Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present:

E) RECEIPT OF NOVEMBER 2013 FIRE DEPARTMENT SYNOPSIS REPORT
Councilmember Duggan mentioned he was concerned with the number of gas cylinders at the location
of the fire outlined in the Fire - Rescue Incident of Interest Report. He believes that if homes are going to
have more than two or three cylinders of gas, the City should consider requiring notification to the fire
department for safety considerations.
City Administrator Justin Miller replied that staff could look into that and report back to the Council at a
later date.
Councilmember Duggan moved to acknowledge receipt of November 2013 Fire Department Synopsis
Report.

H) APPROVAL OF 2013 MENDOTA HEIGHTS ATHLETIC ASSOCIATION CONTRIBUTION
City Administrator Justin Miller explained that over the past several years the City has budgeted to fund
the Mendota Heights Athletic Association. In 2013, the City budgeted $10,000 which was consistent
with what was budgeted in the past. Last year, the City started to ask for more documentation from the
athletic association. Staff developed a form that was completed by the association detailing the
information requested.
Mr. John Masica from the Mendota Heights Athletic Association commented that the association is
growing and the soccer program has almost doubled in the last two years with 537 participants. A lot of
volunteers and hours go into making everything in the association happen, between coaches, assistant
coaches, commissioners for each sport and the board of directors.
Councilmember Duggan moved to approve a $10,000 contribution to the Mendota Heights Athletic
Association.

K) APPROVAL OF RESOLUTION 2013 -98, 2014 SANITARY SEWER UTILITY RATE
ADJUSTMENTS
City Engineer John Mazzitello stated that the City has adopted a five -year Sanitary Sewer Improvement
and Maintenance Plan (SSIMP) and part of that plan is an annual analysis of the revenues taken in by
the utility compared to the anticipated expenditures. The largest expenditure is the amount paid to the
Metropolitan Council Environmental Services for the contribution the City makes to the sewage
treatment plants for the metro area. The estimated MCS bill for 2014 is in excess of $1M; typically it
increases from 3% to 5% per year. At the end of each year staff analyzes the utility account for its
revenues and anticipated expenditures, and for the 2014 budget year staff is anticipating the necessity to
raise the sewer rates by 5 %. This would equate to a $3.00 per quarter increase of the base rate for
residential sewers. The base rate gets a resident the first 15,000 gallons of water consumption, and for
every 750 gallons over the first 15,000, an additional $2.15 is the proposed rate. Engineer Mazzitello
also reviewed the commercial rates which are proposed at a 5% increase. With these increases, the fund
should balance for 2014.
Mayor Krebsbach asked if this was the utility fund that the City subsidized for many years. Mazzitello
replied in the affirmative. The fund ran in a deficit from 1994 to 2010; which is when a major sewer fee
increase took place to make up the balance. It has been moderated year to year ever since.
Councilmember Duggan asked what the percentage increase difference was in residential in the last
couple of years. Mazzitello replied that since the rate increase of 2010, which was substantial, the City
has raised rates 5% per year for 2011, 2012, 2013, and proposed for 2014. Councilmember Duggan
asked for a comparison to similar sized cities. Mazzitello stated that in 2013, Mendota Heights had the
lowest residential base rate in Dakota County. He anticipates that would remain the same in 2014.

Councilmember Duggan asked if there was a way for the City to construct its own system. Mazzitello
replied that it would take a very large quantity of land and a tremendous amount of money.
When questioned by Mayor Krebsbach, City Attorney Tom Lehmann confirmed that the City is part of
the Municipal Urban Service Area (MUSA); and that the Metropolitan Council Environmental Services
has full jurisdiction of the wastewater treatment system within the MUSA.
Councilmember Duggan moved to adopt Resolution 2013 -98, A RESOLUTION AUTHORIZING
SANITARY SEWER USAGE RATES BEGINNING IN THE 1st QUARTER OF 2014.

City Engineer John Mazzitello stated that notice of the rate increase would be sent out with the January
2014 bills and the increase would take effect for the April 2014 billing cycle.
N) APPROVAL OF RESOLUTION 2013 -85, FINAL PAYMENT FOR
MARIE AVENUE STREET IMPROVEMENTS
Councilmember Duggan noticed that there was a savings in the contract and wondered what would
happen to it. Finance Director Kristen Schabacker replied that once all construction costs have been
completed for a project, any remaining funds would get closed out into the debt service for that project.
So it would go towards paying down the City's debt.
Councilmember Duggan moved to adopt RESOLUTION 2013 -85 RESOLUTION ACCEPTING
WORK AND APPROVING FINAL PAYMENT FOR MARIE AVENUE REHABILITATION (EAST
OF DODD RD) IMPROVEMENT #201107 IN THE AMOUNT OF $50,463.88, TO HARDRIVES,
INC. OF ROGERS, MINNESOTA.
Councilmember Petschel seconded the motion.

0) APPROVAL OF PURCHASE OF STREET LIGHT POLES
Councilmember Duggan asked if there were any recycled or less expensive light poles available rather
than brand new ones. City Engineer John Mazzitello replied that typically a street light pole is not
removed until it is at the end of its useful life. As a general rule, they are hard to come by.
Councilmember Duggan moved to authorize the City Administrator to issue a `not -to- exceed' purchase
order in the amount of $10,172.00 for the purchase of four utility poles.

P) ACCEPTANCE OF FIREFIGHTER RETIREMENTS
Mayor Krebsbach, referring to a memo from Fire Chief John Maczko, explained that Firefighter Mike
Coonan and Firefighter Ron Katzenmaier have announced their retirement from the Fire Department.
Firefighter Coonan served for 33 years and also served in the capacity of Firefighter Chaplain.
Firefighter Ron Katzenmaier served for 19 years and was integral in many of the firefighters' volunteer
efforts. It was with regret that the City accepted their retirement.
Each of them will be recognized at the Firefighters' Fire Relief Dinner in February 2014.
Councilmember Duggan moved to regretfully accept the retirement of Mike Coonan effective January
17, 2014 and to formally thank Mike and his family for his 33 years of service to our community as a
Mendota Heights Firefighter; and to regretfully accept the retirement of Ron Katzenmaier effective
December 31, 2013 and to formally thank Ron and his family for his 19 plus years of service to our
community as a Mendota Heights Firefighter.

PUBLIC COMMENTS

UNFINISHED AND NEW BUSINESS
A) RESOLUTION 2013 -88, ADOPT 2014 BUDGET AND PROPERTY TAX LEVY
Finance Director Kristen Schabacker explained that the public hearing was held at the last Council
meeting regarding the levy and budget for 2014. Union contracts have been settled and the final budget
reflects these contracts. The final levy would be at $6,603,749, a 2.92% increase; and the total budget
would be $11,603,972, a 3.49% increase.
Councilmember Povolny moved to adopt RESOLUTION 2013 -88 APPROVING FINAL 2013 TAX
LEVY COLLECTIBLE IN 2014 AND ADOPTING PROPOSED BUDGET FOR 2014.
Councilmember Petschel seconded the motion.

