Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present:
Councilmembers Duggan, Povolny, Petschel, and Norton.

Council, the audience, and staff recited the Pledge of Allegiance.
AGENDA ADOPTION
Mayor Krebsbach presented the agenda for adoption. Councilmember Norton moved adoption of the

E) RESOLUTION 2014 -02, APPROVAL OF LOT SPLIT / LOT COMBINATION
AT 1349 KNOLLWOOD LANE
Planner Nolan Wall gave a brief background on Planning Case 2013 -21 where the applicants requested a
lot split for the unaddressed parcel behind the residence at 1349 Knollwood Lane. The parcel in question
is a 0.58 acre land - locked parcel owned by the property owner at 1335 Knollwood Lane. The two
property owners wish to subdivide the land - locked parcel, which would be combined with the property
at 1349 Knollwood Lane. The remaining parcel would remain under current ownership. Neither parcel is
or would be developable as a separate parcel because they do not have frontage on a public right -of -way.
Staff and the Planning Commission recommended approval of this application with the condition that
the newly created parcel is concurrently combined with the existing parcel at 1349 Knollwood Lane.
Councilmember Duggan moved to approve RESOLUTION 2014 -02 A RESOLUTION APPROVING A
LOT SPLIT AT 1349 KNOLLWOOD LANE with the condition that the newly created parcel is
concurrently combined with the property at 1349 Knollwood Lane.
Councilmember Povolny seconded the motion.

F) RESOLUTION 2014 -01, APPROVAL OF 2014 FEE SCHEDULE
City Clerk Lorri Smith reviewed the proposed 2014 fee schedule with the significant amendments being
as follows:
Recycler Containers - these are now the larger containers and are distributed by the licensed garbage
haulers not city hall.
Wireless Facility Leases rather than having fees set, these rates would be negotiated based on market
conditions.
Tobacco licenses with the recent ordinance change, tobacco licenses are now renewed on an annual
basis and will include an investigation of the licensee each year.
Vehicle impound proposed to charge the current tow rate plus tax.
Storm Sewer Utility Charges for residential and commercial /industrial fees were updated by
Resolution 2012 -114 on December 18, 2012.
Par 3 - 20 round pass has been changed to a 10 round pass, which is more frequently requested.
Pull Cart rental fee - increased from $2 to $3 per round.

Mayor Krebsbach asked about the wireless facility lease fee. City Administrator Justin Miller stated that
negotiating the fee based on current market conditions would be more beneficial to the City since market
conditions change frequently. The City would not be locking itself into a set rate that may or may not be
too low or too high.
Councilmember Duggan questioned the Storm Sewer Utility Charge for commercial properties. Finance
Director Kristen Schabacker explained that the rates had been changed prior but were not reflected in the
fee schedule. This update would correct that.
Councilmember Duggan also reviewed the language changes he proposed to the resolution.
Councilmember Duggan moved to approve RESOLUTION 2014 -01 RESOLUTION REVISING
SCHEDULE OF FEES FOR SERVICES.

I) APPROVAL OF CONSULTANT PLANNER CONTRACT WITH
STANTEC CONSULTING SERVICES, INC.
Planner Nolan Wall explained the contract negotiated with Stantec Consulting Services, Inc., the City's
new consulting planner. The proposed contract has been accepted by Stantec.
Planner Wall introduced Ms. Tina Goodroad from Stantec Consulting Services, Inc. who would be the
point person serving the City.
Councilmember Duggan moved to APPROVE THE AMENDED PROFESSIONAL SERVICES
CONTRACT WITH STANTEC CONSULTING SERVICES, INC. FOR CONSULTING PLANNING
SERVICES.

B) ORDINANCE 454, AMENDMENTS TO CITY CODE PERTAINING TO PRIVATE GARAGES
Planner Nolan Wall summarized the revisions made to the ordinance, which included:
1. "Building footprint" definition added
2. Garage size limitation measured by the "building footprint"
3. Removal of 1,800 sq. ft. total garage area limitation
4. Garage design standards
In addition, Title 12- 1D -3(B) contains the standards for accessory structures (including private garages)
in all zoning districts.
Planner Wall reviewed an additional edit suggested by Councilmember Duggan having to do with
sentence structure for Section 2a, rewording it to clarify what exactly is being referred to. He read the
proposed language to the Council as it was not included in the packet of information.
Planner Wall referred to a memo included in the materials from City Attorney Lehmann pertaining to
potential issues concerning lot splits.
Mayor Krebsbach moved that ORDINANCE 454 only address Section 6, four garage doors. The motion
died for lack of a second.
Councilmember Norton moved to adopt ORDINANCE 454 AN ORDINANCE AMENDING SECTION
12 -1D -3 OF THE CITY CODE BY AMENDING THE ALLOWABLE PRIVATE GARAGE SIZES
ON RESIDENTIAL PROPERTY with the edit(s) suggested by Councilmember Duggan.
Councilmember Duggan seconded the motion.
Councilmember Norton expressed his appreciation to Planner Wall and staff for their work on this
ordinance. He also expressed his appreciation to the City Attorney for the explanations in his memo.
Councilmember Petschel echoed.
Mayor Krebsbach also commended Planner Wall and staff for clearly explaining the proposed changes
and for their work.
Councilmember Duggan echoed the appreciation and sentiments.
There being no other comments or discussion, the vote was called.

