Res 2005- 37 Wetlands Permit 879 Mendakota CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -37 A RESOLUTION APPROVING A WETLANDS PERMIT FOR A NEW HOME AT 879 MENDAKOTA COURT WHEREAS, Mr. Don Streeter has applied for a Wetlands Permit for a New Home at 879 Mendakota Court [Lot 11, Block 1, Mendakota Estates, Dakota County] as proposed in Planning Case #05 -21; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 24, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Wetlands Permit for a New Home as presented to the Planning Commission on the evening of May 24, 2005 and as shown in Planning Case #05 -21; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit for a New Home for 879 Mendakota Court as proposed in Planning Case #05 -21 is hereby approved on the following conditions: 1. No portion of the house shall be constructed within the 100 -foot wetland buffer. 2. The applicant shall provide information on the proposed materials for the wall and steps, and verify that no vegetation is removed that is not necessary for the project, thus retaining a natural landscape cover. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: 1. The proposed project meets the intent of the Wetlands Ordinance. 2. The neighboring property has a similar configuration. 3. The proper erosion control measures are being proposed. 4. No vegetation will be removed that is not required for the project. BE IT FURTHER RESOLVED that the Wetlands Permit for a New Home for 879 Mendakota Court as proposed in Planning Case #05 -21 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
