1973-09-04 Council minutesPage 261 September 4, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, September 4, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Wahl, Gutzmer, Lockwood and Losleben. TAX ABATEMENTS County Assessor O'Toole had notified the Village Offices that he would not be present at the meeting. HEARING -- DUTCH ELM DISEASE CONTROL PROJECT Mayor Huber opened the meeting for the purpose of a hearing on a proposed Dutch Elm Disease control project for the area bounded by Highway 13, Wachtler Avenue, Emerson Avenue (extended) and the center line of Section 13. Mayor Huber turned the meeting over to Village Administrator Johnson for a history of the proposed project. Village Administrator Johnson briefly outlined the proposed project and stated that a notice of the hearing had been published in the Sun Newspaper and that letters and copies of the notice had been sent to the residents within the affected area. Mr. Johnson pointed out that State law encourages municipalities to provide certain services and then levy the cost for the services. He stated that 318 infected trees have been counted in the area and that two tree removal firms had been contacted for price quotations for the disposal and debarking of the trees: the quotes ranged from $70.00 to $90.00 per tree. Village personnel have been in close contact with the Department of Agriculture, Division of Plant Industry and two representatives from the Department, Milton Marinos and John Alberg, are in attendance at the meeting to answer any questions on the disease. Mr. Johnson stated that if the project is approved it is proposed that an assessment area, which would include all of the area within the project boundaries, be set up and that the assessment payments be handled in a manner similar to other public improvements. Mayor Huber asked if anyone in the audience has any questions or comments. Page 262 September 4, 1973 Objections and comments from the audience: Amos Martin, 700 Woodridge, asked where most of the trees are located. He also asked if the Council has met with the residents in the affected area. Mrs. Muriel Vaughan, 1256 Wachtler, asked about trenching and root grafts and also stated that Mr. Vaughan has the equipment to remove diseased trees from their property and they would prefer to remove the diseased trees themselvet. Lorraine Freischel, 663 Maple Park Drive, stated that a committee of the State Legislature will meet on September 17 to discuss Dutch Elm Disease control and suggested that Village representatives attend the meeting. Mr. Robert Clemens, 1138 Sylvandale Road, asked if any consideration would be given to those residents who have already removed diseased trees from their property. He also asked the Village Attorney to explain the definition of benefitted property with reference to assessment procedure. Mr. Harvey Miller, 715 Sylvandale Court, suggested that something should be done to control the disease on the north side of Highway 13 in Lilydale, stating that any effort to control the disease in the Ivy Falls area would be useless without some effort on the Lilydale side. Mr. David Koch, 1100 Sylvandale, asked that any decision by the Council be postponed so that the residents can discuss the suggested project and also suggested that Dutch Elm Disease control should be handled by the Metropolitan Council. Council members, Village Administrator Johnson and the representatives from the Department of Agriculture answered the questions posed. Mayor Huber stated that the hearing was called so that the residents could have some input into the discussion since several residents have voiced their alarm about the spread of the disease. He further stated that this is the Village's first attempt at joint removal of diseased trees. Village Administrator Johnson summarized the proceedings and welcomed any interested residents to contact him or the Village Council with any questions, suggestions or comments. Councilman Losleben seconded the motion. The Council called a recess at 9:25 o'clock P.M. and readjourned at 9:30 o'clock P.M. Mayor Huber acknowledged receipt of the August 28 Planning Commission minutes. Mr. Carmen Tuminelly and Mr. Harvey Bream were present to request approval of the landscape plans for Somerset "19". Mayor Huber moved approval of the landscape plans for Somerset "19" (to include the recommendations of Midwest Planning and Research) prepared by Buell Brothers in September, 1972. Councilman Losleben seconded the motion. Councilman Lockwood moved the approval of a front yard variance of ten feet from the existing conditions on Dodd Road for the east parking lot at Somerset "19" and a front yard variance of a maximum of 17 feet from the existing conditions on Wentworth Avenue for the west parking lot. Councilman Gutzmer seconded the motion. Village Administrator Johnson stated that the plans for Lee's Floor and Janitor Company are submitted for concept approval only and that the Planning Commission has recommended that the Zoning Ordinance be amended to allow office for janitorial, service in a B-1 district. Councilman Losleben moved that the Zoning Ordinance, Sec. 11.2(3) be amended to include "office for janitorial service, storage area for inventory and equipment for janitorial operations." Councilman Wahl seconded the motion. Mayor Huber moved that the Spring Company application for erection of a sign in the Mendota Plaza be denied without prejudice to reapplication because the sign was not completed in channel letters. Councilman Losleben seconded the motion. Page 264 September 4, 1973 TEMPORARY Councilman Gutzmer moved the adoption of Resolution IMPROVEMENT Number 73-69, "RESOLUTION PROVIDING FOR THE PUBLIC BONDS SALE OF $385,000 TEMPORARY IMPROVEMENT BONDS :OF 1973." Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 APPROVAL OF BUILDING PERMITS Ayes: 5 Nays: 0 ASSESSMENT HEARING ESTABLISHED Ayes: 5 Nays: 0 RESOLUTION ORDERING PREPARATION OF ASSESSMENT ROLL Ayes: 5 Nays: 0 1974 BUDGET MENDOTA PLAZA DRAINAGE Mayor Huber moved that building permits be issued to John R. Boller, 2341 Kressin Avenue and Frank R. Kelly, 639 Sunset Lane for construction of a tool shed on each of the properties. Councilman Losleben seconded the motion. Mayor Huber moved the adoption of Resolution Number 73-70, "RESOLUTION AUTHORIZING PREPARATION OF ASSESSMENT ROLLS AND CALLING FOR HEARING ON ASSESSMENT ROLLS FOR IMPROVEMENT NO. 72, PROJECT NO. 2, IMPROVEMENT NO. 72, PROJECT NO. 8, AND IMPROVEMENT NO. 72, PROJECT NO. 7." Councilman Gutzmer seconded the motion. Mayor Huber moved adoption of Resolution Number 73-71, "RESOLUTION AUTHORIZING PREPARATION OF ASSESSMENT ROLLS FOR IMPROVEMENT NO. 72, PROJECT NO. 5 AND IMPROVEMENT NO. 72, PROJECT NO. 6." Councilman Losleben seconded the motion. Village Administrator Johnson distributed to the Council copies of the proposed 1974 budget. Mayor Huber called for a special meeting to be held at 8:00 P.M., September 11, in the Village office for consideration of the proposed budget. The Village Council called for a preliminary hearing on September 18 for consideration of the drainage situation in the Mendota Plaza and directed Village Administrator Johnson to invite Mr. Cy Sheehy to appear at the meeting. LIST OF CLAIMS Mayor Huber moved the Council to adopt the following motion: Ayes: 5 Nays: 0 LICENSES ADJOURN Ayes: 5 Nays: 0 Page 265 September 4, 1973 RESOLVED that the claims submitted to the Village Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, September 4, 1973 having been audited by the Village Council, be and are hereby allowed and the Mayor and Clerk-Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims. Councilman Losleben seconded the motion. Village Clerk-Treasurer Radabaugh stated that the list of licenses is not ready for approval at this meeting.
