Res 2005- 21 Approving Wetlands Permit @ 614 Hidden Creek TrailCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -21 A RESOLUTION APPROVING A WETLANDS PERMIT FOR A FIVE -FOOT HIGH WROUGHT IRON POOL FENCE AT 614 HIDDEN CREEK TRAIL WHEREAS, Mr. Richard Chapman has applied for a Wetlands Permit for a Five -Foot High Wrought Iron Pool Fence at 614 Hidden Creek Trail [Lot 10, Block 1, Hidden Creek Estates] as proposed in Planning Case #05 -09; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 30, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for a Five -Foot High Wrought Iron Pool Fence as presented to the Planning Commission on the evening of March 30, 2005 and as shown in Planning Case #05 -09, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for a Five -Foot High Wrought Iron Pool Fence for 614 Hidden Creek Trail as proposed in Planning Case #05 -09 is hereby approved under the following conditions: 1. The fence shall be located out of the existing Scenic Easement area and Drainage and Utility Easement area, as indicated on the survey by Randy M. Morton of John Oliver and Associates, inc. dated 9/22/03 and submitted by the applicant to the Council on April 5, 2005. 2. The fence shall meet the City's height and openness requirements. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The fence will have little or no negative impact on the water resource. 2. The fence is located to avoid encroachment into the Scenic easement and Drainage and Utility Easement. BE IT FURTHER RESOLVED that the Wetlands Permit for a Five -Foot High Wrought Iron Pool Fence for 614 Hidden Creek Trail as proposed in Planning Case #05 -09 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
