Minutes of the Regular eeting
Held Tuesday, October 3, 1972
Pursuant to due call and notice thereof, the regular
meeting of the Village Council, Village of Mendota Heights,
was held at 8:00 o'clock P.M., at the Village Hall,
2010 South Lexington Avenue, Saint Paul, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock
P.M. The following members were present: Mayor Huber,
Councilmen Blair, Gutzmer and Wahl. Councilman Lockwood
had notified the Council that he would be out of town.
Councilman Gutzmer moved approval of the minutes of the
meeting held Tuesday, September 19r 1972 with correction.
Mayor Huber seconded the motion.
Mayor Huber opened the meeting for the purpose of a hearing
on the assessment roll for Improvement 72, Project 3,
improvements to serve the area immediately north of the
Friendly Hills Rearrangement. Mayor Huber turned the
hearing over to Village Administrator Johnson. 0z. Johnson
gave a brief history of the project and a presentation of
the assessment rates as follows:

Mayor Huber asked if anyone had any objection to their
assessment. 0r. Bob Tanzen, representing Sheehy Properties
stated that Sheehy Properties opposes the assessment.
Mayor Huber requested that 0r. Tanzen clarify with
0r. Sheehy the matter of street dedication and the
objection to the assessment.
Dr. Haines stated that his property has not been
favorably affected by the storm sewer. Mayor Huber
stated that the Village will check out the rear yard
drainage problem.

There being no further objections or comments,
Mayor Huber stated that ,o y written objections should be
filed with the Clerk.
Mayor Huber moved that the hearing be closed.

"RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR

Mayor Huber moved that the request for adjustment in

Councilman Gutzmer seconded the motion.
Councilman Gutzmer moved that the request for adjustment
in assessment by James Wells be denied.
Councilman Blair seconded the motion.
Mayor Huber moved that the request for adjustment in
assessment from Mr. Dominic Alfonso be denied.

Mayor Huber moved that the requests for adjustments
in assessments from Mrs. Helen Adams and
0r. George W. Hanson be denied.
Councilman Gutzmer seconded the motion.
Action was deferred on requests for adjustments from
Mr. Karl Hohenstein and 0r. Samuel Lechtman pending
further study by the Village Engineer.
Mayor Huber moved that a request for adjustment in
assessment from 0r. Charles Garr be denied.
Councilman Gutzmor seconded the motion.
0r. Carmen Tuminelly was present to request appro�al of
the final plat for Eagle Ridge 2/ Plat 2. He stated
that he has furnished the Administrator with two
hardshells and with the square� footage of Eagle Ridge
as had been requested at the September 5 meeting. He
also outlined the proposed mechanical plan.
0r" Johnson stated that the building units are consistent
with the first phase of Eagle Ridge.
Mayor Huber moved the approval of Eagle Ridge Plat 2.
Councilman Blair seconded the motion.
Councilman Gutzmer moved that a conditional building
permit be issued, the condition being that the final
mechanical plans be in accordance with a letter received
from Doody Plumbing and that the plans be received by
October 11.
Mayor Huber seconded the motion.
Mr. Tuminelly stated that when the variance for the height
of the building was approved, he was eSked to lower the
height of the building as far as possible. In his
original plans, the first floor would have been one foot
above Dodd and Wentworth and that now the first

floor is 6~l feet below Dodd and Wentworth. He stated
that a berm will be provided on Wentworth if the Council
so desires, but that at Dodd Road, he will comply with
the State requirements.
Mayor Huber stated that the Village will contact the
Minnesota Highway Department to ascertain the State
requirements.
Officials of the Mid—America Bank were present to request
a variance to erect an advertising sign in a B-4 district.
The Planning Commission on September 27 had recommended
that the zoning ordinance be amended to allow an
advertising sign in a B-4 district on a conditional use
basis.
Councilman Gutzmer moved that the Attorney be directed
to prepare an amendment authorizing an advertising sign
in a B-4 district as a conditional use.
Councilman Blair seconded the motion.
The Building Inspector recommended that the building
permit issued to Paul Binek, 624 Callahan Place, for
a storage shed, be rescinded. He stated that the
structure is in violation of the rear yard setback
requirement.
Mayor Huber stated that the rear yard requirement is
30 feet and that the storage shed is being constructed
within 15 feet of the rear lot line. He stated that the
permit was issued on the basis that the structure would
be constructed on an existing foundation and that a
permit cannot be issued due to the violation of the
sideyard setback requirement.
Mayor Huber moved that the building permit issued to
Paul Binek for a storage shed be revoked.
Councilman Wahl seconded the motion.
On the recommendation of the Planning Commission,
Councilman Wahl moved that Mervin Compton be granted a
variance from the 30/ rear yard setback requirement.

