1973-09-18 Council minutesPage 266 September 18, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, September 18, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber introduced State Representative Raymond Kempe to the audience. Representative Kempe gave a brief presentation of the background for a meeting to be held in the Village Hall at 7:00 P.M. on Wednesday, September 26. Representative Kempe stated that the Senate Subcommittee on Metropolitan and Urban Affairs will hold a public hearing on the Metropolitan Airports Commission on September 26 and that he had requested that the hearing be held in Mendota Heights so that the residents could state their grievances against the MAC with regard to the acquisition of property in the Acacia Park Area. He stated that many of the residents feel that the MAC appraisals are not uniform and he feels that the residents should be heard. Representative Kempe also stressed his concern that Dakota County is not now represented on the MAC, however, he did not know whether or not this would be brought up at the meeting. Mayor Huber thanked Representative Kempe for taking time to appear at the Council meeting. CALL TO ORDER Mayor Huber called the meeting to order at 8:06 o'clock P.M. The following members were present: Mayor Huber, Councilmen Lockwood, Losleben, Wahl and Gutzmer. APPROVE MINUTES Councilman Losleben moved approval of the minutes of the August 21 meeting. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 TAX ABATEMENTS Ayes: 5 Nays: 0 Councilman Lockwood moved approval of the minutes of the September 4 meeting with corrections. Councilman Gutzmer seconded the motion. Mayor Huber moved that an abatement be granted to John H. Burg for Parcel #a26048, reducing assessed value from 40,000 to 35,480 for taxes payable in 1973. Councilman Losleben seconded the motion. Mayor Huber moved that abatements be granted to Esther B. Kirchner, reducing assessed value for Parcel #26126-A from 4,822 in 1970-71 to 3,300 for taxes payable in 1971-72 and from 17,800 in 1972 to 12,100 for taxes payable in 1973; and reducing assessed value for Parcel #26121 from 2,078 in 1970-71 to 1,455 for taxes payable in 1971-72, and from 7,800 in 1972 to 5,467 for taxes payable in 1973; and reducing assessed value for Parcel #26120 from 1,833 Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 MENDOTA PLAZA DRAINAGE CORRESPONDENCE Page 267 September 18, 1973 in 1970-71 to 1,277 for taxes payable in 1971-72 and from 6,867 to 4,801 for taxes payable in 1973. Councilman Lockwood seconded the motion. Councilman Lockwood moved that abatements be granted to Thomas O. Curley, reducing assessed value for Parcel #28915 from 334 in 1970-71 to 66 for taxes payable in 1971-72 and from 1,080 to 200 for taxes payable in 1973; and reducing assessed value for Parcel #28897 from 534 in 1970-71 to 200 for taxes payable in 1971-72 and from 1,760 to 600 for taxes payable in 1973. Mayor Huber seconded the motion. Mayor Huber moved that an abatement be granted to Arnold Ehlert, reducing assessed value for Parcel #a26018 from 16,040 to 11,640 for taxes payable in 1973. Councilman Gutzmer seconded the motion. Mr. Cy Sheehy was present for a discussion on Mendota Plaza drainage. Mayor Huber stated tha t the Village is cleaning the main drainage way and that a problem is developing from the runoff from the shopping center. Village Engineer Kishel explained two preliminary schemes for handling the runoff. Mr. Sheehy stated that he would like to study the first scheme and further stated that this scheme seems like a good solution to the problem. Mr. Sheehy stated that he would like to contact the Highway Department to find out what plans the State has for Highway 49 and that he will report back to the Council on October 2. The Council acknowledged receipt of a letter from Mr. A.A. Ledegar, 595 W. Butler Avenue, regarding the condition of W. Butler Avenue from Chippewa to Ivy Hill Drive. Mr. Ledegar, who was present at the meeting, stated that the holes are so bad they cannot be straddled and asked that something be done to repair the street. Mayor Huber explained the expenses involved in maintaining streets and also explained the Village's budgeting limitations. The Council discussed various methods of financing repairs and maintenance for unpaved streets and Mayor Huber stated that he will discuss various alternatives with Village Administrator Johnson. MISCELLANEOUS METROPOLITAN AIRPORTS COMMISSION COMMUNICATIONS DUTCH ELM DISEASE Ayes: 4 Nays: 0 CHANGE ORDER NO. 3, SOMERSET NO. 2 Ayes: 4 Nays: 0 ASSESSMENT HEARING Ayes: 4 Nays: 0 ROGERS LAKE LEVEL CONTROL Page 268 September 18, 1973 Councilman Gutzmer requested that the Village Clerk contact the school district relative to keeping school buses off of Coleshire Lane. Councilman Wahl gave the Council a brief synopsis of a School Board meeting regarding pathways along Delaware Avenue. Mayor Huber prepared by homes to be requested a offices. Mayor Huber Acting Mayor August, 1973 August, 1973 stated that a Bill of Rights has been the Highway Department for owners of acquired by MAC and that the Village has copy which can be posted in the Village left the meeting at 9:45 o'clock P.M. Lockwood acknowledged receipt of the Fire Department report and the Police Department report. Councilman Losleben suggested that the Council send a letter to the Dakota County Commissioners requesting that Dutch Elm disease control be handled on a County -wide basis, and supporting the position of other communities which have asked that Dutch Elm disease be handled on a regional level. Councilman Gutzmer moved the adoption of Resolution Number 73 -72, "RESOLUTION REQUESTING COUNTY CONTROL OF DUTCH ELM DISEASE." Councilman Losleben seconded the motion. Acting Mayor Lockwood moved approval of Change Order No. 3, for Improvement No. 72, Project No. 6, in the amount of $500. Councilman Losleben seconded the motion. Councilman Wahl moved the adoption of Resolution Number 73 -73, "RESOLUTION CALLING FOR HEARING ON ASSESSMENT ROLLS FOR IMPROVEMENT NO. 72, PROJECT NO. 6, IMPROVEMENT NO. 72, PROJECT NO. 5," the hearing to be held on October 9. Councilman Losleben seconded the motion. Councilman Losleben moved the adoption of Resolution Number 73 -74, "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR ROGER'S LAKE LEVEL CONTROL PROJECT (IMPROVEMENT NO. 72, PROJECT NO. 4)" with the bid date set for Ayes: 4 Nays: 0 REQUEST FOR BUILDING PERMIT Ayes: 4 Nays: 0 LIST OF CLAIMS Ayes: 4 Nays: 0 LICENSES Ayes: 4 Nays: 0 Page 269 September 18, 1973 October 12 at 11:00 A.M. Councilman Gutzmer seconded the motion. Councilman Wahl moved that a request for building permit from Mrs. Dorothy Valencour be referred to the Planning Commission for study and recommendation. Councilman Gutzmer seconded the motion. Acting Mayor Lockwood moved the Council to adopt the following motion: RESOLVED that the claims submitted to the Village Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, September 18, 1973, having been audited by the Village Council, be and are hereby allowed and the Mayor and Clerk-Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims. Councilman Losleben seconded the motion. Councilman Wahl moved approval of the list of licenses, granting licenses to: Inland Construction Corp. Lentsch Company, Inc. Wallmaster, Inc.