B) DESIGNATION OF CONSULTANT PLANNER
City Administrator Justin Miller explained that earlier this year the Council approved a Request for
Proposal (RFP) for a consultant planner. Seven proposals were received. The Council interviewed three
candidates before this meeting; Northwest Associated Consultants, Inc., Landform Professional
Services, LLC, and Stantec Consulting Services, Inc.

Staff requested Council, if they have made a selection, adopt a motion directing staff to negotiate a
contract with the selected consultant. The formal contract would then be brought back before the
Council at their next meeting.
Councilmember Petschel moved to direct staff to negotiate a professional services contract with Stantec
Consulting Services, Inc. as the City's Planning Consultant.

C) ORDINANCE 454, GARAGE CODE AMENDMENTS
City Planner Nolan Wall presented the proposed ordinance amendments, which were discussed at the
October 29 City Council Workshop. Staff was directed to develop potential amendments for review by
the Council. The following issues were addressed in the proposed ordinance amendment:
o Multiple garages- One attached and one detached private garage would be allowed as accessory
buildings on residential properties .75 acres or greater.
o Detached garage size- The permitted and conditional detached garage sizes would be determined by
lot size. No single family parcel would be allowed to have a total garage floor space (detached and
attached) that exceeds 1,800 square feet or the finished square footage of the principal structure,
whichever is less.
o Garage door size- As proposed in previous draft amendments, 36 lineal feet of garage door is
permitted. More than 36 lineal feet is permitted by conditional use permit if it is not visible from a
public street or surrounding residential properties.
Councilmember Duggan asked for clarification on the total maximum garage floor space, which Planner
Wall provided.
Mayor Krebsbach asked about future lot splits and the possibility of lots then becoming noncompliant.
Planner Wall replied that staff would need to take into consideration the impacts of the lot split and how
that might impact their potential for additional accessory structures. Planner Wall confirmed that a lot
split could create a garage that is legal non - conforming. Mayor Krebsbach stated that on this point alone
she would oppose the garage code amendments. However, she commended the committee that worked
on this proposal and the Planning Commission.
Councilmember Duggan moved to adopt ORDINANCE NO. 454 AN ORDINANCE AMENDING
SECTION 12 -1D -3 OF THE CITY CODE, BY AMENDING THE ALLOWABLE PRIVATE
GARAGE SIZES ON RESIDENTIAL PROPERTY.
Councilmember Petschel seconded the motion.
Councilmember Norton asked, in regards to the 1,800 square feet total, if the number is smaller than his
recollection. He would like to see that number changed to reflect what is permitted in the table [included
in the Council packet]. Councilmembers Petschel and Povolny agreed. It was agreed that item 4 in the
resolution would be changed to read: `(4) Notwithstanding the size allowances in Subparagraph

C.1.b.(3) above, no single family parcel shall have total attached and detached garage floor space that
exceeds 1,800 square feet or the finished square footage of the principal structure, whichever is less'.
Councilmember Norton continued by stating that he would like to see the square footage limits be
foundation size rather than floor space. He would like to see it changed from up to 1,200 square feet to
say `up to 1,200 square footprint'. This would avoid people building detached garages if they could have
a garage structure that is multi -story that could accommodate their needs, and from the street it would
look like a three stall garage. This amendment would change the square footage requirements to square
footprint requirements.
Administrator Miller suggested that item 3 would be changed to read: `(3) Detached private garage. One
detached private garage may be allowed on residential property as a second garage by permitted use, or
by conditional use permit, with floor area garage square footprint up to the limits...' Councilmember
Norton agreed but suggested it should be changed throughout to make it clear.
Mayor Krebsbach suggested staff revise the ordinance with the suggestions from Councilmember
Norton and bring it back to the Council's first meeting in January.
Councilmember Duggan withdrew his motion.
Councilmember Norton moved to table the adoption of ORDINANCE NO. 454 AN ORDINANCE
AMENDING SECTION 12 -1D -3 OF THE CITY CODE, BY AMENDING THE ALLOWABLE
PRIVATE GARAGE SIZES ON RESIDENTIAL PROPERTY and giving direction to staff to strike the
1,800 square foot provision (4) as well as making the necessary corrections to the square footprint
allotments so that it is clear that it would be footprint rather than a garage area square footage, and to
bring this back to Council at the first meeting in January 2014.
Councilmember Duggan seconded the motion.

Discussion was had on the potential for lots being split and creating a non - conforming use. Counsel
Lehmann stated he would research the topic and provide the Council with a memo by the next meeting.
COMMUNITY ANNOUNCEMENTS
Assistant City Administrator Tamara Schutta made the following announcements:
• Donations to Toys for Tots should be made by noon on December 19. Toys can be brought to City
Hall or to the Police Department.
• Ice rinks are open and so are the warming houses.
• Citizens interested in serving on the Parks & Recreation Commission should submit a letter of
interest and a resume to City Administrator Justin Miller by Friday, January 10, 2014.
• City Hall will be closed on December 24 and 25 and on January 1.
• Residents have an opportunity to participate in a focus group with NDC4 on January 14, 15, and 16,
2014. NDC4 would like to hear from residents on what they think the biggest issues are that are
facing this community and what is their vision for local media in Northern Dakota County. The
current franchise agreement will end in 2015.

COUNCIL COMMENTS
Councilmember Povolny wished everyone a Happy Holiday and Happy New Year.
Councilmember Duggan wished everyone a Happy Christmas and Happy Holidays. He also requested
that residents with fire hydrants in front of their homes please clear the snow away from them.
Councilmember Duggan stated the cable commission has a wonderful group of volunteers and an
outstanding executive director. Participating in a focus group is a great opportunity to let the board
know things you would like to see on cable television.
Councilmember Duggan commented that the St. Thomas Academy athletes are volunteering to help
shovel snow for the elderly and the disabled.
Councilmember Petschel wished everyone Happy Holidays. She was excited to see the end -of -year
report from the Parks & Recreation Commission and that Recreation Program Coordinator Wallgren is
going to work on setting up a kickball league for young adults.
Councilmember Norton wished everyone a Merry Christmas and a Happy New Year.
Mayor Krebsbach joined in with everyone on the Christmas greetings. She also noted that the Par 3 may
possibly be set up for Nordic skiing through St. Thomas Academy.
She thanked all of the staff, police, firefighters, volunteer reserves, and public works for all of their hard
work. She also mentioned that there would be a celebration for Mr. Paul Berg, Building Official, on
December 18. He is retiring after 34 years with the City.

