1973-10-30 Council minutesPage 288 October 30, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Special Meeting Held Tuesday, October 30, 1973 Pursuant to due call and notice thereof, the special meeting of the Village Council, Village of Meridota Heights was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Acting Mayor Lockwood called the meeting to order at 8:09 o'clock P.M. The following members were present: Acting Mayor Lockwood, Councilmen Losieben, Gutzmer and Wahl. Mayor Huber had notified the Council that he would be absent. APPROVE Councilman Wahl moved approval of the minutes of the MINUTES October 2, 1973 meeting. Councilman Losieben seconded the motion. Ayes: 4 Nays: 0 BID AWARD -- Acting Mayor Lockwood moved the adoption of Resolution ROGERS LAKE Number 73-85, "RESOLUTION ACCEPTING BIDS AND AWARDING LEVEL CONTROL CONTRACT FOR CONSTRUCTION OF DRAINAGE SYSTEM AND LAKE PROJECT LEVEL CONTROL SYSTEM FOR ROGER'S LAKE (IMPROVEMENT NO. 72, PROJECT NO. 4)," conditional upon final approval from the Minnesota Highway Department, awarding the bid to Lametti and Sons, Inc. in the amount of $141,620. Councilman Gutzmer seconded the motion. Ayes: 4 Nays: 0 The Council called for a work session on Monday, November 5 at 4:00 o'clock P.M. in the Village offices to discuss the matter of catch basins on Wagon Wheel Trail being included in the Rogers Lake Level Control Project. PURCHASE OF Village Attorney Winthrop stated that he had PROPERTY negotiated the purchase ,of two easements, in connection with the Rogers Lake Overflow Project, over property owned by Muskey, Tansey and Stacker. The negotiated price for a permanent 30 foot easement and a temporary 50 foot easement is $550. As one alternative, the owners of the property offered to give the entire 8.27 acre parcel of property to the Village and sell the easement to the Village for $1,500. Councilman Losieben stated that this property could have some value as a part of the park system and suggested that $1,000 of the price be paid from the Park Bond Issue, the balance to be charged against the Rogers Lake Overflow Project. Page 289 October 30, 1973 Councilman Gutzmer moved the adoption of Resolution Number 73-86, "RESOLUTION PROVIDING FOR PURCHASE OF STACKER/TANSEY PROPERTY," in the amount of $1,500. Councilman Losleben seconded the motion. Ayes: 4 Nays: 0 PURCHASE OF Village Attorney Winthrop stated that he has PROPERTY negotiated the purchase of 2.6 acres of property owned by the Wachtler family and .7 acres owned by Gustav Webber located at Wentworth and Wachtler Avenues. The purchase price would be $9,000 for the 2.6 acre parcel and $3,100 for the .7 acre parcel. He also stated that as part of the purchase agreement, the Village must have a survey made, and the price will vary (based on $4,000 per acre) if the present measurements do not agree with the survey. Another consideration of the contract is that the Village must agree to deem that this purchase of property will satisfy the required park contribution if the adjacent Wachtler property is ever developed. Ayes: 4 Nays: 0 METROPOLITAN LEAGUE OF MUNICIPALITIES SOMERSET II Ayes: 4 Nays: 0 LEE'S FLOOR AND JANITOR COMPANY Ayes: 4 Nays: 0 EMPLOYEE ATTITUDE SURVEY Councilman Losleben moved the adoption of Resolution Number 73-87, "RESOLUTION PROVIDING FOR PURCHASE OF WACHTLER PROPERTY." Councilman Gutzmer seconded the motion. The Council acknowledged receipt of a Metropolitan League of Municipalities notice of a Labor Conference for Elected Offi0.als to be held on November 8. Councilman Losleben moved the adoption of Resolution Number 73-88, "RESOLUTION ACCEPTING DEVELOPER'S WORK ON SOMERSET II AND RELEASING CONTRACT BOND." Acting Mayor Lockwood seconded the motion. Councilman Gutzmer moved that the revised plot plan for the Lee's Floor and Janitor Company building dated October 17 be accepted. Councilman Losleben seconded the motion. Village Administrator Johnson outlined a memo on a proposed employee attitude survey for Village employees which would be prepared and administered by the League of Minnesota Municipalities. The League would fund 50% of the cost of the survey, the Village must fund the remaining 50%. Ayes: 4 Nays: 0 EIRE PROTECTION RATE INCREASE Page 290 October 30, 1973 Councilman Wahl moved that the Village Administrator be authorized to enter into a contract with the League of Minnesota Municipalities for an employee attitude survey for Village employees. Councilman Losleben seconded the motion. The matter of an increase in fire protection rates for Lilydale, Mendota and Sunfish Lake was tabled until the November 6, 1973 meeting. ASSESSMENT The Council acknowledged receipt of letters from COMPLAINTS R.J. Wolters, 11 Dorset Road, John Lapakko, 2295 Dodd Road, and Curtiss E. Coates, 2361 Dodd Road in objection to assessments. ADJOURN Ayes: 4 Nays: 0 ATTEST: Village Engineer Kishel stated that Mr. Wolters' objection had been taken care of. Mr. Wolters had paid the contractor for dkiveway improvements and was also assessed for the driveway improvements: the contractor has agreed to return the $100 payment for driveway construction. The Council discussed the assessment complaints received on the 1973 assessment rolls and a memo from the Village Administrator regarding the complaints. A special meeting was set for Monday, November 5 at 7:30 P.M. in the Village offices for the purpose of discussing the objections with the persons who submitted letters. No contact will be made and no discussion was held on letters received from those residents involved in a District Court Appeal on the assessment roll for Rogers Lakeside East. The Council directed the Village Administrator to contact Erwin Sell and Frederick Hughes and inform them that the assessments levied against their properties would be adjusted to reflect a $3.38 per foot assessment against 25% of the side yard length of their properties (for curb and gutter improvements). The Village Administrator was also directed to contact R.J. Wolters, advising him that the contractor will refund $100 to him. There being no further business to come before the Council, Councilman Losleben moved that the meeting be adjourned. Councilman Gutzmer seconded the motion.