C) REPORT ON CLOSED SESSION CITY ADMINISTRATOR PERFORMANCE EVALUATION
Mayor Krebsbach explained that Council met in a closed session prior to this meeting to review, as
required on an annual basis, the performance evaluation of the City Administrator and determine his
compensation. City Attorney Tom Lehmann and Assistant to the City Administrator/HR Coordinator
also attended the closed session.

Mayor Krebsbach stated that City Administrator Justin Miller started with the City on December 28,
2011. He is well respected by City Council and staff. He handles the budget well and keeps the Council
informed on important issues. He represents the City well at various meetings and public events. He is
professional and unflappable. The City Council encouraged Mr. Miller to continue doing a great job.
The City Administrator position is assigned to pay grade 44 on the 2014 Employee Position Placement
Pay Classification Plan. The City Council recommended approving Mr. Miller's wage increase to pay
grade 44, step E of 2014 Employee Position Placement Pay Classification Plan.
Councilmember Duggan moved to accept the Performance Review of City Administrator Justin Miller.

COMMUNITY ANNOUNCEMENTS
Assistant to the City Administrator Tamara Schutta made the following announcements:
• The City is accepting holiday lights for recycling at City Hall through January 31, 2014, Monday
through Friday, 8:00 — 4:30.
• NDC4 is holding Focus Groups next week, January 14, 15, and 16. They are starting to discuss
the franchise renewal and are looking for Council and citizen input.
COUNCIL COMMENTS
Councilmember Duggan reminded residents to help keep the fire hydrants in their neighborhoods free
and clear of snow.
Councilmember Duggan also commented that there is an open position on the Parks and Recreation
Commission. City Administrator Justin Miller noted that the deadline for applications is January 10,
2014.
Councilmember Povolny expressed his wishes that it would warm up.
Councilmember Petschel mentioned that the very last DC9 aircraft was retired this week by Delta
Airlines. She also provided additional information on the reduction of noise footprint with the newer
airplanes.
Mayor Krebsbach expressed her appreciation to staff for an outstanding year; the streets are all plowed,
which is one of the city's advantages besides the low tax rate; crime is low; we have a great engineering
department, the water runs into the culverts, and residents are very satisfied. She expressed her
appreciation to the Councilmembers as they have formed a strong team and are looking forward to 2014.

The December meeting of the Mendota Heights Parks and Recreation Commission was held on Tuesday,
January 14, 2014 at Mendota Heights City Hall, 1101 Victoria Curve.
Chair Hinderscheid called to order the parks and recreation commission meeting at 6:30 p.m. The
following commissioners were present: Chair Hinderscheid, Mary McGrory - Ussett, Joel Paper, and
Michael Toth. Staff present: Recreation Program Coordinator Sloan Wallgren.
Approval of Agenda
COMMISSIONER MCGRORY - USSETT MADE A MOTION TO APPROVE THE AGENDA;
COMMISSIONER PAPER SECONDED THE MOTION.

Approval of Minutes of December 10, 2013
Chair Hinderscheid made a correction to the motion passed last month regarding the Ivy Hills Tennis
Courts. Mr. Wallgren noted the correction and will make the changes.

MCGRORY - USSETT SECONDED THE MOTION.

Recreation Programming Report
Mr. Wallgren informed the commission that there were 32 youth participating in our Skating Lesson
program at Friendly Hills Park on Saturday mornings. Mr. Wallgren also stated that the city has groomed
a cross country ski trail out at the Par 3 with the help of St. Thomas Academy. The trail is 1.5 miles and
is free for anyone to use. Commissioner McGrory -Ussett said that she has used the trail and it is a
wonderful amenity for the city. Staff is now accepting reservations for athletic fields and picnic shelters,
application can be found online or at city hall. The next issue of the Heights Highlights will be delivered
to homes around February 17, 2014 and will contain more information about Spring /Summer activities.
Ice Rink Report
Mr. Wallgren informed the commission that during the 14 days in December when the warming houses
were open that there were almost 1,300 users. Commission Paper asked how we obtain these numbers.
Mr. Wallgren explained that the rink attendant takes a head count each hour and record these numbers.
Mr. Wallgren also mentioned that the 2014 budget included funds to replace the hockey boards at
Wentworth Park.

