RESOLUTION 05 -36
A RESOLUTION APPROVING A WETLANDS PERMIT
FOR A SHED AT 2247 SWAN COURT
WHEREAS, Mr. William Dumond has applied for a Wetlands Permit for a Shed
at 2247 Swan Court [Lot 2, Block 1, Eide Estates, According to the Recorded Plat
Therof, Dakota County, MN. PIN: 27 23365 020 01] as proposed in Planning Case #05-
20; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on May 24, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Wetlands Permit for a Shed as presented to the Planning Commission on the
evening of May 24, 2005 and as shown in Planning Case #05 -20;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Wetlands Permit for a Shed for 2247 Swan Court as
proposed in Planning Case #05 -20 is hereby approved on the following condition:
(1) The applicant shall document existing area vegetation, including plans to seed
or plant the area around the shed with similar vegetation, and demonstrate to
the City that the shed construction will not negatively impact area vegetation.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
The proposed shed is located in an area which will minimize visibility of the
structure from neighboring property.
2. The structure is small and will be constructed of materials similar to those of
existing structures in the area.
3. With the condition that the applicant provides additional documentation, no
existing vegetation removal will occur in the wetland buffer area other than
the site of the shed that the applicant has proposed.
4. The improvements appear to comply with the intent and the regulations of the
Wetlands Ordinance.
BE IT FURTHER RESOLVED that the Wetlands Peliuit for a Shed for 2247
Swan Court as proposed in Planning Case #05 -20 under the above condition would not
have an adverse impact on the health, safety, and general welfare of the citizens of the
community and the surrounding land, and would not be adverse to the general purpose
and intent of the Zoning Ordinance.
