Res 2005- 07 Approving Lot Split @ 1316 Victory AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -07 A RESOLUTION APPROVING A LOT SPLIT AT 1316 VICTORY AVENUE WHEREAS, Melvin Koppen has applied for a Lot Split at 1316 Victory Avenue [Lot 1, Block 2, Furlongs Addition, Dakota County, Minnesota] as proposed in Planning Case #05 -02; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 25, 2005; and WHEREAS, The Planning Commission voted 7 -0 to recommend that the Council approve the Lot Split as presented to the Planning Commission on the evening of January 25, 2005 and as shown in Planning Case #05 -02. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Lot Split for 1316 Victory Avenue as proposed in Planning Case #05 -02 is hereby approved on the following conditions: 1. This subdivision approval does not imply any future approvals such as wetlands permits, variances, or any other approvals for a new house on the new lot. Such approvals if necessary must be applied for prior to construction of the new house. 2. Any new home on this new lot must conform to all requirements of the City's Aircraft Noise Attenuation Ordinance BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1 The proposed lot split creates two lots, both of which comply with the City's dimensional requirements for R -1, Single Family lots. 2. The applicant has petitioned, and agreed to pay, for the street and utility improvements necessary to serve the lot. 3. A single - family house that conforms to all zoning regulations can be constructed on the new lot without the need for variances or wetland permits. BE IT FURTHER RESOLVED that the Lot Split for 1316 Victory Avenue as proposed in Planning Case #05 -02 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