Par 3 Report
Mr. Wallgren informed the commission that on December 17, 2013 he arrived at the Par 3 to find that
water line had broken and there was significant water damage to the clubhouse. Staff has taken the
necessary steps to dry the clubhouse out, and is waiting on quote from contractor before we can move
forward with repairs.
Mr. Wallgren announced that the revenue in December was remaining balance form our Groupon of that
we ran this summer. We sold 520 deals with Groupon, which generated $8,500 for the course.
The course took in $143,973 during the 2013 season, down less than 2% compared to 2012 when sales
were $146,751. Mr. Wallgren said that the Par 3 Annual Report will be available in February.
Announcements
Mr. Wallgren informed the commission that city staff is collecting holiday lights at city hall for recycling.
Mr. Wallgren also said that the Mendota Heights Athletic Association is taking registrations for softball,
lacrosse, T -ball, and in -house baseball. Registration forms are now available for the June 7, 2014 5K
online or at city hall Mr. Wallgren also said that staff hopes to have more information about a Dog Park
at the February meeting.
Commission Comments
Commissioners Toth thought thanked staff for all their work, and thanked commissioner McGrory -Ussett
for serving on the commission.
Commissioner Paper thanked staff for all of the work at the Par 3. He also thanked commissioner
McGrory -Ussett for serving on the commission, and commented on the great rinks that we have in town
and encouraged people to get out and use them.
Chair Hinderscheid said it was good meeting. He wanted to thank commissioner McGrory -Ussett for
serving on the commission and has enjoyed working her and valued her opinions and comments.
Commissioner McGrory -Ussett stated that she will miss working with the commission, but believes that
the commission on doing a lot of great things and moving in the right direction. She has enjoyed her time
on the commission and will continue to use the parks regularly.

The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, January 8,
2104 at 7:00 p.m. at 1101 Victoria Curve, Mendota Heights, Minnesota.
The following commissioners were present: Jim Neuharth, Sally Lorberbaum, Gina Norling, Kevin Byrnes and
Paul Portz
Absent: David Sloan and William Dunn (both excused)

Approval of Minutes
Neuharth made a motion, seconded by Norling, to approve the November 13, 2013 minutes as submitted - all
voted in favor.
Discussion of 2014 Commission Work Plan
Vice Chair Lorberbaum introduced the item and indicated that the commission typically reviews the previous
year's work plan and makes revisions as needed. After reviewing the 2013 work plan, the only changes that
were noted were in relation to punctuation errors. Lorberbaum did recommend that the commission devote one
meeting later in the year to reviewing the airport's 2030 long term comprehensive plan. Portz made a motion,
seconded by Neuharth, to approve the 2014 work plan as amended and submit to the city council. All voted in
favor.
Future Televised Meeting/Guest Speakers
The commission proceeded to discuss ideas for speakers /meetings for 2014, including a discussion on when to
hold a televised meeting. The commission agreed to hold the televised meeting later in the year, possibly in
May, so that it could be publicized in the Heights Highlights newsletter. Topics for future meetings included an
RNAV update, a presentation on the Runway 12L early turn study, and a tour of the FAA tower. Also
suggested was to invite the new FAA tower manager, Elaine Buckner, to a commission meeting.
Reports on Areas of Focus
Portz updated the commission on the recent MAC meeting and shared a presentation that was given about the
airport's service quality survey. Norling presented her charts about excessive noise incidents at the RMTs and
noted that the trend continued to be on the upswing.

33 Consulting Planner Bob Kirmis explained that this application is a combination application
34 received from Robert Hockett and Michael McEllistrem to subdivide property and convey it to
35 an adjacent property. Mr. Hockett owns the single family lot located at 1335 Knollwood Lane
36 and also owns the landlocked parcel to the west, which is approximately 25,000 square feet in
37 size. The two property owners wish to split off the southern 70 feet of the landlocked parcel and
38 convey to Mr. McEllistrem. This would be a minor subdivision being conveyed to the adjacent
39 property to the south. Staff has no particular issues with the application. The only condition of
40 approval recommended is that the split off portion be combined with the McEllistrem property
41 located at 1349 Knollwood Lane.

74 Consulting Planner Bob Kirmis explained that the applicants have submitted a comprehensive
75 sign plan that has resulted in the need for a number of conditional use permits and variances.
76 Presently, there are nine signs existing on this property. The submitted sign plan calls for the
77 addition of nine new signs and the replacement of two existing signs on the property. Presently,
78 there are 175 square feet of signage on the property and as a result of the comprehensive sign
79 plan 478 square feet of signage would exist. Specifically, the application involves two
80 conditional use permits and four variances.

82 This particular site is zoned R1 Single - family Residential, which is geared towards residential
83 uses rather than institutional uses, such as that being considered. Regardless, the sign standards
84 in that district allow for one 12 square foot nameplate sign, one second nameplate sign by
85 conditional use permit provided that sign does not exceed 100 square feet. Finally, it allows for a
86 wall sign by conditional use permit up to 100 square feet. The R1 district in total allows for 212
87 square feet of signage upon individual parcels of land.

