A RESOLUTION APPROVING
A WETLANDS PERMIT FOR AN OFFICE BUILDING
AT 1210 CENTRE POINTE CURVE
WHEREAS, Mr. John Farracci has applied for a Wetlands Permit for an Office
Building at 1210 Centre Pointe Curve [Lot 7 Block 1 Yorkton Pointe South, PIN =27-
88100- 070 -01] as proposed in Planning Case #05 -06; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on February 22, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Wetlands Permit for an Office Building as presented to the Planning
Commission on the evening of February 22, 2005 and as shown in Planning Case #05 -06,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Wetlands Permit for an Office Building for 1210 Centre
Pointe Curve as proposed in Planning Case #05 -06 is hereby approved on the following
conditions:
The building shall be at least 35 feet from the wetland at the nearest point.
2. The applicant shall submit a specific maintenance schedule to ensure that the
planting of prairie grasses near the building, and the planting of wetland prairie
grasses adjacent to the wetland edge are properly established over the first few
years, as shown on the landscaping plan submitted by the applicant.
3. The applicant shall submit a maintenance security to provide for proper
installation and growth of the landscape plan.
4. The applicant shall execute and submit a contract with an experienced prairie
grass installation firm to provide assurance that the seeding program will be
properly cared for.
5. The applicant shall comply with all requirements of the City Engineer, including
but not limited to the following:
a. The applicant shall list the impervious surface area percentage on the site.
b. The applicant shall change the drainage arrows on the pedestrian ramp areas
to reflect the opposite drainage flow direction.
c. The applicant shall increase the grades along the north parking lot curb line to
eliminate ponding of water in the paved area.
d. The applicant shall extend the silt fence an additional 200 feet along west
property line to Centre Point Curve.
e. The applicant shall verify the location, size, and depth of structure DMH1.
The applicant shall follow St. Paul Water Utility STANDARDS for the
Installation of Water Mains for proper spacing of utilities.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
The proposed office building meets all requirements of the B-1 zoning district
regulations.
2. The proposed office building meets the requirements and policies of the City's
Wetlands Ordinance.
3. The proposed landscaping plan is consistent with the intent of the Wetlands
Ordinance, including a naturalized landscape adjacent to the wetland area.
BE IT FURTHER RESOLVED that the Wetlands Permit for an Office Building
for 1210 Centre Pointe Curve as proposed in Planning Case #05-06 would not have an
adverse impact on the health, safety, and general welfare of the citizens of the community
and the surrounding land, and would not be adverse to the general purpose and intent of
the Zoning Ordinance.
