RESOLUTION 05-50
A RESOLUTION APPROVING
A FIVE FOOT FRONT YARD SETBACK VARIANCE
FOR A EIGHT FOOT DEEP OPEN FRONT PORCH AT 1155 DODD ROAD
WHEREAS, Jason Hinchliff has applied for a Front Yard Setback Variance (to
the "String Rule") for an Open Front Porch at 1155 Dodd Road [Kirchner Addition 12 8,
PID: 27-42100-120-08] as proposed in Planning Case #05-26; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on June 28, 2005; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve a Five Foot Front Yard Setback Variance for a Eight Foot Deep Open Front
Porch as presented to the Planning Commission on the evening of June 28, 2005 and as
shown in Planning Case #05-26;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Five Foot Front Yard Setback Variance for an Eight Foot
Deep Open Front Porch for 1155 Dodd Road as proposed in Planning Case #05-26 is
hereby approved.
BE IT FURTHER RESOLVED that in support of the above approval, the
Council hereby makes the following Findings of Fact:
The proposed addition is an open eight foot deep open front porch, not an
enclosed building, lessening the impact on the view of the property.
2. The proposed addition would encroach just 5 feet into the "string rule"
setback, similar to other open front porch additions that have been approved.
3. The proposed addition would be no closer to the street that the existing
neighboring home to the north.
4. The proposed addition would be approximately 7 feet farther from the front
property line than the minimum 30 foot setback.
5. Until a recent home was built to the south, the applicant's front setback for the
open front porch would have been approximately 33 feet and the proposed
eight foot deep open front porch would have been in compliance with the
string rule.
BE IT FURTHER RESOLVED that the Five Foot Front Yard Setback Variance
for a Eight Foot Deep Open Front Porch for 1155 Dodd Road as proposed in Planning
Case #05-26 under would not have an adverse impact on the health, safety, and general
welfare of the citizens of the community and the surrounding land, and would not be
adverse to the general purpose and intent of the Zoning Ordinance.