SUBJECT: Designation of Official Newspaper
BACKGROUND
Minnesota Statutes §412.831 requires that the City Council, at its first meeting of the year,
designate a legal newspaper of general circulation in the City as its official newspaper.
Ordinances, financial reports, public notices, and other information as required by law, as well as
matters the Council deems necessary shall be published in the City's designated official
newspaper.
The South -West Review meets the requirements for a qualified newspaper under Minnesota
Statutes §331A.02. The South -West Review is currently designated as the City's official
newspaper. The publisher, Lillie Suburban News has expressed an interest in continuing that
designation for the city. Attached is a quote from Lillie Suburban which has been serving the
city of Mendota Heights for the past 34 years. To date we have received excellent service in
addition to accurate and timely processing of all legal and official publications. The South -West
Review is also the official newspaper for the cities of West St. Paul, Inver Grove Heights,
Mendota, and Lilydale.
The legal publication rates proposed for 2014 are $7.00 per column inch for a one -time
publication. $6.75 per column inch is proposed for each additional publication of the same
article or notification. The 2013 rates were $6.55 and $6.30 respectively.
RECOMMENDATION
Staff recommends the City Council designate the South -West Review as the city's official
newspaper for 2014. This action requires a majority vote of the city council.

BACKGROUND
It is recommended that the city annually approve an out -of -state travel policy for all city
councilmembers and employees. The city council approved the attached policy by resolution
2012 -50 in July 2012. The policy has worked well and staff is recommending that the city
council affirm it.
BUDGET IMPACT
All out -of -state travel is budgeted and approved beforehand by the city council.
RECOMMENDATION
Staff recommends the council approve the attached out -of -state travel policy, originally approved
by Resolution 2012 -50. This action requires a majority vote.

Travel Authorization and Expense Reimbursement Policy
Purpose: The City of Mendota Heights recognizes that its employees and elected officials may at
times receive value from traveling outside the seven - county metropolitan area for workshops,
conferences, events and other assignments. This policy sets forth the conditions under which for
in -state overnight travel and out -of -state travel will be reimbursed by the City.
General Guidelines:
1. All travel by Mendota Heights employees requires either the approval of the City Council,
the City Administrator and /or the Department Head of the employee.
2. All in -state conferences, seminars, workshops, training or other educational related expenses
in excess of $1,000.00 (to include estimated travel related expenses), shall require the
approval of the City Council. All in state training, seminars, etc., in excess of $500.00 or
requiring an overnight stay, shall require the approval of the City Administrator.
3. All out -of -state conferences, seminars, workshops, training or other educational related
expense must be approved in advance by the City Council at an open meeting and must
include an estimate of the cost of the travel. In evaluating the out -of -state travel request, the
Council will consider the following:
• Whether the elected official or employee will be receiving training on issues relevant to
the city or to his or her role;
• Whether the elected official or employee will be meeting and networking with other
officials from around the country to exchange ideas on topics of relevance to the City or
on the official roles city officials.
• Whether the elected official or employee has been specifically assigned to testify on
behalf of the city or to otherwise meet with officials on behalf of the city.
• Whether the city has sufficient funding available in the budget to pay the cost of the trip.
4. No reimbursements will be made for attendance at events sponsored by or affiliated with
political parties.
5. The city may make payments in advance for airfare, lodging and registration if specifically
approved by the council. Otherwise all payments will be made as reimbursements to the
elected official or employee.
6. Conference Registration Fees — if the conference fee was not prepaid, City of Mendota
Heights will reimburse these fees, including business related banquets or meals that are part
of the conference registration. Original receipts to support the payment are required. If the
conference does not provide a receipt, a canceled check, credit card slip /statement, or
documentation that the amount was paid is required for reimbursement.

Entertainment activities such as golf outings and sightseeing tours will not be reimbursed.
7. Airfare — if the airfare was not prepaid, an original itemized airline receipt, an e- ticket
receipt/statements, or an interne receipt/statement is required for reimbursement. Airfare will
be reimbursed at the coach rate.
8. Automobile (Personally owned) - Mileage will be reimbursed at the IRS rate. If two or more
people travel together by car, only the driver will receive reimbursement. The city will
reimburse for the cost of renting an automobile if necessary to conduct city business.
Commercial rental vehicle will be reimbursed for entry -level or the most economic vehicle
available. Original receipts are required for reimbursement.
9. Lodging costs will be reimbursed at reasonable, single occupancy or standard business room
rates. When the hotel or motel is the conference or convention site, reimbursement will be
limited to the conference rate.
10. Meals costs reimbursement will be based on the U.S. General Services Administration (GSA)
guidelines that vary by city location. Meals will be reimbursed up to the amount based on
current GSA rates (i.e. if the GSA per diem amount for breakfast is $7.00, the reimbursement
will be up to $7.00 for breakfast). Meal per diem includes all taxes and tips. Original
itemized receipts are required for reimbursement.
11. Receipts are required for lodging, airfare, meals, and vehicle rental (if applicable) should
accompany an expense report form. The expense report form shall be submitted to the
Finance Department for payment within two weeks after the trip was completed.
12. The city will not reimburse for alcoholic beverages, personal telephone calls, costs associated
with the attendance of a family member, rental of luxury vehicles, meal expenses included in
the cost of registration, or recreational expenses such as golf or tennis.

The applicant has applied for a lot split for the unaddressed parcel behind his residence at 1349
Knollwood Lane. The unaddressed parcel, owned by Robert Hockett of 1335 Knollwood Lane, is
approximately 0.58 acres and landlocked. The two property owners wish to subdivide the portion of the
parcel bordering the McEllistrem parcel, detaching it and combining it with to the McEllistrem parcel at
1349 Knollwood Lane.
The portion being subdivided and joined with the McEllistrem parcel totals approximately 6,994 square
feet. The remaining 17,713 square feet would remain under existing ownership. Neither parcel is, or
would be, buildable as a separate parcel.
The Planning Commission conducted a public hearing at the December 16 meeting. There were no public
comments.

