RESOLUTION 05-33
A RESOLUTION APPROVING A WETLANDS PERMIT
FOR A NEW HOME TO ENCROACH NO FURTHER INTO THE WETLAND
SETBACK THAN 25 FEET FOR A MINIMUM DISTANCE OF 75 FEET FROM
THE EXISTING WETLAND AT 1280 LAKEVIEW AVENUE
WHEREAS, Mr. Kurt Hagen has applied for a Wetlands Permit for a New Home
at 1280 Lakeview Avenue [Lot 1, Block 5 Furlong Addition, Dakota County, Minnesota,
According to the Recorded Plat; Pin#27-28400-010-05] as proposed in Planning Case
#05-14; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on April 26, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Wetlands Permit for a New Home as presented to the Planning Commission
on the evening of April 26, 2005 and as shown in Planning Case #05-14;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Wetlands Permit for a New Home to encroach no further
into the wetland setback than 25 feet for a minimum distance of 75 feet from the existing
wetland at 1280 Lakeview Avenue as proposed in Planning Case #05-14 is hereby
approved on the following conditions:
1. The existing septic system shall be properly abandoned and the new home shall
be connected to City sewer and water.
2. The existing driveway shall be removed and a new driveway shall be built outside
of the 100-foot wetland buffer.
3. Erosion control measures shall be implemented during home demolition and
reconstruction activities as recommended by the City Engineer.
4. Natural vegetation shall be provided along the edge of the wetland to minimize
erosion in the long term.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
1. The proposed home will encroach no further into the wetland setback than 25
feet for a minimum distance of 75 feet from the existing wetland.
2. No existing vegetation removal will occur since the improvements on the site
are being constructed in the location of previous buildings.
BE IT FURTHER RESOLVED that the Wetlands Permit for a New Home for
1280 Lakeview Avenue as proposed in Planning Case #05-14 would not have an adverse
impact on the health, safety, and general welfare of the citizens of the community and the
surrounding land, and would not be adverse to the general purpose and intent of the
Zoning Ordinance.
