1973-10-09 Council minutesPage 277 October 9, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Special Meeting Held on Tuesday, October 9, 1973 Pursuant to due call and notice thereof, the special meeting of the Village Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Lockwood, Wahl, Losleben and Gutzmer. INTRODUCTION Mayor Huber stated that the special meeting was called for the purpose of holding hearings on proposed assessment rolls for five improvement projects. He requested that anyone having questions or objections to an individual assessment submit a letter stating the question or objection. He also stated that anyone objecting to the assessment roll may leave his name and address with the Village Clerk. He further stated that all of the objections in letter form will be researched and answered by the Council in the near future. Mayor Huber turned the meeting over to Village Administrator Johnson for a history of the projects and assessment procedure. Village Administrator Johnson outlined the procedure followed in initiating improvement projects and the various procedures followed by the Council and staff before and during the improvement process. He also outlined the assessing policy and methods established for payment. HEARING -- Mayor Huber opened the meeting for the purpose of IMPROVEMENT a hearing on the assessment roll for Improvement NO. 72, PROJECT No. 72, Project No. 7, sanitary sewer improvements NO. 7, ZACHMAN/ to serve two residences on the east side of Dodd SHIELDS Road from Marie Avenue south about 350 feet. Mayor Huber turned the hearing over to Village Administrator Johnson. Village Administrator Johnson gave a brief history of the project and a presentation of the assessment total which, by mutual agreement, will be divided between the two property owners equally. Mayor Huber asked if anyone had any questions or objections to the proposed assessments. Ayes: 5 Nays: 0 HEARING -- IMPROVEMENT NO. 72, PROJECT NO. 8, SOMERSET VIEW Ayes: 5 Nays: 0 Page 278 October 9, 1973 There being no objections or questions, Mayor Huber moved that the hearing be closed and that Resolution Number 73 -77, "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR CONSTRUCTION OF AN EXTENSION TO THE VILLAGE'S SANITARY SEWER SYSTEM TO SERVE LOTS 24 and 25 IN WILLOW SPRINGS ADDITION (IMPROVEMENT NO. 72, PROJECT NO. 7)" be adopted. Councilman Wahl seconded the motion. The hearing was closed at 8:14 o'clock P.M. Mayor Huber opened the meeting for the purpose of a hearing on the assessment roll for Improvement No. 72, Project No. 8, Somerset View street improvement project at 8:15 o'clock P.M. Mayor Huber turned the meeting over to Village Administrator Johnson. Mr. Johnson gave a brief history of the project and a description of the improvements including a presentation of the assessment rates as follows: Streets: Coleshire Lane $7.10 per foot All other streets 8.85 per foot Driveways 0.30 per square foot Mayor Huber acknowledged receipt of a letter from Mr. H.R. Hinterthuer, 625 Emerson Avenue, in objection to the assessment on his property, and asked if anyone in the audience has an objection to or question on the assessment roll. Mr. Ora Wakefield, 5 Hingham Circle, stated that the contractor tore up part of his driveway during construction and he does not feel he should be assessed for the correction of the damages. Village Engineer Kishel explained the procedure used in assessing for the private driveway improvements and stated that he will research Mr. Wakefield's complaint. There being no further questions or objections, Councilman Lockwood moved that the hearing be closed and that Resolution Number 73 -78, "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR STREET IMPROVEMENTS TO SERVE THE SOMERSET VIEW AREA (IMPROVEMENT NO. 72, PROJECT NO. 8)" be adopted. Councilman Gutzmer seconded the motion. The hearing was closed at 8:48 o'clock P.M. HEARING -- IMPROVEMENT NO. 72, PROJECT NO. 2, SIMEK REARRANGEMENT Ayes: 5 Nays: 0 Page 279 October 9, 1973 Mayor Huber opened the meeting for the purpose of a hearing on the assessment roll for Improvement No. 72, Project No. 2, sewer, water, storm sewer, street and curb and gutter improvements to serve the Simek Rearrangement at 8:52 o'clock P.M. Mayor Huber turned the meeting over to Village Administrator Johnson. Village Administrator Johnson gave a brief history of the project and a description of the improvements including a presentation of the assessment rates as follows: Sanitary Sewer - Pagel Road - $14. Sanitary Sewer - Hazel Court - 11. Water - Pagel Road - 15. Water - Hazel Court - 13. Streets - Hazel Court - 19. Storm Sewer O. Sewer Service 200. Mr. William Simek, 2335 Dodd Road, questioned why the actual cost of the project was $25,000 over the $67,000 contractor's