Res 2005- 06 Approving Wetlands Permit @ 682 Ivy Falls CourtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -06 A RESOLUTION APPROVING A WETLANDS PERMIT FOR A HOME ADDITION AT 682 IVY FALLS COURT WHEREAS, Mr. Will Rossbach, on behalf of Richard and Diane Smoolder, has applied for a Wetlands Permit for a Home Addition at 682 Ivy Falls Court [Property ID #27- 37601 - 060 -01, Ivy Falls 2nd Addition, SE1 /4 SW1 /4 Section 13- 028 -23] as proposed in Planning Case #05 -01; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 25, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for a Home Addition as presented to the Planning Commission on the evening of January 25, 2005 and as shown in Planning Case #05 -01, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for a Home Addition for 682 Ivy Falls Court as proposed in Planning Case #05 -01 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed project consists of an addition to the rear of the existing house. 2. The proposed addition will be constructed on a portion of existing deck. 3. The project also consists of an expansion of the deck area. 4. The construction will not encroach any closer to the edge of the adjoining creek, maintaining a wetland setback of 55 to 58 feet. 5. The construction will not create a significant increase in water runoff, nor will it affect the existing drainage pattern. 6. The project complies with all of the City's Zoning regulations, as well as the requirements of the City's Wetlands Ordinance. 7 The addition will be constructed without the use of heavy machinery. BE IT FURTHER RESOLVED that the Wetlands Peiuiit for a Home Addition for 682 Ivy Falls Court as proposed in Planning Case #05-01 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