89 Consulting Planner Kirmis shared an exhibit of the existing signs and another graphic outlining
90 the new signs, 250 total square feet, as follows:

92 supported by columns. This sign would be more than 16 feet in height to provide
93 clearance for underpassing vehicles, a total sign area of 136 square feet.
94 2. Two Secondary Directory signs at 7 feet in height and 30 square feet in area, with both
95 signs to be installed at a future date. The location of these two signs would be along the
96 entrance drive between the entrance and the parking lot. The purpose of these signs is
97 traffic direction.
98 3. A "School Gate" sign consisting of two monument posts with identifying logo markings
99 at the main entry to the school building (north side). This sign is 30 square feet in total
100 area, and the overall structure height is approximately 12 feet (although the sign location
101 would be approximately 9 feet at its peak height).
102 4. Two "Wayfinding" signs, 12 square feet each, for a total area of 24 square feet. Such
103 signs are traffic directional signs. The plan indicates one such sign at the southeast corner
104 of the parking lot a second location is not clear from the materials.

128 Chair Field asked if the entry arch being on a public right -of -way influenced staff's
129 recommendation. Consulting Planner Kirmis replied that staff was made aware of that on the day
130 of this meeting and there would need to be a special permit granted. Typically cities do not
131 encourage private structures within rights -of -way. However, it is also his understanding that
132 Visitation Drive is a bit unique as it functions as a private drive. City Planner Nolan Wall
133 commented that particular sign is proposed to be brought forward with sign permits, if approved,
134 at a later date. Staff would ask that if that sign was brought forward that in addition to the sign
135 permit that it would also need a right -of -way permit, depending on the actual location of the sign.

137 Additional discussions occurred on the placement of the monument signs in the public right -of-
138 way and the need, during the sign permit process, for a right -of -way permit.

140 Commissioner Magnuson asked for the background on the sign height restrictions. Explanation
141 was provided on the differences between signs in areas zoned residential rather than commercial.

143 Commissioners asked for clarification that digital signs had been requested, and denied, by other
144 institutions. This was confirmed.

146 Other discussions occurred regarding other requested signs in the City of Mendota Heights and
147 the outcomes of those requests. Discussion also occurred around the possibility of changing the
148 code for institutional uses in residential zones.

150 Planner Wall provided further information by stating that initially the only sign permit that is up
151 for consideration immediately is for the `Welcome Digital Display' sign that would be located as
152 part of the renovation project that is currently going on. In speaking with the school about their
153 future plans, instead of coming back for variances and additional conditional use permits over
154 time, it was suggested that they package every sign improvement that they may want to make in
155 the near future as a comprehensive sign plan in order to obtain approvals and recommendations
156 that the Planning Commission would feel could go before the City Council and be adopted. This
157 way they would know what they are allowed and not allowed to do when making future
158 investments in signage on their property.

162 Ms. Dawn Nichols of Visitation School expressed gratitude to City Staff and the Planning
163 Commission for considering their request. She explained the comprehensive signage plan was
164 an effort to upgrade the campus to make it more user - friendly and to beautify it to better serve
165 the community. She furthered explained, specific to the proposed digital display signs, that the
166 intent is to utilize new technology. Upon response to a question from the Planning Commission,
167 Ms. Nichols indicated the proposed comprehensive signage plan would be implemented over 2 -3
168 years.

170 Mr. Scott Shifflett, representing Visitation School, of Opus Design Build detailed the unique
171 features of the Visitation campus, including: one -way ingress and egress; significant building
172 and proposed signage setbacks from property lines; four partnered uses on campus; and public
173 facilities used by Mendota Heights residents. These unique features require additional signage
174 and way- finding to navigate the site and ensure safe traffic movements. He furthered explained
175 the intent of the entry gate sign and showed an example of a similar design at St. Thomas
176 Academy. He also presented information specific to the proposed digital signage on campus.
177 Commissioners asked the applicant and their representatives questions regarding the digital
178 display sign, the existing signage, the ability to alter the proposed digital sign to make it
179 compliant, the restrictions being put on Visitation should any part of this request be denied, and
180 possible code review and adjustments.

181 The Commission took a five minute intermission to allow the applicants to discuss their options
182 (continue with the application as is or request a layover on the current application and then work
183 with staff to create a code amendment request for Council consideration).

185 As a result of their deliberation, the applicants decided to request a layover of this request to the
186 January 28, 2014 Planning Commission meeting and they would then work with staff to submit
187 an application for amendments to the city ordinance.

189 Mr. Glen Unruh and Ms. Jennifer Naas, 2370 Swan Drive, came forward to comment. Mr. Unruh
190 stated he agreed with staff recommendations on the application, particularly pertaining to the
191 digital signage. He then shared images of where his property is in relation to the school and the
192 proposed digital sign. He mentioned that they are already getting quite a bit of light pollution
193 from Visitation and have no desire to have any more.