bid. Mr. Johnson explained the bidding procedure for improvement projects and stated that several right-of-way and easement costs which were not anticipated in the feasibility report had arisen during construction of the project and that the costs were greater because of the wet weather during construction and the soft soil. Mayor Huber stated that the Council and Engineer have studied the assessment rates to see why the increase was so great and invited Mr. Simek to come to the Village offices and study the records. There being no further questions or objections, Councilman Gutzmer moved that the hearing be closed and that Resolution Number 73-79, "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR CONSTRUCTION OF A WATER DISTRIBUTION SYSTEM, SANITARY AND STORM SEWER SYSTEMS, AND OF STREET, CURB AND GUTTER IMPROVEMENTS TO SERVE PART OF THE PAGEL ROAD AREA, (IMPROVEMENT NO. 72, PROJECT NO. 2)" be adopted. Mayor Huber seconded the motion. The hearing was closed at 9:35 o'clock P.M. RECESS HEARING -- IMPROVEMENT NO. 72, PROJECT NO. 5, ROGERS LAKESIDE EAST Ayes: 5 Nays: 0 Page 280 October 9, 1973 Mayor Huber called a recess at 9:35 o'clock P.M. The meeting readjourned at 9:50 o'clock P.M. Mayor Huber opened the meeting for the purpose of a hearing on the assessment roll for Improvement No. 72, Project No. 5, sewer, water, storm sewer, street and curb and gutter improvements to serve the Rogers Lakeside East area at 9:51 o'clock P.M. Mayor Huber turned the meeting over to Village Administrator Johnson. Village Administrator Johnson outlined the procedure followed in initiating improvement projects and also outlined the assessing policy and methods of payment. Mr. Johnson gave a brief history of the project including assessment rates as follows: Sanitary Sewer - $12.50 per foot Water Mains - 5.70 per foot Streets - 18.00 per foot Storm Sewers 0.047 per square foot Sewer Service - 200.00 each Water Service 250.00 each Mayor Huber requested that anyone having objections or questions on a particular assessment file a written objection with the Village offices so that the objections can be researched and answered by the Council at a future meeting. The Council acknowledged receipt of letters from: Dale R. Johnson, 2349 Dodd Road; Joyce Letven, 2371 Dodd Road; Milton Sprengler, 2370 Kressin Avenue; and Calvin Wagenknecht, 2341 Dodd Road. Mayor Huber asked for questions or comments from the audience. Mr. John Lapakko, 2295 Dodd Road, objected to the assessment against his property and questioned whether his benefit would equal the approximately $19,000 in assessments. Mr. Dale Peterson, 871 Cheri Lane, questioned the total cost of the sanitary sewer improvement. Mrs. Marilyn Nelson, 894 Wagon Wheel Trail, stated that the contractor has not returned her lot to its pre-construction condition. There being no further questions or comments from the audience, Mayor Huber moved that the hearing be closed and that Resolution Number 73-80, "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR ROGER'S LAKESIDE EAST IMPROVEMENTS (IMPROVEMENT NO. 72, PROJECT NO. 5)" be adopted. Councilman Losleben seconded the motion. The hearing was closed at 11:10 o'clock P.M. HEARING -- IMPROVEMENT NO. 72, PROJECT NO. 6, SOMERSET II Ayes: 5 Nays: 0 ADJOURN Ayes: 5 Nays: 0 Page 281 October 9, 1973 Mayor Huber opened the meeting for the purpose of a hearing on the assessment roll for Improvement No. 72, Project No. 6 sewer, water, storm sewer, street and curb and gutter improvements to serve the area known as Somerset II at 11:15 o'clock P.M. Mayor Huber turned the meeting over to Village Administrator Johnson. Village Administrator Johnson gave a brief history of the project, including the assessment rates as follows: Sanitary Sewer $10.00 per foot Water Mains 10.75 per foot Streets 14.25 per foot Storm Sewer 0.0562 per sq. foot Sewer Service 200.00 each Water Service 250.00 each Mayor Huber asked for questions or comments from the audience. Mr. Herbert Schechter objected to the inclusion, in the assessment roll, of the $1,950 change order for the holding pond and asked why Lots 1, 2 and 3, Block 2 were assessed for storm sewer at this time. Mayor Huber stated that the storm sewer assessment should be recalculated, spreading the assessments against Lots 1, 2 and 3, Block 2 over the remaining lots. There being no further questions or comments from the audience, Councilman Wahl moved that the hearing be closed, and that Resolution No. 73-81, "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR SOMERSET 2, (IMPROVEMENT NO. 72, PROJECT NO. 6)" be adopted. Councilman Gutzmer seconded the motion. The hearing was closed at 11:46 o'clock P.M. There being no further business to come before the Council, Councilman Wahl moved that the meeting be adjourned.
