1976-08-10 Council minutesPage 715 August 10, 1976 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Special Meeting Held Tuesday, August 10, 1976 Pursuant to due call and notice thereof, the special meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. CALL TO ORDER ROLL CALL IMPROVEMENT NO. 74, PROJECT NO. 2, ORCHARD: HUNTER Mayor Huber opened the meeting at 8:00 o'clock P.M. City Clerk Radabaugh called the roll. The following members were present: Mayor Huber, Councilmen Losleben, Mertensotto, Lockwood, and Wahl. Mayor Huber advised the audience that the special meeting was called for the purpose of discussing and hearing comments on the proposed assessment rolls for Improvement No. 74, Project No. 2. He explained the public hearing procedure for the audience and asked that anyone with specific objections to his assessment should leave a written objection with the Clerk after the meeting or submit a written objection to the City offices by 5:00 o'clock Friday, August 13th. He explained that the written objections will be referred to the staff for inves- tigation of the complaints and for report and recommendations to the City Council. He advised the audience that no decision would be made on adoption of the proposed assessment rolls at this meeting, but would be considered at a future Council meeting. Mayor Huber opened the meeting for the purpose of a hearing on the proposed assessment roll for Orchard-Hunter improvement. He turned the meeting over to the City Administrator for an explanation of the project. Administrator Johnson noted that hearing notices had been sent to the affected property owners and had been published in the legal newspaper. He stated that this project has been a larger and longer lasting project with the petition being received in June, 1973, the feasibility report concluded and the project ordered in on August 20, 1974. Bids were received in April 1975, construction began in May 1975, and concluded in the Spring of 1976. He explained that the project ran 10% over the estimated cost during the long project sequence. He stated that the proposed assessment rates are as follows: Frontage Road (T.H. 110, West of Lexington),'$16.50 per front foot; Lexington Avenue, $16.50 per front foot; Orchard Lane, $24.75 per front foot; Hunter Lane, $24.75 per front foot; Culligan Lane, $26.40 per front foot; Veronica Lane, $11.00 per front foot; an Area Assessment of $0.018 per square foot; and Sewer Services at $250.00 each. Page 716 August 10, 1976 The assessed portion of the project is approzimately $331,000. $71,000. was the cost of the upgrading and restoration on Lexington Avenue. The total City share amounts to approx- imately $125,000. and will be borne by General Obligation Bonds. Mayor Huber then invited questions, comments, or objections, • asking that each person state name and address for the record. James R. Olin, 1140 Orchard Place questioned the 01.8 per square foot assessment. Mr. Johnson stated that most parcels are assessed on both a front footage and area basis, but that the 01.8 per square foot is an assessment against all benefiting areas. Emmie L. Swanson, 1130 Orchard Place, asked if the total figure listed on the assessment roll was her total assessment. Hazel V. Treat, 1219 Highway 110, questioned the assessment amount of her front footage. Theodore Van, 1885 Hunter Lane, stated that he is submitting a letter requesting a feferment on six and one half acres of pasture land and also three and one half acres of ravine. Mrs. Edna Kelly, 1905 South Lexington, questioned why her land was assessed when it is the same type that was excluded from assessment as a wetland area, she also asked about the time limit requirement for hooking up to the sewer. Mr. Harold Radant, 1901 South Lexington Avenue asked for an explanation on area assessment on wetland areas. Mr. John T. Phillips, 1835 Hunter Lane, speaking for he and his father requested a portion of their land to reconsidered because of the low topography being beyond the natural drainage flow. He also questioned one parcel of his father's property as being double assessed. Mr. Redben Phillips, 1815 Hunter Lane, requested the Council to pressure the State to put in a culvert beneath Highway 110 enabling drainage of the wetland area involved. Mr. Harold Rolf, 1861 South Lexington will request a deferment from hooking up to the sewer because of his house located 500 feet from the road. John W. Barber, 1919 Hunter Lane, asked for recognition as being in attendance. Dr. Leo Culligan, 1225 Highway 110, requested explanation of his area assessment. Questions were raised about the developers to the East of Lexington, regarding the sewer service on the Gearman project as to why they were not being assessed. Mayor Huber, City Engineer Kishel and Administrator Johnson gave explanations on this issue, the area assessments are to be made.