Background and Description of Request:
Robert Hockett, owner of a single family residence at 1335 Knollwood Lane is also the
owner of a landlocked parcel to the west of his residence. That parcel is approximately
99.95 feet deep (east to west) and 248 feet long (north to south). The parcel also
adjoins the rear line of his neighbor to the south, Michael McEllistrem at 1349
Knollwood Lane. The two property owners wish to subdivide the portion of the parcel
that lies behind the McEllistrem residence, detaching it from the Hockett parcel and
joining it to the McEllistrem property.
The portion of the property in question is about 70 feet in length by just under 100 feet,
a total of about 6,994 square feet. The remaining 17,713 square feet would remain in

the ownership of Mr. Hockett. Neither parcel is or would be buildable as a separate
parcel.
Analysis:
The existing property is a legal non - conforming parcel, due to its lack of frontage on any
public street. The division of such parcels raises only the concern that property owners
understand that no new building rights are granted as a result of the subdivision. To
help ensure that this is made clear, it is common to require that new parcels created by
such actions are immediately recombined with other adjoining property.
The Subdivision Ordinance permits the approval of such subdivisions by metes and
bounds descriptions as proposed, rather than full plat. Where no new building site is
being created, the minor subdivision is consistent with the requirements of the City's
development regulations.
Action Requested:
The Planning Commission may consider the following action:
1. Approval of a subdivision for Robert Hockett and Michael McEllistrem, splitting a
6,994 square foot parcel from land owned by Mr. Hockett and conveyed to Mr.
McEllistrem, with the condition that the newly created parcel is concurrently
combined with the McEllistrem property at 1349 Knollwood Lane.
Staff Recommendation:
Staff recommends approval of the subdivision, with the condition of recombination as
noted.

SUBJECT: Resolution 2014 -01 Approving Revised Fee Schedule
BACKGROUND
City staff has reviewed the current fee schedule which was last approved on January 8, 2013.
The significant amendments to the fee schedule are as follows:
Recycler Containers - these are now the larger containers and are given out by the licensed garbage
haulers.
Wireless Facility Leases — rather than having fees set, these rates would be negotiated based on
market conditions
Tobacco licenses — with the recent ordinance change, tobacco licenses are now renewed on an annual
basis and will include an investigation of the licensee each year. A survey was completed of
the tobacco fees for area cities.
Vehicle impound — proposed to charge the current tow rate plus tax.
Storm Sewer Utility Charges for residential and commercial /industrial — fees were updated by
Resolution 2012 -114 on December 18, 2012.
Par 3 - 20 round pass has been changed to a 10 round pass, which is more frequently requested.
Pull Cart rental fee has been increased from $2 to $3 per round.
RECOMMENDATION
Staff recommends that the City Council approve Resolution 2014 -01 Revising the Schedule of
Fees for Services. This action requires a majority vote of the city council.

WHEREAS, the City of Mendota Heights adopted Resolution 2013 -03 "Revising
Schedule of Fees for Services" on January 8, 2013; and
WHEREAS, the City of Mendota Heights has established by City Code that all
fee requirement established be brought forth by resolution; and
WHEREAS, the cost of services provided escalates and new services require a
fee to be set; and
WHEREAS, it is appropriate that fees be revised to cover the escalating costs of

INTRODUCTION:
The City of Mendota Heights Police Department currently uses Local Government Information
Systems Association (LOGIS) for part of the software necessary to run the police records. In
2014 it will be upgraded.
BACKGROUND:
The city purchases mobile connectivity software and mobile computer aided dispatch software
from LOGIS. The Dakota Communications Center (DCC) contracts with LOGIS for the
Computer Aided Dispatch (CAD) component of the software. The mobile piece ensures that we
are able to communicate with the DCC and LOGIS via mobile computers.
An upgrade process has been planned since shortly after the December 2012 unsuccessful
upgrade. The conversion process has started and will continue to move rapidly to ensure that we
are ready for the update. The project has been carefully planned for and other than this
expenditure there should be no further costs other than staff time to convert software.
ATTACHMENTS:
LOGIS letter explaining the payment options and election form.
BUDGET IMPACT
The City received a refund from the previous unsuccessful upgrade and we are applying that
refund to this assessment. The remainder was included in the approved 2014 budget.
ACTION REQUIRED:
Authorize staff to sign the form and make a lump sum payment of $42,770 to LOGIS for the
2013 Public Safety Replacement project. This action requires a majority vote of the city council.

The LOGIS Board of Directors approved the special assessment for the 2013 Public Safety
Replacement Project at their July 25, 2f}13 wing. The Board also approved ° the parameters for
1) negotiating a contract with the selected vendor and 2) providing the financing for the project.
The LOGIS Executive Committee met Friday November 22, 2013 to review the contract
proposal developed by TriTech and LOGIS staff The contract was approved within the cost
estimates used to develop the member special assessment, completing item #1,
The preliminary "assessment payment preference" form distributed in July needs to be updated
with your "election" for payment terms. The first payment date will be February 1, 2014.
Members electing to pay the assessment in annual installments of up to five years should note;
subsequent annual payment installments are due each February 1st and will include simple
interest at a rate of 2.5 % to 3.25% per annum. Staff is working with Springsted representatives to
complete the financing arrangements to complete item #2 and finalize the interest rate.

BACKGROUND
At the December 17 Council meeting, Staff was directed to negotiate a professional services contract with
Stantec Consulting Services, Inc. for consulting planning services. Attached is the original contract
received on December 19. After review by Staff and the City Attorney, the following amendments have
been agreed upon by Stantec:
1. Contract agreement and commencement dates are consistent with January 7, 2014. (Page
1 /Attachment A)
2. DESCRIPTION OF WORK (Page 1): Second sentence amended as follows: Stantec may at its
discretion "after consultation and agreement by client" engage subconsultants...
3. CLIENT'S RESPONSIBILITIES (Page 1): Second paragraph amended as follows: When
required by Stantec "and approved by client," the client shall engage specialist consultants
directly...
4. LIMITATION OF LIABILITY (Page 3): First full paragraph of page 3 will be deleted.
S. DOCUMENTS (Page 3): Paragraph amended to include "documents prepared for and on behalf
of client are the property of the client unless specifically designated prior to being prepared and
after consultation and agreement by all parties."
6. DISPUTE RESOLUTION (Page 3 -4): Third sentence amended as follows: If a dispute cannot be
settled within a period of thirty (30) calendar days with the mediator, if mutually agreed, the
dispute "may" be referred to arbitration...
7. The language on Page 4 regarding the limiting liability provisions will be deleted.
The amended version of the contract was not available at the time of the packet publication. However, we

BUDGET IMPACT
The City is requesting consulting planning services on an hourly, as needed basis. If necessary, the City
may also request specific proposals for project planning with the contracted consultant.
RECOMMENDATION
Staff recommends that the City Council pass a motion APPROVING THE AMENDED

