RESOLUTION 05-10
A RESOLUTION APPROVING A CRITICAL AREA PERMIT
FOR RETAINING WALLS AND FILL FOR DENNIS AND LORI GALLIGAN
AT 1845 HUNTER LANE
WHEREAS, Dennis and Lori Galligan have applied for a Critical Area Permit
for Retaining Walls and Fill at 1845 Hunter Lane [Lot 2 Colliton Place, PID=27-18200-
020-00] as proposed in Planning Case #04-43; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on November 23, 2004; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Critical Area Permit for Retaining Walls and Fill as presented to the Planning
Commission on the evening of November 23, 2004 and as shown in Planning Case #04-
43 under certain conditions.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the Council approves a Critical Area Permit for the
following:
1. Construction of three retaining walls.
2. Placement of fill behind the retaining walls, in the vicinity of the driveway, and
other areas of the site.
3. Installation of landscaping within the front yard of the property.
with all work to be consistent with the plans and specifications as presented to the
Council on the evenings of December 7, 2004 and February 15, 2005 and as shown in
Planning Case #04-43 on the following conditions:
1. Any landscaping previously removed as part of the house construction shall be
restored.
2. The applicant shall adhere to the revised grading plan, as presented to the Council
at their February 15, 2005 meeting.
BE IT FURTHER RESOLVED that the Critical Area Permit for a Retaining
Walls and Fill for 1845 Hunter Lane as proposed in Planning Case #04-43 under the
above conditions would not have an adverse impact on the health, safety, and general
welfare of the citizens of the community and the surrounding land, and would not be
adverse to the general purpose and intent of the Zoning Ordinance.
