Res 2005- 09 Denying Wetlands Permit @ 716 Third AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 05-09 A RESOLUTION DENYING A WETLANDS PERMIT WHEREAS, Mr. Stan Genadek applied for a Wetlands Paunit for alterations to a wetland at 716 Third Avenue as proposed in Planning Case #05-03; and WHEREAS, The applicant has failed to submit a detailed site plan of the proposed wetland alterations showing proposed drainage, grading and landscaping as required by the Wetlands Permit; and WHEREAS, the applicant received a letter dated January 7, 2005 from the City Engineer stating that the Wetlands Pennit application is incomplete; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 25, 2005 and continued the public hearing until their regular meeting on February 22, 2005; and WHEREAS, The Planning Commission voted 5-0 (with two Commissioners excused from the meeting) to recommend that the Council deny the Wetlands Permit on the evening of February 22, 2005. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that: 1. The Wetlands Permit at 716 Third Avenue is hereby denied due to the application being incomplete. 2. If the applicant chooses to reapply at a later date providing all information required by the City's Wetlands Permit, the permit application fee will be waived.
