1973-11-06 Council minutesPage 291 November 6, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, November 6, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Lockwood, Losleben, Wahl and Gutzmer. APPROVE Councilman Wahl moved the approval of the minutes MINUTES of the October 9 meeting as corrected. Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 ZONING ORDINANCE Ayes: 5 Nays: 0 Councilman Lockwood moved the approval of the minutes of the October 16 meeting. Councilman Losleben seconded the motion. Mayor Huber opened the Meeting for the purpose of a public hearing on the proposed revised Zoning Ordinance. Village Administrator Johnson gave a brief history of the process which culminated in the proposed revised ordinance, stating that modifications in zoning districts are not under consideration as part of the hearing. Copies of the revised Zoning Ordinance were made available to the audience. Mayor Huber asked for comments or questions from the audience. Mrs. Tobey Lapakko, 1671 So. Victoria, asked some general questions which were answered by the Council. There being no further comments from the audience, Mayor Huber moved that hearing be closed. Councilman Gutzmer seconded the motion. The hearing was closed at 8:25 o'clock P.M. Councilman Gutzmer moved the adoption of Ordinance Number 112, "THE ZONING ORDINANCE OF MENDOTA HEIGHTS, RELATING TO A COMPREHENSIVE AMENDMENT AND REZONING OF THE VILLAGE, AMENDING ZONING ORDINANCE Ayes: 5 Nays: 0 FINAL PAYMENT, IMPROVEMENT NO. 72, PROJECT NO. 8 Ayes: 5 Nays: 0 FINAL PAYMENT, 1973 STREET OILING Ayes: 5 Nays: 0 1973 ASSESSMENT ROLL CORRECTIONS Page 292 November 6, 1973 NUMBER 32 AS AMENDED." Councilman Wahl seconded the motion. Councilman Losleben moved the adoption of Resolution Number 73-89, "RESOLUTION ACCEPTING WORK AND APPROVING FINAL PAYMENT (IMPROVEMENT NO. 72, PROJECT NO. 8)," authorizing the final payment certificate to Bi-Con Construction Co., Inc. in the amount of $7,594.33. Councilman Lockwood seconded the motion. Councilman Wahl moved the approval of the final payment certificate for 1973 street oiling to Bituminous Surface Treating Company in the amount of $437.62. Councilman Gutzmer seconded the motion. The Council adknowledged receipt of a letter from Bjorn Ulstad, Attorney for Dominic Alfonso, stating that a mistake was made on Mr. Alfonso's assessment for Improvement No. 70, Project No. 5 and requesting that the assessment be changed. The Council also recieved a memo from the Village Engineer responding to the letter. Mayor Huber directed Village Administrator Johnson to discuss the letter and response with Mr. Alfonso, and if necessary place the matter on the agenda for November 20. The Council acknowledged receipt of the September, 1973 Dakota County Planning and Development Newsletter. The Council acknowledged receipt of the Park and Recreation minutes of September 26. Councilman Losleben moved the approval of Park Site Development Project No. 2, Change Order No. 3, modifying work to be done on the channel and including the beach add alternate for Rogers Lake Park Site. Councilman Gutzmer seconded the motion. The Council acknowledged receipt of the October 23 Planning Commission minutes. The Council called a recess at 9:25 P.M. The meeting was readjourned at 9:35 P.M. Village Administrator Johnson stated that the Planning Commission has recommended approval of the application for rezoning to R-1 of property described as Lots 15 to 21 and Lots 28 to 33, Willow Springs Addition. Councilman Losleben seconded the motion. Mayor Huber moved to amend the motion to extend the hearing on rezoning to include the property from Marie Avenue to Warrior Drive and south to the R-1 District as it now exists. Councilman Lockwood seconded the motion. Mayor Huber moved that the application from the Lilydale Grand Central Corporation for a variance for off-street parking across from the principal use (Diamond Jim's), for employee parking only, be approved. Councilman Wahl seconded the motion. Mayor Huber moved that a public hearing be called for December 4, 1973 to consider the application for vacation of Pawnee Court and part of Pueblo Drive. Councilman Gutzmer seconded the motion. Councilman Losleben moved the approval of building plans for the expansion of the LCS Company building. Councilman Lockwood seconded the motion. Upon the recommendation of the Village Administrator, Councilman Gutzmer moved that George Noack, Jr., 596 Kirchner Avenue, be appointed to serve on the Volunteer Fire Department. Councilman Losleben seconded the motion. Village Adrhinistrator Johnson distributed for Council consideration copies of a proposed resolution setting forth a personnel code for Village employees. Mayor Huber moved the adoption of Resolution Number 73-90, "RESOLUTION ACCEPTING ENGINEER'S REPORT AND CALLING FOR HEARING ON PROPOSED Ayes: 5 Nays: 0 PROPOSED FIRE PROTECTION RATE INCREASE Ayes: 5 Nays: 0 ENGINEERING STATUS REPORT FINANCIAL STATEMENT LIST OF CLAIMS Ayes: 5 Nays: 0 LICENSES Ayes: 5 Nays: 0 Page 295 November 6, 1973 CONSTRUCTION OF STREET IMPROVEMENTS, STORM SEWER, AND OF AN EXTENSION TO THE VILLAGE'S WATER AND SANITARY SEWER SYSTEMS FOR MARIE AVENUE BETWEEN DODD ROAD AND VICTORIA AVENUE," the hearing to be held on January 15, 1974. Councilman Lockwood seconded the motion. Councilman Gutzmer moved that the Village Administrator be authorized to negotiate an increase in fire protection rates for Lilydale, Mendota and Sunfish Lake based on rates outlined in a memo from the Village Administrator distributed on October 30. Councilman Wahl seconded the motion. The Council acknowledged receipt of Village Engineer Ed Kishel's Engineering Status Report for the period ending October 31, 1973. Councilman Losleben requested that the estimated completion dates on the projects be included in future reports. The Council acknowledged receipt of the Village financial statement for September, 1973. Councilman Gutzmer moved the Council to adopt the following motion: RESOLVED that the claims submitted to the Village Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, November 6, 1973, having been audited by the Village Council, be and are hereby allowed and the Mayor and Clerk-Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims. Councilman Losleben seconded the motion. Councilman Wahl moved approval of the list of licenses, granting licenses to: Shelgren Construction Co. Wensmann Construction Co. Fleming Sheet Metal Co.
