1973-11-20 Council minutesPage 299 November 20, 1973 VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, November 20, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:10 o'clock P.M. The following members were present: Mayor Huber, Councilman Lockwood, Losleben, Wahl and Gutzmer. APPROVE Councilman Lockwood moved approval of the minutes of MINUTES the October 30 meeting with correction. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 FINAL PAYMENT, IMPROVEMENT NO. 72, PROJECT NO. 2 Ayes: 5 Nays: 0 FINAL PAYMENT, IMPROVEMENT NO. 72, PROJECT NO. 5 Ayes: 5 Nays: 0 COMMUNICATIONS Councilman Wahl moved approval of the minutes of the November 6, meeting with corrections. Councilman Losleben seconded the motion. Councilman Losleben moved approval of the minutes of the November 7 Election Canvassing Board. Councilman Wahl seconded the motion. Councilman Wahl moved the adoption of Resolution Number 73-91, "RESOLUTION ACCEPTING WORK AND APPROVING FINAL PAYMENT (IMPROVEMENT NO. 72, PROJECT NO. 2)," authorizing final payment to Beatson and Kelly, Inc. in the amount of $9,764.69. Mayor Huber seconded the motion. Councilman Gutzmer moved the adoption of Resolution Number 73-92, "RESOLUTION ACCEPTING WORK AND APPROVING FINAL PAYMENT (IMPROVEMENT NO. 72, PROJECT NO. 5)," authorizing final payment to Lametti & Sons, Inc. in the amount of $52,825.24. Councilman Lockwood seconded the motion. The Council acknowledged receipt of the Metropolitan Council development Framework Bulletin. Page 300 November 20, 1973 DEPARTMENT REPORTS The Council acknowledged receipt of the Police and Fire Department monthly reports for October, 1973. PLANNING COMMISSION APPOINTMENT Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 The Council acknowledged receipt of a letter from Planning Commission Chairman Edward Stringer in which Mr. Stringer expressed his desire to resign from the Planning Commission. The Council expressed its appreciation for Mr. Stringer's long and dedicated service to the Village. Mayor Huber moved that Mr. Edward Stringer's resignation from the Planning Commission be accepted. Councilman Wahl seconded the motion. Mayor Huber moved that Mr. Raymond Wheeler, 1426 Farmdale Road, be appointed to the Planning Commission to serve the remainder of Edward Stringer's term. Councilman Gutzmer seconded the motion. SQUAD CAR Village Administrator Johnson stated that quotations PURCHASE have been received from three automotive dealers on the purchase of a new Police squad car. He stated that of the three bids, the bid received from Fury Motors, Inc. for a Plymouth Satellite was the lowest and most closely met the specifications for the new squad. Councilman Lockwood moved that the Village Administrator be authorized to purchase a 1974 Plymouth Satellite (squad car) from Fury Motors, Inc. for the purchase price of $3,669.40. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 PERSONNEL Councilman Gutzmer moved the adoption of Resolution RESOLUTION Number 73-93, "RESOLUTION ESTABLISHING A PERSONNEL CODE FOR EMPLOYEES OF THE VILLAGE OF MENDOTA HEIGHTS," incorporating the changes recommended by the Village Administrator. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 SURFACE WATER MANAGEMENT STUDY OUTSIDE WATER CONNECTION CHARGES The Council called for a work meeting to be held in the Village offices on November 27 at 7:00 A.M. for the purpose of discussing the Surface Water Management Study. Village Administrator Johnson outlined a memo to the Council regarding water connection charges for the Inland Apartments in Lilydale and recommended adoption of a proposed resolution establishing connection charges for properties outside of Mendota Heights. Ayes: 5 Nays: 0 MISCELLANEOUS Ayes: 5 Nays: 0 FRIENDLY MARSH POND Ayes: 5 Nays: 0 ORDINANCE NO. 113 Ayes: 5 Nays: 0 ORDINANCE NO. 114 Ayes: 5 Nays: 0 Page 301 November 20, 1973 Councilman Gutzmer moved the adoption of Resolution Number 73-94, "RESOLUTION ESTABLISHING OUTSIDE WATER CONNECTION CHARGES." Councilman Losleben seconded the motion. Councilman Gutzmer moved that Mrs. Lois King be appointed as the Village representative on the Dakota County Committee on the future disposition of the County Courthouse. Councilman Lockwood seconded the motion. Councilman Losleben stated that he has received several requests from Friendly Hills residents to increase the depth of the pond to more than the proposed three foot depth. He stated that this will reduce the possibility of the pond drying up and becoming overgrown with weeds and will create a passive park area with wildlife habitat setting. Village Engineer Kishel stated that if a change is desired, it must be determined with the contractor whether the change would be within the scope of the contract and the contractor should be notified of the change as soon as possible since work on the pond has already begun. He suggested that if the pond depth is made greater, the north shoreline of the pond should be extended, pulling the pond farther from the homes in Friendly Hills. Councilman Losleben moved that the pond be dredged to a five or six foot depth, within the confines of the construction contract and at no additional cost, and if feasible, the pond area should be reduced in size, pulling the pond farther north and away from the residential area. Mayor Huber seconded the motion. Councilman Gutzmer moved the adoption of Ordinance Number 113, "AN ORDINANCE AMENDING ORDINANCE NUMBER 10." Councilman Lockwood seconded the motion. Councilman Wahl moved the adoption of Ordinance Number 114, "AN ORDINANCE AMENDING ORDINANCE NO. 20." Councilman Losleben seconded the motion. INVESTMENTS Ayes: 5 Nays: 0 COMMUNICATIONS LIST OF CLAIMS Ayes: 5 Nays: 0 LICENSES Ayes: 5 Nays: 0 Page 302 November 20, 1973 Councilman Lockwood moved that the Village Clerk-Treasurer be authorized to invest $170,000 in a six month time savings certificate with the Signal Hills State Bank with an interest rate of 81/2% and that the Clerk-Treasurer be authorized to invest $200,000 in a three month time savings certificate with the Cherokee State Bank at an interest rate of 81/2%. Councilman Gutzmer seconded the motion. The Council acknowledged receipt of a letter from Mr. J. Limback, 826 Wagon Wheel Trail regarding construction taking place near his home. Councilman Gutzmer moved the Council to adopt the following motion: RESOLVED that the claims submitted to the Village Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, November 20, 1973, having been audited by the Village Council, be and are hereby allowed and the Mayor and Clerk-Treasurer of the Village of Mendota Heights are hereby authorized and directed to issue Village checks in payment of said claims. Mayor Huber seconded the motion. Councilman Lockwood moved approval of the list of licenses, granting licenses to: Raymond G. Anderson Construction Co. Thomas L. Norman Co.
