Minutes of the Regular Meeting Held Tuesday, December 16, 1980 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights was held at 7:30 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Lockwood called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Lockwood, Councilman Hartmann, Councilwoman Witt. Councilman Mertensotto had notified the Council that he would be absent. Councilman Losleben had notified the Council that he would be late. APPROVAL OF Mayor Lockwood moved approval of the minutes of the October 7th MINUTES meeting. Councilman Hartmann seconded the motion. Ayes: 3 Nays: 0 Ayes: 3 Nays: 0 Ayes: 3 Nays: 0 Councilman Hartmann moved approval of the minutes of the November 6th meeting correction. Councilwoman Witt seconded the motion. Mayor Lockwood moved approval of the minutes of the December 2nd meeting. Councilwoman Witt seconded the motion. Councilman Losleben arrived at 7:40 o'clock P.M. WATER RATES The Council acknowledged a letter from the St. Paul Water Department advising the Council of water rate increases for 1981. COMPREHENSIVE PLAN VICTORIA TOWNHOMES Ayes: 4 Nays: 0 The-Council acknowledged and briefly discussed a letter from the Metropolitan Council relative to the Council review of the Mendota Heights Comprehensive Plan. Public Works Director Danielson and City Engineer Kishel responded to the portions of the letter relating to the City's sewer plan. Engineer Kishel was directed to submit a trunk sewer excess capacity figure, and staff was directed to review the balance of the comments. The Council directed that a copy of the letter be submitted to City Planner Dahlgren for review and comment. The Council acknowledged and briefly discussed a letter from Mr. Gerald Frisch petitioning the City for public improvements • to-serve the Victoria. Townhomes plat. It was noted that Mr. Frisch had •submitted a $2,700 engineering escrow deposit in accordance with City requirements. Councilwoman Witt moved to accept the petition and direct the City Engineer to prepare a feasibility study on public improvements to serve the Victoria Townhomes plat. Councilman Losleben seconded the motion. Page 1396 December 16, 1980 PARK.COMMISSION The Council acknowledged a letter from Mrs. Mary Mills in resignation from the Park and Recreation Commission,effective January 31, 1981. ' • Mayor Lockwood moved that the resignation be accepted with regret and that Mrs. Mills be commended for her six years of service to the City. Councilman Losleben seconded the motion. Ayes: 4 Nays: 0 DEPARTMENT REPORT COMMUNICATIONS DNR HEARING/I-494 PERSONNEL Ayes: 4 Nays: 0 The Council acknowledged receipt of the November Fire Department monthly report. The Council acknowledged receipt of a letter from the League of Minnesot e o egis a ive o icies or The Council acknowledged a notice of hearing from the Department of Natural Resources on an application by the Mn/DOT for permits to alter public waters in connection with the construction of 1-494. Administrator Johnson stated that the DNR will hold a hearing.on January 19th to consider Mn/DOT permit applications for the filling of a portion of Schmidt Lake and construction of drainage facilities along 1-494 from I-35E to South St. Paul. Mr. Johnson explained that the Mn/DOT intends to use'Hornbeam Lake as a discharge point for drainage from 1-494'Which would require installation of an overflow structure and several feet of 30" pipe. The overflow would drain into a slough on the east side of Delaware Avenue which will drain into Mendota Heights. Mayor Lockwood suggested that if the City agrees with the Mn/DOT proposal, an agreement should be made with Mn/DOT wherein Mn/DOT would install metering devices to control the flow of run-off into Mendota Heights. After further discussion, the Council directed the Public Works Director and City Engineer to study the matter and report to the Council on January 6th. Police Chief Thul was present to recommend that Mr. Mario Reyes be appointed to fill the Police Patrolman position left vacant by the resignation of Richard Munson. Chief Thul reviewed Mr. Reyes' qualifications and advised the Council that the applicant has been a reserve officer for the City since April of 1979. On the recommendation of the Police Chief, Councilman Losleben moved that Mr. Mario Reyes be appointed police patrolman, effective after January 1, 1981, at the entry level patrolman salary. Councilman Hartmann seconded the motion. ( MISCELLANEOUS MISCELLANEOUS LABOR NEGOTIATIONS MISCELLANEOUS FRIENDLY HILLS WATER CONVERSION LIST OF CLAIMS Ayes: 4 Nays: 0 LICENSES Ayes: 4 Nays: 0 Page 1397 December 16, 1980 City Administrator Johnson advised the Council of A recent meeting with the superintendent of schools for District 197 .relative to comprehensive plan details. He suggested that the City should formally communicate with the school district to advise that.the schobl district property near Friendly Hills is included in the City's comprehensive Plan as a future park, and to request that the City be notified six to nine months ahead of the time that the School District intends to market the property. After a brief discussion, the Council directed the City Administrator to prepare a draft resolution to express the City's interest in the subject property. The Council acknowledged receipt of the proposed 1981 Budget document. The Council also acknowledged receipt of the proposed schedule of salaries for non-union personnel for 1981. Administrator Johnson advised the Council on the status of negotiations on 1981 Public Works and Police labor agreements. The Council acknowledged and briefly discussed a letter from Mn/DOT relative to sight obstructions at the intersection of T.H. 13 and Downing Street. The Council acknowledged receipt of the Treasurer's report for November. Public Works Director Danielson briefly reviewed a meeting held on December 9th with representatives of the Friendly Hills Civic Association relative to the proposed conversion of the Friendly Hills water system. Councilman Losleben moved approval of the List of Claims dated December 16, 1980 and totalling $105,008.46. Mayor Lockwood seconded the motion.
