Minutes of the Regular Meeting
Held Tuesday, April 21, 1981
Pursuant to due call and notice thereof, the regular meeting of the City Council,
City of Mendota Heights, was held at 7:30 o'clock P.M., at the City Hall, 750
South Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:30 o'clock P.M. The following
members were present: Mayor Lockwood, Councilwoman Witt and Councilman Hartmann.
Councilmembers Losleben and Mertensotto had notified the Council that they would
be absent.
CIRCLE AIR Mr. Patrick Gannon, from Circle Air Freight, was present to
FREIGHT explain his request for approval of a three foot rearyard
variance on the building addition at 1450 Northland Drive.
This would reduce the rearyard setback from the required 50
feet to 47 feet. At the March 17, 1981 Council meeting, the
Council approved a 20 foot sideyard variance and a conditional
use permit for Circle Air Freight and felt that this additional
variance request would not need Planning Commission approval.
After a briefdiscussion„ Councilwoman Witt moved the adoption
of Resolution No. 81-27, "RESOLUTION AMENDING RESOLUTION 81-18,
RELATIVE TO AMCON CORPORATION/CIRCLE AIR FREIGHT CONDITIONAL
USE PERMIT AND VARIANCE", approving a three foot rearyard
setback variance for Circle Air Freight.
Councilman Hartmann seconded the motion.

APPROVAL OF Mayor Lockwood moved approval of the minutes of the April 7th
MINUTES minutes as discussed and amended.

CABLE TV MEMBER The Council received a letter of resignation from Jim Lilly,
RESIGNATION from the Cable Advisory Commission and accepted such letter
with regret and wished to express their thanks to him for his
service to the Commission. City Administrator Johnson was
directed to contact Chairman Dave Zemke regarding a replacement
for Mr. Lilly.
LMC MEMO
An Action Alert Memo from the League of Minnesota Cities was
acknowledged and discussed by the Council. It was the concensus
of the Council that Mendota Heights is not substantially affected
by the proposed revenue sharing cutbacks, and Mayor Lockwood
urged that the City not take a united action to protest the
cutbacks at this point.

The Council received and discussed a memo from the Code
Enforcement Officer relative to a five foot sideyard variance
request from Mr. Thomas Virnig, 1650 Mayfield Heights Road.,/
Mr. Virnig had requested the identical variance and received
Council approval on August 8, 1979, but had since changed his
mind as to the location of his addition. Now he decided to go with
his original plan as previously granted.
After a brief discussion, Councilman Hartmann moved to approve
a five foot sideyard variance to allow construction at 1650
Mayfield Heights Road.
Councilwoman Witt seconded the motion.
The Council acknowledged receipt of the Fire Department monthly
report for March, 1981.
The Council acknowledged a memo from Police Chief Thul relative
to enforcement of the Junk Car Ordinance. It was noted that a
student intern will be searching for all junk car vehicles in
the City. Councilman Hartmann suggested that staff send a copy
of Chief Thul's memo to Phil Iverson, in response to his complaint
at the April 7th Council meeting.
The Treasurer's report for March, 1981, was acknowledged by the
Council.
Report Mary Thompson, with the SouthWestReview was present in
the audience, as was Tom Bayless, representing the Park and
Recreation Commission. Mr. Bayless noted that he had spoken
with a citizen concerning the planting of green ash trees on
City Park property in the Lexington Avenue-Marie Avenue area.
Mr. Bayless informed the resident that these trees may have
to be moved or removed in the event the park land is developed.
City Administrator Johnson read a letter he had received from
Mr. Curtis Wassberg, on a proposed Emergency Medical Services
radio communications system for Dakota, Washington and Ramsey
counties. Dakota County's share of the annual operating costs
amount to 24%, or an estimated $39,530. After a brief
discussion, Administrator Johnson was directed to write a
letter to Mr. Fred Joy, Human Services Director, and Mr. Curtis
Wassberg, stating that the City of Mendota Heights hereby goes
on record as supporting the proposed three County Joint Powers
Board and the associated expenditures for equipment and mainten-
ance.
GOALS AND The Council received a memo from City Administrator Johnson
OBJECTIVES relative to 1981 Goals and Objectives. As there were only
three Council members present, it was suggested that discussion
of the matter be postponed to a time when all the Council
members would be present for discussion, such as May 5th, 1981.

The Council received a handout letter from Mr. DeLisi and a
report from Planner Dahlgren in response to Mr. DeLisi's
letter. The Council took several minutes to review the
information. Attorney Winthrop advised that at the present
time the Ordinance does not permit retail sales in an Industrial
district. The City needs to amend the Ordinance to allow retail
sales in an "I" district. Mayor Lockwood suggested that the
Council consider retail sales as a permitted accessory use in a
warehousing operation. Councilman Hartmann felt that the
Ordinance should be amended and that each case would be treated
as a special case. Councilwoman Witt felt that this would be
appropriate, as the City would not want to lose control over
the situation. Administrator Johnson suggested referring this
matter to the Planning Commission for their recommendation.
Attorney Winthrop advised that any Ordinance amendments require
Planning Commission recommendations. Mayor Lockwood suggested
that this matter be referred to the Planning Commission, noting
that the Council favors Alternate #2, as outlined in Planner
Dahlgren's memo.
Councilwoman Witt reported on a SRA meeting that she had attended,
noting that the Suburban Rate Authority is monitoring the
Metropolitan Waste Control Commission, Northern States Power
Company, Northwestern Bell Telephone Company and Minnegasco.
She also had a question on what kind of a timetable the Cable
Advisory Commission is looking at.
Councilman Hartmann advised that he had been informed that the
Pilot Knob Road upgrading is underway and that they are moving
utilities in Eagan, and heading toward Mendota Heights Road.
City Attorney Winthrop advised that it was his opinion that the
City is not ready for a public hearing on May 5th on the Tax
Increment Financing District. He had spoken with the attorneys
for MAC and there may be a dispute over the land that was
included in the district. Administrator Johnson noted that
staff will meet with County and School District representatives
prior to the hearing.
Public Works Director Danielson reminded the Council of the
third annual City Tour to be held Saturday, April 25th at 8:30
A.M., commencing at the Public Works Garage. Engineer Kishel
noted that he would bring slides of the Water Tower construction
for anyone interested in seeing them.
The Council received and acknowledged the Administrative Annual
Report for 1980, as prepared by City Clerk Swanson. Mayor
Lockwood commented on the excellent report and the amount of
information that it contained. He noted that if the engineering
transfer happens, that he will support the request for additional
clerical staff and would ask the Council members for their
favorable consideration also.

Councilman Hartmann seconded the motion.
Councilman Hartmann moved approval of the following license,
granting a license to:
George's Golf Range, Inc. Malt Liquor License
Councilwoman Witt seconded the motion.
Mayor Lockwood moved approval of the List of Claims, dated
April 21, 1981, and totalling $337,036.60.
Councilman Hartmann seconded the motion.
MISCELLANEOUS Mayor Lockwood noted that he had met with the Mayors of Lilydale
and Mendota and members of the Mendota VFW to proclaim May 1 as being
Loyalty Day. A copy of the proclamation is to be posted on
the City Hall bulletin board.
ADJOURN
There being no further business to come before the Council,
Councilman Hartmann moved that the meeting be adjourned to 8:30
A.M., Saturday, April 25th, at the Public Works Garage, 2431
South Lexington Avenue, for the City Tour.