PROJECT NAME (the "PROJECT "):
Mendota Heights Professional Planning Services
DESCRIPTION OF WORK: Stantec shall render the services described in Attachment "A" (hereinafter called the
"SERVICES ") in accordance with this AGREEMENT. Stantec may, at its discretion and at any stage, engage
subconsultants to perform all or any part of the SERVICES. The CLIENT and Stantec by written amendment to this
AGREEMENT may from time to time make changes to the SERVICES. All changed work shall be carried out under this
AGREEMENT. The time for completion of the SERVICES shall be adjusted accordingly.
COMPENSATION: Charges for the SERVICES rendered will be made in accordance with the CONTRACT PRICE indicated
in Attachment "A ", or, if no CONTRACT PRICE is indicated, in accordance with Stantec's Schedule of Fees and
Disbursements in effect from time to time as the SERVICES are rendered.
Invoices shall be paid by the CLIENT in the currency of the jurisdiction in which the SERVICES are provided without
deduction or setoff upon receipt. Failure to make any payment when due is a material breach of this Agreement and
will entitle Stantec, at its option, to suspend or terminate this Agreement and the provision of the SERVICES. Interest will
accrue on accounts overdue by 30 days at the lesser of 1.5 percent per month (18 percent per annum) or the
maximum legal rate of interest.
REPRESENTATIVES: Each party shall designate in the space provided above a representative who is authorized to act on
behalf of that party and receive notices under this AGREEMENT, Such representatives have complete authority to act
on behalf of their principals in respect to all matters arising under this AGREEMENT.
NOTICES: All notices, consents, and approvals required to be given hereunder shall be in writing and shall be given to
the representatives of each party. All notices required by this AGREEMENT to be given by either party shall be deemed
to be properly given and received within two (2) business days if made in writing to the other party by certified mail,
telegram, email, facsimile or telex, addressed to the regular business address of such party as identified above.
CLIENT'S RESPONSIBILITIES: The CLIENT shall provide to Stantec in writing, the CLIENT's total requirements in connection
with the PROJECT, including the PROJECT budget and time constraints. The CLIENT shall make available to Stantec all
relevant information or data pertinent to the PROJECT which is required by Stantec to perform the SERVICES. Stantec
shall be entitled to rely upon the accuracy and completeness of all information and data furnished by the CLIENT,
including information and data originating with other consultants employed by the CLIENT whether such consultants are
engaged at the request of Stantec or otherwise. Where such information or data originates either with the CLIENT or its
consultants then Stantec shall not be responsible to the CLIENT for the consequences of any error or omission contained
therein.
When required by Stantec, the CLIENT shall engage specialist consultants directly to perform items of work necessary to
enable Stantec to carry out the SERVICES. Whether arranged by the CLIENT or Stantec, these services shall be deemed
to be provided under direct contracts to the CLIENT unless expressly provided otherwise.
The CLIENT shall give prompt consideration to all documentation related to the PROJECT prepared by Stantec and
whenever prompt action is necessary shall inform Stantec of CLIENT's decisions in such reasonable time so as not to
delay the schedule for providing the SERVICES.
When applicable, the CLIENT shall arrange and make provision for Stantec's entry to the PROJECT site as well as other
public and private property as necessary for Stantec to perform the SERVICES. The CLIENT shall obtain any required

approvals, licenses and permits from governmental or other authorities having jurisdiction over the PROJECT so as not to
delay Stantec in the performance of the SERVICES.
STANTEC's RESPONSIBILITIES: Stantec shall furnish the necessary qualified personnel to provide the SERVICES. Stantec
represents that it has access to the experience and capability necessary to and agrees to perform the SERVICES with
the reasonable skill and diligence required by customarily accepted professional practices and procedures normally
provided in the performance of the SERVICES at the time when and the location in which the SERVICES were
performed. This undertaking does not imply or guarantee a perfect PROJECT and in the event of failure or partial failure
of the product of the SERVICES, Stantec will be liable only for its failure to exercise diligence, reasonable care and
professional skill. This standard of care is the sole and exclusive standard of care that will be applied to measure
Stantec's performance. There are no other representations or warranties expressed or implied made by Stantec. In
particular, but not by way of limitation, no implied warranty of merchantability or fitness for a particular purpose shall
apply to the SERVICES provided by Stantec nor shall Stantec warrant or guarantee economic, market or financial
conditions, proforma projections, schedules for public agency approvals, or other factors beyond Stantec's reasonable
control. Stantec does not warrant the SERVICES to any third party and the CLIENT shall indemnify and hold harmless
Stantec from any demands, claims, suits or actions of third parties arising out of Stantec's performance of the SERVICES.
In performing the SERVICES under this AGREEMENT, Stantec shall operate as and have the status of an independent
contractor and shall not act as, or be an employee of the CLIENT.
The SERVICES performed by Stantec shall be subject to the inspection and the review of the CLIENT at all limes but such
inspection and review shall not relieve Stantec from its responsibility for the proper performance of the SERVICES.
TERMINATION: Either party may terminate this AGREEMENT without cause upon thirty (30) days' notice in writing. If either
party breaches this AGREEMENT, the non - defaulting party may terminate this AGREEMENT after giving seven (7) days'
notice to remedy the breach. On termination of this AGREEMENT, the CLIENT shall forthwith pay Stantec for the SERVICES
performed to the date of termination. Non - payment by the CLIENT of Stantec's invoices within 30 days of Stantec
rendering same is agreed to constitute a material breach of this AGREEMENT and, upon written notice as prescribed
above, the duties, obligations and responsibilities of Stantec are terminated.
SUSPENSION OF SERVICES: If the project is suspended for more than thirty (30) calendar days in the aggregate, Stantec
shall be compensated for services performed and charges incurred prior to receipt of notice to suspend and, upon
resumption, an equitable adjustment in fees to accommodate the resulting demobilization and remobilizatlon costs. In
addition, there shall be an equitable adjustment in the project schedule based on the delay caused by the suspension.
If the PROJECT is suspended for more than ninety (90) days, Stantec may, at its option, terminate this agreement upon
giving notice in writing to the CLIENT.
ENVIRONMENTAL: Except as specifically described in this AGREEMENT, Stantec's field investigation, laboratory testing
and engineering recommendations will not address or evaluate pollution of soil or pollution of groundwater.
BUILDING CODES, BYLAWS AND OTHER PUBLIC REGULATIONS: Stantec shall, to the best of its ability, interpret building
codes, by -laws and other public regulations as they apply to the PROJECT and as they are published at the lime
SERVICES commence. Furthermore, Stantec shall observe and comply with all applicable laws, ordinances, codes and
regulations of government agencies, including federal, state, provincial, municipal and local governing bodies having
jurisdiction over the conduct of the SERVICES ( "LAWS "). However, it is expressly acknowledged and agreed by the
CLIENT that as the PROJECT progresses such building codes, by -laws, other public regulations and LAWS may change or
the interpretation of any public authority may differ from the interpretation of Stantec, through no fault of Stantec, and
any extra costs necessary to conform to such changes or interpretations during or after execution of the SERVICES will
be paid by the CLIENT.
Stantec shall continue to provide equal employment opportunity to all qualified persons and to recruit, hire, train,
promote and compensate persons in all jobs without regard to race, color, religion, sex, age, disability or national origin
or any other basis prohibited by applicable laws.
COST AND SCHEDULE OF CONSTRUCTION WORK: In providing opinions of probable cost and project schedule, it is
recognized that neither the CLIENT nor Stantec has control over the costs of labor, equipment or materials, or over the
Contractor's methods of determining prices or time. The opinions of probable cost or project duration are based on
Stantec's reasonable professional judgment and experience and do not constitute a warranty, express or implied, that
the Contractors' bids, project schedules, or the negotiated price of the Work or schedule will not vary from the CLIENT's
budget or schedule or from any opinion of probable cost or project schedule prepared by Stantec. Exact costs and
times will be determined only when bids have been received for the PROJECT and when the construction work has
been performed and payments finalized..
LIMITATION OF LIABILITY: The CLIENT releases Stantec from any liability and agrees to defend, indemnify and hold
Stantec harmless from any and all claims, damages, losses, and /or expenses, direct and indirect, or consequential
damages, including but not limited to attorney's fees and charges and court and arbitration costs, arising out of, or

