1980-05-27 Council minutesMay 27, 1980 Page 1271 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Adjourned Meeting Held Tuesday, May 27, 1980 Pursuant to due call and notice thereof, the adjourned meeting of the City Council, City of Mendota Heights was held at 7:30 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Lockwood called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Lockwood, Councilmen Hartmann, Losleben, Mertensotto and Councilwoman Witt. IVY FALLS CREEK The Council acknowledged receipt of memos from the City DRAINAGE Administrator, Engineer and Public Works Director relative to IMPROVEMENTS construction of the Ivy Falls Creek drainage improvements. City Attorney Winthrop and Councilman Mertensotto reviewed the negotiating session wherein Somerset Country Club granted the City rights of access. It was noted that.there was a certain value to the land access or land rights, however, the amount was unresolved. There was also a discussion as to maintenance of the control structures. It was noted that the City would perform functional maintenance, not maintenance related to aesthetics. There was a discussion as to the assessment procedure -- what phases of construction should be completed before the assessing procedure took place. After a considerable amount of discussion, the concensus was that Phase 1 construction should be currently assessed, leaving phases two and three for construction and assessment in the future. There was a short discussion on capitol improvements and the associated debt service. It was noted that each storm sewer area could possibly adversely impact the capitol improvement program schedule. Attorney Winthrop noted that the legal requirements of Chapter 429 require that assessments must be related to benefits. Councilman Losleben suggested that 75% of the project cost be assess ed at a single rate for all affected properties. It was noted that the 75% assessment proposal would possibly amount to about 80% of the project expenditures, namely $300,484. This would involve using an assessment rate of $0.0535 per square foot over the entire Phase I district. Administrator Johnson questioned the benefits versus the $0.0535 rate. Councilman Losleben expressed negative feelings for a two-step rate. Councilwoman Witt was excused from the meeting at 10:00 P.M. Further discussion ensued when Councilman Mertensotto suggested Page A) -7 May 27, 1980 a two-level assessment rate consisting of 25st per square foot for property immediately adjacent to the creek and 4¢ per square foot would more closely relate to benefits received. He noted, that this should result in a total assessment of $240,000, leav- ing some $60,000 for general obligation. Councilman Mertensotto noted that this scheme and concept would set a precedent for future creek improvement assessment policies. After some further discussion, the staff was directed to prepare figures reflecting the preceding two-level concept. RESOLUTION ON Administrator Johnson noted that a resolution had not been AIRPORT ZONING prepared at this time and that he would present a resolution on airport zoning at a later date. I-35E PRELIMINARY Public Works Director Danielson presented the preliminary plans PLANS for I-35E from 1-494 to T.H. 110. He answered several questions concerning alignment and additional right-of-way. Councilman Losleben noted that the City Council had adopted resolutions in the past addressing I-35E construction. It was noted that • Resolution No. 76-78 called for simultaneous construction of I-49, • and I-35E, and that Resolution No. 77-82 demanded construction of I-35E similar to that construction which would prevail in the City of St. Paul. After further discussion, the Council directed that the Administrator respond to District Nine Engineer Douglas Differt, noting the two earlier resolutions, advising that consideration of the current preliminary plans is premature and that the resolution of this issue could only be completed upon some decisions being made within the City of St. Paul. MISCELLANEOUS Mayor Lockwood reported briefly on the Wilder elderly housing application considered by the Metropolitan Council on May 22nd. ADJOURN There being no further business to come before the Council, Councilman Losleben moved that the meeting be adjourned. ,9( Councilman Hartmann seconded the motion.
