1977-01-04 Council minutesPage 765 January 4, 1977 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, January 4, 1977 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Clerk-Treasurer Radabaugh administered the Oath of Office to Robert G. Lockwood, who was elected to the Office of Mayor, and to James P. Losleben, James E. Schaberg, and Charles E. Mertensotto, who were elected to the Office of Councilman. Mayor Lockwood called the meeting to order at 8:05 o'clock P.M. The following members were present: Mayor Lockwood, Councilmen Losleben, Mertensotto, Schaberg and Wahl. APPROVE Councilman Wahl moved approval of the minutes of the MINUTES December 21, 1976 meeting. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 COMMISSION It was noted by the Council that the terms of three Planning APPOINTMENTS Commission members and two Park Commission members will expire on January 31. Mayor Lockwood recommended that the Council members consider the matter and be prepared for action on January 18. The matter was tabled to the January 18 meeting. CIVIL DEFENSE AUXILIARY Ayes: 5 Nays: 0 WENTWORTH PARK EXCESS PROPERTY The Council discussed a memo prepared by the Police Chief (Civil Defense Coordinator) and submitted to the Council on December 21. In response to Council questions, Administrator Johnson noted that there is no salary compensation for members of the Civil Defense Auxiliary and that the recommended 60-hoUr training course is sponsored via County funding. The only cost to the City would be for uniforms. He pointed out that the City has levied $500 for the Civil Defense fund each year, that this fund has not been used, and that the uniform costs could be charged to this fund. Councilman Losleben moved the establishment of a Civil Defense Auxiliary. Councilman Wahl seconded the motion. The Council discussed the matter of the sale of excess property at the Wentworth Park and the Administrator's memo distributed at the December 21 meeting. Councilman Mertensotto suggested that the City retain this property and use it as nursery land for seeding and growing trees for future transplanting into City parks. After a brief discussion, the matter was referred to the Park and Recreation for consideration of use of the property as a nursery site. Page 766 January 4, 1977 SEWER SERVICE Administrator Johnson briefly outlined the Sewer Service Charge CHARGE STUDY Study distributed to the Council on December 7. After a brief discussion, Councilman Losleben moved that a special meeting be held on January 11 at 7:30 for the purpose of discussing the Sewer Service Charge Study. Mayor Lockwood seconded the motion. Ayes: 5 Nays: 0 PLANNING COMMISSION The Council acknowledged receipt of the minutes of the December 28 Planning Commission meeting. CASE NO. 76-24, CULLIGAN Ayes: 5 Nays: 0 Ayes: 3 Nays: 2 Mertensotto Losleben Dr. Leo Culligan was present to request approval of the preliminary plat for the Valley View Oaks Addition._ Mr. Lawrence Culligan explained the plat, and stated that the proposed plat consists of 21 lots, all of which meet the lot size requirement, Lot 10 consisting of 46,000 square feet. Mr. Wayne Tauer, of Suburban Engineering, explained the sanitary sewer, water and drainage details. He also noted that at the present time there are no plans for Outlot A, and that Outlot B will be deeded to Lawrence Culligan. He further explained that Dr. Culligan and Mr. Ted Van have agreed to a utility easement between Lots 4 and 5 to bring utilities into the Van property. Administrator Johnson stated that Planner Dahlgren advised the Planning Commission that the plat is within the Mississippi River Critical Area and that Dr. Culligan has been advised that the preliminary plat must be taken to the Metropolitan Council for review and approval. Mr. Tauer stated that this will be done after City Council preliminary plat approval. After a lengthy discussion, Councilman Wahl moved approval of the preliminary plat for the Valley View Oaks Addition. Councilman Mertensotto seconded the motion. On behalf of Dr. Culligan, Mr. Lawrence Culligan submitted a petition for public improvements to serve the proposed Valley View Oaks Addition. Mayor Lockwood moved the adoption of Resolution No. 77-01, "RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF REPORT ON IMPROVEMENTS," authorizing the preparation of the report conditioned upon the Engineer preparing only the very preliminary work needing to be done until such time as the approval of the Metropolitan Council is gained. Councilman Wahl seconded the motion. CASE