Res 2005- 49 CUP 1732 Vicki LaneCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 05-49 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A FIVE FOOT HIGH BLACK CHAIN LINK FENCE AT 1732 VICKI LANE WHEREAS, Cori Johnson has applied for a Conditional Use Permit for a Five Foot High Black Chain Link Fence at 1732 Vicki Lane [Tilsens Highland Heights 29 1, PIN:27-76400-290-01] as proposed in Planning Case #05-25; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on June 28, 2005; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for a Five Foot High Black Chain Link Fence as presented to the Planning Commission on the evening of June 28, 2005 and as shown in Planning Case #05-25; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for a Five Foot High Black Chain Link Fence for 1732 Vicki Lane as proposed in Planning Case #05-25 is hereby approved on the following conditions: . The fence shall be black coated chain link. 2. The fence shall be screened from the road with natural plantings (arborvitae). BE IT FURTHER RESOLVED that in support of the above approval, the Council hereby makes the following Findings of Fact: The proposed Five Foot High Black Chain Link Fence is consistent with other Fences in the immediate area. 2. The proposed Five Foot High Black Chain Link Fence exceeds the 30% openness requirement of the Zoning Ordinance. 3. The proposed Fence will be constructed of black-coated chain link material, reducing its visual impact. 4. The proposed Five Foot High Black Chain Link Fence complies with the requirements and intent of the Conditional Use Permit regulations. BE IT FURTHER RESOLVED that the Conditional Use Permit for a Five Foot High Black Chain Link Fence for 1732 Vicki Lane as proposed in Planning Case #05-25 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
