ours currently is a bit smaller). We have done quite a bit
of work to this home recently including a full basement finish, bath finish, new concrete driveway
(2014), landscaping, patio work, etc. etc. all of which increase the look and appeal of the home.
MANY compliments and kudos from our neighbors.
The Planning Commission must make an affirmative finding on all of the criteria listed
above in order to grant a variance. The applicant for a variance has the burden of proof to
show that all of the criteria listed above have been satisfied.