NO. 76-29, WALLNER/JOYCE Ayes:5 Nays:0 CASE NO. 76-30, PABST Ayes: 5 Nays: 0 Page 767 January 4, 1977 Mr. Robert Jackels, representing Mr. Joyce and Mr. Wallner, explained the preliminary plat for the Wallner/Joyce Estates, explaining that two lots would have frontage on Wentworth Avenue, and one lot would front on Delaware Avenue. After a brief discussion, Councilman Losleben moved approval of the preliminary plat of the Wallner/Joyce Estates. Councilman Schaberg seconded the motion. Mr. Jackels was advised that a final plat must be prepared and presented for Council approval. Mr. Russell Sudeith, representing Mr. Pabst, explained the proposed subdivision of 980 Wagon Wheel Trail. He pointed out that Mr. Pabst proposes to divide the property into two lots, one consisting of approximately 4 acres, and one consisting of approximately 5 acres. The Council asked questions regarding access and utilities. Councilman Losleben moved approval of the subdivision of 980 Wagon Wheel Trail (into two lots as proposed), conditioned upon receipt of a satisfactory park contribution. Councilman Wahl seconded the motion. CASE NO. 76-34, Mr. Ned Bohrer, representing Mrs. Clara Rechtzigel, explained RECHTZIGEL the proposed division of Lot 17, Wagenknecht Addition (1960 Walsh Lane) into two lots. Mr. Bohrer indicated that there may be a slight change in the lot sizes and that he would return to the Council to present a final survey at a future meeting. After a brief discussion, Councilman Losleben moved approval of the concept of the division of Lot 17, Wagenknecht Addition. Mayor Lockwood seconded the motion. Ayes: 5 Nays: 0 RECESS Mayor Lockwood called a recess at 10:10 o'clock P.M. The meeting readjourned at 10:17 o'clock P.M. ACTING MAYOR Ayes: 5 Nays: 0 HEALTH OFFICER Ayes: 5 Nays: 0 Mayor Lockwood moved that Councilman Charles Mertensotto be appointed Acting Mayor for 1977. Councilman Wahl seconded the motion. Councilman Mertensotto moved that Dr. Thaddeus Chao be appointed City Health Officer for 1977. Councilman Schaberg seconded the motion. Page 768 January 4, 1977 DEPARTMENT OF Mayor Lockwood requested Council concurrence in the appointment TRANSPORTATION of Donald L. Huber as the liaison between the City Council REPRESENTATION and the Department of Transportation on highway matters. The Council members unanimously concurred with the recommendation. It was determined that Mr. Huber, as the Mendota Heights representative, should be requested to advise the City officials of any meetings he will be unable to attend so that an alternate can be appointed. Ayes: 5 Nays: 0 1977 BUDGET Ayes: 5 Nays: 0 BONDING Ayes: 5 Nays: 0 FINAL PLAT Councilman Mertensotto moved that Donald L. Huber be appointed as the Council representative in matters relating to Interstate and State highways and directed that Mr. Huber periodically report and update the Council on the meeting discussions. Councilman WAhl seconded the motion. Mayor Lobkwood7MOved the adoption of Resolution No. 77-02, "RESOLUTION ADOPTING 1977 BUDGET DOCUMENT." Councilman Losleben seconded the motion. Mr. Lawrence Shaughnessy was present to discuss bonding considerations. After a brief discussion, Councilman Losleben moved the adoption of Resolution No. 77-03, "RESOLUTION PROVIDING FOR THE PUBLIC SALE OF $585,000 GENERAL OBLIGATION IMPROVEMENT BOND OF 1977," the sale to be held on March 1, 1977. Councilman Mertensotto seconded the motion. Mr. James Riley was present to request approval of the final plat for the Ivy Falls West Second Addition. Administrator Johnson listed several items which still must be completed by the Developer, including: 1) submission of two copies of the latest-grading plan; 2) completion of the several unfilled blanks on the hardshells; 3) Lot 16 access is via a 15 foot easement from the street through two of the lots -- a variance from the required 100 foot frontage requirement should be considered; 4).Mr. Riley has prepared and submitted a proposed Developer's Agreement for the plat, however this was not adequat( and a Developer's Agreement has since been prepared by the staff. Administrator Johnson explained the several changes in the agreement, including among other things a park contribu- tion of $16,000 and the requirement for submission of a cash escrow. Mr. Riley objected to both the proposed park contribution and the cash escrow, stating that he would agree to a park contribution of $400f which was the requirement for the south half of the plat, and that he would agree to a bond rather than a cash escrow. * $400 per lot Ayes: 5 