195 Ms. Naas stated that it appeared to her that the Commission was trying to work with Visitation to
196 get this pushed through — something that would impact all of the neighbors located right across
197 the street from them. She does not feel that this should be pushed through at the expense of the
198 neighbors.

Par 3 Update — January
On December 17th staff went to the Par 3 clubhouse and found that a pipe had frozen, which
caused some pretty substantial water damage. Staff has been working with our insurance
company and contractors to fix the issues. So far much of the work has been done by city staff.
The revenue earned for the month of December was the remaining balance from our Groupon
offer this summer. The 2013 Par 3 Annual Report will be presented at the February meeting.
BUDGET IMPACT
The course took in $143,973 in revenue during the 2013 season. This is down just under 2%
from 2012, when the course took in $146,751.

The department responded to 21 calls for the month, bringing the total fire calls to 243 for the
year. The majority of calls were classified as false alarms or as good intent calls. Nine calls were
residential in nature, of the other calls, six were commercial, two calls were auto accidents, one
was a utility call, one was an EMS call, one call was a carbon monoxide call, and one call was
for mutual aid to Inver Grove Heights.
The mutual aid call to Inver Grove Heights was initially to stand -by at their station while they
were at the scene of a house fire. During stand -by, the crew received a fire alarm call in an
assisted living building. En route, the crew was informed that there was a car fire in the
underground parking garage. Upon arrival, the crew reported heavy smoke in the underground
garage. They advanced a hand line and attacked the fire. West Metro and Eagan fire also
assisted.
Monthly Department Training
The monthly department drill was a presentation put on by firefighter Vince Belmares. Vince
works for Xcel Energy in the gas emergency department. Vince reviewed the process for
responding to gas emergencies, and how best to use our gas monitors to monitor for natural gas.
Monthly Squad Training
The monthly squad training was our annual training called "Captain Choice ". This training
allows the squad captains a chance to address any training needs that they feel their squad needs
additional work on, or to address training requests they may receive by members of their squad.
Some captains also use this training as an opportunity to review key trainings that we have done
throughout the year.

Each year the Airport Relations Commission establishes a workplan that spells out what they
will be focused on for the upcoming year. During their January meeting, the commission
reviewed the 2013 workplan and, with the exception of a few minor grammatical and
punctuation changes, approved the same plan for 2014.

Mendota Heights Airport Relations Commission
Mendota Heights City Code (2 -4 -6) establishes the following powers and duties for the Mendota
Heights Airport Relations Commission:
A. The Airport Relations Commission shall advise the city council on matters pertaining to
airport noise and operations at Minneapolis - St. Paul International Airport (MSP).
B. The Airport Relations Commission is expected to monitor proposed rules, procedures and
programs which impact the air noise situation within the city and to make
recommendations to the city council regarding strategies to mitigate the city's air noise
exposure.
C. The Airport Relations Commission shall have such other duties and powers as granted by
the City Council from time to time. (Ord. 290, 4 -20 -1993)

In an effort to mitigate airport noise in the Mendota Heights community and assure equity of the
current runway use system, the Commission has given high priority to the following issues (not
in priority order):
1. Develop and strengthen our partnerships with the Metropolitan Airports Commission
(MAC), the Federal Aviation Administration (FAA), legislative leaders and other
government bodies regarding airport issues.
2. Monitor airport operations.
3. Work collaboratively with other communities on mutual concerns in regards to airport
development and operations.
4. Monitor implementation of Performance Based Navigation (PBN) procedures.
5. Monitor residential land use in Mendota Heights, particularly developable parcels that
may be affected by airport noise.
6. Monitor night time aircraft operations and restrictions.
7. Observe ongoing changes in fleet mix.
8. Provide oversight of 2030 Plan.
9. Provide communications to City Council and residents regarding airport issues, and
inform the City Council of pertinent issues.

It is with great pride that I announce that the new engine that council authorized at the April 16,
2013 council meeting has arrived and it is time for final payment. The truck was delivered to the
city on January 11, 2014, and the committee has completed its inspection and acceptance of the
truck. The department will be hosting an open house in the upcoming months to allow the
community the opportunity to come to the station and formally "welcome it" to the city. The fire
truck has an expected service life of 25 years. The date and time of the open house will be
included in the upcoming Heights Highlights.
BUDGET IMPACT
As Council is aware, the Council approved pre - payment of the truck that allowed us to earn
interest on our payment and result in a savings to our citizens of up to $25,200.00 depending on
the actual delivery date of the truck chassis and final delivery to the city.
At this point the total balance owed to the manufacturer, Custom Fire Apparatus, is $12,297.72
bringing the total cost of the truck (delivered) to $602,463.00 or $12,932.00 less than the bid
price of $615,395.07.
The final amount owed is impacted by two factors and below is a breakdown of cost:
A) Actual delivery date of the chassis to the manufacturer and the final delivery of truck
The actual interest credited was based on a chassis delivery on November 15, 2013,
and a final truck delivery on March 15, 2014. In actuality, the chassis was delivered
approximately 45 days early and the final truck delivery about 60 days earlier than
estimated. This resulted in an actual interest credit of $17, 404.35 instead of the
estimated $25,230.00.

