RESOLUTION 05 -38
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR A 48" HIGH BLACK VINYL CHAIN -LINK FENCE
AT 2459 HAMPSHIRE COURT •
WHEREAS, Nicolas and Julie Smith have applied for a Conditional Use Permit
for a 48" High Black Vinyl Chain -Link Fence at 2459 Hampshire Court [Lot 4, Block 2
Hampshire Estates (PID: #27- 31800 - 040 -02)] as proposed in Planning Case #05 -22; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on May 24, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Conditional Use Permit for a 48" High Black Vinyl Chain -Link Fence as
presented to the Planning Commission on the evening of May 24, 2005 and as shown in
Planning Case #05 -22;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for a 48" High Black Vinyl
Chain -Link Fence for 2459 Hampshire Court as proposed in Planning Case #05 -22 is
hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
1. The proposed project will not further impact traffic visibility on Huber Drive.
2. There is a Fence in a similar location on a neighboring property.
3. The Fence will not negatively impact any neighboring properties.
4. Construction of the Fence in this location will preserve a significant amount of
vegetation.
BE IT FURTHER RESOLVED that the Conditional Use Permit for a 48" High
Black Vinyl Chain -Link Fence for 2459 Hampshire Court as proposed in Planning Case
#05 -22 would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