Nays: 0 PERSONNEL Ayes: 5 Nays: 0 Page 769 January 4, 1977 After a lengthy discussion, Mayor Lockwood moved the adoption of Resolution No. 77-04, "RESOLUTION APPROVING FINAL PLAT," contingent upon a park contribution of $400 per lot (33 lots), and submission of a $6,000 performance bond, along with the execution of a satisfactory Developer's Agreement, and approved a variance from the front yard setback requirement for Lot 16, allowing a 15 foot front yard from the point of access to the ends of Lots 15 and 17. Councilman Wahl seconded the motion. Councilman Wahl moved approval of the probationary-employment of Mrs. Valerie Bliss as Receptionist/Clerk-Typist at the probationary salary of $540 per month. Councilman Losleben seconded the motion. MUNICIPAL MATTERS The Council acknowledged receipt of a memo from the City OF CONCERN Administrator outlining several matters of municipal concern. Mayor Lockwood briefly outlined the memo for the audience. FRONTAGE ROAD Ayes: 5 Nays: 0 DEPOSITORIES OF FUNDS The Council acknowledged receipt of a memo from the City Planner regarding the proposed frontage road along TH 110 from Lexington Avenue to Hunter Lane. Councilman Losleben outlined a recent meeting with Department of Transportation personnel regarding the frontage road. Councilman Losleben stated that the D.O.T. personnel indicated that if the Council could reach agreement on the proposed location of the frontage road, they would attend the next Council meeting with plans for location and layout. He further noted that the D.O.T. indicated that the City would be allowed to complete the engineering and construction and that the State would reimburse the City for the costs involved. The Council discussed the matter and concurred with the Planner's recommendation that Plan 3 of the report was the best location. Councilman Wahl moved approval of the concept of Plan 3 of the planner's report for the TH 110 frontage road. Councilman Losleben seconded the motion. The Council directed the City Administrator to contact Mr. Charles Burrill of the Department of Transportation to advise him of the Council action and request that he appear at the January 18 meeting with plans for the layout of the frontage road. Councilman Losleben moved that the Clerk-Treasurer be authorized to sign the agreement for safekeeping of Pledge Securities for depository funds placed with the following and consisting of: Dakota County State Bank $250,000 Federal Intermediate Credit Bank Bonds $650,000 Federal Intermediate Credit Bank Bonds $150,000 Federal Intermediate Credit Bank Bonds $200,000 U.S. Treasury Notes $140,000 U.S. Government Guarantee $ 60,000 U.S. Treasury Bills Cherokee State Bank $760,000 U.S. Treasury Notes $100,000 U.S. Government Guarantee Minnesota State Bank $100,000 U.S. Government Guarantee Midwest Federal Savings and Loan $100,000 U.S. Government Guarantee Minnesota Federal Savings and Loan $100,000 U.S. Government Guarantee Councilman Schaberg seconded the motion. LIST OF CLAIMS Mayor Lockwood moved the adoption of the following motion: Ayes: 5 Nays: 0 LICENSES RESOLVED, that the claims submitted to the City Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, January 4, 1977, having been audited by the City Council, be and are hereby allowed and the Mayor and Clerk- Treasurer of the City of Mendota Heights are hereby authorized and directed to issue City checks in payment of said claims. Ayes: 5 Nays: 0 COMMUNICATIONS The Council acknowledged receipt of a letter from the United States Department of the Interior regarding- the establishment of the Minnesota Valley National Wildlife Refuge. WATER RATES The Council acknowledged receipt of a letter from the St. Paul Water Department and a water rate schedule for 1977. SALARY ADJUSTMENTS Councilman Wahl moved the adoption of the following schedule of salaries and benefits for non-union employees for 1977: Public Works Supervisor $1,330/Mo. Public Works Inspector 1,415/Mo. Engineering Aide II 835/Mo. Parkkeeper Aide 835/Mo. Police Captain 1,580/Mo. Police Sergeant 1,485/Mo. Police Chief 1,745/Mo. Police Clerk (part-time) 3.45/Hr. Bookkeeper 840/Mo. Receptionist/Clerk 580/Mo. Administrator Secretary 840/Mo. Clerk-Treasurer 1,340/Mo. Administrator 2,265/Mo. Fire Chief 185/Mo. Assistant Fire Chief 100/Mo. City Hospitalization Insurance maximum of $65.00 per month for employee and dependent coverage; Administrator auto allowance to be $140 per month; Police Chief auto allowance to be $75.00 per month; all other allowed mileage to be reimbursed at a rate of 15 per mile.