claimed to arise out of, the performance of the SERVICES, excepting liability arising from the negligence or willful
misconduct of Stantec.
It is further agreed that the total amount of all claims the CLIENT may have against Stantec under this AGREEMENT or
arising from the performance or non - performance of the SERVICES under any theory of law, including but not limited to
claims for negligence, negligent misrepresentation and breach of contract, shall be strictly limited to the lesser of the
fees paid to Stantec for the SERVICES or $500,000. No claim may be brought against Stantec in contract or tort more
than two (2) years after the cause of action arose. As the CLIENT's sole and exclusive remedy under this AGREEMENT
any claim, demand or suit shall be directed and /or asserted only against Stantec and not against any of Stantec's
employees, officers or directors.
Stantec's liability with respect to any claims arising out of this AGREEMENT shall be absolutely limited to direct damages
arising out of the SERVICES and Stantec shall bear no liability whatsoever for any consequential loss, injury or damage
incurred by the CLIENT, including but not limited to claims for loss of use, loss of profits and loss of markets.
INDEMNITY FOR MOLD CLAIMS: It is understood by the parties that existing or constructed buildings may contain mold
substances that can present health hazards and result in bodily injury, property damage and /or necessary remedial
measures. If, during performance of the SERVICES, Stantec knowingly encounters any such substances, Stantec shall
notify the CLIENT and, without liability for consequential or any other damages, suspend performance of services until
the CLIENT retains a qualified specialist to abate and /or remove the mold substances. The CLIENT agrees to release and
waive all claims, including consequential damages, against Stantec, its subconsultants and their officers, directors and
employees arising from or in any way connected with the existence of mold on or about the project site whether during
or after completion of the SERVICES. The CLIENT further agrees to indemnify and hold Stantec harmless from and against
all claims, costs, liabilities and damages, including reasonable attorneys' fees and costs, arising in any way from the
existence of mold on the project site whether during or after completion of the SERVICES, except for those claims,
liabilities, costs or damages caused by the sole gross negligence and /or knowing or willful misconduct of Stantec.
Stantec and the CLIENT waive all rights against each other for mold damages to the extent that such damages
sustained by either party are covered by insurance.
DOCUMENTS: All documents prepared by Stantec or on behalf of Stantec in connection with the PROJECT are
instruments of service for the execution of the PROJECT, Stantec retains the property and copyright in these documents,
whether the PROJECT is executed or not. Payment to Stantec of the compensation prescribed in this AGREEMENT shall
be a condition precedent to the CLIENT's right to use documentation prepared by Stantec. These documents may not
be used for any other purpose without the prior written agreement of Stantec. The CLIENT shall have a permanent non-
exclusive, royalty -free license to use any concept, product or process which is patentable or capable of trademark,
produced by or resulting from the SERVICES rendered by Stantec in connection with the PROJECT, for the life of the
PROJECT. The CLIENT shall not use, infringe upon or appropriate such concepts, products or processes without the
express written agreement of Stantec. In the event Stantec's documents are subsequently reused or modified in any
material respect without the prior consent of Stantec, the CLIENT agrees to indemnify Stantec from any claims
advanced on account of said reuse or modification.
Any document produced by Stantec in relation to the Services is intended for the sole use of Client. The documents
may not be relied upon by any other party without the express written consent of Stantec, which may be withheld at
Stantec's discretion. Any such consent will provide no greater rights to the third party than those held by the Client
under the contract, and will only be authorized pursuant to the conditions of Stantec's standard form reliance letter.
Stantec cannot guarantee the authenticity, integrity or completeness of data files supplied in electronic format
( "Electronic Files "). CLIENT shall release, indemnify and hold Stantec, its officers, employees, consultants and agents
harmless from any claims or damages arising from the use of Electronic Files. Electronic files will not contain stamps or
seals, remain the property of Stantec, are not to be used for any purpose other than that for which they were
transmitted, and are not to be retransmitted to a third party without Stantec's written consent.
PROJECT PROMOTION: Where the Client has control or influence over construction signage, press releases and /or other
promotional information identifying the project ( "Project Promotion "), the Client agrees to include Stantec in such
Project Promotion.
FORCE MAJEURE: Any default in the performance of this AGREEMENT caused by any of the following events and
without fault or negligence on the part of the defaulting party shall not constitute a breach of contract: labor strikes,
riots, war, acts of governmental authorities, unusually severe weather conditions or other natural catastrophe, or any
other cause beyond the reasonable control or contemplation of either party.
GOVERNING LAW: This AGREEMENT shall be governed, construed and enforced in accordance with the laws of the
jurisdiction in which the majority of the SERVICES are performed.
DISPUTE RESOLUTION: If requested in writing by either the CLIENT or Stantec, the CLIENT and Stantec shall attempt to
resolve any dispute between them arising out of or in connection with this AGREEMENT by entering into structured non-
binding negotiations with the assistance of a mediator on a without prejudice basis. The mediator shall be appointed
by agreement of the parties. If a dispute cannot be settled within a period of thirty (30) calendar days with the

