Minutes of the Regular Meeting
Held Tuesday, February 20, 1973
Pursuant to due call and notice thereof, the regular meeting of the Village
Council, Village of Mendota Heights was held at 8:00 o'clock P.M. at the
Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Losleben, Gutzmer and Wahl.
Councilman Lockwood had notified the Council that he would be late.
APPROVE Councilman Gutzmer moved approval of the minutes of the
MINUTES February 6 meeting with correction.
Councilman Wahl seconded the motion.

COMMUNICATIONS Mayor Huber acknowledged receipt of a letter from the Richline
Company in which the Richline Company agreed to perform
appropriate landscaping in compliance with the Council's
request of February 6.
MAC Mayor Huber moved adoption of Resolution Number 73-14,
MEMBERSHIP - "RESOLUTION SUPPORTING CONCEPT OF H.F. 273," calling for increased
H.F. 273 membership on the Metropolitan Airports Commission to include
suburban communities (as proposed in H.F. 273):.
Councilman Gutzmer seconded the motion.

CEDAR AVENUE Mayor Huber acknowledged receipt of Village of Apple Valley
BRIDGE Resolution No. 1973-24 and Resolution No. 1971-4 calling for
CONSTRUCTION immediate construction of a new Cedar Avenue Bridge with
a construction completion date of no later than July 1, 1975.

Mayor Huber mired adoption of Resolution No. 73-15,
"RESOLUTION SUPPORTING IMMEDIATE CONSTRUCTION OF A NEW
CEDAR AVENUE BRIDGE," endorsing and supporting the
position taken by the Village of Apple Valley.
Councilman Losleben seconded the motion.
The Village Attorney pointed out to the Council the corrections
which have been made to the original proposed contract.
Mayor Huber moved that the corrected contract with Beckman,
Yoder and Seay for Park Planner services for 1973 be approved
and that the Mayor and Clerk-Treasurer be authorized to sign
the contract.
Councilman Gutzmer seconded the motion.

PROPOSED Village Attorney Winthrop distributed to the Council copies
ORDINANCE ON of a proposed ordinance regulating parking withinthe
PARKING Village. Village Administrator Johnson suggested that the
REGULATIONS Council study and consider the proposed ordinance and that the
item be placed on the agenda for the next regular meeting.
Councilman Gutzmer asked if the proposed ordinance is strong
enough to allow enforcement of fire lanes, and the Village
Attorney stated that he feels that the ordinance is strong
enough.
Mayor Huber tabled action on the proposed ordinance until the
next regular Council meeting.
SOMERSET Village Administrator Johnson stated that a letter had been
NO. 2 received from Herb Schechter and that among other things,
Mr. Schechter requested that the Village initiate action for
extension of sewer, water and streets into Somerset No. 2.
Mr. Johnson stated that the letter constitutes a petition
for sewer, water, streets and some storm sewer work and that
it would be appropriate to direct the Village Engineer to
prepare a preliminary report and cost estimate.
Mayor Huber moved adoption of Resolution No. 73-16,
"RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF
REPORT ON IMPROVEMENTS TO SERVE THE AREA KNOWN AS
SOMERSET NO. 2."
Councilman Losleben seconded the motion.

I-35E Mayor Huber stated that several meetings on the construction
of I-35E have been held and that another meeting is scheduled
for February 26.

Village Administrator Johnson stated that the meeting will be
held in the Civic Center and that officials from Dakota County,
St. Paul and other interested groups have been invited to
attend.
Village Administrator Johnson outlined for the Council a
proposed resolution setting sewer rental charges for sewer
users with a water meter size in excess of 11/2 inches.
Councilman Losleben moved adoption of Resolution No. 73-17,
"RESOLUTION SETTING SEWER RENTAL CHARGES FOR MULTIPLE DWELLINGS,
DUPLEXES, TOWNHOUSES, APARTMENTS, CONDOMINIUMS, AMENITY
STRUCTURES, COMMERCIAL AND INDUSTRIAL USERS AND FOR ANY OTHER
USER WITH A WATER METER SIZE IN EXCESS OF 11/2 INCHES."
Councilman Gutzmer seconded the motion.
Councilman Lockwood arrived at 8:47 P.M.

Village Administrator Johnson read to the Council a letter
from Mr. Lawrence A. Anderson commending Officer Floyd Arndt
for assistance provided by Officer Arndt on February 10, 1973.
Village Attorney Winthrop outlined the history of a law suit
involving Officer Hugo Blackfelner and Mr. Raymond Hanson.
Mr. Winthrop stated that the Village's Insurance Company has
agreed to assume the defense and asked that the Mayor sign a
Substitution of Attorney form on behalf of the Village and also
that Officer Blackfelner be given the forms for signature.
Mayor Huber stated that the Insurance Company should be
advised not to settle voluntarily.
Village Attorney Winthrop stated that he has received a bond
for grading and storm sewer for Somerset No. 2 and that it is
in order except that the signature of Herbert Schechter was
not notarized.
Clerk - Treasurer Radabaugh stated that in 1970
Mr. & Mrs. Hyman Cohen were charged for a special assessment
in conjunction with Improvement No. `69, Project No. 2 and they
paid the assessment in full on November 12. The County did not
take the Cohens off the assessment rolls as per the Village's
instructions of November 12, 1970, and the Cohens have been
paying on the assessment for the past two years.
Mr. Radabaugh requested that a refund in the amount of $413.25 be
made to the Cohens for the payments they have made for the
past two years.
Mayor Huber moved that an assessment refund in the amount of
$413.25 be made to Hyman and Ruth Cohen.
Councilman Wahl seconded the motion.
The Council acknowledged receipt of the 1972 Village
Financial Statement.
Mayor Huber moved the Council to adopt the following
motion:
RESOLVED that the claims submitted to the Village Council for
payment, a summary of which is set forth on the list attached
hereto and identified as List of Claims submitted for
payment, February 20, 1973, having been audited by the Village
Council, be and are hereby allowed and the Mayor and Clerk -
Treasurer of the Village of Mendota Heights are hereby authorized
and directed to issue Village checks in payment of said claims.

LICENSES Councilman Wahl moved approval of the list of licenses,
granting licenses to:

Councilman Lockwood seconded the motion.

ADJOURN There being no further business to come before the Council,
Councilman Gutzmer moved that the meeting be adjourned.
