Minutes of the Regular Meeting
Held Tuesday, September 3, 1974
Pursuant to due call and notice thereof, the regular meeting of the City
Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City
Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Losleben, Wahl and Gutzmer.
Councilman Lockwood had notified the Council that he would be out of town.

Councilman Wahl moved approval of the minutes of the
August 6 meeting.
Mayor Huber seconded the motion.
Councilman Losleben moved approval of the minutes of the
August 20 meeting.
Mayor Huber seconded the motion.
Councilman Gutzmer moved approval of the minutes of the
August 27 meeting.
Councilman Wahl seconded the motion.
After a brief discussion, Councilman Gutzmer moved the
adoption of Resolution Number 74-84, "RESOLUTION ADOPTING
ASSESSMENT ROLL FOR ROGERS LAKE LEVEL CONTROL PROJECT
(IMPROVEMENT NO. 72, PROJECT NO. 4)," and directed the
City Engineer to prepare responses to the objections to the
assessment roll for discussion on September 17.
Councilman Losleben seconded the motion.
The Council acknowledged receipt of the August 27 Planning
Commission minutes.
Councilman Wahl moved that a public hearing on
Dr. Thomas Koepke's application for conditional use permit
to construct a veterinary hospital be held on October 1, and
that the City Administrator be directed to study and make
a recommendation on the trading of property between Dr. Koepke
and Brian Birch.
Councilman Losleben seconded the motion.

The Council acknowledged receipt of a memo from Park and
Recreation Commission Chairman Kevin Howe recommending the
initiation of condemnation proceedings for the acquisition
of the Allstrom/McCloud property for park purposes. City
Attorney Winthrop stated that although he would have no
objection to going to condemnation on the property he still
feels that it is possible to negotiate the property purchase.
Mayor Huber moved to table the matter until October 1, pending
additional negotiation.
Councilman Wahl seconded the motion.
Mayor Huber acknowledged receipt of a letter from
Mr. & Mrs. Courtney Pince in objection to their assessment
for the Rogers Lake Level Control Project. The City Engineer
was directed to prepare a response for the September 17
meeting.
The Council acknowledged receipt of a letter from the Dakota
County Administrator and a resolution regarding a proposal
for the discontinuation of the road and bridge fund
allotments.
Councilman Losleben moved the adoption of Resolution
Number 74-85, "RESOLUTION OPPOSING PROPOSED ELIMINATION OF
ROAD AND BRIDGE DISTRIBUTION FORMULA."
Councilman Wahl seconded the motion.
The Council acknowledged receipt of a memo from the
Association of Metropolitan Municipalities regarding a
membership meeting to be held on September 11. Councilman Wahl
and Councilman Gutzmer stated they would attend the meeting.
The Council also acknowledged receipt of a memo from the
Northern Dakota County Chamber of Commerce regarding an
informal meeting of elected officials to be held on
September 16.
The Council acknowledged receipt of a letter from
Mr. Robert McCarthy requesting a hearing to consider renaming
Swan Lane as Swan Drive. The City Administrator was directed
to contact the Post Office to determine if a conflict would be
caused by renaming the street.
After a brief discussion, Mayor Huber moved the adoption of
Resolution Number 74-86, "RESOLUTION REQUESTING COMMISSIONER
OF HIGHWAYS TO APPROVE BASIS FOR FINANCING CONSTRUCTION OF
MARIE AVENUE IMPROVEMENTS BETWEEN DODD ROAD AND VICTORIA
AVENUE."
Councilman Losleben seconded the motion.

RAILROAD Administrator Johnson explained a letter and proposed
SIGNALS Ex Parte Order from the Minnesota Department of Public Safety
regarding the installation of cantilever signals at the
railroad crossing on Mendota Heights Road.

MUNICIPAL LIQUOR
Mayor Huber moved that the proposed Ex Parte Order covering
installation of cantilever-type railroad crossing signals
at Mendota Heights Road be approved.
Councilman Wahl seconded the motion.
City Attorney Winthrop advised the Council that provisions
for private on-sale liquor license issuance would require a
referendum. The Council directed the Attorney to research
State statutes on referendums and prepare an opinion for the
City Council.
MISCELLANEOUS The Council acknowledged receipt of the August, 1974
Engineering Status Report.

BUILDING PERMIT
The Council acknowledged receipt of a proposed assessment roll
for the street scarifying and oiling project.
Mayor Huber moved the Council to adopt the following motion:
RESOLVED that the claims submitted to the City Council for
payment, a summary of which is set forth on the list attached
hereto and identified as List of Claims submitted for payment,
September 3, 1974, having been audited by the City Council, be
and are hereby allowed and the Mayor and Clerk-Treasurer are
hereby authorized and directed to issue City checks in payment
of said claims.
Councilman Losleben seconded the motion.
Councilman Wahl moved approval of the list of licenses,
granting licenses to:
Daniel T. Bowler & Son General Contractor License
Standard Heating & Air Conditioning Heating License
Domestic Mechanical Contractors Heating License
Councilman Losleben seconded the motion.
Building Inspector Bjorklund advised the Council that
Mr. William Wegner, 577 Valley Lane, has applied for a building
permit to construct a new garage on the site of his present
garage. He pointed out that a sideyard setback variance had
been granted to Mr. Wegner for the original garage and
recommended that the new building permit and associated
variance be granted.

Mayor Huber moved that the building permit and sideyard
setback variance be granted provided that the new garage
is no closer to the property line than the original garage.
Councilman Wahl seconded the motion.
There being no further business to come before the Council,
Councilman Wahl moved that the meeting be adjourned.
Councilman Losleben seconded the motion.