Mr. Jerry Murphy was present to request permission to
replace an existing accessory buildihg used for
seasonal storage with a new structure.
Mayor Huber moved that Somerset Golf Course be allowed
to replace the existing storage building with a new
structure.
Councilman Wahl seconded the motion.
0r. Peter Honsa was present to request approval of
an application for subdivision of property on the
north end of the cul—de—sac on William Court.
Councilman Gutzmer moved approval of the subdivision
of property.
Councilman Wahl seconded the motion.
Representatives of Laosoo were present to request approval
of grading plans and platting for Somerset II.
0r. Schechtor outlined the material contained in a
letter transmitted to the Council on October 3.
Mayor Huber directed that the matter be handled on an
administrative level between the Administrator,
Village Engineer and Lassco representatives so that the
matters of storm sewer costs, engineering considerations
and park contribution can be ironed out prior to
submission to the Council.
The matter of Somerset View Streets was introduced
by the Engineer and was continued to the October 10
Special Council Meeting.
Discussion on the proposed municipal liquor ordinance
and the Planning Commission ordinance was postponed.

VARIANCE -- The Village Attorney stated that 0r. Bernard Friel
B. FRIEL has requested a variance from the required lot size
for Lots 17 and 18 of the Friendly Hills Addition,
Lot 17 contains 14,505 squard feet and Lot 18 contains
13,070 square feet. The purpose of his request is to
make Lots 15, l7 and 18 buildable lots. Mr. Winthrop
stated that if the request is granted it should be
conditional upon the vacation of the balance of the plat.
Councilman Blair moved that the variance from lot size
be granted on Lots 17 and 18 conditional upon vacation
of the entire plat with the exception of Lots 16, 17
and 18.

CLAIMS
Continued from September 19. Mayor Huber moved
that the bid of the LaHass Corporation in the amount
of $872.00 for a snowplow and undercarriage for Park
equipment be accepted. Councilman Gutzmer seconded
the motion.
Councilman Gutzmer moved that the bid of Motorola
for four radios in the amount of $2,346.00 be
accepted.
Mayor Huber seconded the motion.
A special meeting was scheduled for Tuesday,
October 10, 1972 to award bids for Improvement 72,
Project 5, Rogers Lakeside East.
Mayor Huber moved that Sandra Sol6ure be
reemployed by the Village as Recreation Coordinator
for 1973 at a salary of $45.00 per week, effective
November 20, 1972.
Councilman Gutzmer seconded the motion.
Mayor Huber moved the Council to adoptkthe
following motion:
RESOLVED that the claims submitted to the Village
Council for payment, a summary of which is set forth
on the list attached hereto and identified as List

of Claims submitted for payment, October 3, 1972,
having been audited by the Village Council, be
and are hereby allowed and the Mayor and Clerk-
Treasurer of the Village of Mendota Heights are
hereby authorized and directed to issue Village
checks in payment of said claims.
Councilman Wahl seconded the motion.
Mayor Huber moved that Mr. Lawrence Balzer,
1132 Sibley Highway be allowed to add ten feet onto
his garage.
Councilman Blair seconded the motion.
Councilman Wahl moved approval of the licenses
granting licenses to:
Custom Pools
Webster Company, Inc.
George Coverdale
Swimming Pool License
Excavating License
Plumbing License
Councilman Gutzmer seconded the motion.
There being no further business to come before
the Council, Councilman Blair moved that the
meeting be adjourned. •
