Minutes of the Special Meeting
Held Tuesday, June 12, 1979
Pursuant to due call and notice thereof, the special meeting of the City
Council, City of Mendota Heights, was held at 5:30 o'clock P.M., at the
City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 5:37 o'clock P.M. The
following members were present: Mayor Lockwood, Councilmembers Losleben,
Witt, Mertensotto and. Hartmann.

Mayor Lockwood gave a brief summary of the June 5th
City Council meeting discussion regarding the variance
of Town and Country Builders, which ended in a tie vote.
Mayor Lockwood moved to reconsider the application for
variance.
Councilwoman Witt seconded the motion.
Mayor Lockwood explained the conditions which were
discussed at the June 5th Council meeting, including
the findings of the Planning Commission, the Code Enforce-
ment Officer's recommendations, the matter of a retaining
wall possibly being required and that there be no future
subdivision of the lot at 610 Ivy Falls Avenue. He felt
the suggestion of no future subdivision was to be com-
mended.
It was the concensus that the Code Enforcement Officer
should determine whether the retaining wall be considered
a part of the grading plan.
The matter of who should post the bond was brought up and it
was felt that Town and Country was the applicant and they
should post the bond.
Mayor Lockwood inquired whether the City could revoke or
refuse renewal of the contractor's license if the house is
not built to code. Attorney Winthrop stated that he dis-
cussed with the attorney for Town and Country, the pos-
sibility of the Council requiring submission of a fee to
cover City expenses incurred for legal, engineering and
planning costs and staff time expended on the matter.
He suggested a maximum fee of $750.00 be required. Mayor
Lockwood then suggested that this stipulation be a condition
of granting the variance and that the builder is to re-
imburse the City for the City's cost of outside consulting
for engineering, legal and planning fees, not to exceed
$750.00.

Councilman Hartmann expressed concern with the fill on
the west side of the basement and whether or not it
will meet the energy calculations. After further
discussion Councilman Mertensotto suggested that
there be no more thafi one course of exposed block on
the west side of the house.
Councilman Mertensotto moved adoption of Resolution No.
.611 79--61, "RESOLUTION GRANTING SETBACK VARIANCE FOR 610
IVY FALLS AVENUE", establishing conditions which must

ADJOURN
There being no further business to come before the
City Council, Councilman Mertensotto moved to adjourn
the meeting. Councilman Losleben seconded the motion.
Time of adjournment: 6:31 o'clock P.M.
Mrs. Stein, 622 Ivy Falls Avenue, read a note to the
Council thanking the Council for the thought and
time which was given to this matter.
