1973-08-21 Council minutesPage 255 August 21, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, August 21, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:05 o'clock P.M. The following members were present: Mayor Huber, Councilmen Losleben, Gutzmer, Lockwood and Wahl. APPROVE MINUTES Ayes: 5 Nays: 0 HEARING -- TRANSPORT DRIVE/MENDOTA HEIGHTS ROAD, IMPROVEMENT NO. 73, PROJECT NO. 3 Councilman Lockwood moved approval of the minutes of the August 7 meeting as corrected. Councilman Wahl seconded the motion. Mayor Huber opened the hearing for discussion on the proposed construction of sanitary sewer, water, storm sewer, curb and gutter and street improvements to serve Transport Drive from Mendota Heights Road to Pilot Knob Road and on Mendota Heights Road from T.H. 13 to T.H. 55. Mayor Huber turned the hearing over to Village Administrator Johnson who then gave a review of the project. Improvements being considered include concrete curb and gutter along Mendota Heights Road, the upgrading with the widening of the existing 24 foot surface including additional base with a layer of bituminous material on top to make it a completed 44 foot, 9 ton street. Transport Drive would be constructed with the same street standards as Mendota Heights Road and improvements would include sanitary sewer, water mains and storm sewer construction. Mr. Johnson reported the following estimated costs of the improvements on Transport Drive: sanitary sewer extension on Transport Drive estimated to cost $72,333. An estimated assessment figure of $17.00 an assessible foot would bring in about $37,825 in assess- ments. The remainder of $34,508 is proposed to be paid for by General Obligation revenues because of oversize piping required to service an area north of the railroad tracks. Water mains estimated at $26,700, or $12.00 per front foot. Storm sewer estimated at $63,600, proposing $.05 per square foot assessed against benefitted property would bring in about $42,500, leaving about $21,100 for general obligation because of oversizing for future obligations. The estimated cost for upgrading Mendota Heights Road is $123,000, or $14.00 to $15.00 per front foot. A question and answer period followed. Ken Stensby of Northland Company was present to speak on the proposed improvement project. An opportunity was given to file objections with the Clerk on the proposed project. Councilman Gutzmer moved the hearing be closed at 8:20 o'clock P.M. Councilman Losleben seconded the motion. Councilman Lockwood moved the adoption of Resolution Number 73 -65, "RESOLUTION ORDERING CONSTRUCTION OF AN EXTENSION TO THE VILLAGE WATER DISTRIBUTION SYSTEM, SANITARY AND STORM SEWER SYSTEMS AND OF STREET, CURB AND GUTTER IMPROVEMENTS TO SERVE PROPERTIES ABUTTING ON MENDOTA HEIGHTS ROAD FROM STATE TRUNK HIGHWAY NO. 13 TO STATE TRUNK HIGHWAY NO. 55 AND TRANSPORT DRIVE FROM MENDOTA HEIGHTS ROAD TO PILOT KNOB ROAD." Councilman Wahl seconded the motion. Construction plans had been presented to the Building Inspector for review and approval prior to the meeting. Mayor Huber moved the Council grant a building permit to Inland Construction Company for an addition to the east side of the existing Pabst Meat Packing Plant. Councilman Lockwood seconded the motion. MARIE AVENUE Mayor Huber gave a review of the communications and IMPROVEMENTS considerations on the proposed Marie Avenue improvements continued from the August 7 meeting. The Mayor reported the following estimates in costs for the imp- rovements from Dodd Road to Delaware Avenue: total cost estimate of $280,000 at a proposed assessment rate of $15.00 per front foot would raise $105,000; a Village contribution of $21,450 or $3.00 per front foot would supplement the State Aid funds of about $153,550 or approximately $22.00 per front foot. August 21, 1973 Page 257 Councilman Losleben gave a review of the letter of original proposal in comparison to the present proposal; namely the 80 foot right-of-way was reduced to 66 feet of ROW and the 44 foot street reduced to 36 foot with the full fledged storm sewer system revised to a modified storm sewer system and the deletion of sidewalks from the present proposal. Councilman Lockwood suggested keeping an open mind on the possible desire for sidewalks along Marie Avenue before project completion. Village Administrator Johnson again noted that people west of I-35E have requested some type of walk-ways along Marie Avenue. Objection to the sidewalk issue was raised by some of the residents present. Councilman Wahl raised a question concerning continued maintenance of Marie Avenue after completion of construction and further commented on the proposed assessment rate of $15.00 to the residents being out of line, with concern to the resulting economic effect. Councilman Lockwood gave his opinion on the proposed assessment rate stating that this rate of assessment was not out of line for streets being constructed to the proposed standards. Other objections and comments followed concerning the proposed project and assessment rate. Mr. Johnson announced the provision that if the plans are approved by the Council with a 36 foot street width, the State will approve only if parking is allowed on one side of the street. Councilman Gutzmer stated that he too felt the assess- ment rate