mediator, if mutually agreed, the dispute shall be referred to arbitration pursuant to laws of the jurisdiction in which the
majority of the SERVICES are performe or elsewhere by mutual agreement,
ATTORNEYS In of a dispute hereunder, the prevailing party is entitled to recover from the other party all
costs incurred by the prevailing party in enforcing this AGREEMENT and prosecuting the dispute, including reasonable
attorneys and expert's fees, whether incurred through formal legal proceedings or otherwise.
ASSIGNMENT AND SLJCCESSQRS: Neither the CLIENT nor Stantec shall, without the prior written consent of the other
party, assign the benefit or in any way transfer the obligations of this AGREEMENT or any part hereof. This AGREEMENT
shall Inure to the beneflt of and be blnding upon fhe parlles hereto, and except as otherwise provided herein, upon
thelr executors, adminlstrators, successors, and assigns.
PROTECTION OF PRIVACY LAWS: Stantec will comply with its statutory obligations respecting the collection, use,
disclosure, access to, correction, protection, accuracy, retenlion and disposiiion of personal informaiion That may be
collected or created under this AGREEMENT. Stantec will refer any request for access to or correction of personal
information that is made under statute to the CLIENT and will comply with any directions from the CLIENT respecting the
access request, or respecling correction and annotation of personal info oh Stantec wIII, at reasonable fimes and
on reasonable notice, allow the CLIENT to enter its premises and inspect any personal informcrtion of the CLIENT's that is
In the custody of Stantec or any of Stantec's policies or practices relevant to the management of personal information
subject to thls AGREEMENT.
ENTIRE AGREEMENT: This AGREEMENT constitutes the sole and entire agreement between the CLIENT and Stantec
relating to the PROJECT and supersedes all prior agreements between them, whether written or oral respecting the
subject matter hereof and no other terms, conditions or warranties, whether express or implied, shall form a part hereof.
This AGREEMENT may be amended only by written instrument signed by both the CLIENT and Stantec. All attachments
referred to In thls AGREEMENT are | nztedhem|nbyfh|omfmmnmahow*ver,|ntheewantofonyoonMiotbetween
attachments and the terms and conditions of this AGREEMENT, the terms and conditions of this AGREEMENT shall take
precedence.
SEVERAW|UTY: If any term, condition or covenant of this AGREEMENT is held by a court of competent jurisdiction to be
invalid, void, or unenforceable, the remaining provisions of this AGREEMENT shall be binding on the CLIENT and Stantec.
THE PARTIES EXPRESSLY ACKNOWLEDGE THAT THIS AGREEMENT CONTAINS LIMITATION OF IIABILITY PROVISIONS
RESTRICTING RIGHTS FOR THE RECOVERY OF DAMAGES.

Scope of Services & Compensation
Stantec will provide professional planning services to the City of Mendota Heights in the following ways:
1) For work related to applications submitted to the City that will be paid through the city's escrow
system, Stantec will work on a time plus materials basis in accordance with the Pass Thru Rate in
the table of hourly rates below.
2) For work requested by the city on other matters, not related to an application, Stantec will work
on a time plus materials basis in accordance with the City Rate in the table of hourly rates below.
3) For regular meetings of the Planning Commission, City Council, and twice monthly meetings with
prospective applicants, Stantec will work on a time plus materials basis in accordance with the
City Rate in the table of hourly rates below, to a maximum of $225 (Two Hundred Twenty -five
Dollars) per meeting.
4) For special projects, the City and Stantec will negotiate fees and rates.
Stantec will bill the City monthly for services rendered in the previous month. The invoice date will be
approximately 5o calendar days from the first date of the service provided.

There are 3 items that need to be reviewed by the council on an annual basis. Two of the items
have attached resolutions and the other item need to be authorized and reviewed by the council.
• Each year the city designates financial institutions that may be used as depositories for
city funds. The attached resolution lists those institutions that may be used in 2014.
• Minnesota statue 118A.03 requires that to the extent city funds in a financial institution
exceed FDIC insurance amounts, a collateral security be pledged to cover the difference.
The attached resolution states the collateral that is in place for the city at American Bank.
• The council needs to authorize the finance director to execute electronic payments and
prepay claims. This is not a change in process, but an acknowledgement that there are
claims paid prior to your approval on the agenda. This item was recommended to be
formally authorized by the city auditors.

Staff recommends that the Mendota Heights City Council approve the attached resolutions
designating city depositories and accepting pledged securities. Staff recommends that the
finance director is given the authority to prepay claims. This action requires a majority vote of

BACKGROUND
Minnesota State Statute 412.121 requires the city to appoint an acting mayor at the first city
council meeting of each year. The acting mayor shall perform the duties of the mayor during the
disability or absence of the mayor from the city or in event of vacancy in the office of the mayor,
until such time a successor has been appointed.
The acting mayor is selected at the will of the city council with no established pattern. The past
seven years the acting mayor position for the City of Mendota Heights has been held by the
following councilmembers:

BACKGROUND

As a result of the discussion at the December 17 Council meeting, the DRAFT Ordinance has been
revised for additional review. The following revisions are included in Ordinance 454 for continued
discussion:
1. `Building footprint" definition
2. Garage size limitation measured by the "building footprint"
3. Removal of 1,800 sq. ft. total garage area limitation
4. Garage design standards
In addition, Title 12-1D-3(B) contains the following standards for accessory structures (including private
garages) in all zoning districts:
B. Accessory Structures In All Zoning Districts:
1. Setbacks:
a. Front Yard Setbacks:
(1) No detached garage, or other accessory building, shall be located nearer the
front lot line than the principal building on that lot.
(2) No accessory structure shall be located within any front yard.
b. Side And Rear Yard Setbacks:
(1) Accessory structure one hundred forty four (144) square feet or less: Five feet
(5).
(2) Accessory structure exceeding one hundred forty four (144) square feet: Ten
feet (10).
c. Setback From Principal Building: No accessory structure shall be erected, altered, or
moved within five feet (5) of the principal building.
2. Height:
a. All districts: No accessory building shall exceed the height of the principal building.
b. Residential districts: No accessory building shall exceed fifteen feet (15) in height.
3. Time For Construction: No accessory building or structure, including parking area, shall be
constructed on any lot prior to the time of construction of the principal building to which it is
accessory.
4. Use Restrictions: No cellar, basement, tent, tent trailer or accessory building shall at any time
be used as an occupied dwelling primarily for human habitation.
5. Subdivision: In the event that any property upon which an accessory structure or structures
have been erected shall later be subdivided, then the number and size of accessory structures on
the subdivided property shall conform to the requirements of this chapter, and those which do not
conform shall be relocated, removed or reconstructed so that they do conform.

