1972-08-01 Council minutesPage 70 August 1, 1972 VILLAGE OF 0ENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, August 1, 1972 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the Village Hall, 2010 South Lexington Avenue, Saint Paul, Minnesota. Acting Mayor Lockwood called the meeting to order at 8:00 o'clock P.M. The following members were present: Acting Mayor Lockwood, Councilmen Blair, Gutzmer and Wahl. Mayor Huber had notified the Council that he would be out of town. APPROVE MINUTES Ayes: 4 Nays: 0 BID AWARD Ayes: 4 Nays: 0 Ayes: 4 Nays: 0 Councilman Blair moved approval of the minutes of the regular meeting held Tuesday, July 18, 1972, with corrections. Councilman Wahl seconded the motion. Mr. Larry Shaughnessy, Jr. opened the bids received for the sale of $l,700,000 Permanent Improvement Bonds. The following represent the various banks and bond brokers bidding on the issue: First National Bank of St. Paul — bid $792,572.00 with an interest rate of 5.0729/; Banc Northwest and National City Bank of Minneapolis — bid $781,665.00 with an interest rate of 4.9708qt; and American National Bank and Trust Company — bid $792,258.00 with an interest rate of 5.0382%. Councilman Gutzmer moved adoption of Resolution Number 503, "RESOLUTION AWARDING SALE OF $I,700:000 IMPROVEMENT BONDS, SERIES 1972,x awarding the Bond Sale to Banc Northwest and National City Bank of Minneapolis. Councilman Blair seconded the motion. Acting Mayor Lockwood moved adoption of Resolution Number 504, "RESOLUTION AUTHORIZING AND ESTABLISHING THE FORM AND DETAILS OF $l,700,000 IMPROVEMENT BONDS, SERIES 1972, AND LEVYING TAXES AND APPROPRIATING SPECIAL ASSESSMENTS FOR THE PAYMENT THEREOF." Councilman Wahl aadondod the motion. Page 71 August 1, I972 LOWER Acting Mayor Lockwood acknowledged receipt of a MINN. RIVER letter from the Lower Minnesota River Watershed WATERSHED District. Councilman Gutzmer stated that he mould DISTRICT like to attend the August 16 meeting referred to in the letter and requested that Mr. Johnson contact him to remind him of the meeting date. Acting Mayor Lockwood stated that he would also attend the meeting. PEDESTRIAN Acting Mayor Lockwood read letters received from the SAFETY Automobile Club of Saint Paul and the Department of AWARD Public Safety which congratulated the Village of __ Mendota Heights on the Village's receipt of the 1971 Pedestrian Safety Award. The plaque was put on public display during the meeting. Acting Mayor Lockwood acknowledged receipt of a letter from Attorney Harry Ray and 0r. Warren Powell requesting a vacation of the alley in Block #9, T.T. Smith's Subdivision #3. 0r. Ray stated that the matter originally came before the Council in October of I969 and that no formal action was taken on the vacation at that time. ALLEY VACATION Ayes: 4 Nays: 0 0r. Winthrop stated that consent of the contract vendee must be received and that according to statutory provisions, there must be public notice and a public hearing. Councilman Gutzmer moved that a public hearing for vacation of the alley be held on September 5and that the notice of hearing be published on August 15. Councilman Blair seconded the motion. 0ENDOTA Acting Mayor Lockwood referred to the minutes of MONTESSORI the July 26 Planning Commission meeting wherein SCHOOL the Commission recommended denial of the application CASE #72-19 of the Mendota Montessori School for a variance for ' an 8 foot by 10 foot sign on the St. Peter's Church property. On the recommendation of the Planning Commission, Councilman Blair moved denial of the application for variance for sign size. Councilman Gutzmer seconded the motion. `^'=. Ayes: 4 Nays: 0 August 1, 1972 Page 72 FRANZ0[IER The Council acknowledged the July 26 Planning PLANNING Commission recommendation to approve a variance COMMISSION of 4'7" from the 30 foot front yard setback' CAS[ #72-22 requirement. Mr. Franzmeier stated that he would ' like to convert the present garage into a family room and build a garage further out in front of the house. He further stated that his neighbors have no objection to the variance request. Councilman Blair moved approval of the variance of 4'7" from the thirty foot front yard requirement. Councilman Gutzmer seconded the motion. Ayes: 4 Nays: 0 HARRIS — Acting Mayor Lockwood referred to the July 26 PLANNING Planning Commission minutes wherein the Commission COMMISSION recommended approval of a variance to build on an CAS[ #72-23 80' lot and to allow an 8' sidelot on the east property line. Ayes: 4 Nays: 0 CORRES- PONDENCE PARK FUNDING Acting Mayor Lockwood moved that the application for variance to build on the 80' lot and granting a 2' reduction from the required 10' side yard setback on the east side be granted. Councilman Wahl seconded the motion. Acting Mayor