RESOLUTION 05-22
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR A DETACHED GARAGE MODIFICATION
AT 1737 DELAWARE AVENUE
WHEREAS, Mr. Kevin Courtney and Mr. John Weikert have applied for a
Conditional Use Permit and Variance for a Detached Garage Modification at 1737
Delaware Avenue [Section 24 Twn 28 Range 23 E 526.39 ft of N half of S half of N half
of SE quarter of SE quarter, PID=27-02400-023-79] as proposed in Planning Case #05-
10; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on March 30, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Conditional Use Permit for a Detached Garage Modification as presented to
the Planning Commission on the evening of March 30, 2005 and as shown in Planning
Case #05-10; and
WHEREAS, The Planning Commission also voted to recommend that the
Council make a fmding that the Detached Garage Modification as presented to the
Planning Commission on the evening of March 30, 2005 and as shown in Planning Case
#05-10 does not require a Variance,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for a Detached Garage
Modification for 1737 Delaware Avenue as proposed in Planning Case #05-10 is hereby
approved under the folio-wing condition:
The finished space shall be used for storage purposes only as described in the
applicant's materials submitted to the Planning Commission for their March 30,
2005 meeting and to the City Council for their April 5, 2005 meeting.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
1. Although the proposed detached garage modification requires a Conditional
Use Pennit, upon receipt of said CUP, it is consistent with the requirements of
the zoning ordinance and does not require a variance because it does not
constitute an addition of usable space.
BE IT FURTHER RESOLVED that the Conditional Use Pelinit for a Detached
Garage Modification for 1737 Delaware Avenue as proposed in Planning Case #05-10
would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
