1972-06-20 Council minutesVILLAGE OF 0ENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Page 48 June 20, 1972 Minutes of the Regular Meeting Held Tuesday, June 20, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the Village Hall, 2010 South Lexington Avenue, Saint Paul, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Blair, Lockwood and Wahl. Councilman Gutzmer had notified the Council that he would not be present. HEARING — ROGERS LAKESIDE EAST Mayor Huber declared the meeting open for the purpose of a public hearing for proposed improvements for Rogers Lakeside East and the areas adjacent thereto. Mayor Huber turned the meeting over to Village Administrator Orvil Johnson. 0r. Johnson pointed out that this is a feasibility hearing for installation of sewer mains, water mains, concrete curb and gutter, storm sewer improvements and bituminous surfacing for the property between Cheri Lane and Bluebill Drive. The petition for improvements was made by the developers, Bjorklund and Hansen. The estimated costs are as follows: sanitary sewer extensions are estimated to cost a total of $33,336 or approximately $8.55 per assessible foot; watermains approximate total including services would be $30,239 or about $7.11 per foot; storm sewer costs for a total of about 4,400 feet is estimated to cost about $57,750 using assessible square footage in the area from Bluebill to the centerline between Cheri and Wagon Wheel Trail, or about 50 per square foot; estimated cost of street construction including bituminous base material, bituminous surfacing and curb and gutter will be approximately $81,700 or about $15.13 per foot. The cost of sewer and water connections will be $200 per connection. Village Engineer Ed Kishel stated that those persons presently being assessed for street improvements will be assessed for one—fourth of the length of their lot for the addition of curb and gutter because of the added benefit they will be receiving. He further stated that after all of the costs are known and the project is ordered in, a public hearing will be held and all affected property owners will be notified. Ayes: 4 Nays: 0 DO0INIC ALFONSO Page 49 June 20/ 1972 Mayor Huber asked for any further questions before closing the hearing and stated that anyone with formal written objections should submit them to the Clerk. There being no further questions, Mayor Huber moved that the hearing be closed at 9:03 p.m. Motion seconded by Councilman Lockwood. Mr. Alfonso and his Attorney, Harry Ray, were present. 0r. Ray stated he was present because of the Building Inspector's refusal to give 0r. Alfonso a building permit. He stated that the garage is already close to completion and wanted to know why the permit was refused. Mayor Huber stated that the permit was refused because the original variance was issued as a sidelot variance to build an ordinary garage. The garage under construction is two stories. At the time the variance was granted, the Council did not have the plans for the building, only the placement of the building. He suggested that 0r. Alfonso apply for a variance to build a garage of two stories and also for a variance for a special use permit to house pigeons in the structure. He further suggested that 0r. Alfonso discuss his plans with his neighbors. METRO Orvil Johnson condensed the notice received by the AIRPORTS Council for a MAC hearing on the acquisition of COMMISSION property in the Acacia Park area on July 6, 1972 at 7:00 P.M. in the Henry Sibley Auditorium. ACACIA PARK CEMETERY Jim Martin was present to represent the Acacia Park Cemetery. He stated that in 1967 a plat was sub- mitted to the Register of Deeds for the purpose of dedication of cemetery property in connection with a request from the Minnesota Highway Department; however, prior approval of the Village Council was not obtained. Mayor Huber suggested that 0r. Martin submit to 0r. Johnson a proposal of all land presently held by the cemetery and not presently dedicated for cemetery uses so that a study may be made. MISS SWISS Mr. Solland and Roger Groth presented plans for m Miss Swiss convenience store to be located on prop- erty north of the Skelly Gas Station. The property is presently zoned 8-2 and they would like to apply for a building permit. The rear left and right sides would be painted concrete brick. The front will face Dodd Road. Mayor Huber suggested that the sides abutting residential areas be made more attractive. He further suggested that 0r. Groth submit the plans to Dick Bjorklund, including sign specifica- tions and that he should work with Dick. Continued to July 11 meeting. 0r. Schechter was present regarding a petition for sewer and water improvements for Somerset II. 0r. Kishel was directed to prepare a preliminary study of the drainage plan including proposed pipe sizes and location and alternative methods of drainage. Continued to July 11 meeting. Continued from June G. 0r. William Allen was present to discuss a preliminary study of the lake level. 0r. Allen is to give his level information to Ed Kishel who is to work with Mr. Johnson on an application to the Department of Natural Resources. Sherman Winthrop is to draw up a covenant with 0endakota Country Club or suggest an alternative. Mr. Johnson requested a promotion for Wayne Schwanz to leadman with a salary of $BOO per month. Councilman Blair moved that Wayne Schwanz be promoted to leadman with a salary of $800 per month, effective July 1, 1972. Mayor Huber seconded the motion. Councilman Wahl asked if filling station rental equip- ment is covered by ordinance and if storing boats and renting trailers violates any ordinance. 0r. Johnson is to follow this up. Sherman Winthrop presented proposed Ordinance Number 102, Zoning Administration Costs. Councilman Lockwood moved that Ordinance Number 102, "AN ORDINANCE AMENDING THE VILLAGE ZONING ORDINANCE" be adopted. Councilman Wahl seconded the motion. Dudgeon has refused the settlement checks. He returned to the Clerk the settlement checks in the amounts of $3,500 and $300. Mayor Huber moved that the Attorney be instructed to proceed and put the matter on the Court calendar. Councilman Blair seconded the motion. The Council directed the Mayor to sign the agreement hiring Richard Parranto to obtain options on park property. The Park site development project form of bond was approved as submitted. Councilman Lockwood moved approval of the Treasurer's request to reinvest $100,000 of State Aid Fuhds. Councilman Wahl seconded the motion. Councilman Wahl moved the Council to adopt the following motion: RESOLVED that the claims submitted to the Village Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, June 20, 1972, having been audited by the Village Council, be and are hereby allowed and the Mayor and Clerk—Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims. Motion seconded by Mayor Huber.