B) Change orders
As with any project there are unforeseen items that come up or changes are made to
improve the project. This project was no different. The truck committee did a very good
job in writing the specifications and detailing what was needed so the unforeseen items
were few. Overall the change orders amounted to an increase of $4,108.00 in the contract
(less than 0.7% of the project cost).
While there were other minor changes, the bulk of the changes can be categorized into three
main items:
1) An unrealized savings of $1,250.00 when the old siren we were intending on
salvaging from the existing truck became unrealistic.
2) The cost of a storage system for our vehicle stabilization equipment was
$1,660.00 more than anticipated.
3) A design change that added ladders to the rear of the truck instead of the
specified steps - in the committee's opinion (and I concurred), significantly
improve firefighter safety when climbing on the truck to load hose added
$1,968.00 to the cost.
RECOMMENDATION
I recommend that City Council approve final payment of the fire truck and authorize a final
payment of $12,297.72 to Custom Fire Apparatus.

Trista Miller
Effective January 16, 2014, Trista Miller has successfully completed her one -year probationary
period as PT Police Support Specialist. Trista is doing an outstanding job and is a perfect fit for
this position. Trista has been a great asset to the city.
Trista Miller's position is a Grade Level 12 in the city's position and pay classification plan. On
January 16, 2014, Ms. Miller is at Grade Level 12, Step C with a current hourly rate of $22.58.
City staff recommends that the City Council officially appoint Trista Miller to the position of
regular, part-time Police Support Specialist, effective January 16, 2014.

City staff recommends that city council authorize the staff to begin the re -hire and recruitment
process for the above listed spring /summer 2014 Par 3, parks and recreation and public works
seasonal positions.
Item 3: Project Engineer Position
In November, city council authorized staff to begin the recruitment process for a Civil Engineer
11 position. The position was posted through December 6, 2013. After evaluating the recruitment
process, staff regrouped and reviewed the Civil Engineer I and 11 position descriptions. Staff is
proposing combining the two positions into one Project Engineer Position. This person would
join the existing city engineer and assistant city engineer currently on staff. This would provide
staff some flexibility during the recruitment process. Minimum requirements for the position
include bachelors of Science degree in Civil Engineering or its equivalent and registered as an
Engineer in Training (EIT) in the State of Minnesota. The desired qualifications include two
years' experience of progressively responsible engineering experience and professional
registration as an Engineer in the State of Minnesota.
The Project Engineer position would be assigned to a pay range of $50,559 to $76,247. This
salary range represents a combination of pay grade 19 and pay grade 28 of the 2014 Employee
Position Placement/Pay Classification Plan. By combining the two pay grades it provides staff
with an opportunity to develop a pool of well - qualified candidates and a match for the position.
The combination of the positions could also provide a candidate an opportunity to build a long-
term career with the city.
Staff is requesting council approve the position description and provide authorization to begin
the recruitment process for the Project Engineer position.
RECOMMENDATION
Staff recommends that the Mendota Heights City Council approve the actions requested above
for these three items.

Job Purpose:
This Project Engineer position This is a professional engineering position
his responsible for assisting and supporting the Engineering Division in the
planning, development, and implementation of public works improvement projects.
Incumbent is expected to organize and conduct work in accordance with City Policies
and standard professional practices, with applicable Federal, State, and local laws
and codes.
Essential Duties and Responsibilities
1. Assists the City Engineer and Assistant City Engineer in the development of public
improvement projects which include preparation of construction plans and
specifications, feasibility studies, the bidding process and assessment rolls.
2. May be required to act as project inspector and assist survey crew on public
improvement projects in progress to insure compliance with plans and
specifications. Ensures field -staff are enforcing the City's construction
specifications through field inspection and review of field inspection reports. Take
notes and make sketches of work performed and material quantities used.
3. Assists with updates to the City's asset management system, including cost
estimates and recommendations
4. Research new methods of municipal infrastructure rehabilitation, maintenance,
and construction.
5. Reviews development proposals, plans, and plats prepared by private developers
for conformity with City standards, Code, and Comprehensive Plans including
transportation, water distribution, and storm water drainage.
6. Must be able to communicate with property owners affected by construction
projects to inform them of timetables and responds to inquiries in a tactful and
helpful manner.
7. Uses computer assisted engineering and design software and equipment in
preparation of construction drawings and working details for city projects.
8. Acquire temporary and permanent easements as needed to complete

improvement projects.
9. Furnish sewer and water locations to plumbers and as -built information to
contractors /developers.
10. Service the general needs of the public in making information and records
available to them, including specific information on public utilities, pending
assessments, etc.
11. Assists in working with other public agencies concerning matters of the City, and
prepares and files applications for governmental permits
12. Responds to Resident /citizen inquiries and recommends actions as appropriate.
Provides a high level of public relations and customer service, and responds in a
quick and positive manner.
13. Responsible for preparing and executing design service and construction
contracts.
14. Assists the Public Works Director /City Engineer with the preparation and
implementation of Council and Commission memorandums and reports, the
departmental budget, and Infrastructure /Capital Improvement Plan.
15. Assist the Assistant City Engineer with managing and updating the City's
Municipal State Aid (MSA) System
16. Performs other duties and assumes other responsibilities as assigned.