OF MENDOTA HEIGHTS, MINNESOTA, DAKOTA COUNTY, BY AMENDING THE
ALLOWABLE PRIVATE GARAGE SIZES ON RESIDENTIAL PROPERTY
The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Section 12 -1B -2 is hereby amended to read as follows:
BUILDING FOOTPRINT: The outline of the total area covered by a building's perimeter at the
ground level to the block/foundation.
Section 24.
Section 12 -1D -3 C.1.a. is hereby amended to read as follows:
a. Number: One attached and one detached private garage shall be allowed as accessory
buildings on residential property, subject to the size allowanceslimitations identified in
this Section.
Section 32.
Section 12 -1D -3 C.1.b. is hereby amended to read as follows:
b. Size, as measured by the building footprint:
(1) Attached private garage:
(A) Up to one thousand two hundred (1,200) square feet is permitted.
(B) More than one thousand two hundred (1,200) up to one thousand five
hundred (1,500) square feet is allowed via a conditional use permit.
(2) Single Family residential parcels that do not have an attached garage may be
allowed one detached garage up to seven hundred fifty (750) square feet as a
permitted structure, or up to one thousand (1,000) square feet upon approval of a
Conditional Use Permit.
(3) Detached private garage. One detached private garage may be allowed on
residential property as a second garage by permitted use, or by conditional use
permit, with floor arras up to the limits according to the following table:

garage or other accessory building space on a single or two - family residential
property. More than thirty six (36) lineal feet of garage door may be provided by
Conditional Use Permit when such additional garage door exposure is not visible
from a public street or from surrounding residential property.
(5) Detached private garages must be architecturally compatible with the
principal structure, including exterior design, materials and colors.
Section 54.
This Ordinance shall be in effect from and after the date of its passage and publication.

ORDINANCE REGARDING ALLOWABLE PRIVATE GARAGE SIZES AND POTENTIAL
FOR ISSUES CONCERNING LOT SPLITS
FACTS
The Council is addressing by Ordinance issues concerning Allowable Private Garages and the size
thereof pertaining to those garages. An issue was raised as to how the accessory structure /garages
would impact future lot split requests on appropriate and legally compliant lots in the city. The
concern is if a property owner having a lot in the city that could be split due to its size and who has
prior to the request for a lot split built an accessory building/garage under the amended ordinance
being discussed by the city might impact said lot split request. Does the city have any ability to
regulate future lot split requests with the adoption of the proposed ordinance allowing additional
accessory structures /garages and if so how.
ANALYSIS
It is important in analyzing any zoning issue that one understand how a reviewing court would
decide an issue if it had to be reviewed. Ultimately a court of law maybe the final decision maker
regarding any zoning issue. In reviewing zoning decisions of local governing bodies, courts make
an independent examination of the record to reach its own conclusions with no special deference.
Northwestern College v. City of Arden Hills, 281 N.W.2d 865 (Minn.1979). The goal of review is
to determine whether the municipality's action was reasonable. Honn v. City of Coon Rapids, 313
N.W.2d 409 (Minn.1981). The interpretation of an existing zoning ordinance is a question of law
for a court to decide. Amcon Corp. v. City of Eagan, 348 N.W.2d 66 (Minn.1984). Zoning
ordinances should be construed strictly against the city and in favor of the property owner. Id The
court uses the least restrictive interpretation, protecting the rights of the property owner. Id
The issue that arises under the facts as presented is whether an applicant looking to add an accessory
building/garage and then requests a lot split; can the city deny an application for a lot split because
the accessory building/ garage would be a legal nonconforming structure after the lot split. The
scenario being that an applicant requests a lot split under Mendota Heights City Code Title 11 and

as set forth above, the accessory structure /garage previously approved could be in nonconformity
with the current zoning code. The nonconformity would be a legal conformity. Legal
nonconformities are those that were legal when the zoning ordinance or amendment was adopted, in
that they complied with then existing ordinance and law. Mendota Heights City Code 12 -1B -2
Definitions. Minnesota Statutes §462.357, subd. le provides that in Minnesota, any legal
nonconformity generally has a statutory right to continue. Specifically, legal nonconformities may
be continued, including through repair, replacement, restoration, maintenance or improvement, but
not including expansion. This is important because as you may or may not be aware the rights of
legal nonconformities to continue does not depend on local ordinance, and so a city often has little
role administering nonconformities.
There are three options how the city could address the issue. Option one would be if the city
adopts the ordinance allowing additional accessory building/garages as a permissive use, then, if the
city later requires removal of the accessory building/garage as a condition of a lot split, the city
would have to pay for the garage. Minnesota Statutes §117.184 provides that "notwithstanding any
law to the contrary, an ordinance or regulation of a political subdivision of the state or local zoning
authority that requires the removal of a legal nonconforming use as a condition or prerequisite for
the issuance of a permit, license, or other approval for any use, structure, development, or activity
constitutes a taking and is prohibited without the payment of just compensation." This would not be
a cost effective solution for the city. In addition, Minn. Stat. §117.184 only applies to removal of
nonconforming use.
Option two would be if the city adopts an ordinance that allows the accessory structure /garage only
as an interim use, then at the time the interim use is granted, the city could specify that the interim
use would terminate if the lot were subdivided. Minnesota Statutes §462.3597 provides "an
"interim use" is a temporary use of property until a particular date, until the occurrence of a
particular event, or until zoning regulations no longer permit it. Zoning regulations may permit the
governing body to allow interim uses. The regulations may set conditions on interim uses. The
governing body may grant permission for an interim use of property if:
(1) the use conforms to the zoning regulations;
(2) the date or event that will terminate the use can be identified with certainty;
(3) permission of the use will not impose additional costs on the public if it is necessary for
the public to take the property in the future; and
(4) the user agrees to any conditions that the governing body deems appropriate for
permission of the use.
Any interim use may be terminated by a change in zoning regulations. The concern with this
scenario is the additional cost and resources that would be needed to update our current code as well
as the process required for adopting this as an interim use.
Option three would be to deny any lot split as creating nonconformity thus avoiding implicating
Minn. Stat. §117.184. This solution seems best fitted for the city. This solution would
accommodate the city with regards to protecting the interests of its planning process and zoning
codes. My suggestion would be to notify applicants who would be applying for the additional
accessory structure /garage that should they want to split their lot in the future and they meet the lot

split requirements that the accessory structure /garage may become a legal nonconforming structure
and may cause the city to deny any future lot split. The idea is to provide as much notice to any
land owner, so as to avoid any claim of lack of notice or prejudice.
CONCLUSION
The city would have the ability to prevent future legally nonconforming structures and adopt an
ordinance allowing additional accessory structures /garages. The city would have the legal authority
to prevent future Iot splits if the lot split would create nonconformity.

Report on City Administrator's Performance Evaluation
Prior to the regular city council meeting, the mayor and city council will be conducting a
performance evaluation of the city administrator. Pursuant to Minnesota State Statute 13D.05,
the review may be held in a closed session but the conclusions must be reported at the next open
meeting of the city council.

RECOMMENDATION
Staff recommends that the city council summarize the conclusions of the city administrator's
performance review at this time.
