Res 2005- 48 CUP 2276 Apache StCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05 -48 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A 42" HIGH SILVER CHAIN LINK FENCE AT 2276 APACHE STREET WHEREAS, Brian and Andrea Crosby have applied for a Conditional Use Peiiuit for a 42" High Silver Chain Link Fence at 2276 Apache Street (Lot 10 Block 11, Friendly Hills Rearrangement, according to the plat thereof now on file and of record in the office of the Registrar of Titles within and for Dakota County, State of Minnesota [27- 27800- 100-11)) as proposed in Planning Case #05 -24; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on June 28, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for a 42" High Silver Chain Link Fence as presented to the Planning Commission on the evening of June 28, 2005 and as shown in Planning Case #05 -24; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for a 42" High Silver Chain Link Fence for 2276 Apache Street as proposed in Planning Case #05 -24 is hereby approved on the following condition: . The fence setback from Pontiac Place shall be specified (i.e., shall be consistent with the existing fence.) BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed project will not further impact traffic visibility at the Apache Street/Pontiac Place intersection. 2. The proposed fence type and height constitutes a continuance of a fence segment which presently exists along the north property line of the subject property. 3. The 42" High Silver Chain Link Fence will not negatively impact any neighboring properties. BE IT FURTHER RESOLVED that the Conditional Use Permit for a 42" High Silver Chain Link Fence for 2276 Apache Street as proposed in Planning Case #05 -24 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
