Minutes of the Special Meeting
Held Tuesday, July 30, 1974
Pursuant to due call and notice thereof, the special meeting of the City
Council, City of Mendota Heights was held at 8:00 o'clock P.M. at the City Hall,
750 South Plaza Drive, Mendota Heights, Minnesota.
Acting Mayor Lockwood called the meeting to order at 8:05 o'clock P.M. The
following members were present: Acting Mayor Lockwood, Councilmen Losleben
and Wahl. Mayor Huber and Councilman Gutzmer had notified the Council that they
would be absent.

Mr. Larry Shaughnessy, Jr., City Financial Advisor,
opened the bids received for the sale of $125,000
Permanent Improvement Bonds. The following represent
the various banks and bond brokers bidding on the issue:
First National Bank of St. Paul bid $52,670 with a
percentage rate of 6.27%; Dain, Kalman and Quail bid
$54,050 with a percentage rate of 6.34%; Banc Northwest
bid $54,000 with a percentage rate of 6.428%; Marquette
National Bank of Minneapolis bid $52,615 with a
percentage rate of 6.263%; Jurand and Moody bid $54,307.50
with a percentage rate of 6.465%; Piper, Jaffray and
Hopwood bid $54,810 with a percentage rate of 6.525%.
Councilman Wahl moved the adoption of Resolution Number
74-68, "RESOLUTION AWARDING SALE OF $125,000 IMPROVEMENT
BONDS OF 1974," awarding the bid to the Marquette
National Bank of Minneapolis.
Councilman Losleben seconded the motion.
Councilman Losleben moved the adoption of Resolution Number
74-69, "RESOLUTION AUTHORIZING AND ESTABLISHING THE FORM
AND DETAILS OF $125,000 IMPROVEMENT BONDS OF 1974, AND
APPROPRIATING SPECIAL ASSESSMENTS FOR THE PAYMENT THEREOF."
Acting Mayor Lockwood seconded the motion.
Mr. Larry Shaughnessy opened the bids received for the
sale of $660,000 Temporary Improvement Bonds. The
following represent the various banks and bond brokers
bidding on the issue: Dain, Kalman and Quail bid
$129,228 with a percentage rate of 6.526%; First
National Bank of Minneapolis bid $127,050 with a
percentage rate of 6.41%; Banc Northwest bid $129,725
with a percentage rate of 6.55%; First National Bank of
St. Paul and Cherokee State Bank bid $124,280 with
a Percentage rate of 6.276%; Robert S. Peterson Company
and Payne, Webber, Jackson bid $122,100 with a percentage

rate of 6.166%; Marquette National Bank of Minneapolis
bid $124, 280 with a percentage rate of 6.276%.
Acting Mayor Lockwood moved the adoption of Resolution
Number 74-70, "RESOLUTION ACCEPTING BID ON SALE OF
$660,000 TEMPORARY IMPROVEMENT BONDS, SERIES 1974
AND PROVIDING FOR THEIR ISSUANCE," awarding the bid
to Robert S. Peterson Company and Payne)Webber, Jackson.

EAGLE RIDGE Mr. Carmen Tuminelly and several representatives of the
ASSOCIATION Eagle Ridge Association were present to request
information on future assessments for the construction
of Marie Avenue. The main concern of the Association
is the procedure to be used for spreading the assessments
for the common area. They were concerned that the
assessments might be levied against the condominiums
which are the closest to Marie Avenue rather than
spreading the assessments among the Association.

DISEASED TREES
The Council pointed out that no policy for assessing can
be established at this time since the assessment hearing
will most likely not be held until 1975 or 1976. It
was indicated, however, that the assessments would in
all probability not be charged against only the property
owners nearest Marie Avenue, because the entire
Association will benefit from the improvements.
Discussion of the Space Study proposals was tabled until
August 6.
Acting Mayor Lockwood called a recess at 9:40 o'clock P.M.
The meeting was readjourned at 9:45 o'clock P.M.
Administrator Johnson outlined the history of the
subject of municipal liquor, stating that in view of the
media advertising proposal before the State Legislature
last year very little work has gone into municipal
liquor for Mendota Heights. He stated that if the
Council were to decide to consider issuing private
off-sale licenses rather than a municipal operation, the
original Ordinances on municipal liquor would have to be
rescinded.
After a lengthy discussion, the matter was tabled until
August 6.
Administrator Johnson gave the Council a brief outline
of the diseased tree situation, stating that there are
25 diseased trees on public land and 609 diseased
trees on private property. He suggested that the City
work with Inver Grove Heights and West St. Paul to hire
a tree expert to check trees for disease, in order to
save staff time.
The Council also discussed time limits for removal of
diseased trees from private property, providing a dumping

area for trees taken down by individual property
owners, a possible levy increase for removal and
control of diseased trees and several other items.
Councilman Wahl suggested that Harvey Franzmeier
be allowed to use his own discretion in setting time
deadlines for removal of trees.
Councilman Losleben moved that the Mayor and Clerk
be authorized to execute the contract for 1974 Street
Oiling between the City of Mendota Heights and Allied
Blacktop, Inc.
Councilman Wahl seconded the motion.
Engineer Kishel and City Administrator Johnson outlined
the costs for the Rogers Lake Level Control Project
(Improvement No. 72, Project No. 4), and Engineer Kishel
asked for authorization to prepare the assessment roll
for the project.
Councilman Wahl moved the adoption of Resolution
Number 74-71, "RESOLUTION AUTHORIZING PREPARATION OF
ASSESSMENT ROLL FOR ROGERS LAKE LEVEL CONTROL PROJECT
(IMPROVEMENT NO. 72, PROJECT NO. 4)," the hearing to be
held on August 27.
Councilman Losleben seconded the motion.
Administrator Johnson stated that a meeting of Dakota
County Engineers will be held on July 31 to discuss
the Dakota County Thoroughfare Plan and that he would
inform the Council of the results of the meeting on
August 6.
There being no further business to come before the
Council, Acting Mayor Lockwood moved that the meeting
be adjourned.
Councilman Wahl seconded the motion.
