1976-07-27 Council minutesPage 705 July 27, 1976 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Special Meeting Held Tuesday, July 27, 1976 Pursuant to due call and notice thereof, the special meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. ROLL CALL City Clerk Radabaugh called the roll. The following members were present: Councilmen Losleben, Mertensotto and Wahl. Mayor Huber and Councilman Lockwood had-notified the Council that they would be out of town. CALL TO ORDER Councilman Mertensotto opened the meeting at 8:00 o'clock P.M. Ayes: 3 Nays: 0 Councilman Wahl moved that Councilman Mertensotto be appointed Acting Mayor to preside over the meeting. Councilman Losleben seconded the motion. Acting Mayor Mertensotto advised the audience that the special meeting was called for the purpose of discussing and hearing comments on proposed assessment rolls for Improvement No. 75, Project No. 5, Cullen Avenue improvements; Improvement No. 74, Project No. 7, Bachelor Avenue improvements; and Improvement No. 73, Project No. 2, Marie Avenue improvements. He explained the public hearing procedure for the audience and asked that anyone with specific objections to his assessment should leave a written objection with the Clerk after the meeting or submit a written objection to the City offices by July 30. He explained that the written objections will be referred to the staff for investigation of the complaints and for report and recommendations to the City Council. He advised the audience that no decision would be made on adoption of the proposed assessment rolls at this meeting, but would be considered at a future Council meeting. IMPROVEMENT NO. 75 Acting Mayor Mertensotto opened the meeting for the purpose of PROJECT NO. 5, a hearing on the proposed assessment roll for Cullen Avenue CULLEN AVENUE Street improvements. He turned the meeting over to the City Administrator and Public Works Inspector for an explanation of the project. Administrator Johnson noted that hearing notices had been sent to the affected property owners and had been published in the legal newspaper. Public Works Inspector Pearson gave a brief history of the project. He stated that the total project cost, including right-of-way acquisition, was $9,781. It is proposed to assess $2,885 of the project cost, at a rate of $10.00 per assessible foot, and to carry the $6,896 balance on general obligation taxes. Ayes: 3 Nays: 0 Page 706 July 27, 1976 Acting Mayor Mertensotto asked for questions and comments from the audience. Mr. 0.J. Courtemanche, 2161 Theresa, asked about the assessment policy for corner lots. He objected to the assessment roll, asking why all the home-owners in the Curley's Valley View Addition should not be assessed since all of the homes are benefitted by the second access to the Addition and only four home-owners will be assessed. There being no further questions or comments from the audience, Councilman Wahl moved that the hearing be closed. Councilman Losleben seconded the motion. The hearing was closed at 8:32 o'clock P.M. Acting Mayor Mertensotto stated that anyone having a specific objection to his assessment should submit a letter to the City Clerk by July 30. IMPROVEMENT NO. 74, Acting Mayor Mertensotto opened the meeting for the purpose of PROJECT NO. 7, a hearing on the proposed assessment roll for Bachelor Avenue BACHELOR AVENUE improvements. Ayes: 3 Nays: 0 Administrator Johnson gave a brief history of the project. He stated that notices of the hearing had been mailed to the affected property owners and had been published in the legal newspaper. He outlined the proposed assessment rates as follows: sanitary sewer, $11.00 per front foot; water, $7.50 per front foot; storm sewer, $0.03 per square foot; streets, $22.00 per front foot; $250 for each sanitary sewer connection; $350 for each water connection. He noted that sanitary sewer, water, and storm sewer assessments can be paid over a 19 year period at 7% interest, and that street assessments can be paid over a 10 year period at 7% interest. Acting Mayor Mertensotto asked for questions and comments from the audience. Mr. Eugene Schway, representing Par 3 Golf, Inc., stated that Par 3 objects to their proposed assessments, and that Par 3 will ask for a deferment on a large portion of the proposed assessments. He stated that Par 3, Inc. will submit a letter of objection. Mr. John Fahey, 1709 Lansford Lane, requested information on the assessment formula used. He stated that his assessment is different from lots which are the same dimensions as his lot. There being no further questions or comments from the audience, Councilman Losleben moved that the hearing be closed. Councilman Wahl seconded the motion. The hearing was closed at 9:02 o'clock P.M. Page 707 July 27, 1976 IMPROVEMENT NO. 73, Acting Mayor Mertensotto opened the meeting for the purpose of a PROJECT NO. 2, hearing on the proposed assessment roll for Marie Avenue MARIE AVENUE improvements (Dodd Road to Victoria Avenue). Administrator Johnson gave a brief history of the project, noting that the project was initiated by the Council in December, 1972. He pointed out that hearing notices had been mailed to the affected property owners and had been published in the legal newspaper. The total project cost amounted to $800,539. He listed the assessment rates if the project were totally assessed and stated that it is proposed to apply approximately $600,000 in M.S.A. funds towards the project cost. He listed the following proposed assessment rates: Street improvements, $18.00 per foot for Marie Avenue, $10.00 per foot for Wachtler Avenue; Sanitary sewer at $15.00 per front foot; water at $12.00 per front foot; and storm sewer at $0.05 per square foot. Ayes: 3 Nays: 0 Acting Mayor Mertensotto asked for questions and comments from the audience. Mr. Richard Leyh, representing the Eagle Ridge Association, stated that the Association objects to the manner in which the proposed assessments were made. The Association does not feel that the townhouses which abut Marie Avenue receive any benefit from the street improvements. They feel that the entire Eagle Ridge area, including the condominiums and vacant portions of the Bream and Tuminelly property which do not abut Marie Avenue should share in the assessments. The Council discussed the proposed Eagle Ridge assessments at length with Mr. Leyh and other residents of Eagle Ridge. The Eagle Ridge people questioned the appropriateness of the term "benefit" as applies to the street improvements. Dr. C.N. McCloud stated that he and the other owners of the property on the north side of Marie Avenue, east of Victoria are requesting a deferment on the proposed assessments. The Council acknowledged receipt of letters from Dr. McCloud and Mr. Reynolds Guyer in regard to their proposed assessments. There being no further questions or comments from the audience, Councilman Losleben moved that the hearing be closed. Councilman Wahl seconded the motion. The hearing was closed at 10:08 o'clock P.M. Acting Mayor Mertensotto again stated that anyone having an objection to their proposed assessments should submit written comments to the City Clerk prior to July 30. ADJOURN There being no further business to come before the Council, Councilman Losleben moved that the meeting be adjourned. Councilman Wahl seconded the motion.
