Res 2005- 12 Approving Critical Area Permit @ 716 Maple Park CourtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -12 A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR AN 8' X 12' HOME ADDITION AT 716 MAPLE PARK COURT WHEREAS, Mr. Gregg Conway has applied for a Critical Area Permit for an 8' x 12' Home Addition at 716 Maple Park Court [Lot 6 Block 6 Ivy Falls Addition and Outlot as Attached in Exhibit A] as proposed in Planning Case #05 -05; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on February 22, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Critical Area Permit for an 8' x 12' Home Addition as presented to the Planning Commission on the evening of February 22, 2005 and as shown in Planning Case #05 -05, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Critical Area Permit for an 8' x 12' Home Addition for 716 Maple Park Court as proposed in Planning Case #05 -05 is hereby approved. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed building expansion is more than 100 feet from the bluff line of the Mississippi River Critical Area. 2. The proposed building expansion is screened by the existing building from full view of the River. 3. The proposed building expansion is designed to use materials which match the existing structure, and will not cause a visual conflict with the goals and objectives of the Critical Area Ordinance. 4. The proposed building expansion meets all other applicable zoning regulations for the R -1 zoning district and the Critical Area Ordinance. BE IT FURTHER RESOLVED that the Critical Area Pei nit for an 8' x 12' Home Addition for 716 Maple Park Court as proposed in Planning Case #05 -05 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
