Minutes of the Regular Meeting
Held Tuesday, September 21, 1976
Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Acting Mayor Lockwood called the meeting to order at 8:00 o'Clock P.M. The
following members were present: Acting Mayor Lockwood, Councilmen Losleben and Wahl.
Mayor Huber had notified the Council that he would be out of town.
Councilman Mertensotto had notified the Council that he would be late.
APPROVE MINUTES

Councilman Losleben moved approval of the minutes of the
September 7 meeting with corrections.
Councilman Wahl seconded the motion.
ABATEMENTS County Assessor O'Toole was present to request approval of a
list of abatements.

After a brief discussion, Councilman Wahl moved that an
abatement be granted to the Minneapolis/St. Paul Metropolitan
Airports Commission for Parcel No. 27-69150-251-00, reducing
the assessed value from 43 in 1974 and 1975 to nil for taxes
payable in 1975 and 1976.
Acting Mayor Lockwood seconded the motion.
Councilman Losleben moved that an abatement be granted to
Mrs. Emmie L. Swanson for Parcel No. 27-02700-020-02, reducing
the assessed value from 9992 to 5148 for taxes payable in 1976.
Councilman Wahl seconded the motion.
Councilman Mertensotto arriVedat 8:18 o'clock P.M.
ASSOCIATION OF Acting Mayor Lockwood introduced Mr. Vern Peterson, Executive
METROPOLITAN Director of the Association of Metropolitan Municipalities.
MUNICIPALITIES Mr. Peterson and Mr. Roger Peterson of the Association gave a
verbal and slide presentation of the Association accomplishments
and goals, and answered questions from the Council.

Financial Advisor Lawrence Shaughnessy was present regarding
financial needs and bonding.
After a brief discussion, Councilman Mertensotto moved the
adoption of Resolution No. 76-72, "RESOLUTION PROVIDING FOR
PUBLIC SALE OF $180,000 GENERAL OBLIGATION TEMPORARY IMPROVEMENT
BONDS OF. 1976, SERIES 1 AND $570,000 GENERAL OBLIGATION TEMPORARY
IMPROVEMENT BONDS OF 1976, SERIES 2," the bid opening to be held
on Ocfober 19, 1976.
Councilman Losleben seconded the motion.

Acting Mayor Lockwood opened the meeting for the purpose of a
public hearing on the proposed 1977 Budget. Administrator
Johnson outlined the budget proposal. The Council discussed
several items, including inflow/infiltration into the sewer
system, the possibility of a sewer rental rate increase and
public works facilities rental. Acting Mayor Lockwood asked
for questions or comments from the audience.
Mr. & Mrs. Robert Ridder, 1744 Dodd Road, urged the Council to
place a high priority on Dutch Elm Disease control, and
suggested that the City budget a suitable amount of funding
for 1977 and use matching State funds for a removal and control
program.
Mr. Richard Bancroft, 1350 Clement Street, stressed his concern
that the Council establish a firm and substantial budget amount
for Dutch Elm Disease control.
After a lengthy discussion, Acting Mayor Lockwood moved that the
hearing be closed,. and that the City Administrator be directed
to report on additional special levy fUnding for diseased tree
control. Councilman Mertensotto seconded the motion.
The hearing was closed at 11:18 o'clock P.M.
LARSON GREENHOUSE Mr. Robert Larson was present to request approval of a building
permit to allow construction of new greenhouse facilities at the
present greenhouse location. The Council acknowledged receipt
of a memo from the City Planner recommending approval of the
permit conditioned upon conformance with all of the appropriate
setbacks.

Councilman Mertensotto moved approval of the application for
building permit subject to the approval of the City Planner.
Acting Mayor Lockwood seconded the motion.
The Council acknowledged receipt of a memo from City Planner
Howard Dahlgren regarding a request for building permit from
the Richline Company. Richline proposes to construct an addition
on the west side of the present structure to house a compressor
unit. Mr. Dahlgren recommended that the permit be approved
subject to repainting of the entire building.
After a brief discussion, Councilman Mertensotto moved approval
of the application for building permit in accordance with the
Planner's recommendation.

SCHAAK The Council acknowledged receipt of a memo from the City Planner
ELECTRONICS regarding an application for building permit for construction
of an addition to the Schaak Electronics building, 1415 Mendota
Heights Road.

After a brief discussion, Councilman Wahl moved approval of the
application for building permit subject to final approval by
the City Planner and Building Inspector.
Councilman Losleben seconded the motion.
Councilman Losleben moved the adoption of Resolution No. 76 -73,
"RESOLUTION ORDERING CONSTRUCTION OF IMPROVEMENTS TO SERVE THE
IVY FALLS WEST ADDITION AND ADJACENT AREAS (IMPROVEMENT NO. 75,
PROJECT NO. 3, STAGE II)."
Acting Mayor Lockwood seconded the motion.
After a brief discussion, Councilman Losleben moved the adoption
of Resolution No. 76 -74, "RESOLUTION EXTENDING CONDITION
ATTACHED TO RESOLUTION NO. 74 -67," extending the use of the
second residence at 2288 Dodd Road as a permanent residence
through September 21, 1977.
Councilman Wahl seconded the motion.
Attorney Winthrop outlined the negotiations held with
Mr. Michael Kassan, Jr., regarding acquisition of a permanent
and a temporary easement (in connection with the Northeast Area
Improvement Project) over the Kassan property on Dodd Road.
He recommended that the City acquire the easements at a cost of
$950.
Councilman Mertensotto moved that the City Attorney be directed
to prepare the appropriate papers for acquisition of the .:.
easements.
Councilman Wahl seconded the motion.
MISCELLANEOUS The Council acknowledged receipt of the Engineering Status Report
for August.
PERSONNEL
The Council acknowledged receipt of the Police and Fire
Department monthly reports for August, 1976.
Administrator Johnson explained that the promotional testing
procedure for Sergeant in the Police Department has been
completed and that he concurred with the Police Chief's
recommendation that Dorance Wicks be appointed Sergeant.

Councilman Wahl moved that Dorance Wicks be appointed Police
Sergeant, effective October 1, 1976, at a monthly salary of
$1,400 per month.
Councilman Losleben seconded the motion.
Councilman Mertensotto moved the adoption of the following
motion:
RESOLVED that the claims submitted to the City Council for
payment, a summary of which is attached hereto and identified
as List of Claims submitted for payment, September 21, 1976,
having been audited by the City Council be and are hereby
allowed and the Mayor and Clerk-Treasurer are hereby authorized
and directed to issue checks in payment of said claims.
Acting Mayor Lockwood seconded the motion.
Councilman Mertensotto moved approval of the list of licenses,
granting licenses to:

There being no further business to come before the Council,