Physical Activities /Requirements
Positions in this class typically require: sitting, standing, climbing, kneeling, twisting,

pressures. There is sustained exposure to computer keyboards and video screens.
Sedentary work: Exerting up to 50 pounds of force occasionally and /or a negligible

Environmental Conditions -Most work is performed in the city hall. Some driving
between work sites will be required. Most work is performed in a well -lit, well
ventilated and temperature controlled office. Noise level is at a minimum. Some work
is performed outside when working on projects. Outdoor work may constitute unstable
ground, tripping hazards, and working in close proximity to heavy equipment. Noise

Equipment and Tools- Computer, terminal, telephone, fax machine, calculator, and
other basic office machines. Outdoor project work may involve the use of tools and
survey equipment. Manually lifting and moving tools and equipment may be required.
Safety Policy

SUBJECT: Award of a Professional Services Contract for Design and Surveying of the Victoria
Road & Rolling Green Neighborhood Improvement Project
BACKGROUND
City Council, at their November 19, 2013 meeting, authorized staff to prepare plans and
specifications for the reconstruction of Victoria Road and the rehabilitation of the Rolling Green
Neighborhood. Due to a vacant engineering position, staff has requested proposals from consultants
for assistance with the preparation of plans, specifications and surveying on the project.
The RFP was published and invitations were sent to three consulting firms that specialize in
municipal work. Three proposals were received and evaluated by staff using the criteria published in
the RFP.
Bolton & Menk submitted a proposal for the design, surveying and record drawing preparation for
the project for a not -to- exceed fee of $58,890.00. The second competitive quote submitted by TKDA
engineers was $46,875.00; however, their proposal did not include the surveying portion requested in
the proposal. This additional service would increase their fee by approximately $12,000.00. The
third quote submitted by Pioneer Engineering totaled $124,700.00.
BUDGET IMPACT
The proposed contract price of $58,890 will be charged to the project which is funded through:
Special Assessments, City Bonds, Municipal State Aid, Storm Water Utility and Water Utility. The
proposed fee is around six percent of the total project cost which includes the production of plans and
specifications and construction staking only.
RECOMMENDATION
Staff recommends Council accept the proposal of Bolton & Menk, Inc. for the proposed not -to-
exceed price of $58,890.00. If Council wishes to implement the staff recommendation, pass a motion
authorizing staff to enter in to a contract with Bolton & Menk, Inc. This action requires a simple
majority vote.

Core Values Award
In 2013, employees were asked to identify four core values that we share. The shared values
include respectful, ethical, service oriented and professional. Each day, we all live these values as
we carry out the functions of the city to make Mendota Heights a quality place to live and work.
There are times when an employee exceeds standards by going the extra mile. Employees were
asked to nominate their peers who have gone the extra mile this past year. We are delighted to
announce the recipients for this year's core values awards.
Respectful — Nancy Bauer, Engineering/Public Works/Fire Department Secretary
In her nomination, Nancy was commended for her willingness to step in and help with jobs
outside of her nonnal duties, always having an attitude that is genuine and coming from the heart,
and never speaking in a disrespectful or derogatory way. The nomination closed by stating that
"Nancy has demonstrated the qualities the City of Mendota Heights looks for in an employee
throughout her career."
Ethical — Rich Burrows, Utilities Leadworker
In August of 2013, while cleaning sanitary sewer lines, Rich found a rather valuable diamond
wedding ring. Rich immediately brought the ring to the police department to see if the owner
could be located. Although the efforts to find the rightful owner were unsuccessful, Rich's
immediate regard for our residents demonstrated the ethical values we aspire towards in the City
of Mendota Heights.
Service Oriented — Sergeant Neil Garlock
For the past eight years, Sgt. Garlock has organized the Mendota Heights 5K benefiting Special
Olympics. He spends countless hours of his own time planning the event, collecting donations,
and working with the police department to make sure that the race goes smoothly. Over the
years, due to the efforts of Sergeant Garlock, tens of thousands of dollars have been raised and
donated to Special Olympics. In addition, the race has become a tradition for hundreds of
runners and walkers and continues to grow each year.
Professional — Cliff Kirchner, Public Works Mechanic
In the words of the employee nominating Cliff, he is the most valuable employee in the city. By
keeping the city's fleet of vehicles and equipment running smoothly, the most visible operations
of the city can continue without fear of mechanical failure. He does not hesitate to drop what he
is doing to move to a job that requires immediate attention, and is always willing to come in
during off -hours and make the repairs necessary to keep his fellow employees working.
ACTION REQUIRED
If the city council agrees with staff recommendation, the mayor will present a letter, certificate
and gift to each employee during the city council meeting.

