RESOLUTION 05-30
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
AND WETLANDS PERMIT FOR GRADING WORK
FOR PLAYGROUND IMPROVEMENTS AT 1355 DODD ROAD
WHEREAS, Mr. Mark Fenton has applied for a Conditional Use Permit and
Wetlands Peimit on behalf of ISD 197 for Grading Work for Playground Improvements
at Somerset Elementary School at 1355 Dodd Road [legal description] as proposed in
Planning Case #05-16; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on April 26, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
deny the Conditional Use Permit and Wetlands Permit for Grading Work for Playground
Improvements as presented to the Planning Commission on the evening of April 26, 2005
and as shown in Planning Case #05-16;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and Wetlands Permit for Grading
Work for Playground Improvements for 1355 Dodd Road as proposed in Planning Case
#05-16 is hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
The proposed project will create a natural buffer between the creek and the
playground.
2. The proposed project will reduce erosion that is currently occurring on the site.
BE IT FURTHER RESOLVED that the Conditional Use Permit and Wetlands
Permit for Grading Work for Playground Improvements for 1355 Dodd Road as proposed
in Planning Case #05-16 would have an adverse impact on the health, safety, and general
welfare of the citizens of the community and the surrounding land, and would be adverse
to the general purpose and intent of the Zoning Ordinance.