Lockwood acknowledged receipt of a letter from Mr. and Mrs. Dale Peterson clarifying their feelings on the Roger's Lakeside East project. Mr. Johnson commented on a memo received by the Council from the Park and Recreation Commission, stating that much time should be spent discussing what should be done with regard to funding. He stated that the memo indicates that the Park Commission intends to proceed with 1972-73 park acquisition and 1973 park improvement construction as though no funds are available, at the same time making an attempt to re—apply for funds. Acting Mayor Lockwood gave the audience a brief history of the HUD application and denial and reviewed a letter received from Lee Starr outlining the reasons for the denial. PARK COMMISSION APPOINT- MENT Ayes: 4 Nays: 0 I-35[ -- RESOLUTION NO. 501 Ayes: 4 Nays: 0 STREET LIGHTS Ayes: 4 Nays: 0 Page 73 August 1, 1972 0r. Joe Btofoni stated that the Park Commission is considering making application for LA000N funds even though LA000N funds are primarily for acquisition of property around water. Councilman Gutzmer requested that the Park and Recreation Commission give the Council a report of the Commission's plans for use of the bond issue money. Councilman Wahl moved the appointment of 0r. Gerald Finn to Mrs. Kathy Ridder/o unexpired term on the Park and Recreation Commission and directed 0r. Johnson to send written notification of the appointment to 0r. Finn. Councilman Gutzmer seconded the motion. Councilman Gutzmer moved adoption of Resolution Number 501` , nRESOLUTImN DEPLORING INDECISIONS AND DELAYING OF I-35E WITHIN THE CITY OF SAINT PAUL." Councilman Blair seconded the motion. Councilman Blair moved adoption of Resolution Number 502, "RESOLUTION PROPOSING TWO ADDITIONAL JOINT STREET LIGHTS." Councilman Wahl seconded the motion. PROBATION— 0r. Johnson stated that Fred Pfeiffer and Leonard ARY Kanitz have completed their six—months probationary EMPLOYEES employment satisfactorily and recommended that they be established as permanent employees. Ayes: 4 Nays: 0 METRO SEWER CHARGES Acting Mayor Lockwood moved the establishing of Fred Pfeiffer and Leonard Kanitz as permanent employees at a salary of $775 per month. Councilman Blair seconded the motion. 0r. Johnson stated that he and Councilman Lockwood met with members of the MSB staff on August 28 and that the MBB people acknowledged that they would Page 74 August 1, 1972 investigate possible errors in the Village's 1972 charges, especially in the areas of interceptor reserve capacity, day students and meter readings. mr. Shaughnessy stated that he had attended a recent MSB meeting and the mSB is proposing that all future building permits be charged 5350 as a connection charge in lieu of the present reserve capacity charges. MID— AMERICA mr. Howard Hanson explained proposed Village office STATE BANK layout in the bank building and Acting mayor Lockwood LEASE directed mr. Johnson to put the plans on display AGREEMENT for the audience during the meeting. Ayes: 4 Nays: 0 IMP. 70, PROJECT 5 ACQUISI- TION OF FISCHER PROPERTY Ayes: 4 Nays: 0 Mr. Johnson stated that the lease will be for five years with rent of $880 per month with an escalation figure for taxes in 1974. The Village will have free use of the lobby for any types of meetings. He recommended that the Mayor and Clerk be authorized to sign the agreement. Councilman Blair moved authorizing the Acting Mayor and Village Clerk to execute the agreement with the Mid— America Bank. Councilman Gutzmer seconded the motion. Mr. Kishel stated that he is almost ready to prepare the assessment rolls for Project 70 -5. Acting Mayor Lockwood suggested that he and Mr. Kishel and Mr. Johnson meet to discuss the matter of assessment rates for the project. Councilman Gutzmer moved adoption of Resolution Number 505, "RESOLUTION AUTHORIZING ACQUISITION OF FISCHER PROPERTY." Councilman Wahl seconded the motion. USDU Mr. Bill Clapp presented building plans for the IVY HILLS Ivy Hills Townhouses. Mr. Bjorklund questioned the TOWNHOUSES exterior design on units D -1 and E -5. LIST OF CLAIMS Ayes: 4 Nays: 0 LICENSES Ayes: 4 Nays: 0 ADJOURN Ayes: 4 Nays: 0 Page 75 August 1, 1972 Acting Mayor Lockwood directed 0r. Johnson to write to USDC in care of 0r. Clapp, stating that the sides of units D-1 and E-5 should be finished in brick siding and noting the absence of landscaping plans which must be presented to the Council. Councilman Gutzmer moved the Council to adopt the following motion: RESOLVED that the claims submitted to the Village Council for poyment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, August 1, 1972, having been audited by the Village Council, be and are hereby allowed and the Acting Mayor and Clerk— Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims.