was steep and that during the time between ordering the project in and the assessment hearing, the Council should do whatever possible to come up with a better solution, a better price to the residents. Councilman Losleben moved the adoption of Resolution Number 73-66, "RESOLUTION ORDERING STREET IMPROVEMENTS ON MARIE AVENUE BETWEEN DODD ROAD AND DELAWARE AVENUE." Mayor Huber seconded the motion. Ayes: 5 Nays: 0 PLANNING COMMISSION Mr. Chuck Mertensotto was present to report on the CASE NO. 73-4 & 73-15, proposed preliminary plats and to ask for Council KOPP/GEARMAN approval. Mayor Huber moved approval of the Kopp/Gearman preliminary plats in general concept subject to many problems being resolved before final plat approval Ayes: 5 Nays: 0 CASE NO. 73-15, GEARMAN Page 258 August 21, 1973 and that the applicant come back with a preliminary after problems are worked out: the problems are in regard to drainage, County right-of-way on Lexington Avenue, Marie Avenue assessments being spread over the area, further study by the Village Engineer on realigning the east street to Summit Lane and upon the Mayor's suggestion that definite measures are made to insure that the designated "open space" remain public and wild. Councilman Wahl seconded the motion. Discussion was held on the variance for St. Peter's rectory because of the proposal of a duplex or condominium structure in an R-1 area. The matter is to be continued upon further work and consideration by the developers. RECESS The Council called for a recess at 10:50 o'clock P.M. The meeting readjourned at 11:05 o'clock P.M. FINAL PAYMENT, PARK PROJECT NO. 1 Ayes: 5 Nays: 0 CHANGE ORDER NO. 2 PARK PROJECT NO. 2 Ayes: 5 Nays: 0 HOUSE MOVING ORDINANCE Ayes: 5 Nays: 0 RUSS PROPERTY Councilman Losleben moved the adoption of Resolution Number 73-67, "RESOLUTION ACCEPTING WORK AND APPROVING FINAL PAYMENT (PROJECT ONE - PARK SITE DEVELOPMENT)," approving the final payment certificate in the amount of $1,665.83 to El Mac Landscaping, Inc. Councilman Gutzmer seconded the motion. Councilman Wahl moved the approval of Change Order No. 2 for Park Site Development Project No. 2, Marie Avenue Park, in the amount of up to $2,500.00, for grading to produce slope changes around the pond area -- subject to Park Commission approval at their meeting on August 22. Councilman Gutzmer seconded the motion. Councilman Losleben moved the adoption of Ordinance Number 111, "AN ORDINANCE PROVIDING FOR THE REMOVAL AND RELOCATION OF BUILDINGS WITHIN THE VILLAGE OF MENDOTA HEIGHTS." Councilman Lockwood seconded the motion. The Council acknowledged receipt of a letter from Mr. & Mrs. William Russ requesting a feasibility study on the construction of sanitary sewer to service their property on Wachtler Avenue. The Council acknowledged receipt of a letter from the League of Minnesota Municipalities regarding the Annual Congress of Cities to be held on December 2-6, 197 The Council acknowledged receipt of the July, 1973 Dakota County Planning and Development Newsletter. The Council acknowledged receipt of the Police Department monthly report for July, 1973. The Council acknowledged receipt of the Fire Department monthly report for June, 1973. The Council acknowledged receipt of the July 19 Parks and Recreation Commission minutes. Mayor Huber moved the adoption of Resolution Number 73-68, "RESOLUTION AUTHORIZING TRANSFER OF FUNDS," the transfer allows for certain expenditures to be disbursements from Federal Revenue Sharing funds and also establishes that Federal Revenue Sharing funds be appropriated for certain future expenditures. Councilman Gutzmer seconded the motion. The Council acknowledged receipt of the memo from Village Administrator Johnson on City Code Transition and responded with the following motion: In consideration of various election options hereto available to Village governments and also giving considerations to the legislative intent of Laws 1973, Chapter 123, I, Councilman Gutzmer move that the Village Council accept the intent of said Chapter 123, thereby establishing even-year elections, all in accordance with said Chapter. Councilman Losleben seconded the motion. The Village Engineer submitted a letter and two prints showing two different possible methods of handling the drainage for Mendota Plaza. The matter was referred to the Village Attorney for consideration and tabled until September 4 for further study by staff and Counsel. MISCELLANEOUS LIST OF CLAIMS Ayes: 5 Nays: 0 LICENSES Ayes: 5 Nays: 0 ADJOURN Ayes: 5 Nays: 0 Page 260 August 21, 1973 Councilman Lockwood indicated a problem in the Somerset View area regarding drainage affected by changing the grade of the sod. Village Administrator Johnson will prepare a proposed ordinance on boulevard obstruction. Mayor Huber moved the Council to adopt the following motion: RESOLVED that the claims submitted to the Village Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, August 21, 1973, having been audited by the Village Council, be and are hereby allowed and the Mayor and Clerk-Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims. Councilman Gutzmer seconded the motion. Councilman Wahl moved approval of the list of licenses, subject to approval by the Building Inspector, granting licenses to: Ted Murr, Inc. Quimby Co. E.L.
