Res 2005- 47 CUP 1301 Delaware AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05-47 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A DETACHED GARAGE AT 1301 DELAWARE AVENUE WHEREAS, Troy and Debra Davison have applied for a Conditional Use Permit for a Detached Garage at 1301 Delaware Avenue [Lot 4, Block 1, Somerset Heights, excepting the west 110 feet thereof] as proposed in Planning Case #05-23; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on June 28, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for a Detached Garage as presented to the Planning Commission on the evening of June 28, 2005 and as shown in Planning Case #05-23; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for a Detached Garage for 1301 Delaware Avenue as proposed in Planning Case #05-23 is hereby approved on the following conditions: The garage shall meet applicable 10 foot side and rear yard setback requirements. 2. The garage shall match the principal building in color. 3. The existing garage slab and driveway apron shall be removed where practical and re-established in turf within six months of CUP issuance. The applicant shall submit a restoration plan which will be subject to staff review and approval. 4. The applicant shall remove the shed in the rear of the existing garage within six months of CUP issuance. BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed garage meets all zoning requirements for setback and size. 2. The proposed detached garage is consistent with other single family properties in the area. 3. The proposed garage will be able to be designed and constructed to be consistent with the architecture and materials of the principal building. 4. The relation of the driveway will eliminate an existing shared driveway condition that causes safety concerns for the applicant. BE IT FURTHER RESOLVED that the Conditional Use Permit for a Detached Garage for 1301 Delaware Avenue as proposed in Planning Case #05-23 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