Advisory Commission Members
The City of Mendota Heights is served by three commissions which are advisory to the city
council. Members of the airport relations commission, parks and recreation commission and
planning commission appointed by the city council serve three year terms. The following
commissioners are at the end of their current term and eligible for reappointment:
Planning Commission: Howard Roston and Mike Noonan
Airport Relations: Kevin Byrnes, Gina Norling and Jim Neuharth
Parks and Recreation: David Miller
Each of these commissioners has expressed their interest in serving an additional three -year term
with their respective commissions.
This evening the City Council also interviewed Mr. Jackson Evans for a three year term on the
parks and recreation commission. After meeting with Mr. Evans, the city council may consider
adding his name in the attached resolution.

RECOMMENDATION
Staff recommends reappointing commissioners Howard Roston, Mike Noonan, Kevin Byrnes,
Gina Norling, Jim Neuharth and David Miller. The city council may also consider appointing
Mr. Evans to the parks and recreation commission. If city council wishes to implement the
recommendation, pass a motion adopting RESOLUTION 2014 -05, A RESOLUTION
APPOINTING ADVISORY COMMISSION MEMBERS. This action requires a simple
majority vote.

A RESOLUTION APPOINTING ADVISORY COMMISSION MEMBERS
WHEREAS, the City Council of the City of Mendota Heights benefits from the active
participation of citizens in our advisory commissions; and
WHEREAS, the City Council recognizes the excellent service provided by the following
commission members /representatives whose terms expire in January 2014.
WHEREAS, the City Council interviewed one candidate for a vacancy that exists on the
parks and recreation commission for a full term starting in February 2014.
NOW THEREFORE, BE IT IS HEREBY RESOLVED by the City Council of the

SUBJECT: Resolution of Support for Dakota County Proposed Pedestrian Underpass
BACKGROUND
Dakota County has approved a master plan to connect communities and resources across the
county via greenways — trails that are buffered by natural landscapes — called the
Mendota/Lebanon Hills Greenway Master Plan. Part of this plan would establish a greenway
trail through Mendota Heights; specifically, it would establish a pedestrian underpass (tunnel)
under Highway 110 somewhere in the vicinity of Dodd Road to connect the greenway to the
North Urban Regional Trail.
City staff presented a brief overview of the master plan to City Council at your June 4th, 2013
meeting, and County staff presented a more detailed report to the Council during a workshop
held on July 16th. The County is seeking a grant from the Metropolitan Council for construction
of the underpass in 2017. This construction year would coincide with the planned Minnesota
Department of Transportation (MnDOT) project to rehabilitate (resurface) Highway 110. The
attached resolution would offer the City of Mendota Heights' support for the grant application.
Representatives from Dakota County and MnDOT will be present to discuss the proposed project
and grant application.
BUDGET IMPACT
None.
RECOMMENDATION
Staff recommends Council hear the County's proposal, and if Council wishes to support the
grant application, adopt the attached Resolution 2014 -06 - A RESOLUTION SUPPORTING
DAKOTA COUNTY GRANT APPLICATION FOR A PEDESTRIAN UNDERPASS
CROSSING OF HIGHWAY 110 by a simple majority vote.

A RESOLUTION SUPPORTING DAKOTA COUNTY GRANT APPLICATION
FORA PEDESTRIAN UNDERPASS CROSSING OF HIGHWAY 110
WHEREAS Dakota County has developed and adopted the Mendota to Lebanon Hills
Regional Greenway Master Plan, which recommends a pedestrian underpass under State Trunk
Highway 110; and
WHEREAS the proposed underpass would provide a critical link between the North
Urban Regional Trail and the planned Mendota Lebanon Hills Regional Greenway; and
WHEREAS the Minnesota Department of Transportation (MnDOT) is planning a
rehabilitation of Highway 110 in 2017 and has indicated a willingness to incorporate the
underpass into the design and construction of their project at the County's expense; and
WHEREAS coordination of the underpass construction with the MnDOT rehabilitation
project would provide significant cost savings and increase the efficiency of construction; and
WHEREAS Dakota County has requested a statement of support from the City of
Mendota Heights for a Federal Transportation Alternatives Program grant to secure $1 million to
be applied to the pedestrian underpass project; and
WHEREAS Dakota County has committed to providing the local funding match
required of any grant received, as well as to owning and maintaining the underpass as part of the
regional greenway system.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that
the City of Mendota Heights supports the efforts of Dakota County in obtaining grant money to
construct a pedestrian underpass in the vicinity of the highway's intersection with Highway 149
(Dodd Road).
Adopted by the City Council of the City of Mendota Heights this 21st day of January 2014.
